At what point does the burden of proof that Biden got enough votes shift to the Democrats.
After all, the Democrats control the computers and the software. They should not be able to simply claim Biden got more votes in any state just because the Democrats said he did.
It seems to me that the party who has sole control of the evidence must also bear the burden of proof for their claims.
Your on the right track, but off just a little.
In election law, by longstanding precedent, the party alleging ballots are invalid, and so should not be counted, does NOT have the burden of proof.
It is the party arguing that the ballots ARE valid, and so should count, that has the burden of proof to show they are.
And they can’t, because the ‘ballots’ or votes aren’t valid.
By the same principle, as applied to eldctions, Team Trump doesn’t have to PROVE the election was invalid, the other side has to prove it was valid,…and they CAN’T.
Mind you, I think Team Trump DOES have enough evidence to meet the burden, but they don’t HAVE to, the other side does.
If I understand it correctly, it’s when these states move forward with certifying the ballots that they are on the hook and officially join the fraud. With the Trump team pointing out so much evidence of fraud, waving around so many affidavits citing sworn testimony of fraud, they are holding those states’ feet to the fire.
Essentially the Trump defense team is saying, “Are you sure you want to certify those election results wiith all this evidence we hold in our hands? We know all the evidence we hold. We’ve put it out to the media so the whole world knows. Therefore, surely you know how much evidence we have. Are you sure you want to go there and become party to this fraud? Choose wisely. We’re all watching.”
Good to know because when it comes to our President the rules/principles do not apply.

The problem with running a candidate that isn’t 100% cognitive is that they’ll actually tell the truth when they’re suppose to lie. In court (I recently looked this up related to a personal matter) statements made against yourself are admissible because the party wouldn’t make a statement against there own interest unless there was a scantilla (a tiny trace or spark, comes from a Scantilla which was a small Roman Empire era coin) of truth.
Granted, Biden’s statements weren’t made during an interview with law enforcement or a court proceeding, but still Biden wouldn’t have said these things unless they were true.
In all fairness, if you listen carefully to that clip, Biden didn’t say “I don’t need you to get elected.”
He said, slurring, “Folks, we have a lot work to do. I not only need you to get elected. I’ll need you after I’m elected..”
“Fairness” appears to an antiquated concept, at least in the political realm. Lets be honest though, we’d probably be a bit more on the fair side about what Biden said if they’d be a bit more honest about how many votes he received. It remains a two way street.
I’m sorry but I disagree. He said what he said. There’s no changing that. Surely we can find more incriminating things that he has said and done. This is not one of them.

Calling Arizona so early and refusing to call Florida when it was so blatantly obvious that President Trump had won and even Gov. DeSantis had been complaining loudly that it made no sense not to call it (or Texas or Ohio). As Gov. DeSantis said, even if every single remaining vote went to Biden he could never overcome the 400,000 vote lead. Still, Fox held the call and held the call and held the call.

They never once showed President Trump in the lead when clearly he was. Conversely, they showed Hiden in the lead when clearly he was NOT! And they did this with a minuscule (some cases zero) percent was reporting, and when voting was still going on!
To clarify: fox never showed President Trump ahead in the EC votes, the whole while showing Hiden ahead, which made POTUS look like the underdog with an impossible hurdle to overcome.

I THINK what happened was “talk radio”, when it went from Howard Stern b.s., to Rush conservative talk radio, threatened the left.

Our medical system is really messed up right now due to covid. They are woefully behind due to shut down. Even though many are open, new covid prevention protocols have slowed things to a crawl.
Our system right now has wait times akin to Canada or worse. Cancer patients waiting months for necessary testing, surgeries and treatment. I know because I’m one and caught in this quagmire. If I hadn’t walked this path with relatives I wouldn’t recognize the impact, but I have and I do.
Doctors all over refuse to see sick patients. Anyone sick is sent to ER, clogging them up. A relative spent 16 hours at ER to find out they had a UTI.
My mother fell and broke her leg requiring surgery, she floundered in the ER for over 24 hours, took 2 days to set her leg.
Our system is at a breaking point and it’s not because of covid patients it’s because of shut downs and covid policies. If we shut down again, our system may crash, at the very least it will be a year or more to catch up.
If you haven’t had need of medical services count yourself lucky. I wish I had no need, I wish my family had no need, because things are really, really messed up. I am in Florida, btw, I can’t imagine how bad it is in blue states. The backlogs, the slow down due to protocols, all of this is flying under the radar for the most part, but it’s real I’m living it.
PRAY that Sidney, Rudy and Lin find an HONEST court.

I realist its not the topic du jour (election fraud) nor the SECOND topic du jour (China virus), but it IS on topic for the Presidential thread.
The Coulter argument that “Demographics is destiny” and that we are all doomed because of illegal immigration, mostly from Mexico, Central and South America will INEVITABLY give Democrats a permanent majority?
PDJT succeeded in greatly reducing traffic, and turns out their are a LOT of legal immigrants from that region, that a FLEEING Conmunism in their former home countries, and DO NOT want it here.
Even with the screwed up ballots, its obvious PDJT got a bigger percentage, by far of the hispanic/latino vote, in Florida and Texas, probably other states as well.
It has long been pointed out that hispanic/latinos, as a group tend to have conservative values.
There is also other demographics. It may not seem like much, but how many uber liberal women (men) do you know that don’t have kids? I know at least 5 and a bunch with only one child. Then again I know a bunch of conservative families with 4+ kids who home school.
In another life, I used to read the National Review/NRO. At NRO, they constantly noted that Latinos as a group tend to have conservative values, which is/was true.
In retrospect, though, it’s now easy to easy how bassackwards the NRO true con “outreach” was to Latinos. On the one hand, those NRO writers pointed out Latino conservatism in areas like traditional marriage, gender roles, family values, abortion, rule of law, etc.; on the other hand, these same NRO writers were offering Latinos endless New World Order wars, open borders and the commodification of labor, a gradualist form of Cultural Marxism, etc.
I vetted this a bit, and it looks reliable to me. More vetting needed

The voting system needs to be changed. Three key encryption and security chips offer a very good solution.
In my current product designed, I use the same chips that are used in credit cards to protect each component of the system from chinese IP theft. My product will shut down if it detects counterfit parts, fraud or intrusion.
These chip store multiple keys (100-ish IIRC), and have a small processor capable of encrypting and decrypting a small set of data with those keys.
Skipping a lot, to keep this post short, we need a voting system where each voter is given a security “voting card” (that looks like a credit card with the electrical contact pads like a phone SIM card) that stores their personal identification and voting “ballot” information.
Using multiple keys, different portions of the data can be encrypted with different key sets. That way, their identity and voting records can be protected with different keys.
When a voter votes, the system can authenticate their identity to the local precinct voter roles with a set of state, county and precinct keys. Then their election specific vote can be stored under a set of keys, and the key sets in such a way their vote can be tallied without exposing their identity, unless the voter presents their card with the proper key set. Their vote record can be stored on their personal card, and piblished in a public database.
The public database, along with different public read keys can then be used by anyone to audit the “ballot selections” or the voter list, while maintaining individual privacy.
The individual voter will also be able to vetify their election specific vote, in the public database, using their voting key card, ensuring their vote was encoded correctly.
By segregating and replicating the data under different keys, any election specific list of “ballot records” then becomes open source verifiable by many millions of people, while retaining privacy.
Although this is very technical, this is not knowledge unique to me. There are tens of thousands of engineers who understand what I am talking about.
I have been developing a voting system design for a while, in my spare cycles, but I am very busy on another design project ATM. If someone else doesnt run with this, I will finish a design and publish it, or start another company to sell it.
Maybe it’s just me, but I have more faith in paper ballots and purple ink.

I reject the exclusivity of your proposed hypothetical; it can and must be both.
