WASHINGTON, Dec 19 (Reuters) – Former President Donald Trump cannot appear on the ballot in Colorado in next year’s presidential election due to his role in the Jan. 6, 2021, attack on the U.S. Capitol by his supporters, the state’s top court ruled Tuesday in a historic judgment that is likely to find its way to the U.S. Supreme Court.
The 4-3 ruling from the Colorado Supreme Court makes Trump the first presidential candidate in U.S. history to be deemed ineligible for the White House under a rarely used provision of the U.S. Constitution that bars officials who have engaged in “insurrection or rebellion” from holding office.
The court concluded that the U.S. Constitution bars the frontrunner for the Republican nomination in 2024 from appearing on the ballot because of his role instigating violence against the U.S. government.
“We do not reach these conclusions lightly,” the majority justices wrote. “We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach.”

The Colorado court said the ruling is stayed until Jan. 4, 2024, to allow for appeals.
Trump’s campaign called the court decision “flawed” and “undemocratic,” and said it would be appealed.
“The Colorado Supreme Court issued a completely flawed decision tonight and we will swiftly file an appeal to the United States Supreme Court and a concurrent request for a stay of this deeply undemocratic decision,” a spokesperson from the Trump campaign said.
One of the dissenting justices, Carlos Samour, said in a lengthy opinion that a lawsuit is not a fair mechanism for determining Trump’s eligibility for the ballot because it deprives him of his right to due process, noting that a jury has not convicted him of insurrection.

I believe I read that Samour is a dem too. Though I could be mistaken about that.
Now we find out what the United States Supreme Court is really made of. Are we still, even if on a string, a nation of laws, where a person is innocent until proven guilty by a jury of one’s peers, or are we indeed post-Republic.
Finally the wait will be over once we see what they do, or don’t do.

My initial impression is that this decision is calculated to permit the Supreme Court to avoid reaching the issue of the legitimacy of vote fraud protest. The Colorado ‘decision’ is calculated to coordinate with the “trumped up” Atlanta and DC cases in extremely dem-oriented cities where juries are easily selected for their Trump-hatred, to convict him. The SC can just stay or ignore until after the DC and Atlanta dem-hatred=based city cases have concluded. In the meantime, Trump-hatred propaganda is empowered and enhanced, and likely followed by other dem-appointed state courts.

I agree with your boomerang-spades opinion. We both share a still-optimistic belief in the citizens of the US having the integrity to ultimately see through and overcome the propagznda and political corruption exposed by PDJT.
However, I don’t think the SC will appreciate this command by 4 dem-appointed judges to force the SC to “jump into action”. [4 dem state judges tell the SC to “Jump to our poorly decided case” , and the SC is supposed to ask “how high?}
The cases against PDJT get weaker and more absurd as more evidence of federal and dem involvement get revealed. I think the SC wil do the minimal appropriate to this scam, while the overall scam unravels. The SC knows its legitimacy is on the line, and will want time for the most evidence of political corruption to become availacle to it and the public.

I’m not surprised by this result from the Colorado Supreme Court.
But it’s wrong and the vote was 4-3 — as close as it comes.
The U.S. Supreme Court must take the case, stay the outcome pending final resolution, and reverse.
As one of the dissenters in Colorado would have held, keeping Trump out of the race violates the President’s due process rights.
Also, as I have written, President Trump was acquitted in his second impeachment and I don’t think Section 3 of the 14th Amendment even applies to Trump as the lower Colorado Court rightly held.
The other two dissenting Colorado Justices reject the majority’s anti-Trump outcome on state-law grounds. Those I will have to study before offering a view.

This is what an *actual* attack on democracy looks like: in an un-American, unconstitutional, and *unprecedented* decision, a cabal of Democrat judges are barring Trump from the ballot in Colorado. Having tried every trick in the book to eliminate President Trump from running in this election, the bipartisan Establishment is now deploying a new tactic to bar him from ever holding office again: the 14th Amendment. I pledge to *withdraw* from the Colorado GOP primary unless Trump is also allowed to be on the state’s ballot, and I demand that Ron DeSantis, Chris Christie, and Nikki Haley to do the same immediately – or else they are tacitly endorsing this illegal maneuver which will have disastrous consequences for our country.
Today’s decision is the latest election interference tactic to silence political opponents and swing the election for whatever puppet the Democrats put up this time by depriving Americans of the right to vote for their candidate of choice.
The 14th Amendment was part of the “Reconstruction Amendments” that were ratified following the Civil War. It was passed to prohibit former Confederate military and political leaders from holding high federal or state office. These men had clearly taken part in a rebellion against the United States: the Civil War. That makes it all the more absurd that a left-wing group in Colorado is asking a federal court to disqualify the 45th President on the same grounds, equating his speech to rebellion against the United States.
And there’s another legal problem: Trump is not a former “officer of the United States,” as that term is used in the Constitution, meaning Section 3 does not apply. As the Supreme Court explained in Free Enterprise Fund v. Public Company Accounting Oversight Board (2010), an “officer of the United States” is someone appointed by the President to aid him in his duties under Article II, Section 2. The term does not apply to elected officials, and certainly not to the President himself.
The Framers of the 14th Amendment would be appalled to see this narrow provision—intended to bar former U.S. officials who switched to the Confederacy from seeking public office—being weaponized by a sitting President and his political allies to prevent a former President from seeking reelection. Our country is becoming unrecognizable to our Founding Fathers.
I fully approve this sentiment, but totally disagree that the south took part in a rebellion against the United States; at first they attempted to just peacefully separate from the part of the country committing those abuses and usurpations.
And there’s a huge question about whether the south was in fact the first to fire. If nobody fired, the secession happened as cleanly as the Czech Republic and Slovakia’s “Velvet Divide.”
Ironically… The Marxists are in the process of erasing U.S. Civil War history… figure that one out…
