Where I live in Texas there is no paper ballot, only whatever the machines say the tally is. An audit would be useless, even if they could have access to the machines.

Generic paper ballots are worthless because they are too easily discarded and replaced by fraudulent ones. Barcoded ballots that can be audited and traced back to individual voters are what’s needed to prevent fraud.
Also needed is ONE Election Day, in which all votes are counted by midnight, without the stragglers and the mail-in ballots counted after-the-fact.
We should be given certified copies of our ballot right after we cast it.

Any funding to States legislation, includes conditions that must be met, in order for the State to recieve the funds.
So, to get highway funds, for example the highway must be constructed to federal highway standards, and Fed has some say in the route, etc.
But no Federal highway bill conditions funding, based on ABORTION.
When a State opposes Federal policy, for instance mj legalisation, OR “sanctuary state” for illegals, threats are made to withhold Federal funding, but again unless THE ORIGINATING LEGISLATION conditioned the States recieving the funds on,…mj enforcement, or cooperation with Federal detainer requests, the Fed govt can’t withhold the funds.
Whenever the Fed govt threatens to withhold funds from the State, it probably means they know they have no authority, and are resorting to threats,..and the question to ask is “What legal authority do you have, to withhold the funds?”
Unless their is language in THE ORIGINAL AUTHORISING LEGISLATION specifically laying out conditions which aren’t being met ..so they can’t amend legislation, and add a condition like abortion, now.

Tucker is quoting from Alito’s decision, which does in fact say that the decision relates to abortion, and abortion alone. Thomas’s concurrance, as you mention, is where the subject of revisiting past decisions, based on faulty interpretations of the 14th Amendment comes up. I agree that he should have mentioned Thomas’s comments, but then he also could have fully critiqued the dissent, which is perhaps the worst-reasoned dissent in modern memory, and a monument to confusion and illogic.

Thomas has written about bad substantive due process reasoning in multiple concurring and dissenting opinions for a long time. He is correct. But his purist opining does not mean that all the multifarious cases that have used substantive due process all are in the queue for being quashed any time soon. I tend to think that rather than creating a huge problem by overturning all kinds of cases, he’s trying to stop the theory from being used again as precedent, rein it in.
Perhaps people in states that do not have privacy provisions in their constitutions (as Florida does, e.g.) should consider starting there. The federal government is not supposed to be the big cahuna over everything.

Merrick Garland already threw a big ole monkey wrench into the Dobbs decsion by correctly pointing out that States have no authority to ban or regulate Mifepristone (the abortion pill).
That will be the left’s next big move. The abortion bans and trigger laws are null and void because the 10th amndment does not grant them the auhority to regulate Mifepristone or its administration.

I think this is unclear. These pills can only be used very early in a pregnancy and cause the equivalent of a spontaneous abortion (miscarriage). Not very pleasant. They can be dangerous. They usually have to be prescribed by doctors, and usually require a followup doctor visit just like a natural miscarriage would. States regulate doctors.

@Dutchman it appears that the recent US Supreme Court ruling pertaining to Federal FUNDING for private religious charter schools certainly advances the argument regarding withholding Federal FUNDING for private religious institutions in general, like hospitals and other private healthcare settings.
Of course, with or without the funding aspect, Freedom of Religion already has a set Constitutional precedent regarding healthcare choices and medical interventions like transfusions and cancer treatments. So mark of the beast mandates are a moot point for Christians.
If a state can ban selling ivermectin or hydroxychloroquin or recreational drugs then it can ban or make illegal the selling of any other drug.
I just don’t think Abortion is going to be an issue now that it passes to states.

I will say that I think part of the apparent apathy over abortion in such polls is that it has been all but a lost cause for half a century.
Now it’s not only not a lost cause, it’s back in the hands of the States, closer to the people, it’s a fight worth having and one that can be won.
There are many abortion limitation laws recently passed throughout the country, this is genuine momentum and the lost cause factor just got tossed out the window with prejudice.

The difference between Constitutional “Due Process” versus non-Constitutional “Substantive Due Process” is a vital distinction that I honestly was not aware of, the latter claiming that some liberties are so powerfully significant that no form of due process whatsoever can be used to limit them.
Essentially another vacuous self-serving legal theory thrust into Constitutional jurisprudence to warp its meaning in order to inhibit the Constitution’s authority to limit whatsoever behaviors the perverters desired to enable.

scalia was fundamentally correct in his lone dissent and nearly all academic legal scholars agree he got it right and the majority was wrong.
I won’t give away the spoiler, but if you all have the time, it’s an interesting short video that explains how Scalia operated, how we viewed the president’s powers to be and how specifically within the bounds of the constitution any independent counsel could perform a duty to investigate the president and not be in conflict.

My wife I were blessed with two beautiful sons 32 and 30 years ago. I didn’t sober up until the older one was 2. So never truly appreciated the blessing of witnessing the birth of one’s children.
Just an hour ago our three grandsons were in our home.
The oldest is 21 months, the younger 13 months and the youngest nearly 12 weeks.
The wife and I were close by for the birth of all three..to their mothers ( not birthing persons 😉)

As with every crime, the guilty should be punished, the innocent should be protected, and the victims should receive justice. So let’s give the victims (the mothers) the option of carrying their babies (the innocent) to viability and adoption, in return for executing their rapist (the guilty). There HAVE been men, who have been convicted of Felony Murder, and sentenced by State courts to prison time, for killing a fetus.
Albeit not many, they (accidentally) caused the death of the fetus, while in the commision of a Felony.
Accidentally shot a customer or teller, during a bank robbery. Victim was pregnant. If mother dies, and autopsie shows she was pregnant, its TWO counts of murder.
Of mother survives, but UNBORN FETUS doesn’t, its ONE count of murder.
And “the fetus was only 3 weeks old” is NOT a viable defence; it doesn’t MATTER, the law clearly recognises that Life begins at conception.
So, if he is guilty of murder, for being responsible for the death of a fetus, than how are the mother, Dr and staff NOT guilty of Conspiracy to commit murder, and murder with premeditation.

I started to think about the issue more last night and it did occur to me that Democrats have some very bad traits……
We have the Civil War whom Democrats once again had a very specific target that they wanted to work for them for little money and were going to fight for it.
It was Margaret Sanger that was most instrumental in all this termination…….and she made it clear what section of society she was aiming for…and her party.
This issue of course is most used by 13 percent of the country…..who have actually have 35 percent of the terminations……..
It would seem to me that banning this procedure is actually good for a certain section of society………..and could well be population control for Liberals and Democrats??? Just a thought!

NEVER in my 80 years, have I ever called a pregnant woman’s BABY (including my own) a *fetus*… When visiting the doctor during my two pregnancies, I can tell you for sure.. OBs and nurses asked about the BABY I was carrying!!
My experience also. In addition, my maternity wardrobe included a shirt with “BABY” and an downward arrow. Everyone wore them.

The US Constitution never said anything about women or their babies or their rights. “Seven old men” (six white, one black) simply made the whole thing up out of whole cloth. Their “decision” looks like the work-product of a legislature, and it reads like one. But, this is not the proper role of a court.
“Four words in a handwritten document” are not supposed to mean “anything you want them to.” Nobody elected you. You don’t write laws.
For fifty-something years, though, Legislatures and Congress were happy to have Roe because it meant they didn’t have to take up the issue. But it was flawed from the beginning, as the Casey decision pointed out but didn’t fix. Now, the Legislatures are forced to finally do their jobs. They can’t dodge the bullet anymore.
Officials such as District Attorneys would now be very wise to keep their mouths shut and to lay low until their Legislatures have time to take up the issue, which all of them must now do. Now is not the time to strap on your pistols and play Marshal Dillon …

If only this were fully true. But listen to Brett Kavanaugh, in his individual opinion on page 125 of the 213-page decision:

Wait … Congress?
If the Constitution — a grant of limited powers to the fedgov — is silent on abortion, how then can Congress legislate on the subject when it was not granted any authority to do so?
Without referencing the Tenth Amendment (mentioned NOWHERE in the decision), the court has just stuck another dagger into its belly.
Its open invitation to Clowngress to butt in ensures years of partisan battles to dictate abortion policy by top-down fedgov statute, rendering nugatory an exhaustive list in the opinion of state abortion laws in the 1800s.
Thus a seemingly pro-federalism opinion is actually anything but.
Rather, it enables the two wings of the Uniparty to continue their kabuki battles over guns and abortion at the national level (which should make no law concerning either one), while the Deep State prospers in the shadows, not only vetting candidates but also deciding which one “wins” the most votes.
Abort the fedgov.
I think that the most important aspect of this decision is to begin to put a dagger in the heart of “substantive due process,” which is a code-word for Court law-making. Several times in the past, Courts at various levels have decided for themselves what the Law ought to be, and then simply crafted “rulings” which said that it was so. Roe being one of the worst examples. It reads like something a legislature would write, but it was written entirely by seven old men and then imposed upon all of the states.
The five words, “the due process of law,” are not a magic phrase. They do not mean “whatever you want them to.” They’re supposed to mean what “hundreds of quarreling legislators” finally compromise that they should mean.

Already fourteen Republican Senators introduced the Prohibiting Federal Emergencies for Abortion Act, to pre-emptively block “Biden” from declaring a public health emergency to protect access to abortion services nationwide.
This is just the first skirmish in an endless war that could have been avoided by ruling that the Tenth Amendment applies. That is, neither the Supreme Court nor Congress nor the President have any federal authority whatsoever over abortion. But sadly, the court didn’t say that.
