SAVANNAH, Ga. (AP) — A Georgia teenager shot a 13-month-old baby in the face while trying to rob the child’s mother, according to an indictment returned Wednesday that also charged the suspect with shooting another person in an unrelated robbery attempt earlier this month.

The indictment by a Glynn County grand jury charges 17-year-old De’Marquise Elkins on nine counts, including malice murder, in the slaying last Thursday of young Antonio Santiago a few blocks from his home in coastal Brunswick.

Another suspect, 15-year-old Dominique Lang, was indicted on seven counts including felony murder. But the indictment specifies that authorities believe it was Elkins who shot the child and wounded his mother with a .22-caliber revolver as the boys tried to steal money from her.

District Attorney Jackie Johnson of the Brunswick Judicial Circuit said in a statement Thursday she would not seek the death penalty against either suspect because Georgia law doesn’t allow capital punishment for defendants charged with crimes committed before they were 18. Both teens are charged as adults.

Elkins was also indicted on two counts in a second attempted robbery and shooting that happened 10 days before the baby was slain. On March 11, according to the indictment, Elkins tried to rob a person identified as Wilfredo Calix-Flores, pointing a gun at him while demanding his cellphone and wallet. Elkins shot Calix-Flores in the arm with the same caliber revolver used to kill the baby 10 days later, the indictment says. He is charged with attempted robbery and assault with a deadly weapon.

Kevin Gough, a public defender representing Elkins, said he felt prosecutors rushed to indict his client before collecting all available evidence. Gough had asked a judge for a preliminary hearing next week to determine if prosecutors had sufficient evidence to charge Elkins. The indictment means a grand jury has already made that determination and Elkins’ attorneys won’t get an early look at the evidence against him.

“It’s a major setback in the sense we would like to have an opportunity to test the strength of the evidence against our client,” Gough said.

Lang’s attorney, Kimberly L. Copeland, said she planned a vigorous defense but had no further comment.

“I believe in the innocence of my client,” Copeland said.

The few details contained in the indictment seem to back up the story the slain baby’s mother, Sherry West, has repeated to numerous reporters: She was pushing her baby in a stroller as she walked home from the post office when two youths approached asking for money. West says when she refused, the older teen drew a gun and shot her in the leg before shooting her son in the head.

Glynn County Police Chief Matt Doering told reporters Wednesday before the indictment was returned that investigators believe the crime was random — something police hadn’t said previously.

“We’re comfortable now, six days into it, to say the location of the incident and the victim were random,” Doering said. “I don’t have any information that shows otherwise.”

The grand jury also indicted three of Elkins’ relatives on charges that they tried to help him after the shootings.

The suspect’s mother, Karimah Elkins, and older sister, Sabrina Elkins, were charged with evidence tampering. The indictment says they threw the revolver that police suspect was used in the shooting into a saltwater pond where investigators recovered it Tuesday. Doering said the gun is being tested to see if it can be linked to the child’s slaying.

Karimah Elkins and the suspect’s aunt, Katrina Elkins, were also charged with making false statements to police. The indictment says the aunt told investigators her nephew was at her house when the slaying occurred — which she also told The Associated Press and other news outlets. It says the suspect’s mother told police that her son was with her when the baby was shot.  (continue reading)

    Take a close look at ALL of the different charges. When I see something like this, I wonder if there are other crimes he committed that are not yet linked to him.

    I thought the same thing about Trayvon. Was George his first ever victim?

      Trayvon got a free knockout game with the bus driver (he wasnt arrested for his criminal assault of the bus driver – his parents sent him on vacation with lots of money and very little supervision – some would say NO SUPERVISION at all)

      Well, in the trayvon case, the parents got to lie about their son with IMPUNITY (they havent had to face any consequences for their many many many many lies) while the other kids parents were actually taken to task for their many lies (the way the law is supposed to work).
      maybe the bgi didnt know they were supposed to show up for this case? did messy jackson not get his stipend to show up?

      Lying in general to subvert justice. In the Zimmerman case, we have “non party” attorneys lying through their teeth to subvert justice, to the tune of millions of taxpayer dollars – money that could, and should, be directed towards necessary expenditures, not as a payoff to the BGI. It’s infuriating.

      That was why I posted the comment in the OT about the Toronto Police holding an inquiry into Judges being concerned about officers allegedly lying on the stand. This rot is deeply embedded; and has become so corrosive to the fabric of our society that it has almost frayed beyond repair. “We” are the problem in that we have remained too complacent about this for too long. There are absolutely no real consequences to speak of for lying in today’s “anything goes” Progressive constructed culture. Our family has been on the receiving end of egregrious lies without foundation – all proven to be completely untrue – the liars got everything they sought with no sanction, while we were in mop up with heavy expenses incurred to defend ourselves, not to mention the emotional toll.

      Lying to protect criminals. Individual entering the country illegally to secure benefits they are not entitled to for themselves and their chidren. Lying for political power. Lying specifically to undermine the system of elections and justice. And on and on and on.

      And yet, society seems to be okay with lying with out repercussions. Have been quite some time. The GZ case and the battle over illegal aliens is just the symptom of the deeply embedded cancer that most are okay with.

      Lying also seems to be a Progressive construct of a one way valve. Certain protected classes are permitted to lie with encouragement, since the “end justifies the means” while others not under political cover are routinely, and unfairly, accused of lying when they seek to expose the rot.

      From what I have seen, the baby was interracial. The killers were black. Sounds like racial hatred to me. The black killers targeted a mixed race baby (and his white mama who dared be with a man of color) to teach em a lesson.
      It could be black racism if such a thing was even recognized as a bad thing (it might easily be otherwise, but we will never know since the powers that be refuse to even acknowledge black racism

          Yes. The killer was black and the mother and child were white. Maybe the baby is biracial, but he didn’t look like it to me. Let’s start calling it a racial incident until we know it is not. Oh, just like in Zimmerman’s case.

          The George case has nothing similar to this case! I believe that george was really attacked by trayvon because the kid had attacked a bus driver before that! If my child is not good I will say it I’m not gonna paint my child as this really good kid when he wasn’t!!! This case has a little of that how elkins mom was telling everybody that her son was a good kid and he will never comit this crime I really don’t think thisis a race issue I think its more of I’m trying to make a dollar out of .50 cents a robbery gone really wrong

        Libby this time I think you are wrong. The police have said it was totally random, and I tend to believe that. I think he knew these neighborhoods, knew where to go at what time, and basically look for a victim. Now the mother tends to feel she was spotted by him at the post office, cause she was returning from the post office. Perhaps, like a lion, he watched and saw she would be alone on the path she was taking home. Very few ppl out, very few watching. That’s why he could make a move like this in broad daylight. The police claim they have a video. The video could be from the post office, or a 7/11 or someone’s home. The only way I think your theory could be correct is if he had been setting this target up for quite some time, and could see the family that lived at her house had a person of color living there … putting two and two together. But that would take a brain, and I don’t believe he has any. I believe he just went hunting. Also, why ask Mother for anything? why not just grab her purse and run like normal criminals. No, this kid liked to inflict pain. I think that is pretty obvious. I don’t believe the mother took the baby out like clockwork in order to establish a pattern for a criminal to attack. No, I think it was random, he spotted her alone … and that’s all he needed. He was full of himself to attack in broad dayling. Did not have to shoot anyone in order to steal a purse, but he chose to do the most heinous thing .. kill an infant child. For his family not to recognize the kid is an abomination and needed to turn him in defies all reason. I will go on the record to say, I don’t care how much I loved my kid, if he killed ANYONE … i repeat … ANYONE … for any reason (even self-defense) I would be contacting police.

        Seems like stick up kids to me nothing more. They probably target certain people at certain times of the month. This women was the perfect target. There is a pecking order in gangs you have your top guys then you have kids like this. Gangs use you for what your worth. When this first happen I kept hearing people say this isn’t how it’s supposed to work innocent people aren’t supposed to be involved but that’s not the truth.     What is sick is that there are people who think that the mother did this, even after this evidence keeps coming out, they claim there is no way these boys did this and the mother is involved. I have taken a couple of them on at the CNN blogs, but it is just insane for anyone to be on any side other than the mother’s in this case. It just goes to show how some people are so out of touch with reality that they can’t accept things like this.

    What do you want to bet that the same people that express all manner of ill will toward George Zimmerman’s family, merely for voicing their belief in his innocence, would defend the actions of Elkins’ sister, mother, and aunt, who tampered with evidence, lied to police, and obstructed justice in Elkins’ (alleged) cold-blooded murder of a 13-month-old baby?

    The leader of the Black Panthers should be indicted for his statement he made about killing white babies. Also when the baby was shot there was a black investigator saying in an interview that what happened was very suspicious and wanting so bad for it to be someone other than the

        Canada, I agree the sympathy is running out, but still appears to be a trickle instead of a geyser. Some of the more recent heinous crimes by this particular demographic (young AA males) have put this on the map for alot of law-abiding citizens of ALL colors.
        That said, there is still a sub-group of the population that continues to side with skin color, regardless of facts or logic. Until more black role models such as Dr. Carson step up and speak out on this to their own “community” and the MSM will pull their heads out of you-know-where, it will be an uphill battle.

    In our collective efforts to keep the media and our community informed regarding the subsequent events stemming from the Thursday, March 21st 2013 homicide of 13 month old Antonio Santiago; it appears at this time that the incident was a random act. Additional search warrants have been issued and served, and currently more evidence is being gathered. We previously mentioned that information was received which led investigators to a pond/marsh area located off of Highway 17. There, a handgun was discovered submerged under water it was retrieved and sent to the Georgia Bureau of Investigation’s Crime Lab for an analysis. At this time we cannot give a description of the firearm’s name, make, model or caliber. However, we can indicate that the weapon was found 2.3 miles from the incident location.

    In conclusion, the Grand Jury has indicted De’Marquise Elkins and Dominique Lang for the murder of 13 month old Antonio Santiago. On Wednesday, March 27, 2013 at approximately 7:00p.m. Two arrests were made; (Karimah Aisha Elkins, Mother of De’Marquise Elkins, a 36 Yr Old Black Female of Brunswick, Ga.) was re-arrested on a bench warrant for (tampering with evidence) and for (possession of a firearm by a convicted felon). And (Sabrina Elkins, Sister of De’Marquise Elkins, a 19 Yr Old Black Female also of Brunswick, Ga.) was also taken into custody on a bench warrant for (tampering with evidence). A photograph of Ms. Sabrina Elkins can be obtained from the Glynn County Sheriff Office, Booking Dept. (912) 554-7604. According to the District Attorney’s Office, the case will proceed to Superior Court. Updated information will continue to be provided as it becomes available. Additional information continues to be encouraged.     Howdy all

    I think I have only posted once here , mostly lurk. like how you been on the facts and evidence on GZ and such.
    Something is bothering me with the elkins lang case. The first day or so, before they were caught, even when people were speculating it was a susan smith type case, I saw a interveiw with the mother where she was giving a description of the “kids” she said very pointly that the younger kid, she thought he was around 12 or so IIRC, was hiding behind the bigger kid. I think she even said he was shakin or something to that effect. Now the other day I read where the grandmother? of lang claims that elkins forced lang to come with him. threatened to shoot him I believe.

    If what she says is true then I fear that Lang may be caught up in something that he had no control over. I hope I am getting across what is bothering me about it. From the evidence I reserve judgement for the courts but in trial by media they are guilty as hell. When I personally know about a case and see what makes it into court and what makes to press is totally half truths and such I feel for lang IF what I have heard is even close to the truth. I know nothing about either of them its just the mothers words and the grandmothers words make me really wonder if lang isnt going to get railroaded over the fury of a 13 month old baby shot in face.
