According to our Constitution there is no such thing as a “hate crime”, but illegal actions are crimes and must be proven in Court. We cannot accuse people of thought crimes because they cannot be proven. If someone commits what most feel is a heinous crime, it is up to the Judge in the punishment phase of a trial to apply mitigating penalties for the commission of such a crime. But only if the crime has been proven to have been committed by the accused perpetrator and a jury agrees that he/she did commit the crime.
It is very explicitly stated in our Constitution, on which, our laws are all supposed to be based.
