Can we now be rid of agencies of swamp that were never properly / lawfully created by CONgress ?
Figure each case to take the typical years to wind its way through the lower courts to the final federal courts of appeal. Meanwhile, lawyers will still get wealthy and rules will still get made and threats against citizens and businesses under color of law will still be proffered, just like in the Covid operation, of which the emergencies act still continues.
The notable lack of any green protestors at SCOTUS this morning tells me the PTB’s didn’t care enough to have their contractors out there for the media, who were there in significant numbers, at least from the street level live coverage I saw. Protestors, almost nil. The lawyers have already war-gamed this out. It is war you know. We just haven’t gotten to the killing yet, rather have been taking casualties and doing nothing.
100, 000 casualties as a direct result of the invasion of our Southern border but nobody in Washington or the new media give’s a tiny rat’s ass. How is that even possible?

STATES that challenge Federal overreach, because they are inherently CONSTITUTIONAL issues of States vs Fed gov., go directly to SCOTUS.
And, SCOTUS MUST take them, BECAUSE they are inherently Constitutional cases.
With State officials intent on challenging Federal pre-emption and overreach, WE can greatly reduce the POWER of the Federal govt.
We can not “cut Congresses allowance” as fiscal conservatived have long advocated, recent events make that clear.
But, we CAN cut away at the POWER, and the Fed govt has expropriated powers never granted it under the Constitution, for so long, and to such a degree, that you hardly need to aim.
EVERY aspect of our lives is in some way regulated by some Federal law, rule or regulation.
Read “3 Felonies a day”; the average adult “breaks” 3 Federal laws, rules, regs/day, without ever realising it, and if you own a Business, even more.
WE, the People, and our elected State reps ALLOWED this Federal overreach, and the behemouth of the Federal administrative State to grow, because wedidn’t challenge it, in court.
Too focused on “other things”, the promise of Federal $’s (without noticing the strings attached) or on the manufactured crises the new Federal agency was supposedly going to address.
These two cases open a huge door, if we can elect STATE Officials (Gov’s, SoS’s, A.G.’s etc. prepared to fight for We, the People.
Reality is, the Federal govt really doesn’t have THAT much power; it is largely an illusion.
Pierce the illusion, directly challenge them in court, and in the vast majority of cases, they fold like a cheap suit.

Agreed. The conservative justices in this SCOTUS are deserving of our prayers and appreciation. IMO, the attempted intimidation of the justices in fact emboldened them. It may have in fact revealed to them the grave nature of this moment in history.

Govt agencies are executive branch organizations and should have neither legislative nor judicial powers. Just enforcement of laws.
Laws should be unconstitutional for saying “the Secretary shall determine.”
No regulation should be legal unless Congress has passed it and the President signed it.
It would also be good to sunset all regulations, requiring review and renewal. They can sunset our tax cuts so they can sunset regulations.
These things would keep them responsive to the people. And give them full constitutional support, not the imaginary constitutional deference to usurp article I powers.
Sunset all agencies not mentioned in the constitution (all of them) and give it all back to the states. EPA (or any agency) is not supposed to make policy

The Fed govt is NEVER going to WILLINGLY or volontarily cede power back to the States, any more than it is going to volontarily restrain its budgetary largesse.

WE just need to get A1 candidates into STATE offices, that are willing to aggressively pursue States rights.

This would be a revolution in Administrative Law. I imagine it would result in a thousand “rules” needing approval by Congress. While Congress itself is grossly inept at such rule making.
I think such a revolution would or should require a broad-based review of all that federal rule making and related spending to determine whether it actually is within the enumerated powers granted to Congress, or was instead reserved to the States and to the people.
Areas of federal government that, I believe, would fail that review, if conducted by Clarence Thomas-style conservatives, include healthcare, education, housing, urban development, intra-state transportation, police power / law enforcement, intra-state agriculture and food production, likely major aspects of “federal” land management. Readers can add their own favorite areas of federal overreach.
It is possible that the reaction to this Commie/WEF/corrupted -“science” takeover attempt -if stopped – could include the opportunity for a complete reevaluation of every area where the “federal government” has “big-footed” more locally accountable state and local governance, to our general detriment. You seem to have missed the Memorandum of Understanding drafted in Moscow on 08 February, 1990 between then Sec State James Baker and Mikhail Gorbachev. It was agreed that NATO would not expand eastwards into former Warsaw Pact and Soviet territory. There were no escape hatches, so what has happened since is repeated violations of the agreement, violations taken by the US government under both Democrat and Republican administrations.
What Putin objects to is the violation of this agreement. Note that he does not object to any and all joining the EU; this Russia is willing to honor.
In future, you need to distinguish between the EU and NATO. Failure to do so sets you up to go on uncritically swallowing the nonsense that is spewing forth from the Swamp these days.

I don’t know what it’s like today but back then there was access to almost all the battlefield and Devils Den was also memorable the steepness of it and all the boulders!

What did you expect the Court to do… overturn the Electoral College vote and declare the presidency to Trump? And by what legal ruling that applies only to Trump in 2020 to the exclusion of any Democrat in 2024 and beyond?
The voters do not elect the president. The Electors use the popular vote to cast their ballots. You are asking the Court to overrule the electors because of a lawsuit? Just think what Perkins-Coie can do in upcoming elections if SCOTUS agreed to hear that case.
The way to have stopped the 2020 election is for Pence to refuse to accept the Elector’s ballots in those contested states until the states investigated the election process. And he had every constitutional tool to do so, despite his protestations. Nobody asked Pence what he would have done if the slate of Electors chose a non-natural born citizen under the age of 35. Would he have accepted the ballots? If yes, then what is the point of Article II Section 1? If no… well there goes his excuse.

The Supreme Court is the “court of primary jurisdiction” for any disputes between two States. (Article III, Section 2: “[…] to Controversies between two or more States […]”) There is literally no other place for States to go.
It was therefore judicially impossible for a court to declare that the States “didn’t have standing,” when the Constitution itself places it there. And when inter-state cases have been accepted and decided many times before.
The simple truth of the matter, obvious to one and all, is that Courts at every level were part of the overall conspiracy. They consistently acted to prevent all challenges to what was taking place right in front of our eyes, and that is why peaceful citizens assembled to protest.

(At the hearing on April 28, Alsup himself raised the question of whether Musk’s purchase would make the lawsuit moot.) Musk didn’t email back. The last time I’ve heard from him was last year. Whether the deal played any role in Twitter’s decision to settle is a question you’ll have to ask them, but I mostly doubt it, given the fact that no one really knows if – much less when – it will close.

The New Yorker just ran its second big negative piece on Ron DeSantis in a week, proof of how much the woke media fears the governor of Florida. (Yes, I read the New Yorker so you don’t have to.)
The article is nominally about DeSantis’s support for age-appropriate teaching of gender and sexuality in public schools. Or, as the Democrats like to call it, “Don’t Say Gay.” The wokesters have not figured out that label is not quite the devastating comeback they think.
Plenty of parents of six-year-olds are fine with not having teachers say “gay” – they think that even if they support same-sex marriage (as I do), they and not outsiders should decide what their first- or second-graders hear about sex and family structures. Then again, these are the people who thought “defund the police” was an electoral winner, so their political instincts may not be the best.
But I digress, briefly. As you would expect, the article treats DeSantis as a political opportunist. But, unlike most woke media reporters these days, the author actually took the time both to talk to conservatives who support DeSantis’s views and to try to understand why those views are gaining so much ground right now.
