The Australian Open is scheduled to begin January 17th in Melbourne, the epicenter of Australia’s totalitarian COVID mandates. Australia granted unvaccinated tennis superstar Novak Djokovic a visa to compete. Australian border officials then attempted to block his entry and deport him because he was unvaccinated.
Novak Djokovic took the issue to the federal court in Australia and won his legal case against the Australian government. However, earlier today Australian Immigration Minister Alex Hawke unilaterally cancelled his visa.

I’m an Australian with dual Canadian citizenship. For nearly 2 decades I’ve been based in Canada but always went back to Australia every year for 2-3 months to spend time with my family (including aging parents). The last time I was back there was Jan 2020. 2 years.
I’ve been prevented from going back to Australia during that time (like tens of thousands of Australians living overseas) – initially because the country’s borders were closed (until Dec 2021) and now because of vaccine requirements. I – as an Australian citizen – cannot go back if I am not fully vaxed. No exceptions.
Last year the AO went ahead DESPITE strict lockdowns and lockouts for Australian citizens and residents. There was an uproar – and rightly so – why should the elite be granted permission to do things that the regular people cannot? At that time, if you wanted to go to Aus, you faced a mandatory 10 day hotel quarantine at your expense. You basically were met off the plane and escorted to a government designated hotel where you were imprisoned for 10 days. Of course, the rich and famous didn’t have to do this – THEY could quarantine at their own home or location of choice.
The tennis players that came for the AO did not (at least to my knowledge) have to quarantine. And it wasn’t just tennis players. Throughout the 2 years Australia was closed to the world – and states within the country were closed to other states – many sports people and entertainers were given free passage. Football teams crossed state borders with impunity while regular Australians were forbidden even to attend dying relatives in another state. In the eyes of many government officials, a FOOTBALL GAME is more important than someone’s dying father, mother, sister, brother or even child. There was even one infamous case where a woman with a difficult pregnancy was barred from emergency transportation to her nearest large hospital because it lay on the other side of a state border. She was taken to another hospital in her own state which was much further away. She lost the baby. But hey, can’t miss a footy match. Or a tennis game.
Australians have a RIGHT to be upset about that. One thing that Australia has always been is a very egalitarian society. Australians generally don’t take kindly to one rule for them and one rule for us.
But it gets worse. Many Aussies were caught overseas without residency or citizenship in the country they happened to be in when the border closed. They were stuck overseas, unable to work and at the mercy of whichever government jurisdiction they were in at the time. No visa, no home, no income. And very, very few repatriation flights to Australia. And as for the few commercial flights going to Aus – you were looking at US$7,000 for a seat from LAX to SYD. Out of most people’s price range. Plus the $3,000 for quarantine.
Just imagine how they felt when they saw the rich and famous being ushered into the country with open arms. It was absolutely bloody outrageous.
I STILL can’t go back because of the vax issue – and I have no idea when – or even if – it will be resolved. The most likely outcome is that I will be forced to take it if I ever want to see my family again. Meanwhile, my parents are in their ’80’s so time is running out. I thank God that nothing bad has happened during this interminable 2 years.
So, when I see a sportsperson – ANY sportsperson – being treated any differently to a regular Australian (and I would argue the Australian has more right given they are a citizen) – it makes me angry.
That said, the Australian government should have been clear from the get go. These are the rules that apply to everyone. No exceptions just because you’re famous.

Aussie here. Update: Novak has appealed the Minister’s decision.
It’s Saturday morning down here. Grand Slam organisers have announced that the top half of the draw are playing Monday, which includes Novak. (They had the option of playing the top half on Tuesday, giving Novak an additional day for his appeal, but they didn’t). So, the appeal has to be decided by Monday in time for Novak to play.
9.00pm last night Novak’s lawyers brought the matter back before Justice Anthony Kelly in the Federal Circuit Court. He’s the Judge who heard the first case, overturning Border Force’s cancellation of Novak’s visa. It was broadcast live with 50,000 tuning in.
Novak’s Barrister, Mr Woods SC said the Minister’s decision to cancel his visa was “patently irrational” and was based on the claim his being in Australia could excite “anti-vaxx sentiment”.
The Judge ordered that Novak’s deportation be delayed, and he was not held in detention overnight. However, he is being to detention this morning this hour, after being interviewed by Government officials. Other than meeting with his lawyers this weekend, he will remain in detention.
Judge Kelly ordered that the matter be transferred to the Federal Court as he didn’t have jurisdiction to hear the matter further, so a new Judge, Justice David O’Callaghan, will be hearing the appeal.
An online hearing before the Judge has just commenced minutes ago (livestreamed on YouTube, I believe) to determine issues before the main appeal hearing on Sunday.
Lets hope there is another judge in Australia who will do the right thing and slap down the tyrants once again.

The vax does not prevent a person from contracting or transmitting the virus. Its effectiveness is so limited and wanes so quickly, a “booster” is required in just 4 months (and 3 months in many countries).
The effectiveness of natural immunity as protection against viruses has been scientifically recognised for 2,500 years. Until Covid, peculiarly. I wonder why.
Natural immunity affords at least equal (and indeed on the data, higher and longer) protection than the Covid vaxxes.
Of course Novak is opposed to the vax. He has naturally immunity to Covid. The vax is redundant and unnecessary.

The Judge ordered a timetable for submissions by both parties today, with the hearing proceeding tomorrow (Sunday).
The Judge is considering whether the matter will be heard by him as a single Judge, or before the Full Court of the Federal Court (3 Judges).
It was submitted that as a single Judge decision can be appealed to the Full Court, whereas a Full Court decision can only be appealed to our highest Court, the High Court, it would be prudent for the matter to be heard directly by the Federal Court, given a decision is required by Monday for Novak to play (or not).

The most recent document uploaded was the Order made by Judge Kelly ~11.00pm last night, transferring the matter from the Federal Circuit Court to the Federal Court, and other matters re detention etc.
One of the Orders made by the Federal Court in a brief hearing this morning was for Novak to file his submissions by midday (Melbourne time) which was 15 minutes ago, so hopefully they’ll be uploaded soon.
Interestingly, the main ground for the Minister to cancel Novak’s visa was on the grounds his presence may stir up “anti-vax” sentiments which is patently absurd, particularly when PM Morrison himself just boasted in his Statement that we have one of “the highest vaccination rates in the world”.

I disagree. Movie stars have been welcomed into Australia with open arms during these draconian lockdowns to make their movies while locals are treated like prisoners.
