Hopefully the legislators can fix whatever is necessary and pass new legislation that is more bulletproof and do the cleanup well in advance of the 2024 election.

Has President Trump filed a complaint about a Fourth Amendment violation of the obvious overly broad search warrant? If not why not? Have I missed something? There is no 4th Amend violation if the search complied with the terms of the warrant. And this compliance simply cannot be established unless and until there is proof of what materials were seized and from where.

In Rainey, the Court held that the warrant was void because police “should have known, from reasonable investigation that the warrant description was overbroad” (seeMaryland v Garrison, 480 US 79, 85 [1987])
Since the DOJ supposely had “an inside guy” I would think the burden would be on the DOJ to limit the broad search warrant. Did they have reason to believe that things would be stored in underwear drawers? Why did they take passports? I think the warrant has been executed illigelly

I’m not a lawyer, but I’ve overheard other lawyers say that the broadness of the search area in the warrant was a 4th Amendment violation. Maybe others more qualified than me can address this.

It is extremely difficult to hold the cops/FIBs and/or magistrate liable for a violation of this sort. That is why the U.S. Supreme Court fashioned a rule that evidence seized illegally cannot be used as evidence in a criminal case. Also “fruit of the poisonous tree” etc.
But ask: what happens when no criminal case is filed, when it’s merely at the “investigation” stage, and the ulterior motive was to accomplish something else (e.g. thwart, to the extent possible, a pending civil case somewhere else, e.g. make a ruckus for perceived political gain.)
What is the remedy? One cannot go back and somehow retract from the FIBs the copious notes and copies that I guarantee they made immediately. One cannot go back and erase knowledge from someone’s mind. There is no provision that I am aware of for civil or criminal sanctions where a claim can be made, however speciously, that it was a “mistake”, or “good faith belief” that there was hidden classified or otherwise inappropriate materials. Not even attorneys’ fees.
Generally the cops are off the hook if a judge/magistrate signs a warrant and they comply with that. Let’s say that they exceeded the parameters of the warrant. Which one went where under whose orders… (a mess). Let’s say that one of them lied to the magistrate. (We’ve already seen how that goes, e.g. Carter Page FISA.)

You would think. Also you would think that someone would be able to sue for money compensation for garden-variety 4th Amend violations. But it’s not that easy even when there are big damages and disastrous consequences, e.g. cops bust down the door of the wrong house or cause personal injury or death. Even then, there are lots of hoops to jump through.
Here, we don’t have a prosecutor. We have cops. FIBs (although they were accompanied by DOJ lawyers.) It is all still in the cop-level “investigation” stage. Probably a concocted fake investigation, too. Granted, a judge-signed warrant is supposed to be our protection. Judges, however, makes their decisions based on what is presented to then, and as we have seen time and time again, can “play stupid” when they want to.
There are a lot of wrongs for which there are no explicit laws providing for a right to sue.

That is essentially what the Supreme Court said when they decided that evidence gained in an illegal search cannot be used in a criminal case.

How could there be a case when they had no idea what they were looking for according to what we have been allowed to see on th affidavit.
The over road warrant is in itself a breach.
The Master’s work will assist in determining whether good faith probable cause existed to support the warrant and its supporting affidavits and materials.
At that juncture, the trial court can determine upon further motion whether the warrant was appropriate and based on a good faith application or an improper one (a fraud upon the court), and whether to exclude all materials improperly obtained thereunder, including all evidence that relied on such illegally seized evidence.
So there is a 4th Amendment issue, but it is not quite ripe just yet.

Two years in, many have already cleared coronaviruses through natural infections. Their immune systems are primed and the virus would typically fade away at this point, having nowhere else to go.

The McCarthy interview did not disappoint. They started talking about 9/11 and he said we should never forget and our country needs to come together like we did under a former president. Ok-Fine.
They moved on to the problems in our country and what can the Republicans need to do to get us back on track. He, in his mealy mouth way, said that the fault lies with the Democrats and Biden. The Republicans have a, soon to be released, Four Pillar Plan that includes Boarder Security, Stop Illegal Drugs, Support Police/Reduce Crime, Stop Over Spending and back to Energy Independence to control inflation, etc. Basically the same issues that MAGA supporters have been screaming for, but never mentioned by McCarthy.
He went on to say Republicans have a plan, but Democrats do not. Republicans need to win back Congress to solve these issues. Maria did not ask anything about MAGA and that MAGA supporters do not see any resistance to what is going on by Republican leadership or most Republicans in Congress. Why should they believe you? Seems to most that the Republicans are fighting between Establishment and MAGA both saying they want the same thing. No questions or pushback on that.
McCarthy said we need to work together Republicans and Democrats to solve these issues and stop being divisive. We are more divided today than we were when Biden took office. He didn’t say that the Democrats have no interest in working together. That if we push back on their policies they go to calling us racist, homophobes, anti-women, etc. He sounded more like Neville Chamberlain trying to work out the differences with Germany while Germany had no interest in working out their differences.
I guess to summarize my analysis. McCarthy is trying to convince voters that we can work out our differences with the Democrats to solve our problems. We just need to play nice and get away from divisive politics(Trump). While the divisiveness has been around long before Trump, McCarthy wants us to believe Rs&Ds can work together.
Like I saw where someone said-The Republicans want to get along with the Democrats and the Democrats want to Destroy the Republicans.
So, I was not disappointed in the interview. McCarthy came across, to me, as weak and is not of a leadership mindset to get our country back on track even if we win back the majority. He is Establishment through and through. No mention of the strong support of MAGA and Trump and no mention that R voters are totally disappointed with R leadership in even trying to fight these D policies.

If the cell phone is lost or stolen I still need a phone. I like the cell phone for in the car and hiking emergencies…

I saw part of a kid’s program this morning, Curious George on PBS, and they were selling windmills and grinding your own grain as a very practical and simple alternative to anything else, like buying already-milled flour in a store. The brainwashing is so painfully obvious. There was, of course, no discussion of the maintenance required, of the windmill or the milling equipment, and no discussion of how much time a person would need to spend to do their own milling. There was an implication that the grain was grown right there on the property too by some guy who plows and tills using horses for power, and no doubt his wife will, after she has hand-laundered all of the clothing, towels, and sheets and carried water from the well to the house and brough some firewood in for the stove, bake 4 beautiful loaves of bread. Because you know Dems don’t want white-collar careers, they just love to stay at home and do this stuff. Their favorite era to recreate is 1850. lol Most Dems probably don’t even know what milling is.

I am reading a book right now called “The Next Greatest Thing” about providing electricity to rural areas starting in the 1930’s and going through the 1950’s. The photographs of women doing this back breaking work is just heart breaking.
I grew up with a wringer washer and that was bad enough; getting fingers caught in the wringer. Before that it was wash boards and lye soap. It took all day Monday to wash clothes and all day Tuesday to iron them. And if that wasn’t enough, you had the wood burning stove in the kitchen which made a real mess and trying to control the temp was impossible.
If you want to live that way go for it. As for me, I like at least a few modern conveniences.
A distant relative and neighbor of mine in England , lost track of their daughter. She was a war bride and ended up in Kentucky or somewhere similar. They finally went to America to find her and approached an old lady near the farm where thy thought she lived. Only to discover it was their daughter, who had been treated like a slave and looked older than her parents.
The kids cartoon made no mention of the effort required, or the dangers. It was all totally romanticized. I have a feeling in some other episode they’re all eating insects, and in another they’re all buying new EVs. The brainwashing is so overt on PBS I can’t even stand watching anything but maybe nature shows. This cartoon I happened to land on while changing channels, I saw the windmills and I had a feeling …

I spoke to an oncologist this weekend who deals with severe cancer cases. She said that there are unbelievable numbers of people in their 30’s that have Stage 4 cancers, especially breast cancer and colon cancer.
She also stated that the cancers were typically incidental finds; for example, the patient was in an accident and the cancer was then discovered. This makes me wonder how many young people have Stage 4 cancer unaware?
She shook her head in agreement as I suggested the “shot” had something to do with it.
