New Documents Show IRS Used Donor Lists to Target Audits…

(Washington, DC) – Judicial Watch announced today that it has obtained documents from the Internal Revenue Service (IRS) that confirm that the IRS used donor lists to tax-exempt organizations to target those donors for audits.

The documents also show IRS officials specifically highlighted how the U.S. Chamber of Commerce may come under “high scrutiny” from the IRS.  The IRS produced the records in a Freedom of Information lawsuit seeking documents about selection of individuals for audit-based application information on donor lists submitted by Tea Party and other 501(c)(4) tax-exempt organizations (Judicial Watch v. Internal Revenue Service (No. 1:15-cv-00220)).

A letter dated September 28, 2010, then-Democrat Senate Finance Committee Chairman Max Baucus (D-MT) informs then-IRS Commissioner Douglas Shulman: “   I request that you and your agency survey major 501(c)(4), (c)(5) and (c)(6) organizations …”  In reply, in a letter dated February 17, 2011, Shulman writes: “In the work plan of the Exempt Organizations Division, we announced that beginning in FY2011, we are increasing our focus on section 501(c)(4), (5) and (6) organizations.”

In 2010, after receiving Baucus’s letter, the IRS considered the issue of auditing donors to 501(c)(4) organizations, alleging that a 35 percent gift tax would be due on donations in excess of $13,000.  The documents show that the IRS wanted to cross-check donor lists from 501(c)(4) organizations against gift tax filings and commence audits against taxpayers based on this information.

A gift tax on contributions to 501(c)(4)’s was considered by most to be a dead letter since the IRS had never enforced the rule after the Supreme Court ruled that such taxes violated the First Amendment.  The documents show that the IRS had not enforced the gift tax since 1982.

But then, in February 2011, at least five donors of an unnamed organization were audited. (read more)

    Anyone who thinks that the government has not weaponized the IRS is either foolish or a liberal.

    The best way to prevent this is to abolish the IRS.

    Neither the GOPe nor the Dems, really one and the same, call them the Political Elite(PE), are going to abolish the IRS without massive pressure as it is part of their power base. As the Dems learned a few decades ago and the GOPe are finally learning, the voters are rather easy to manipulate. Divide and conquer. .

        One issue is the 10% of Americans, including 25% of middle aged women, who are taking antidepressants and thereby numb to most emotions. Not sure how many others are smoking pot and drinking excessively, but people are just not in their right minds. What better conspiracy theory to have medicated one’s enemy and caused them to neither think nor fight?

        Those of us who are outraged are too busy working for a living. Besides protesting only works for the left. The media will take a few dozen leftist protester in a tight camera shot to help their cause, but no camera will be in sight for a conservative protest.

          Yes I get the alternative media angle, but if you protest while filming yourself and then post on the alternative media, Who do you reach? Answer: the Choir! Now there are those lib trolls that visit the alternative sites, but they are Hard Core Kool Aid drinkers and they won’t be swayed.

          We are in a situation where we can’t bring the horses to the water, let along see if they will drink.

      It is tyranny hiding in plain sight. How many prominent Rs call this what it is? Very damn few. Just the other day in the ICE hearing Cruz stated that if Obama had the courage of his convictions he wouldn’t release criminals and rapists. So it’s a lack of courage from Obama that has him releasing rapists and murderers? Good grief. And Cruz is one of the best Rs.

        I think you may have misread Cruz. He knows who and what he is dealing with. I have personally spoken with him on this. His father lived this.

        He was being a Prosecutor during that hearing, not a candidate. You do not show your full hand under that scenario.

    I got audited (no red flags, no weird amounts, no outrageous income, nothing hinky) for a few years in a row. Suddenly stopped getting audited when the story broke about them auditing conservative…

    The audits never changed my return, they were all fine, was just a huge PITA.

    I am an advocate on tax what you spend, not what you earn.
    Promotes saving and taxes criminals, very simple and no IRS.

    Feds were never supposed to be able to levy a tax “by heads” i.e., no direct taxing power over individual citizens. That was an easy lesson learned by colonists under the strict tutelage of Imperial England, Spain and France. Don’t remember history–doomed to repeat the worst of it.

    Nixon tried, but found few fellow travelers. Liberal tried and succeeded because the IRS is full of fellow travelers. This is the impact Obama as President makes by encouraging other to act out in his name.

    Now if somebody would be just go to jail?

      When Nixon learned the CIA was secretly giving 1/2 billion dollars to Howard Hughes and Howard Hughes was then giving 1/2 million dollars to the DNC’s Lawrence O’Brien … Nixon used the IRS to confirm O’Brien’s skullduggery. I don’t believe O’Brien or any other Nixon “enemy” was audited … but I could be wrong. Do you have an actual source for your anti-Republican accusation?

    Keep going back to the Watergate analogy. If AG John Mitchell and host of other people went to jail for a break-in, then I’m thinking a whole lot of these people should be in jumpsuits. I understand that breaking laws is what they do, what I can’t fathom is the foot-dragging on the part of the opposition? Or is there really an opposition anymore?
