No. Rubio is not a Natural Born Citizen as defined when the Constitution became law (Law of Nations written by Emerich de Vattel, a copy of which was provided to the Convention). Neither are Obama, Cruz, Haley, Harris for the same reason – one or both parents not an American citizen when born. This was an important issue at the Constitutional Convention. John Jay sent a letter to George Washington during the convention encouraging a change to the “Citizen By Birth” wording to “Natural Born Citizen.” The change was made without any opposition or further discussion.
Nonetheless, the Obama precedent was used by an Illinois judge to rule Cruz (Citizen by Birth because Mother was a citizen when he was born in Canada. Cruz is always careful to say he’s eligible because he a Citizen by Birth and to my knowledge has never claimed to be a Natural Born Citizen) was constitutionally eligible and that’s apparently all that’s necessary in today’s world to make an exception to the Constitution.
You are correct. Rubio is an anchor baby. In my view he’s not even a citizen at birth since both parents were Cuban migrants with no visa or permission to enter the US at time of his birth. Don’t forget Trump spent several years litigating at the Supreme Court AGAINST ancho babies’ rights to be deemed birthright citizens by being born in the US regardless of parents’ status. But lets assume SCOTUS is right, and he is a birthright US citizen born to non-legal resident migrants. Obviously that does not even come close to being an Natural Born Citizen. This will be a deal breaker for Rubio if he even tries to campaign for President. They should just keep his as a sort of perpetual Secretary of State where he does a creditable service.

About 10 years ago, Dhillon, head of a private law firm in San Francisco, filed a federal class action suit in the Northern District of California, San Jose Division, against the City of San Jose, San Jose Mayor (now Congress-critter) Sam the Sham Lie-ccardo, San Jose Police Chief Village Idiot Edgardo Garcia, and 7 San Jose Police Dept. lieutenants.
Plaintiffs were rally-goers who were assaulted by left-wing mostly Hispanic terrorists at the Trump Rally in downtown San Jose on June 2, 2016. The day before, Garcia had issued a “stand-down” order to the estimated 250 cops on the ground, and had directed the route of egress post-rally from the Convention Center.
The day after the rally, Lie-ccardo blamed the violence on Trump’s “rhetoric.” Garcia praised the “bravery” of his officers. Yes, the same officers who stood by and did absolutely nothing while citizens were being beaten, chased, egged, assaulted and harassed by scores of violent punks, many of them carrying Mexican flags.
Liccardo and Garcia managed to extricate themselves from the case via a 12(b)(6) motion to dismiss, based on sovereign immunity.
The 7 police lieutenants were not so lucky. The 9th Circuit ruled that the lieutenants were on the ground at the time (who knows where Garcia was?), saw that the exit route put the rally-goers right into the mouth of the terrorist mob, and should have altered the route. Instead, they forced the rally-goers to run the gauntlet. State-created danger exception to sovereign immunity.
This was a great ruling.
Except: instead of proceeding with the case, Dhillon ended it with a whimper. A secret settlement, with San Jose officials apologizing to the plaintiffs, and promising to make changes to their policy in the future.
No repercussions for Sham or Edgardo (who went on to become police chief of Dallas, TX, then Fort Worth, TX) and no justice for the people who were assaulted by the thugs (yours truly included).
So, no, Dhillon’s most recent action does not surprise me in the least.

As a person living in Texas, I find our results easy and hard to believe. As always I hoped there was a plan and Harmeet would be on top of this election, so this news is disappointing. With the influx of millions of Californians and millions of H1B’s and other visa’s the numbers may be correct. I’ve worked elections for years, did not this time as the primary was full of foreign voters. Two years ago we fought Jane Nelson (SOS) and Abbott tooth and nail to keep illegals from voting. Nelson/Abbott wanted anyone with a license to be able to vote (they issue those to anyone and everyone no citizenship required). I can only tell you as a lifelong republican that Greg Abbott hates republicans, he hates conservatism and is worse than Bush. Huffines nailed it when speaking of him and Patrick. It’s so disheartening as I often say for 24 years I’ve been a refugee from Chicago. I’m not sure how my district could elect Brandon Gill and Talarico. Doesn’t seem possible, the two could not be more ends of the spectrum. Thune knew and so did his group of old codgers that the SAVE ACT would have saved us.

But now is not the time to quit when they need a strong AAG in place to stay on top of this. At least stay until there is a reasonable replacement who is fully informed. Ross Perot, only a minority of them will do it instead of enough leaving the GOP choice for President, splitting their ticket, and giving Perot the win. No, they won’t do it. This is why it all happened, barring the possibility nearly all of this is just theater. We’ll and see who all gets jailed in the next year or two to find out about that.
