Claims of unlawful command influence (UCI) are already central to any Senator Kelly Court Martial and would almost certainly be a primary defense argument if Kelly were court-martialed.
Legal experts widely agree that public statements by President Donald Trump and Secretary of Defense Pete Hegseth, who labeled the lawmakers the “Seditious Six” and called their actions “despicable, reckless, and false”, constitute a clear case of unlawful command influence. UCI occurs when a superior pressures the military justice process, compromising the fairness of a trial.
Because everyone in the Pentagon chain of command reports to Hegseth, legal scholars argue it would be nearly impossible to convene an impartial court-martial. Rachel VanLandingham, a former Air Force judge advocate and national security law expert, stated: “Hegseth has completely tainted this process.” Similarly, Col. Morris Davis, former chief prosecutor at Guantanamo, noted that Trump and Hegseth have “predetermined guilt and punishment,” making an impartial jury highly unlikely.
That’s ok. Just charge him in Federal court, along with the other Seditious 6, under Federal Statute 18 U.S.C. § 2387 –
(a) Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:
(1) advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; or(2) distributes or attempts to distribute any written or printed matter which advises, counsels, or urges insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States—
Shall be fined under this title or imprisoned not more than ten years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
This has a much better chance of succeeding.

Kelly might be the exception. I am not sure but I think I remember he wore his uniform in the video. That crosses a line.
I’ve said this before, and I’ll say it again – the making of that video provides the intent needed. That video was done intentionally, with coordination, conspiratorially, and once we find out who proposed it and wrote the script, the intent will be obvious for all to see.

Whether he can still be court marshaled is not for “legal experts” to determine. There must be a trial and the trier of fact then determines if he is guilty. This is true in military court, or in civil court.

If the video’s message is directed at undermining military or naval forces in the manner described in the statute, it could constitute a violation under this statute.
A video without direct words can still show intent under 18 U.S.C. § 2387 if its visual content, symbolism, or context conveys a message intended to interfere with, impair, or influence the loyalty, morale, or discipline of the U.S. military.
The law focuses on the intent behind the communication, not the form it takes. Verbal language makes intent easier to prove.

The Seditious 6 had intended a particular result and had a specific purpose in the making of that video, and that was undermining the orders of the Commander-in-Chief, and thus interfering with the discipline of the military. The video and their words speak for themselves.
Military members are made well aware of “illegal orders”, and don’t need civilians and members of Congress giving them their ideas of what it means.

The Court does not have to consist of Officers from the Pentagon. Officers can be “detailed”, from outside the Pentagon, to comprise the Court as needed. I have seen it done in the field for this very reason.

Good advice as it would be indiscernible to distinguish anything he might say in his official capacity as President vs official capacity as CIC and as CIC, he’d be Kelly’s boss, if called back to duty, although unlikely, as CIC he could actually be called as a witness or hostile witness in a trial (assuming USMJ rules of procedure in this aspect would be the same as civil procedure).

They and their children are supported through massive payments from Patriotic American Citizens who, because of their beautiful hearts, do not want to openly complain or cause trouble in any way, shape, or form. They put up with what has happened to our Country, but it’s eating them alive to do so! A migrant earning $30,000 with a green card will get roughly $50,000 in yearly benefits for their family. The real migrant population is much higher. The seriously retarded Governor of Minnesota, Tim Walz, does nothing, either through fear, incompetence, or both, while the worst “Congressman/woman” in our Country, Ilhan Omar, always wrapped in her swaddling hijab, and who probably came into the U.S.A. illegally in that you are not allowed to marry your brother, does nothing but hatefully complain about our Country, its Constitution, and how “badly” she is treated, when her place of origin is a decadent, backward, and crime ridden nation, which is essentially not even a country for lack of Government, Military, Police, schools, etc. Even as we have progressed technologically, Immigration Policy has eroded those gains and living conditions for many. I will permanently pause migration from all Third World Countries to allow the U.S. system to fully recover, terminate all of the millions of Biden illegal admissions, including those signed by Sleepy Joe Biden’s Autopen, and remove anyone who is not a net asset to the United States, or is incapable of loving our Country, end all Federal benefits and subsidies to noncitizens of our Country, denaturalize migrants who undermine domestic tranquility, and deport any Foreign National who is a public charge, security risk, or non-compatible with Western Civilization. These goals will be pursued with the aim of achieving a major reduction in illegal and disruptive populations, including those admitted through an unauthorized and illegal Autopen approval process. Only REVERSE MIGRATION can fully cure this situation. Other than that, HAPPY THANKSGIVING TO ALL, except those that hate, steal, murder, and destroy everything that America stands for — You won’t be here for long!

An excellent question! The H1B Visa holders do not have the same violent tendencies but they are still working the system for all its worth and most do not want to acclimate – they are very insular and only socialize with their own families and their own people! And when their parents/elderly relatives come to join them, once they get their Green Card, they do NOT acclimate at all – most never even bother to learn English but somehow quickly manage to get onto SSI and Medicaid!
Thanks, Vikingmom! Even more frustrating is that especially in tech, you get Indian managers working for US companies who will only hire other Indians. So we have encouraged our young people to get degrees in STEM careers — only to have them shut out from American jobs due to discrimination. And then they are accused by our leaders of not wanting to work, or having inferior skills to their foreign counterparts, when many have been barred from entry level positions just for not being Indian. Hardly sounds like America First to me…
