Eight of the ten claims made by Arizona gubernatorial Kari Lake were dismissed by the state judge. The claims dismissed were for violations of freedom of speech, invalid signatures on mail-in ballots, equal protection, due process, secrecy clause, incorrect certification, inadequate remedy, and constitutional rights claims.
However, two claims were approved for trial, fraudulent tabulator configurations and violations pertaining to chain of custody for ballots. Mrs. Lake faces a steep hill to climb as the election results were certified as accurate and correct by county and state officials. Lake will have to prove any tabulation errors or ballot custody issues were the result of intentional wrongdoing by Maricopa County officials.
ARIZONA – Arizona Republican gubernatorial candidate Kari Lake is heading to trial after a judge allowed two out of 10 of her election lawsuit claims to move forward Monday.
Lake had brought forward a civil complaint earlier this month to overturn her 2022 midterm election loss against Democrat Katie Hobbs. Judge Peter Thompson decided that two claims, one regarding her allegations about illegal tabulator configurations and the other about violations pertaining to ballot chain of custody, can move forward.
“Our Election Case is going to trial. Katie Hobbs attempt to have our case thrown out FAILED. She will have to take the stand & testify. Buckle up, America. This is far from over,” Lake beamed on Twitter.
To be successful in her lawsuit, Lake’s legal team must prove that “printer malfunctions were intentional, and directed to affect the results of the election, and that such actions did actually affect the outcome,” according to the judge. She must also show that the lack of chain of custody was “both intentional and did in fact result in a changed outcome.” (read more)

Yes, thats a disappointment, however that issue WILL be heard, in the case Mohave County is bringing against Maracopa County, which as its County vs. County, should go straight to State Supreme Court, which unlike Texas, I the Supreme Court of Az. i.e. no appeal.
Mohave is alleging their is no legal, legislative or Constitutional justification for Maracopa County (and it was ONLY Maracopa County, to use AI for signature verification.
Az. election laws and rules, policies and proceedures do NOT make any provisions for (allow) AI to be used.
They are alleging the use of AI allowed large #’s of fraudulent ballots to ‘get thru’ and each fraudulent ballot counted in Maracopa County, disenfranchises the voters in Mohave County, because it ‘waters down’ their vote, which is an issue already decided by SCOTUS.
As for Kari, she has a guy that worked for the last nine years, serviving/maintaining the tabulators and ballot printers FOT Maracopa County.
He has already asserted, in a sworn deposition, that the ONLY possible way those machines could have failed, is if they were INTENTIONALLY reset.
On chain of custody, she has the runbeck whistleblower, saying they recieved almost 300,000 ballots on election day, with no chain of custody or security.
As the certified totals have only 17,000 lead for hobbs, obviously 300,000 is enough the effect the results.
I believe once KL team present that evidence, the burden of proof switches to the Hobbs team.
THEY must prove the ballots in question are legitimate, lawful ballots, by producing chain of custody documents for the ballots KL has challenged.
And they must provide maintanence logs for the machines, everyone who touched them.
THATS how you respond to a challenge of ballots; KL doesn’t HAVE to prove the ballots are invalid; ballots are not people, “innocent until proven guilty”; they are DOCUMENTS.
Like any other document (Will, Power of Attorney, Deposition) if a document is challenged by one party, the other has to prove it is legal and legitimate.

OK, but that is the witness’ opinion, which while possibly true, is not a fact. That part of the case needs someone to testify from firsthand knowledge that the machines were intentionally reset and that the intention was to thwart voting. Otherwise, this claim goes pfffft.

It’s rigged. All of the claims should be allowed, certainly the signature validations of mail-in votes. It’s like the judge didn’t want to shut all the claims down so is allowing the most difficult ones to prove. When AZ law says it is against the law if chain of custody is broken and there are 200,000 plus ballots with no chain of custody then Kari should automatically get a new election in Maricopa County. With that many ballots without a documented chain of custody there is certainly a high probability ballots could have been added and it could have easily changed the election. Proving intent will be very difficult.
The entire system is rigged. Judges are either bought off or they are afraid of being accused of disenfranchising voters. What they seem not willing to accept is that the fraud is what disenfranchised the voters before they ever went to the polls.
And how will changing parties fix any of those issues? The problem here is the lack of law enforcement, ie a judge who actually wants to enforce the law.

(1) Fortunately, the chain-of-custody issue does not rely on intent. My understanding is that the required paper trail / documents that by law are required to prove chain-of-custody –are missing, do not exist. This part of the trial is a clear documentation issue. The onus will be on Hobbs to prove a chain-of-custody when the necessary documentation is simply not there. That is the strongest part of Kari’s case. The law is clear and there is no issue of intent.

While I too have times of hopelessness, I try not to spread it far and wide. At this precarious stage for our country, I believe we need to either be in the arena ourselves or quietly supporting those who are in the arena.

1) I hope you’re right about ‘intent’ because most people reporting on this seem to indicate that ‘intent’ needs to be proven for the 2 claims that are moving forward.
The only reason to look for (or prove) ‘intent’ would be to file criminal charges. The facts that we know; the machines broke down consistently throughout the day and chain-of-custody was broken…those two issues should be enough for Kari to win her case (IMO) if ‘intent’ does not need to be proven.
2) As you posted the Borrelli lawsuit was thrown out, now we have to wait and see what they can to do regarding the signature review with ballot envelopes.

Perhaps someone here can correct me if I am mistaken, but I believe this is the first election fraud case that has been permitted to go to trial and have evidence presented. As I recall, every case on the 2020 presidential election and every other case on the 2022 midterm election has been dismissed on pretrial motions, generally on the grounds that the plaintiff(s) did not have standing to bring the case. This is the first case in which the fraud evidence will actually be presented to a fact-finder. Is that correct?

I believe “Standing” puts the burden of proof on the claiment (KL) to show that the ballots in dispute, if invalid, would be enough to change the outcome.
Once that burden of proof is met, by the claiment they then enter evidence to support their challenges of certain ballot or election procedures.
The burden of proof then switches to the State election officials to prove all ballots counted in the official tally, were legal votes.
Like by entering into evidence the chain of custody documentation on 297,000 (so not 200,000 but close to 300,000) ballots recieved by Renbeck on election day, that whistleblower says there WAS no chain of custody on.

The surviving claims don’t automatically go to trial. Before trial there will be an attempt to throw the proceeding claims out on Summary Judgment. That normally happens after the evidentiary phase. The legal standard is no reasonable jury could find for the plaintiff (Lake). So still a very good chance Hobbs won’t take the stand but she should at least be subject to deposition.
Hobbs side needs to provide concrete evidence, maintenance logs, and chain of custody documents, otherwise I think ballots are discounted.

If she prevails on the two claims that he allowed, she has proven the constitutional violations of due process, equal protection and first amendment rights that he would not allow to go forward.
Me thinks he has distilled the contest down to two issues he knows he can swat away, and her appeals won’t be heard until 2024, at the earliest.
The judge is also narrowing the issues toward a ruling that impacts upon local ‘procedures’ only, making sure to avoid constitutional rulings that would say that election tampering is a violation of constitutional rights which would apply to the entire nation and provide Lake with immediate rights to appeal in the federal courts.

Please see my posts above. There is no Arizona law nor any state’s law that trumps Federal constitutional rights of due process and equal protection in elections. The Voting Rights Act, the 19th and 15th Amendments are examples under different fact patterns.
The states’ rights to manage the machinery of their elections are valid only if in compliance with the Bill of Rights which has supremacy.
Litigation that pulled questions about those constitutional rights into court in Arizona with respect to this case could open up a can of worms that could extend to other states. A nationwide debate with a supreme court hearing about the minimum features for any election to pass constitutional muster would be a disaster for the practitioners of drop and roll.

A case is not able to be brought in Az BEFORE the election is certified. This should have been changed along with other problems-but the RINO McCain GOP has refused to cooperate.

Unfortunately, the court dismissed the most easily-demonstrated defect: the lack of signature verification. This is the most important, albeit very weak, control that is used to determine if a ballot is legitimate. As she included in her complaint, there were wild differences between them. And, the inspectors rejected a large number of them … only to have those rejections mysteriously overruled. That should have been admitted to trial.
P.S. Below I see that Mojave County is directly suing Maricopa over a signature-related issue, where Maricopa claims to have used “AI” to verify them. That ought to produce enough examples of impossible “matches” in a courtroom.
