Prosecutors and U.S. corporate media attempted to claim that Rittenhouse was a vigilante looking for a fight; however, the defense, and all video of the events, show all shootings were justifiable self-defense.

It sure would bolster the courage and conviction of the jury if they new somebody in any level of government has them covered. It was broadcast loud and clear over public TV News from the President of the US down to the Mayor’s Office in Kenosha that they are covered (maybe) ONLY if the right verdict is delivered. Otherwise their homes, families and neighbors burn at the hands of Government Brown Shirts.
These people are human…plus more than their own persons have been threatened…people criticizing their courage have zero idea of the power of a threat vs associates, if one lacks the assets to fight back.

It really doesn’t matter whether the split for acquittal is 1-11 or 6-6, the judge will have to declare a hung jury soon. Whether he will also declare a mistrial is the question.

A hung jury works. A Dismissal without prejudice and a new defense team would also work. This defense team should have been pushing for dismissal with prejudice from the get go but have sat back and not pushed the matter. Fine. Get a new defense team and get going. The state has shot their wad. We now know all they have. A dismissal with Prejudice is unlikely to me because the judge doesn’t want the heat. I don’t think Kyle will get that. Besides, he’ll be the subject of civil lawsuits and I’m sure the Feds are coming with Civil Rights bullcrap charges too. He’s not finished, sadly. This is the Stasi after all.

Yeah, right. Obvious. Four days later. No, that’s not beyond a reasonable doubt; that’s convincing oneself to decide something. There is a universe of difference between those two points.
Properly done, a shooting is reviewed for justification in approximately the following way:
You get everyone’s attention, then tell them to look at the screen. Once that is set up, you roll tape serially with each new camera angle played immediately after another, real time.
When the video has run and the episode is over in whatever time it took at real speed–in this instance, moments x however many additional vantage points–then you shut down the video and allow the jurors to ponder what they saw.
You tell them this: “The defendant is innocent. That is the baseline determination at the beginning of court. The prosecution, to get a guilty determination, must now move that marker clearly away from innocence into guilt without a reasonable doubt.”
“Anyone here see the act of a guilty person, and if so, please point out the angles and the time stamp?”
Lacking no hands, because no one in this particular instance could identify a specific act on the fly, you have met the burden of review. Innocent by default, but they cannot demonstrate guilt.
Snap decisions cannot properly be critically reviewed in slow motion with repeated exposures to the same stimulae in an attempt to derive an understanding sufficient to grade a person’s reflexive response. If it ain’t there real time, then you aren’t going to tease it out four days later–not without violating the reasonable doubt clause.

For clarity, when innocence is not obvious on the fly, then it would be appropriate for the defense to review the footage to exhaustion if necessary to establish the element of doubt.
That is, when a real time review indicates guilt but a studious review teases out exculpatory evidence, then the burden sits on the prosecution to prove that away.
We’ll never get there, but that is a very troubling problem in eternally reviewed snap decisions. About the only cure for shootings and self defense cases is for the jury to be those who have “been there” or at a minimum have training and life experience with the weapons and tactics under review.

The problem I think is you have jury members who are reacting emotionally and politically to the evidence rather than objectively. All they see is that people were shot by Rittenhouse. Most if not all of them have never been in a combat or self-defense situation. It is very easy to second guess the defendant’s actions from the safety of the courtroom with days to decide on the correct course of action. Layer this over the fact that he should not have been there in the first place, I as a parent can understand that and a year of the MSM claims of racism and painting him as a vigilante looking to shot someone. There is also the fear of what will happen to the town if he is found not guilty. If riots occur again as expected then they fear for their lives and property and being ostracized by their friends and neighbors. They should have had a change of venue for the trial, but this whole situation is occurring because a total failure of the state political leadership, law enforcement and the local legal system. The jury is looking for a way out of this situation where they can appease their conscience and avoid any political and social consequences.
If a conservative white mob was trying to intimidate a jury, it is certain that there would be fighting in the street. Additionally, the fact that there is no pushback against the street mob is instructive here.
Just a reminder, (and certainly without predicting) that the jury is permitted to find on one or more counts and hang on the rest.

Whenever they tell the judge they are deadlocked, he will likely tell them to give it one more try. If they’re still deadlocked, he will declare a hung jury.
As long as they tell him they are deliberating, he will let them continue.
I keep forgetting to factor in that the judge will tell them to give it another try. Looking at the calendar, it seems like that admonition would have to come tonight or maybe Monday, otherwise this train chugs right through Thanksgiving (or, worse, pauses on Tuesday or Wednesday and resumes the next week).

When the prosecution presented the higher resolution video, they were trying to show that Kyle pointed his gun at the thugs, NOT self defense was the theory.
Now when you think about that and any jury surely should, a person in fear for their life may very well point their gun attempting to stop the threat. Police do it. Point their gun, shout stop, and may well never fire.
After the supposed gun point, Kyle took off running. In my mind this reinforces self defense because he tried to stop the aggression of the mob by pointing his gun, but the rabid dogs ignored it. Eventually Kyle fired because the “pointing” did nothing.

At this point, the jury deliberations may have been so tainted by one or more jurors looking at media reports that sequestration would not be an option. A mistrial for ignoring his advice should be the result. The judge has no way of knowing what the media-influenced jurors said to the other jurors or how it affected their deliberations.
So in other words, the Prosecution gets a free “do-over” for mis-handling their case.

A verdict now is acquittal (pray) OR I hate to say it, it could be a compromise verdict – meaning a guilty on one of the lesser charges. Pray, but brace ourselves.
Don’t shoot the messenger — but if foreperson was refusing to let people go with hung jury, with T-day coming up, a compromise becomes more likely.
Even the lesser charges carry a 12 year sentence plus an extra 5 year enhancement for having a gun.
