          The EO says they stay with the parents for the duration of the process. But now they will face the lawsuits per the old ruling on the 20 day thing…

          • I think you’re right, however lawsuits do take a bit of time to proceed. The EO gives Congress time to improve the law. To me, this was a very smart pivot. POTUS reacted with compassion to the unintended negative consequences of the separations, and can’t be blamed if the law remains the same or the EO is overturned in court. He can say, “I tried.”

      Section 1. Policy. It is the policy of this Administration to rigorously enforce our immigration laws. Under our laws, the only legal way for an alien to enter this country is at a designated port of entry at an appropriate time. When an alien enters or attempts to enter the country anywhere else, that alien has committed at least the crime of improper entry and is subject to a fine or imprisonment under section 1325(a) of title 8, United States Code. This Administration will initiate proceedings to enforce this and other criminal provisions of the INA until and unless Congress directs otherwise. It is also the policy of this Administration to maintain family unity, including by detaining alien families together where appropriate and consistent with law and available resources. It is unfortunate that Congress’s failure to act and court orders have put the Administration in the position of separating alien families to effectively enforce the law.

      Sec. 2. Definitions. For purposes of this order, the following definitions apply:

      (a) “Alien family” means

      (i) any person not a citizen or national of the United States who has not been admitted into, or is not authorized to enter or remain in, the United States, who entered this country with an alien child or alien children at or between designated ports of entry and who was detained; and

      (ii) that person’s alien child or alien children.

      (b) “Alien child” means any person not a citizen or national of the United States who

      (i) has not been admitted into, or is not authorized to enter or remain in, the United States;

      (ii) is under the age of 18; and

      (iii) has a legal parent-child relationship to an alien who entered the United States with the alien child at or between designated ports of entry and who was detained.

      Sec. 3. Temporary Detention Policy for Families Entering this Country Illegally. (a) The Secretary of Homeland Security (Secretary), shall, to the extent permitted by law and subject to the availability of appropriations, maintain custody of alien families during the pendency of any criminal improper entry or immigration proceedings involving their members.

      (b) The Secretary shall not, however, detain an alien family together when there is a concern that detention of an alien child with the child’s alien parent would pose a risk to the child’s welfare.

      (c) The Secretary of Defense shall take all legally available measures to provide to the Secretary, upon request, any existing facilities available for the housing and care of alien families, and shall construct such facilities if necessary and consistent with law. The Secretary, to the extent permitted by law, shall be responsible for reimbursement for the use of these facilities.

      (d) Heads of executive departments and agencies shall, to the extent consistent with law, make available to the Secretary, for the housing and care of alien families pending court proceedings for improper entry, any facilities that are appropriate for such purposes. The Secretary, to the extent permitted by law, shall be responsible for reimbursement for the use of these facilities.

      (e) The Attorney General shall promptly file a request with the U.S. District Court for the Central District of California to modify the Settlement Agreement in Flores v. Sessions, CV 85-4544 (“Flores settlement”), in a manner that would permit the Secretary, under present resource constraints, to detain alien families together throughout the pendency of criminal proceedings for improper entry or any removal or other immigration proceedings.

      Sec. 4. Prioritization of Immigration Proceedings Involving Alien Families. The Attorney General shall, to the extent practicable, prioritize the adjudication of cases involving detained families.

      Sec. 5. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:

      (i) the authority granted by law to an executive department or agency, or the head thereof; or

      (ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

      (b) This order shall be implemented in a manner consistent with applicable law and subject to the availability of appropriations.

      (c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

    During the ABC broadcast, the banner briefly displayed the chyron “Manafort pleads guilty to 5 charges of manslaughter.” While the former Trump campaign manager is in jail after his bail was revoked, he has not pleaded guilty to any crimes and has not been charged with manslaughter.

    In a series of tweets, ABC News apologized for the error and promised to get the bottom of why the graphic appeared.”

        From what I’ve read this will likely be reversed by the courts fairly quickly. It is not legal to keep families together. Trump has played this perfectly as the courts will completely validate his original premise that the law is what is causing the situation not his actions. This blows the whole controversy back to Congress where it belongs and next time they won’t have the argument that Trump could end it with an executive order.

        I have written to the President to day and asked him to do the following. Ask for volunteers to sponsor families. They will be responsible for their welfare, medical, food and clothing etc. Tell them he is no longer going to expect the taxpayer to do it. Anyone who wishes these people to say needs to step up and pick up the tab. I would personally ask Chuck how many families he is willing to sponsor out of his own pocket. It will be hillarious as they trample each other trying to get out the door.

    Ome of the funniest things is how quickly and decisively the President acts. The media manufactures a crisis. in less than a week the crisis is solved (temporarily until congress acts) and if we are truly being honest, this EO affects roughly 2000 illegal kids. The president actually gets a PR win without really doing anything of substance. He truly is a Very Stable Genius.

For all those that support President Trump, here is how you spot a troll. If someone writes anything intended to divide President Trump from you, they are a troll. People that have differences of opinion, but are supporters of the president will almost always write in this fashion, I think the president should do X, but support him for all the great Y that he has done.     I’d just like to congratulate the MSM for distracting the nation into talking about immigrant kids for the past several days instead of IG Horowitz’s report. /S

    They were so effective they even took the WH off message…..not to mention most people here at CTH.

    As regulars here know, I am not one to criticize POTUS. But his advisors should have seen this coming and undermined the effort by issuing today’s EO on Tues. or Wed. of last week.

    Of course, hindsight is 20/20, but it SEEMS (note my careful use of that word) that the WH was caught flatfooted by the left/MSM when they should’ve KNOWN a counter-narrative offensive was imminent.

These Rinos are not the best when it comes to policy, but they want to get reelected.       It won’t stop. Why would it? It’s only escalated since Trump became president (as I predicted it would. I said on election night that the war had only begun), and will only continue to escalate. 1. It’s who they are. That is, they have no other dispositional options. 2. They have enormous cultural clout, and know it. 3. They look around and see ZERO consequences for their actions. All their major capos walk free — no reprisals, no indictments, no justice. Wouldn’t that make you feel invulnerable? Twitter, facebook, et al, do nothing to punish their most vile attack dogs. 4. They have embedded agents throughout the government. 5. Outside of calling them “fake news” (which is becoming rather lame at this point), we really do nothing from a proactive point of view to make them pay.

    Allison Hrabar, a paralegal, ““Kirstjen Nielsen, you’re a villain, locking up immigrant children,” activists can be heard saying in a video.
    “If you see these people in public, you should remind them that they shouldn’t have peace,” she told The Examiner. “We aren’t the only ones who can do this.
    Anyone who sees Kirstjen Nielsen at dinner, anyone who sees anyone who works at DHS and ICE at dinner can confront them like this, and that’s what we hope this will inspire people to do.”
    Following the protest, Hrabar tweeted that, “No one who has ever made their living terrorizing immigrants deserves peace. If you see one in a restaurant, at a movie, or in your neighborhood, remind them of that.”

    Hrabar has worked at the DOJ since July 2016. Prior to that, she was a student at the selective Swarthmore College where tuition runs over $50,000 annually. She previously attended a charter school in Arizona.

    The Midyear investigation refers to the Clinton email probe.

    One part of the report implies that if a new investigation were to be opened and prosecutable evidence is found, it is possible that Mills and Samuelsson could still be held liable despite the immunity agreements

    These threads are on fire. I can’t believe the number of comments. This really re-affirms my belief that while the Democrats believe they’re firing up their own apathetic side they’re really just making Conservatives double down on our resolve.
    –Just remember how Trump started with single digit approval in the primaries, and grew to win the presidency with every “controversy” the press manufactured to take him out.
    –In the Art of the Deal he wrote that believe it or not, he learned that bad press was better than no press and that it can be used to advance your goals. So it’d be nice if the press left the man alone and gave us all some peace, but their constant histrionics actually fire up Conservatives. So just notice how lit up we all are. I believe it will be the key to us keeping winning if we do like our fearless leader and continue to turn lemons into lemonaide.

      President Trump won in 2016 because of his stance on immigration…you would think that immigration would be the last subject that the Democrats would want to bring up before the 2018 mid-terms….just shows how out of touch the D.C. liberals are with the rest of the country.

        I agree. Even though the MSM is pounding this story, the comments from people are mostly against illegal immigration and they don’t really have an issue with “children in cages”. Trump needed to bring the MSM fervor down a notch. This should it. Now we can expect a Stormy II!

      We have not yet begun to fight. Not even close. In fact, we’re just getting warmed up to get warmed up.

      The Trump #MAGA train hasn’t even left the station yet. People are still climbing on board by the tens of thousands each and every day.

      Nov. is coming, and with it a Red Wave the likes of which haven’t been seen since Reagan. POTUS will get an undeniable electoral mandate, along with control of both chambers of Congress and a 60-vote senate super majority.

      THEN the Trump Train departs into it’s scheduled glory and historic achievements!

      If I remember the name correctly, I think Pollak is supposed to be on our side, but I don’t see that PDJT caved.

      He still has zero tolerance enforcement, and IMO the only reason the separated the kids was because of the 1997 judgement agreement.

      The libs said it didn’t apply and he called their bluff: problem solved.

      The only wrinkle, is sometime parents can be deported faster than the kids because the parents committed a crime coming here while the kids are deemed “innocent”. So the kids have a lengthier appeal process -available- to them.

      But in this case it is the parents choice to leave them behind. The kids don’t need to appeal.

      He did cave — in a sense. This is what they were after. They got it. They drove the narrative and forced a response in order to damage Trump’s image of uncompromising toughness on a core issue.         If Trump #resists, then the media complains he is an uncaring heart of stone. After all, everyone is following the law.

        What the Democrats wanted was to release the illegal immigrant parents when they legally release the child after 20 days. After all, the child must stay with the parents.

        Instead Trump says, ok, the child stays with the parents, in a detention facility. Bam, separation issue off the table. And Sessions, get on it to ask for an exception to Clinton’s misinterpreted law that forces the 20 day release. And get more people working on asylum petition cases.

        Now the media will complain, he is an uncaring heart of stone for keeping children in a detention facility. But the narrative changes.

    We need to put enough immigration judges in place to tackle new arrivals (the backlog stays in queue with existing judges) and process these illegals right the hell back out to their country of origin in a matter of days, fewer than the 20-day limit.

    Like Night Court.

    Families get to stay together in detention until deported.

    This business of releasing them and they never show back up for a hearing is intolerable. We no longer have a border with that, and pretty damn soon we don’t have a nation.

      We used to just round them up and deport them.
      We also used to just turn them around at the Border.

        There, PresTrump should insist they apply in the 1st “safe” country according to international guidelines.

        That would be Mexico.

        PresTrump should insist on that and cut off all foreign aid and other assistance to Mexico NOW unless that is enforced.

          I searched last year, to find whatever piece of legislation it was that created this ‘rule’…and went cross-eyed.

          It started, I think, with an immigration bill that HWBush signed…but that bill didn’t create this ‘rule’.

          I discovered references to various amendments tacked onto other bills…bills that had Nothing To Do With Immigration.

          So I think this ‘rule’ was an accumulation of things sneaked into other bills, in a gradual concerted effort to reach the insanity that we have now.

              AG Sessions reorganized how illegal boarder jumpers were handled so they were no longer released into the USA and recent cases would be expedited. He is adding 35 assisting United States attorneys at the border to prosecute illegal entries and moving 18 supervisory judges that don’t have existing caseloads to the border to expedite cases. It will be about a 50% increase in the number of immigration judges.
