Since Obama made the flip-flop on his position regarding the Defense of marriage Act (DOMA) I’ve been contemplating what his angle was.   I know this administration always has another angle, we just don’t always know what it is, and sometimes it takes a while to figure out the exact motivation.   It is hard to keep an eye on all their tentacles hands and figure out what the ‘real’ agenda item actually is.    However, distance always provides the best perspective and I think it is now clear. 

The basic issue I personally had with the dismissal and change to the military’s’ Don’t Ask Don’t Tell policy (DADT) was the probability of a hyphenated soldier.  It really doesn’t matter to me what sexual orientation a soldier has so long as they can do the job.  Period.  However, I am not naive enough to ignore the problems with the change.  The problems always come from the unintended consequences, the consequences of needing to create “sensitivity training”, changes to established Code of Military Conduct, and the obvious problems with litigious claims against military officers based on discrimination charges from those seeking protections behind the shield of sexual orientation.  That is the problem I had/have with DADT removal.  That is what the progressives always do.  When we were discussing back then I said:

“Wait until soldiers face court-martial for making fun of a gay guy. Wait until the sensitivity training begins. Wait until the lawsuits begin because gays will say they aren’t being promoted. Wait until every single solitary thing that goes on in civilian life gets hectored into the military as a deliberate distraction to what the main responsibility of the military is – to have an elite force that kills the other guys better than they kill them.”… /SD

 — American combat troops will get sensitivity training directly on the battlefield about the military’s new policy on gays instead of waiting until they return to home base in the United States, the senior enlisted man in Afghanistan said Thursday.

The Pentagon is launching an extensive force-wide program to ease the process of integrating open homosexuals into the ranks, including into close-knit fighting units. Army Command Sgt. Maj. Marvin Hill, the top enlisted man in Afghanistan where 100,000 U.S. troops are deployed, said that the sessions on respecting gays’ rights will go right down to the forward operating bases, where troops fight Taliban militants. 

“I have heard about the training that will be forthcoming to the battlefield,” Sgt. Hill told Pentagon reporters via a teleconference from Kabul.  “We will take our directions from the Department of Defense, from the secretary of defense, the chairman, as well as the service chiefs of each service. Our plan is to take their direction, and we’re going to execute that training right here on the battlefield.”    No unit is exempted, he said.

What is more alarming is the connection of DADT to the DOMA position recently outlined.   Remember, Obama’s’ decision NOT to enforce the Defense of Marriage Act laws is not only concerning, his decision NOT to enforce laws is “unconstitutional”.   The President does not make laws, nor does the Executive Branch get to decide which laws the Justice Department will, or will not, enforce.    The legislative branch creates the laws, the executive branch enforces the laws, the judicial branch applies the laws.  That’s the way it works.

Obama specifically and with intent directing the Justice Department NOT to enforce a law specifically violates his oath of office.   Yet why would he do that?  What possible reason could there be for him to stop defending and enforcing a law?   It appears the DOMA law is a back door into changing the military implementation of DADT.   Specifically as it pertains to housing.   You can expect to see a new requirement for military housing specifically for gays and lesbians now.   Consider this article which outlines the Duplicity:

(OneNewsNow) A conservative military watchdog says a recent announcement from the Justice Department reveals that the administration misled Congress about the effects of repealing the ban on homosexual military service.

Attorney General Eric Holder’s announcement that the Justice Department will no longer defend the constitutionality of the Defense of Marriage Act (DOMA) in federal court has not settled well with pro-family advocates who believe the Justice Department is obligated to enforce the statutes passed by Congress, regardless of whether the administration agrees with them politically.

Elaine Donnelly, president of the Center for Military Readiness (CMR), says the declaration contradicts Defense Secretary Robert Gates’ pledge to Congress and the military service chiefs last year, when he said DOMA’s existence would prevent the military from providing housing and benefits for same-sex couples who live together as “married” or “committed partners” on military bases.

“Members of Congress last December were misled by the administration on the DOMA issue, and probably on some other issues,” Donnelly contends. “The claim that they will continue to enforce…DOMA, the Defense of Marriage Act, really is meaningless. Nothing this administration says anymore is credible on anything to do with the LGBT — that is lesbian, gay, bisexual and transgender activists — and what they want, not just in the military, but in the civilian world as well.”

The CMR president concludes that Congress should call for immediate hearings to reconsider the rash action taken during the lame-duck session of the 111th Congress late last year. (full article)
