      I just arrived for a vacation in northern Arizona last night. At the local grocery store there were two large matching unmarked vans. Inside were two large groups of people speaking Spanish shopping in a group. I suspect there were border crossers being transported to who knows where.

    We even have three members of Congress writing a Memorandum of Understanding (MOU).

    Tf you can use a Memorandum of Understanding (MOU) to circumvent laws by institutions like the FBI, DOJ and CIA then why bother to have Congress in-act Laws or for that matter, why have a Presidency.

    No, I submit, that the Memorandum of Understanding (MOU) are written to hide an illegal Act of those involved. If either signer reveals the true nature MOU then all will face the potential for prosecution. And, from what I can see their are a number of MOU issued.

    So, why are these MOU’s not being prosecuted?

      You know what else is weird and forgotten?
      That the OBAMA State Department stepped in and helped a number of Americans attempting to leave the country of Haiti without required paperwork for a bunch of kids they got the parents to agree to give them.
      I used to think it was a poor choice of who to help in a foreign country, someone doing something highly suspicious involving kids, and knowingly flouting the laws of two countries.
      What I did not know until just the other day is that the reason the State Department doesn’t give more help to Americans arrested overseas, is because it is illegal to do so, beyond a certain amount.
      Yes, Hillary Clinton, with her ties to known perv Epstein, made an illegal exception for one woman.
      Is this the reason there was an illegal secret server in her basement?
      Here we were, thinking of all the more obvious reasons someone might do that, but what if there was an even darker motive?
      Dong something illegal in the wake of the Haitian earthquake, that a preoccupied boss, Obama, might not notice, if he didn’t happen to be watching TV at that very moment?
      What we do know is that nobody working for Obama, Valjar, for instance, would have been likely to have had her staff notified.
      So that other parties could be kept abreast of State Department doings would be one of the important reasons for using the government systems.
      I don’t like Obama, but I don’t think he would have been enabling suspected human traffickers had he been aware.
      Ms. Silsby was just not someone our government would have or should have gone out on a limb for, she was just not worth it.

      In my lifetime, CA has has moved along the social spectrum, passing through cool and trendy, peculiar, concerning, unreasonable, un-American, and unhinged.

      It is clear to me that the state is lost to those who profess and aggressively promote socialist and communist manifestos, and it is not recoverable by American patriots. I offer sincere condolences to my fellow Treepers who are trapped in that cesspool.

      CA reminds me of earlier stages of Venezuela, when it became apparent that the indigenous population was an inconvenient annoyance to the political leaders, and was steadily beaten into submission. The quality of life for the masses continually declined while the politicians enriched themselves and acted with impunity.

      From 1,500 miles away, the wonders of television, the rapid and unending media news cycle, the Internet, and blogs like TCTH provide stories and images that support a reasonable person’s belief that Oregon and Washington are following in California’s footsteps. In these states the American dream is also quickly eroding. I can’t stop it. I can only observe the degeneration in-progress with equal measures of disbelief and disgust overwhelming my emotions.

      Farewell California, I once knew you as a shining beacon of American brilliance and success. Now, you are an open and dangerous wound on the American body politic.

    Lurking Lawyer here.
    A major announcement by AG Barr this am, effective tomorrow. He is issuing a ‘rule’ exactly as I suggested here at CTH some months ago, that allows the US to immediately send back to Mexico most asylum seekers from anywhere (Triangle countries, Haiti, Africa…). And federal courts can do NOTHING about it.

    The key is correctly understanding the basic asylum law, 8USC§1158.

    The problem that needs fixing is §1158(a)(1), which says (paraphrasing) if any alien reaches the US, they can apply for asylum by claiming a credible fear in their home country, guaranteeing them a US asylum court hearing years down the road while released into the US interior with a work permit in the mean time, during which they ‘disappear’.

    The solution is a ‘correct’ interpretation of §1158(a)(2)(a), which says (slightly paraphrasing):
    “(A)(1) shall NOT apply if AG determines the alien may be removed, pursuant to a bilateral or MULTILATERAL treaty, to a safe third country (other than alien’s own) in which alien is not threatened (no credible fear) AND where alien has access to a full and fair asylum process…”

    Note Mexico has refused to sign a bilateral safe third agreement with US, and Guatemala just balked today after promising to do so. Because that would make ‘asylum’ seekers their problem.

    BUT Mexico and US are both signatories to the fundamental 1951 Refugee Convention and its later revisions. That is a MULTILATERAL treaty guaranteeing a ‘full and fair asylum process’.
    So Barr is invoking that multilateral treaty to unilaterally declare Mexico a safe third for purposes of §1158(a)(2)(a). Rather than having to have a US asylum hearing, all the asylum seekers overwhelming the southern border get legally sent immediately back to Mexico for ‘asylum’. This essentially solves the fake asylum problem. The asylum seekers are in reality economic migrants looking for free stuff in the US, and almost all fail get get asylum eventually granted by US courts. This action also gives Mexico a very strong non-tariff threat incentive to seal its southern border.

    And the most beautiful part (Dems will go crazy) is §1158(a)(3), which reads:
    “NO court shall have jurisdiction to review any determination by the AG under (a)(2).”

    PDJT and AG Barr lawfare. Nothing not to like except why did it take so long? Answer: Pelosi begged PDJT for time to fix immigration properly rather than begin ICE removals pursuant to final orders of deportation. He did, she didn’t. Bet PDJT will have fun with this at Wednesday’s rally.

        People used to make jokes about 3D chess, but Trump does think past the action. I don’t think he very often says let’s do it and see what happens, then we’ll figure it out. He tried the easier way here, but they forced this path on them. Well, the easiest way would be for Congress fix illegal immigration and robbing their taxpayers for the privilege.

      The rule just appeared in the Federal Register. Have not read it, but do note it is being incorrectly reported as ‘sure to be challenged in court’. The only correctly reported parts are is prospective only, and will eventually not apply if asylum is not granted by Mexico. Not big practical issues, as the point is to stop them from trying in the first place and A1§9.3 prohibits ex post facto laws.

      No longer has any weight in what Federal Judges do.

      In this case the federal judge even quoted the fact that Congress has stripped him of any authority to review. He then went on and continued his review:

      Section “1254a(b)(5)(A) provides that “[t]here is no judicial review of any determination of
      the Attorney General with respect to the designation, or termination or extension of a designation, of a foreign state under this subsection.” Id. § 1254a(b)(5)(A). However, the Court previously held that this provision does not bar the Court from considering Plaintiffs’ particular claims brought in the instant case, including their Administrative Procedure Act (“APA”) and Equal Protection claims. See Docket No. 55 (Order at 15, 20-21) (holding that this provision does not preclude a challenge to general collateral practices or certain colorable constitutional claims).”

      Excellent. Now pray that this is all followed up with promises to enforce 18 U.S. Code § 1509. Obstruction of court orders, and 18 U.S. Code § 111. Assaulting, resisting, or impeding certain officers or employees as they may relate to immigration and the enforcement of deportation orders.

      These legislators, mayors and the police departments who are part of the resistance must be put on notice that they are dangerously close to violating federal law with their attempts to protect lawbreakers and hinder ICE operations.

Which if true the purpose of indicting Epstein might have been to seize all the salacious material secreted in his mansion to prevent it from being used by Epstein for blackmail and self-defense ? In addition to trying to find something, anything, to bring Trump down, even at the cost of destroying existing Democratic and Republican powers-that-are? Or possibly so they cause use that same material against said people to keep them in line?

        TT, I think not. The NPA was between Southern District Florida and concerned specific people and events in Palm Beach. The SDNY indictments concern different victims in NYC. Epstein’s lawyers will of course make the argument. SDNY US DA Berman was quite clear about this point in his presser announcing Epstein’s arrest. Rely on his judgement.

      This is what I like best about CTH.
      I have been studying and thinking about just what the heck happened to America for quite some time.
      I’m no genius, but I hit upon little things here and there which make me think “Eureka! That’s it, this has something to do with it!”
      Many times I’ve posted eensy contributions, my ideas or other people’s, and subsequently become aware that our Very Stable Genius has been alerted to these things.
      He’s got people out there sifting and listening, and is not wedded to the failed dogmas of the past.

      A lot of our leaders and Thinkers and ‘pundits’ are not as smart as we thought they were.
      People like Nancy Pelosi are cunning and well-adapted, that’s why they cling to the old worn and failed so bad.

        A keyword is “other,” which, if Pavlich is correct, would, presumably, extend the applicability of the rule to anyone transiting through or originating from within Mexico. I have no reason to be confident in her interpretive legal skill, so we’ll just have to see what happens when the dust settles.

        I am reminded of the truism that “all initial reports of a major event are erroneous, in whole or in part.”

    Pursuant to statutory authority, the Departments are amending their respective regulations to provide that, with limited exceptions, an alien who attempts to enter the US across the southern border after failing to apply for protection in a third country outside the alien’s country of citizenship, nationality, or last lawful habitual residence through which the alien transited en route to the US is ineligible for asylum.

    This basis for asylum ineligibility applies only prospectively to aliens who enter or arrive in the US on or after the effective date of this rule.

    In addition to establishing a new mandatory bar for asylum eligibility for aliens who enter or attempt to enter the US across the southern border after failing to apply for protection from persecution or torture in a least one third country through which they transited en route to the US, this rule would also require asylum officers and immigration judges to apply this new bar on asylum eligibility when administering the credible-fear screening process applicable to stowaways and aliens who are subject to expedited removal under section235(b)(1) of the Immigration and Nationality Act

    The new bar established by this regulation does not modify withholding or deferral of removal proceedings.

    Aliens who fail to apply for protection in a third country of transit may continue to apply for withholding of removal under the Immigration and Nationality Act and deferral of removal under regulations issues pursuant to the legislation implementing US obligations under Article 3 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

    Effective Date:

    30 days after date of publication in the Federal Register.

    In a statement on Facebook , Aurora Police Chief Nick Metz said police decided not to intervene when the flags were being removed to protect the safety of the majority of protesters who were acting peacefully as well as that of officers but they would have acted had there been violence or damage to the property.
