Back door ‘jury nullification’? Lawyer tactics, and he knows the judge on call???
Not liking what am seeing, and am not a lawyer but…the rest of the jury did not like what one, who held to his/her convictions, considered? (Clancy Trial)…
It’s hard to tell without having heard all the evidence on her alleged mental illness. What I found interesting:
She was a labor and delivery nurse who had already had two children before her last baby. She knew about pregnancy complications.
She lived near Boston, which has world-class medical care at place like Mass General.
How much did she tell her husband, such as “Honey, please take the kids to you mom, my sister, someone, so I don’t hurt them.”
My in-laws worked in that medical system. St. Tony Fauci and his ilk are there, all with god complexes.
One of their identical twins (shared amniotic sac and placenta, high risk pregnancy and heavily monitored by same hospital system) was enrolled in a federally funded clinical medical study. Pulled her from the study after learning the data was falsified to list the child as a fraternal twin without available prior records.
Medical providers lie all the time in records, and are told to testify in court only that their “records reflect”.
Absolutely. I’m a retired litigator (civil), and doctors would almost always say, “My records indicate…”
Rural medicine in north western Mass. almost killed my daughter and grandbaby….until they finally swallowed their ego’s and transferred to Amherst….

Both Clancys have civil suits against the healthcare providers. An acquittal would give the civil attorneys some juice. Anything else might actually reduce their leverage. Would a healthcare system put a ringer on the jury?
But the system would have no control over which people were ultimately chosen as jurors. Not to mention a possible alternate whose name will be picked at random out of a box. So while an interesting theory, I don’t see how that could be arranged in advance, so to speak?
Both sides get several challenges to bump jurors they don’t like when they are picking them
Am aware of the voir dire process. Sometimes the attorneys still get stuck with potential jurors they don’t want because the challenges were not used in the most efficient manner:)
The jurors went home each night. Someone could have gotten an offer in a phone call.
I have mentioned that she would be better off being a ‘ward of the state’….
Her healthcare would be provided for…and again, based on my correctional health care experience and experience with health care in the community, as a bedside provider…she would be better off. So an ‘innocent verdict’ may not really be a victory. Subsequent law suits? They take time…so who knows? Certainly not me.
At some time…families get tired of taking care of the loved one…it happens, I have seen it a lot…it takes a family ‘team’ dedicated towards that endeavor.
At this point, I truly believe, its in God’s Hands…only He knows for sure.
My girlfriend has a cousin with bipolar disorder. Twenty years of on and off meds, psychotic breaks, and 72-hour holds. His mother is now in her 70s and dad has died. No one wants to pick up the slack. The dude is in California and is now on permanent disability.
That is a tough one…when the bipolar feels better, that is when they seem to go off their meds…my ex did that.
Those babies deserve justice.

I had an adult mentally ill neighbor that tortured our subdivision for years. Parents couldn’t get him committed. He would go severely crazy town and they would send swat to pick him up ( what’s that $150,00 per trip? ). Hospital would boot him “ well” after about 6 months and we were left to deal with him again till the 3 rd or 4 th swat trip to the court and hospital. His home was sold and I don’t know where he is except last I heard he set the hotel room on fire when swat came for him, Again. We need to be fair to the universe and keep these people in a safe treatment jail. Drugs are not the cure for all mentality ill people.
No one expects the horrible killing of her children but family friends and her work should have got her into a facility for treatment maybe starting with an emergency room. A bunch of drugs were not going to make her better overnight. Getting her help is not an easy task either. Society failed. She killed three children.
Letting her free would be wrong.

My reading of this maniac’s text messages indicate that she was frustrated that she was going to have to return to work when it was obvious to her that her youngest was not ready nor wanting to be weaned.
She asked for Zoloft for her anxiety — anxiety due to HAVING to return to work.

Massaschusetts is one of the deepest blue, highly taxed and most expensive states to live in in the entire country.
The average home price today in Plymouth County is $753,500.
If this where young people are living and then having three kids, they are signing up for one hell of a tough and hard life by staying in Massachusetts.
Her stress and anxiety was likely related to the reality of trying to make it financially in a state like that with three kids.
We say here every day that Socialism is a failure, well this is what that all looks like.

I know plenty of people in Massachusetts and if you can’t make a ton of money, if you aren’t smart enough to do that, if you don’t have help from your well off parents, it’s a pretty hard life there.

I am with you on the pharmakeia. I do believe it is behind much of the social problems we are seeing and it is deliberate. We are dealing with pure evil. Tail wagging the dog has led to many of the horrible and oppressive laws we have seen over the years.

The defense attorney was making it up as he went. The mental illness is a side issue and not a relevant “reasonable doubt” as to whether she is guilty of murder. Most of the jury probably wanted to let her off scot free as if she had no responsibility. They got it wrong as they did not consider if the evidence fit the elements of the law as it concerns murder.

This is the concept, of course IMHO, (or not so humble)….this is the living breathing BS of “group think” at work.

Massachusetts does not want this case back. I wouldn’t be surprised if they make the judge remove the holdout.
Then an alternate would take his place, and the jury would have to start deliberations all over again. There are six alternate jurors.
Wondered how the one out of six would get selected. Looked it up. It’s picking one name out of a box. Would be a huge irony if the one name was another holdout.
One point to remember: once the mistrial in the Clancy case is recorded, the jury is discharged, and is no longer required stay silent (and we know some won’t be).
Votes on individual charges would then not be in the record, so she could be re-tried on all charges.

The Court had the hearing and denied the defense motion. The judge was allowed to enter a mistrial and has discharged the jury. The jurors cannot be called back to re-deliberate. Their jury service is done.
The next hearing is Sept. 29. The date for a re-trial has not been set. Defense wanted a prompt re-trial, no doubt while this case was in the news cycle.
After Labor Day, election season starts, and this case may shift out of the spotlight.

A very bad precedent. What good is a jury trial if they can just remove someone who isn’t going along with
the desired verdict? This would completely make a jury trial worthless in the future and defeats the entire purpose of one. Surreal.
I think the appeals court (and probably most trial and appeals courts) agree with you.
A hung jury means a mistrial, and the fact that a case is high-profile is no reason to change established practice.

I was wrong about Lindsay Clancy. Here’s why I changed my mind.
She was never diagnosed with postpartum depression or psychosis. She was not on 13 medications at once. She was not “hearing voices.” She was not abandoned by her family.
She was diagnosed with a mood disorder – never psychosis – and went to a variety of doctors who all prescribed different medications, which she took unreliably and not simultaneously.
She only heard a voice one time – and that was right before she killed her kids. Extremely atypical for psychosis.
She carefully planned her children’s murders down to the minute. She researched the distance of a restaurant she’d ask Patrick to go to. Added on a last-minute errand before he left. Calmly answered his phone call in the middle of her crime. Brought her children down to the basement one by one, overpowering their resistance and killing them slowly.
It does seem like she had support from her family. She may have still been overwhelmed, but it’s not true that all of her cries for help went unanswered.
I originally placed too much blame on the many SSRIs she was prescribed. For years on my show, I’ve talked to health professionals who have been warning about the violence-inducing effects of these drugs, and I thought Lindsay’s case may be an example of that reality.
Is it still possible these SSRIs had a negative effect? Absolutely. But the case that these drove her into a psychotic episode is weak.
This evidence continues to reveal, in my opinion, that Lindsay Clancy methodically murdered her children and she was fully aware of what she was doing.

That is a great closing argument for the prosecution. I’d be interested to see if the prosecutor hit the same points.
For retrial, do you think the prosecution will be able to strengthen their case? If history repeats, which side has the advantage? Do you have an opinion? How will they find jurors the second time around who have not been influenced by the news coverage, which I suppose could work to the advantage of either side?
Hard to say. There won’t be a new trial until at least October, and the second trial may not be as newsworthy.
The judge will have to closely question jurors on their ability to start our with impartiality. He could always bring in a jury from some other part of the state, but this has received national attention.
Publicity didn’t stop the prosecution of the Boston marathon bomber.
Will it be the same judge? Is it always?
Can she request a non-jury trial at this point?
It seems to me that it will be very difficult to find jurors who have not already formed an opinion, in the midst of all this media barrage.
But something stopped the FBI from being charged.
She is simply evil. There is no excuse, there is no reason, there is no failure of medicine to blame in this case.

I use workout bands to maintain some flexibility in swollen feet. The bands are devilishly difficult to use- both slippery and stretchy. It took strength and determination, but mostly strength, to use those bands on her children.

I had to compile a list of drugs my sister-in-law was taking when brother-in-law was fighting for custody of his children, and they were the same drugs – she Dr shopped and went to different pharmacies for years – just like Clancy. She (SiL) was completely evil, and everything was all about her. She didn’t care the holidays she ruined, the financial devastation or what she put her three kids through. Luckily he won, by the grace of God AND that list of meds… those children were saved.
Dear God, she TOOK TIME to murder those poor babies… she even took a phone call from hubby mid-murders. Then learning about the nanny… UGH!
