If President Trump could succeed in getting the Des Moines Register and Ann Selzer to the point of discovery in the lawsuit, he would win- BIG TIME. However, getting a judge to allow Trump as a plaintiff to advance a lawsuit to the level that would expose the fraud, is a very uphill battle.
Intellectually honest people know exactly what happened. Ideological political operatives in/around Ann Selzer’s polling operation, perhaps even Ann Selzer herself, manufactured, meaning completely fabricated, a polling outcome of Kamala Harris +3 in the final weekend before the November election.
It likely wasn’t an actual poll per se’, and no one is even sure if any voters were contacted; however, the assembled data analysis was sold as a genuine poll outcome. The poll was 16 points wrong. The claimed Kamala +3 poll was actually Trump +13 in the voter result in Iowa. Quit Pretending – Pollsters don’t miss by 16 points unless they are trying to miss by 16 points.
Selzer didn’t get it wrong or make a mistake. With malicious intent and malice of forethought, Selzer created a fraudulent narrative using a manufactured poll to push it.
If Trump could get to the emails, text messages and various communications from the people in/around Selzer’s polling operation, he would find the explosive planning and coordination in the background. But I doubt it’s going to get that far; a judge will likely try and stop it.
The motive for the poll was simple. In the final days of the Kamala campaign, they were pushing the abortion message as hard as possible to get out the votes. The Iowa +3 poll was the launch vehicle where Selzer proclaimed that a “MASSIVE UPSWING” in Iowa women suddenly shifted the entire race as the women were showing up inside the data to support Kamala.
The corporate media ran with that shock polling narrative on Saturday, Sunday and Monday before election day on Tuesday. It was all nonsense, and Ann Selzer knew it. That’s why Trump is suing her.

The Des Moines Register will never permit Ann Selzer to sit for a deposition where she likely describes the people who did everything for her, under her name, and claims she had no idea what they were doing. Nor will anyone associated with the plan allow their emails and text messages, which clearly evidence the structure of the fraud, being reviewed in discovery.
If President Trump’s lawyers got close to discovery where depositions and communications were going to be revealed, the DMR and Selzer would throw massive money at him to settle the lawsuit, just like ABC did…. for exactly the same reason.

Some of us on X (formerly Twitter) have been torturing Democrats over the abortion issue. It started when, after the Dobbs decision was released, if Democrats could “codify Roe v. Wade after Dobbs,” why couldn’t they have done it FIFTY YEARS AGO? The answer was obvious: Democrats used the vulnerability of Roe v. Wade, a vulnerability exposed years before by RUTH BADER GINSBURG, to scare women into giving Democrats their votes and their donation money. Other posters went to work and found how many times the Democrats had majorities, and even SUPER MAJORITIES–they had 2 in 50 years– but failed to cement Roe with legislation of any kind.
Schumer didn’t seem to understand the quicksand they stepped in when he boldly bragged that he was going to use Article 3, Section 2 powers of Congress over SCOTUS’s jurisdiction, to take PRESIDENTIAL IMMUNITY out of SCOTUS’s jurisdiction and eliminate the decision. He got hammered for not including the Dobbs decision. It never crossed Schumer’s mind since it would mean giving up the power the Democrats exercised over college educated suburban women to scare them out of their votes and their money.
While presumably President Trump will not get to discovery in this case, the fact that he actually brought the case itself is that bit of sunlight that exposes the issue, if not the mechanism behind it.

When it distorts, mutates, or tortures the truth it must be held responsible so others do not act as the instruments of propaganda. The institutions that used her work are just as guilty. Discovery is not automatic. A plaintiff can petition for discovery. A judge can rule against it. Ask Mike Lindell of MyPillow what he thinks of the idea that “Suing, or being sued, automatically leads to discovery, so anyone who has something to hide better not sue me.”
Suing worked for Dominion because Dominion got the right judge and foiled Lindell’s attempts to penetrate Dominion’s secrets. Lindell was badly hurt by Dominion’s lawsuit. A particular lawyer on social media advanced the notion that Discovery was something every party in a lawsuit gets automatically. That turned out to be disastrously incorrect.
Maybe this is the role for James O’Keefe!
As a procedural note, the Des Moines Register and its attorneys no longer have attorney-client privilege with Ms. Selzer, because she is a former employee.
President Trump may settle with her and her counsel for a modest amount based on what she can offer by way of testimony in the case against the Des Moines Register. Her lawyers’ duty is to her and her alone. If her attorneys can buy her peace through a modest settlement, particularly one which actually admits wrongdoing, she can be a vital witness in President Trump’s case against the newspaper.
Lawsuits like this and the one against ABC and George Stephanopoulos can serve as grim reminders of what can happen when pollsters and journalists lie to achieve a political objective.

While President Trump can file a lawsuit against this pollster and the paper, her and the paper’s bigger concern are their violations of Executive Order 13848 on Election Interference. President Trump signed it back on Sept 12, 2018, and it is still in effect today.
The federal govt can immediately seize their assets and charge them with criminal offenses. Election Interference is a criminal act against our country with potentially very serious consequences for violators.

The timing of releasing the poll right before the election was interference and because it was so skewed toward Harris it reeked of fraud. Pollsters have reputations that others rely upon for accurate information. She was not ethical with this poll, not just a bad poll, but a deliberately fraudulent poll.
Iowa was 13 to 16 pts in favor of Trump, so the “how” and ”why” she came up with this wacky poll is part of the legal question. Trump feels it was malicious and an obvious attempt to sway an election.
