Compelling any employee to take any current Covid-19 vaccine violates federal and state law.
First, federal law prohibits any mandate of the Covid-19 vaccines as unlicensed, emergency-use-authorization-only vaccines. Subsection bbb-3(e)(1)(A)(ii)(III) of section 360 of Title 21 of the United States Code, otherwise known as the Emergency Use Authorization section of the Federal Food, Drug, and Cosmetic Act, demands that everyone give employees the “option to accept or refuse administration” of the Covid-19 vaccine. ( … ) This right to refuse emergency, experimental vaccines, such as the Covid-19 vaccine, implements the internationally agreed legal requirement of Informed Consent established in the Nuremberg Code of 1947.
As the Nuremberg Code established, every person must “be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, overreaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision” for any medical experimental drug, as the Covid-19 vaccine currently is. The Nuremberg Code prohibited even the military from requiring such experimental vaccines. (Doe #1 v. Rumsfeld, 297 F.Supp.2d 119 (D.D.C. 2003).
Secondly, demanding employees divulge their personal medical information invades their protected right to privacy, and discriminates against them based on their perceived medical status, in contravention of the Americans with Disabilities Act. (42 USC §12112(a).)
Third, conditioning continued employment upon participating in a medical experiment and demanding disclosure of private, personal medical information, may also create employer liability under other federal and state laws, including HIPAA, FMLA, and applicable state tort law principles, including torts prohibiting and proscribing invasions of privacy and battery. Indeed, any employer mandating a vaccine is liable to their employee for any adverse event suffered by that employee. The CDC records reports of the adverse events already reported to date concerning the current Covid-19 vaccine.

May I add that I have never been in favor of MANDATORY vaccination? But sure, on a risk vs benefit basis, if your doctor recommends it, I’m absolutely in favor of developing and using vaccines.

I have nothing against vaccines, I just don’t think it’s necessary to vaccinate agains Covid, any other coronavirus, the flu, etc. They are ever evolving viruses. You’re better off focusing on making yourself overall healthy plus supplement where needed (Vit D in winter, Vit C or anywhere your specific blood chemistry is lacking) .
Take the vaccine if you want, but there’s no need to mandate or worry about wether someone else took it or not.

The polio, smallpox, and other vaccines cannot be compared to the experimental injections for covid–which have been mislabeled as vaccines.
In fact, the decades-old, proven vaccines are of much higher value to the populace than other flu vaccines. Of course some folks benefit from the other flu vaccines, but to me and to many it is not worth the risk, i.e.: a virile 35 yr. church member of ours got a seasonal flu vaccine, and has been in a wheel chair ever since; a family member–still in good health in her golden years–died 6 weeks after getting the seasonal flu vaccine. Doctor even put the shot onto her death certificate as cause of death.

Mostly I’m pro medicine. I’m in favor of consulting licensed, qualified providers in order to get the best info available. People have different health needs. I support every patient’s right to refuse any medication. But if you choose Internet research over the advice of your own doctor, I’m going to reserve the right to think you are being foolish.
Absolutely. Being recovered from the disease should certainly be the standard for a medical exemption from having to vaccinate where employers require it. It is in my local hospital and the independent practices I know.
Hospitals are a special class of employer. Hospital staff work in direct physical contact with the most vulnerable populations of patients, and nosocomial infections are no joke. IMO, they are entitled to demand that workers take extra precautions, above those the general public needs to take.
It’s really no different in principle than having to adhere to the safety standards of whatever kind of job you do. Some jobs require steel-toed footwear and hard hats. Some require extra PPE, extra shots, and a higher than average level of cleanliness.

Most docs don’t even bother to read the package insert on vaccines. Too many docs no longer practice independent medicine or thinking. They do what they are told by the giant medical conglomerate that owns them or follow what the pharmaceutical companies tell them to do. All the medical schools do the same. There is an unholy, unhealthy alliance between medicine and big pharma. You’de have to be obtuse not to see it. If nothing else the treatment of COVID (and the stonewalling of effective treatmeant)and the pushing of the experimental vaccine by the medical community should be an indicator of how far the establishment medical community has fallen. I just gave an obvious example. I also had school classmates go deaf and develop heart problems from rubella, and I was in hospital when I got mumps at 15. As a worker I’ve had to watch an infant unvaccinated against pertussis take three months to cough to death. Had to hold onto a sobbing mom when the doc I worked for called 911 for her toddler that had not been vaccinated against meningitis.
The one time I went against medical advice was in waiting to get the shingles vaccine, because it costs $200+ if you are under 65. (It’s free with Medicare.) I got shingles, and it was the worst pain I have ever experienced, for weeks. If I had understood that, or paid better attention, I would have sold my car to get those shots.

Workers Compensation is state administered. In Florida, the governor made it clear that vaccine passports are illegal so Workers Comp will NOT be needing to know. That will go for all the other states that follow suit.

Again, the original post, the first one in the thread, said the employer asked vaccination status, and said answering the question is mandatory. The employee can certainly query why it is being asked, but the EEOC has ruled it’s legal to do.
There are other kinds of insurance, as well as state licensing regulations, where such questions may be mandatory. Most of my career was in hospitals and clinics. Many aspects of your health info can be required for malpractice insurance, or to maintain a physician’s DEA license, a nursing/tech license, sometimes a business license for a practice. I often was assigned the duty of making sure all the necessary forms were filled out and filed on time. The forms and requirements change over the years.
On the question of legal validity, that is in progress. The 117 employees of Houston Methodist just lost at district court, using the specific arguments Gipper provided. I posted several times prior to that ruling that the Nuremberg Code is not relevant law, so you can’t rely on it as justification in a civil lawsuit about a labor dispute.

They held a famous trial in Nuremberg on the medical experiments Dr Mengele was conducting and the violations were so egregious, the Nurénberg Code of Medical Ethics were developed and agreed to by nations including the US. People were held to account in that trial.

Read this doc carefully. It says the Vax is NOT approved. On p8 it says people who are allergic should not take it. Tell them your doc has advised you not take it at this time due to allergies. Keep reading. One of the side affects is death, which is why you cannot take it per your doctor because of allergies. At the end, the doc says the Vax MAY PREVENT COVID. It doesn’t say it WILL prevent covid.

all of this is heartbreaking.. my whole family has taken the shots. I haven’t and wont. I got a flu shot ten years ago that put me in the hospital and the doctors could never explain it. Now I live in fear of their future health.
As sad as it is, there are many prescription drugs that list in the possible side affects, death, or major issues with health. But, many people continue to take them. Even aspirin can cause problems in some people.
You could also use driving as an analogy. You voluntarily drive. But if you do, someone beyond your control can smash into you. Does anybody say I’m simply not driving because it could lead to my death? Does anybody produce a video saying a relative died in a car crash so please people don’t drive?
As a child standing in line to get polio vaccine, another student passed out due to needle phobia or stress, and was taken to the hospital. They didn’t even get to the vaccine and had a side effect.
I guess my point is that everyone makes their own choice, no one should force it or diminish anyone who has taken it, and if you do have any side effects please report it so that any future research is improved. You think nobody ever died from the first organ transplants? Would anyone talk someone out of getting a new kidney or liver or heart because “people have died” from it?

To be realistic, it all depends what happens with the recent decision by the Federal Judge in Houston, Texas to stop the law suit by the representative of the 100+ nurses fired from the hospital for not getting vaccinated. The Judge sided with the employer.
The Federal District Court Judge essentially ruled:
The vaccine IS NOT experimental, rendering moot the argument about forcing use of an experimental drug.
Public safety and good outweighs individual rights, as in protections under constitution.
That is now the law of the land by precedent, until undone by a higher court or another court rules differently forcing a decision by the Supreme Court.
So, reality of the current situation is YES they can demand an answer, unless you want to try your luck at Federal Court roulette.

HIPAA privacy laws clearly state we CANNOT be forced to disclose our health information to anybody. And even *if* we voluntarily disclose this private information to our employer, they are *not* authorized to *share* our confidential health information with anybody else, without first obtaining our *consent.*
Punitive restrictions like segregation and masks, that single out employees based on *confidential* information, would violate HIPAA’s law against announcing your personal information to others.
Oh.. and Big Pharma expressly *SOUGHT* the FDA’s EUA (which stands for EMERGENCY use authorization) so that they could be free from liability for side effects.

That judge’s decision has no force outside of his District, or with different parties.
That is an untested legal theory, not a fact. As thedocoo pointed out, the ruling is now precedent. It WILL be cited in future cases. If upheld on appeal, then it will have force outside the original situation.

I signed up for a paid clinical trial to develop plasma therapeutics as new treatments for COVID and hopefully other diseases. Participants all got serologic (blood) tests, because they were harvesting the preferred types of antibodies from donated whole blood. Because I had not contracted the COVID virus, i did not have the desired antibodies. I was offered my choice of the three EUA vaccines if I wanted to continue in the trial.
After consulting my doctor, I got the Pfizer shots. They were the highest efficacy/lowest risk ones for my age and health profile. No side effects, not even a sore arm. We’ll know in a year or so if this leads to new products.
I have had health challenges since childhood. I couldn’t possibly qualify for military service. I made the choice way back in college to participate in trials for new drugs and new assistive technologies as one way to give back to this great country for saving my life over and over through medical interventions. I’ve never regretted the choice.
If you understand HOW precedent works, you would understand that the decision is ONLY precedent for the parties involved and in the District the judge is from.

It is not precedent. It has advisory status to other circuits, but does not in any way bind them. It will not have any force outside of the 5th if upheld on appeal. The old “take it to the 9th and get a liberal ruling to bind all the US federal courts” has been abrogated, or didn’t you pay attention? The ruling by the 5th should they uphold a questionable district court ruling will be advisory to other circuits, but not mandatory for them to follow. Each circuit is its own boss under the SCOTUS.

She certainly has opinions about environmental factors and autism, and now vaccines, but she isn’t a medical doctor. Her area of expertise is computer science and her degrees are in computer science and electrical engineering.

This is how I understand it as well. If the employee provides a definitive answer, either a yes or a no, then the employer segregates/imposes workplace restrictions based on that answer. I agree it is therefore safest to cite HIPAA privacy laws, while declining to answer the question.
I also believe it is a violation of HIPAA privacy laws to “share” an employee’s confidential health information without prior consent. For example, Doctors must obtain consent prior to sharing health information with insurance companies and other doctors.
Wouldn’t segregation and punitive workplace restrictions based solely on vaccination status (think: scarlet letters, isolation and masks) violate HIPAA laws by identifying the employee to others, against his wishes?

I think you can “volunteer” the information if they ask but you can also decline to provide personal healthcare info.
Sometimes yes, sometimes no. HIPAA isn’t a total shield. Examples:
You become injured or ill, and need either time off work, or an assignment to lighter duties. The employer can require medical exams and verification of your health status from your doctor.
Employers can require random drug tests. If you fail one, you can be required to prove having a prescription for the drugs involved. They can fire you if you refuse.
If you need any type of special access or accommodation for a disability (ADA), the employer can require proof of your limitations before complying.
If the reason the employer is asking has anything to do with their insurance, your refusal to answer can be cause for firing.
As an attorney, I would advise a client to ask “Why do you ask, Dog Puking?” If they hem and haw and don’t give you a definite “The insurance company requires it” response and show you that is true, then unload your rights guns. Employers don’t own the employee’s and will not pay if the required experimental gene therapy cripples you, renders you an idiot, or kills you. This is beyond simple questions such as ADA–By the way, Mike, ADA accommodations must be requested by the employee. Drug tests are tied to job safety. Requesting a physician’s note if missing work is to ensure you aren’t malingering. Definitely get a lawyer right away. Save every communication. Have something to record any communication. The specificity is frightening as well, pushing specific for profit companies. Ask how your HIPAA rights (and many other rights) are being protected from a separate HR person but EXPECT retaliation if you do ask any questions. So if you ask questions, expect yourself to be red flagged and such so consider if you can afford to risk anything at this time.

My HR side-stepped this entire segregation issue by wisely opting to apply the stricter mask/distancing protocols for every single employee and visitor, regardless of vaccination status. That option is always left on the table, because it absolves the CDC and the states from assuming the liability of the other poor choices: The employer gets to choose their poison.
In other words, nothing was changed by HR in response to the new CDC guidelines. There.. Problem solved.
Nobody must ask or tell. Nobody must check papers. Nobody must get the jab.
If anybody is still required by the state to mask up, then everybody must do so.
When masks/ distancing become optional for *all* per the state and CDC, then nobody will be required to follow these protocols, although they may still be “encouraged” to do so.. The end result of all of the ADA is that it is a disability and must be accommodated. It is up to the employer to provide the data to prove that there is a significant danger to the company. That will be hard to provide given the 99.8% survival rate. IMHO.
Does that make it ok if they “provide an alternative”? My sister is in a nursing home and already had covid (well, if you trust the tests she did). She has refused the vaccine. Therefore, even fully vaccinated family members cannot go to her room to visit her. She must be taken to the lobby for visits. We have no way to check the conditions of her room, make sure her tv and computer are working properly (and are still there!), etc.
In addition to this her disability makes it very difficult to be taken out of bed and put in a wheelchair in which she never feels comfortable. She is physically unable to adjust her body into a comfortable position like you or I might be able to do. Everyone still must wear a mask but we are able to sit close to her and give her a hug, etc. But we cannot go into her room! They have no answer when I ask why.
They do not own her. Get an attorney ASAP. I got my Dad out of an elder prison camp that DeSantis made off-limits “because. COVID-19. Or something.” Dad was living in filth! We must be able to take care of our loved ones and to ensure that the “loving staff” (barf) are actually caring for them.
And check into the state regulations on nursing homes that family members are authorized to inspect the rooms. Are you paying for this?
What if one day you were to just walk into her room? Try first with just one member, not your whole family. Then see if you can get away with this a few more times until they start seeing you in her room by habit.

The paper cards you get when you are vaccinated are largely for your benefit. You can find the PDF of the blank CDC vaccination cards online. You can also find many examples of filled out cards on twitter and instagram. Do what you will with that information.
There should definitely be a database to track people who volunteered for experimental injections. These are experimental trials. The patients are supposed to be followed and studied for a period of time specified by the drug manufacturers.
Some studies end in 2022, others in 2023. These studies should be a period of two years AT MINIMUM. The vaccines themselves are tracked by batch, as well. If patients report side effects they need to refer back to the batch.

So, Dr. Humphries left her job to research vaccines (how they are made, what goes in them, etc.) and immunology. She also looked at the historical records and data, and she came to the conclusion that everything we have been told about vaccines is a lie. She says most of the childhood illnesses were on there way out, long before vaccines were implemented. And she notes that the world’s leading expert on smallpox, Dr. Thomas Mack says that vaccines had nothing to do with the eradication of smallpox and that it was economic development that was responsible.
Some people are so sold on vaccines that they are blind and deaf to any contrary information. The whole term “anti-vaxxer” is used as a pejorative. I prefer “vaccine skeptic”. Most pro-vaxxers know little or nothing about our natural, God given immune system and have been convinced through years of conditioning that they need a vaccine shot for everything. American Disabilities Act (ADA) accommodation for an allergy that your doctor has recommended you do not take the Vax because it will injure you. An employer will not touch this with a ten foot pole. Ask for an accommodation. A lawyer in a previous comment said the accommodation must be requested by the employee.
I have seen employer emails stating that the employer is NOT forbidden by HIPPA to make inquiries or require the answer to such questions. As the employer owns the medical insurance policy of the employee, it makes sense that the employer is at least vested in the employee’s health records TO A DEGREE.
In any event, it’s one thing to trade information, it’s another to mandate medical procedures, experimental ones at that. Since your option is comply or be out of compliance, probably wise to comply and see where things go. If they go the extra mile and mandate the EUA vaccine–by definition a “potential danger and hopefully less dangerous than the disease”–then you are at your decision point, but by then your decision would be to remain on staff until they fire you without cause.
There’s something fishy about all of this.
The EUA came into existence to allow use while bypassing full testing regimen because the now-known therapeutics were suppressed in an organized fashion. If the pandemic is a Black Plague, then it’s all Russian roulette all over the place, vaccine or no vaccine. So on August 24, 2016, the Russian hackers sent spoofed emails purporting to be from Google to employees of an unnamed U.S. election software company, according to the NSA report. Although the document does not directly identify the company in question, it contains references to a product made by VR Systems, a Florida-based vendor of electronic voting services and equipment whose products are used in eight states.
According to its website, VR Systems has contracts in eight states: California, Florida, Illinois, Indiana, New York, North Carolina, Virginia, and West Virginia.
The spear-phishing email contained a link directing the employees to a malicious, faux-Google website that would request their login credentials and then hand them over to the hackers. The NSA identified seven “potential victims” at the company. While malicious emails targeting three of the potential victims were rejected by an email server, at least one of the employee accounts was likely compromised, the agency concluded. The NSA notes in its report that it is “unknown whether the aforementioned spear-phishing deployment successfully compromised all the intended victims, and what potential data from the victim could have been exfiltrated.”
Halderman told The Intercept. “I would worry about whether an attacker who could compromise the poll book vendor might be able to use software updates that the vendor distributes to also infect the election management system that programs the voting machines themselves,” he added. “Once you do that, you can cause the voting machine to create fraudulent counts.”
VR Systems declined to respond to a request for comment on the specific hacking operation outlined in the NSA document.
