Has a civilian ever been the subject of an impeachment trial? Is it Constitutional? Sen. Schumer stated no witnesses. A while ago, Sen Warren and Sen Blumenthal stated Roberts should preside. What say now? Can Trump demand a statement from Roberts?
Roberts said he would not preside. W/out Roberts presiding I dont believe the Senate Impeachment trial… can be legitimate, constitutionally.

Now it seems that forever Sen. Patrick Leahy (D) will preside. He explains the rationale that the president pro tem of the Senate presides over the impeachment of non-presidents. That is probably true, but a non-president (someone in an office other than president) is not the same a a former president. One would think a public defender worth his salt could shred that kind of pretzel logic….

The whole point of the impeachment process, constitutionally, i believe, is for Congress to have a way to remove a truly bad, dangerous, corrupt sitting president.
Impeachment is a security last ditch mechanism… or should be and really has been for our 240 years as a nation.
UNLESS… all of Congress KNOWS PDJT really IS the real POTUS… there is no point to the impeachment process at all.
WHO is to be removed IF Trump is the former potus already. He is already removed. There’s nothing to do here.. no point to having an impeachment trial at all.
The point is to prevent him from running for any federal office in future. They can’t vote to “disqualify” (majority vote), unless they first reach conviction in an impeachment trial (2/3 vote).

Mechanisms for impeaching NON-presidents would still involve removing the elected official from office… which is still unnecessary in PT’s case b/c he is already removed.

Everybody remembers what the last impeachment intended to hide. I wonder what this impeachment controversy is meant to hide? I suspect that the facts will ultimately show that something was brewing at this moment, just as the Covid plot was brewing while Nancy showed off her dancing shoes in San Francisco’s Chinatown for the Chinese New Year celebration Feb. 24, 2020 where it was fashionable, right after the first impeachment acquittal, to bash the great, former President’s China travel ban.
The Epoch Times’ Covid timeline is very instructive in this area. If you read carefully, you see Covid was a set-up, and Dems were in the loop. For instance, the WHO waited an entire month before declaring a pandemic (Jan. 30, 2020) during which time Dems knew that China and WHO were both deliberately lying to the President about person-to-person transmission (that there was none!!!), and that all would be easily contained within China, and that as such, appropriations for the Covid pandemic would only be in accordance with the actual threat which Dems knew they would pound the President on as being too cheap. Dems also knew the President would relay all of China’s and the WHO’s assurances to the American people who were being horribly mislead by Communist News Services with their fearmongering. It was exactly one day (24 hours) after WHO declared a pandemic that the great, former President issued his ban (Jan 31, 2020).
Dems knew Covid was their 2020 plan to remove Donald Trump, and I’m sure that the impeachment was merely a strategic ruse to occupy the entire White House’s time and energy. They knew the great, former President was being fed lies that China would control spread, and, in connivance with China, planned to use this against the President as he did what all great presidents do, i.e instill confidence in the American people’s ability to overcome.
It’s hard to fathom in all of American history a greater scourge against America than Pelosi, Schumer et al.

There is no provision in the Constitution for the impeachment of one who doesn’t hold an office. The president is a civilian; so are other officeholders who might be subject to impeachment. But one has to be holding an office.

I like what you wrote with one quibble: “FAKE trial”, not “unconstitutional trial”.
Among other reasons, if Chief Justice Roberts or an acting SCOTUS CJ, does not preside, it’s not an “impeachment trial”. If there were no judges available in the courthouse, could a bailiff preside? This is beyond idiot.
There have been several historical instances of impeachment trials after the individual had already resigned or left office. I listed three in detail before, so I’ll just mention one now. 1876, William Blount, President Grant’s Secretary of War. He had resigned, but was then tried (and acquitted) anyway. The Senate’s reasoning was that if impeachment and trial was not an available option AFTER leaving office, then guilty persons would just quit to avoid it.
CJ Roberts’ desire not to preside is based on his reading that the Constitution only requires his presence in cases of impeaching a PRESIDENT, since that is the exact language. As Mr. Trump is now a FORMER president (legally speaking), he doesn’t have to play.
Art 2 section 4 provides you the list of which officials can be impeached in our system. Private citizen is not on that list.
So our side letting them distract us once again. Suddenly no one is talking about the election fraud and overthrow of our government and focused on impeaching the president who is in exile from the very coup that everyone is ignoring ever happened.
BTW the US Constitution is currently on hold, so whether or not any of this is legal, the answer is NO because the minute they overthrew the government on Jan 20, 2021 our laws will only be used against us and they will make new ones to protect themselves.

I think the key part of the statement above is a 27 year old Army captain “shot”. He didn’t write letters, didn’t talk about a third party, didn’t boycott. He did something that required way more courage than that.
They are not called “the greatest generation” because they sat on their hands and did nothing.
They won a World War on two fronts in less than 4 yrs, think about it we are still fighting in Afghanistan now for 19 yrs.
They were infected with patriotism, courage and victory. They did no have Fauci (I won’t call him doctor, he has not seen a patient in more than 40 yrs) to demand they stay indoors and wear a mask.

Like most squatters, they can’t get into the office they desire, but they’re going to sit outside as long as they are allowed, or until they are placated. The message is being sent loud and clear: if the great, former President criticizes the impeachment or its supporters, or threatens a Third Party movement, or criticizes Election 2020, or the Biden Administration, then more Republicans are likely to convict the President, OR, the squatters, by resorting to some political ruse, might be secretly conspiring to vote to disqualify the President from future office by a mere majority vote, constitutional or not, AND EVEN IF NO OTHER HEARING IS ACTUALLY HELD.
As things stand in our current Kremlin-inspired government, if Schumer sends the pertinent federal offices a signed Senate disqualification notice for great, former President, and if it is received into the record, it won’t matter at all if the process was according to the framers notion of impeachment or disqualification. In such a case, to depend on a Kremlin-inspired judiciary to rule fairly regarding these matters is expecting too much from the Kremlin.

Creating a new party adds an enormous logistical burden, and divides our forces in the face of the enemy. What is needed is massive activation in local politics to displace RINOs and Corruptocrats, while pushing for fair and transparent elections, and each MAGA policy objective.

I can switch back to the Republican Party if I need to vote in a Primary. It is all done with a ballot delivered by the mailman anyway. I can only confirm that my ballot was accepted for counting. Only God knows what my “elected” officials actually do with my ballot.
I can understand the sentiment – however after looking into what it would take to get involved locally and get involved in the elections at the precinct level, you maybe disqualifying yourself from being able to do anything that way with that action.
The local rules for me require you to have not changed your voter registration status for over a year to be eligible to be a poll worker.

And the entities become “super citizens” with amplified power and influence, which they then use to confer “super rights” to amplify an ordinary citizen constituent of their choosing creating “superior citizens” by fiat of corporate amplification.

Ausonius- I have been very much against trying to start a third party simply because it doesn’t seem practical or do-able. I say this based on my own experience in local grassroots politics for many years, working on campaigns, running for office, getting people elected, etc.
However, today I am listening to Mark Steyn in for Rush on the radio and I must say, that he makes an extremely compelling case for our President Trump to form a new party. Steyn brought up a recent poll that showed a third party under Pres. Trump would beat both Dems and Repubs!
He also pointed out the success of the Brexit party in the UK as a primary example of how even a one off third party can be successful. So at the very least, I am keeping an open mind on this issue.
Given the nightmare that we are living in during the first week of the Fake Administration, I think it is a most urgent matter as to what is going to happen in this regard.
We need to regroup and get organized asap before we lose momentum. I honestly believe that our President will be able to do either one- GOP or third party- successfully but he must strike while the iron is hot.

I’ve predicted that Dems will nuke the filibuster soon. Now Manchin has said he won’t “under any circumstances” and Sinema has also said she’s against ending the filibuster. I hope my prediction will be proven wrong, but we’ll see.
Just read that about Sinema on PowerLine. Her spokesperson says she is “against eliminating the filibuster, and she is not open to changing her mind.” That is good news. Hope she stands by this.
I think some Dems in Congress may fear what could happen if they get rid of the filibuster now and Republicans gain control back down the road. If they keep the filibuster, they will be able to get enough GOPe support from McConnell and that way they will still get much of what they want. But if they get rid of the filibuster and go crazy with the agenda that the radicals in their base want them to pursue, then the Republicans may well have a better chance to regain the majority, only when they do there will be no filibuster available for the Dems to protect their legislative gains. That is what some clear-headed Dems (a distinct minority) fear. They think they will still get everything they want by a slow approach, and that the radicals among them could mess that up by forcing their way with a fast approach.
By the way, the filibuster as we know it today is not the filibuster that was practiced (and practiced rarely) prior to 1975. It is not the filibuster of “Mr. Smith Goes to Washington”. Although the old filibuster is still technically possible, no one attempts it anymore because the rule changes that Democrat Majority Leader Mike Mansfield and Majority Whip Robert Byrd (of KKK and Hillary-mentoring fame) pushed through that essentially converted cloture into a super-majority requirement for almost all legislation. Cloture (first adopted in 1917) was originally intended as a means to halt a filibuster that was already underway. Mansfield and Byrd changed it into a 60-vote threshold that had to be achieved before legislation could move forward. No one has to actually filibuster anything anymore when the new kind of “cloture” is invoked almost every time. You have to meet the 60-vote threshold for your bill to advance, or deny 60 votes to kill your opponent’s bill. No more reading all the names in the phone book for hours on end.
Bannon was touting that as a massive victory. Unfortunately, i think he is dead wrong and no reason to pat ourselves on the back. They will get their amnesty…they players are just positioning for the big payoff. I agree that HR-1 is grossly Unconstitutional. Yet it does need to be mentioned that there is a division of authority between State Legislatures and Congress with respect to Federal Elections. The State Legislatures are not the only ones with Constitutionally allocated authority. The congress sets the requirements for the Federal Elections, while the States determine how they will comply with those rules.
HR-1 is crossing and removing the line with respect to legislating compliance with coercive langauge and with regulations they outright usurp legislative powers by mandating methods. The States and Members of Congress have grounds to sue for violation of the Constitution, it remains to be seen if anybody files suit before this corrupt court.
On the down side, I can see Democrats, Democrat Controlled States, ACLU, et al filing briefs and suits claiming HR-1 removes “voter suppression” and “systemic racism”. Civil rights and illegal activities are the two areas where the courts can intervene and Congress will claim HR-1 is legislating. This would not be an easy case even in an honest court.
I also find it interesting that none of the regulations in HR-1 actually undoes any of the existing voting and election ACTS passed by congress.

I don’t care much about the Senate trial of an impeached ex- President. It is clearly foolish and unconstitutional on several levels. What I am worried about is the HB-1 bill that looks like it will enshrine all of the election fraud that was found over the last 2 1/2 months. If this thing passes, we will never have a legitimate Presidential election again.
I don’t know, but something seems odd about all of this. Biden insisting on keeping NG troops in the Capitol. I believe they would all still be there if their Governors had not called them home.
Then this stupid impeachment. It’s totally uneccessary and they know it. Why they insist on pushing it is bizarre, even for the Dems.
I still think something happened behind the scenes we don’t about, might still be happening. Whatever it was/is, seemed to scare the living s*** out of the Democrats.

I suppose most here know there is a still possibility of a big trap closing on the election fraudsters and those in office due to fraud, plus who knows what else, If that is the case, then the impeachment game can be seen as a delay tactic. Not the only factor in that complex situation but one that carries some weight. If they spring the trap before the trial, to many in the public it will look like a desperate move to avoid conviction. Optics will be better a week after the trial.
