The Dept of Justice in Washington, DC, dropped all charges against David Hearn for damage to the reflecting pool, saying instead that an investigation has led to information the installation was botched during construction.
Obviously, the leftists are taking a victory lap against previous accusations by President Trump that vandalism was the major cause of the algae return.

DOJ said they “first became aware of information showing that the damage was the result of a botched installation and not vandalism” after reviewing more documents.
The Justice Department filing said that based on its review of evidence, “it is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt.” (read more)

But Hearne was indicted by a grand jury. And it is not the success or failure of the act of vandalism but the attempt that is the crime. She should have allowed this to go to trial. If nothing else she could have dropped the felony charge and left it as a misdemeanor.

If it is apparent that the defense is going to produce documents that show the contractor did a poor job and that may be the cause of the problems, and that you will probably lose the case in the liberal DC court, you drop the charges against the defendant and pursue the contractor poor workmanship. Its the only winning route. (btw, the “pe” means professional engineer and yes, I do testify about such things).
It appears Pirro did not inform the president prior to the announcement and convince him her finding is accurate. Hence, he blasted her, creating a serious, unforced PR mistake.

Jeannine Pirro is a FORMER judge who is now a US Attorney, which is a prosecutor job. She doesn’t “hear” cases as a judge. I don’t know if her role is management and PR, or if she actually made the presentation to the Grand Jury in this case as a prosecutor.
In this particular case, because of how voicetrous President Trump was about the damage, she should have known that informing President Trump was imperative.

Informing is Todd Blanche’s job. Attorney Pirro got late information (reports about faulty installation) from the Dept of the Interior. I know it may pain some to read an MS NOW article but it’s same story reported by Fox. Read the article. From a prosecutorial standpoint she didn’t have much to go on. President Trump can yell & throw papers, but that’s sometimes what happens with a case.

Before throwing JUDGE PIRRO under the bus … she is not the one who “discovers evidence” nor “determines how the evidence is linked to the charges” by the DoJ. JUDGE PIRRO rules on the application of the law.
What choice did she have?? We do not know how the “new evidence was presented” by DoJ. Did the DoJ present the new “as the sole cause of the damage”.
A full review of what “new evidence” the DoJ presented and how was the “new evidence” presented is needed.
This is a dismissal and NOT a verdict … so after a review new charges can be filed.
The President is flat wrong on this one with respect to Judge Pirro and needed to keep quiet until there is a review of what exactly happened. As it is now after his tirade .. refiling may not even an option thanks to his inability to show just a modicum of patience.
My opinion is that Pirro should have notified PDJT of the fact that they were going to drop the charges. Then she could have explained that there was (in her opinion) enough reasonable doubt in regards to the reflecting pool. Then he could have explained his position and come to an understanding.
Pirro’s office is the one that blindsided PDJT. He now has a right to put his opinion into the public airwaves.

Discussing her ruling with the President before it was released to the Public and Defendant would be illegal and grounds for dismissal of charges. The President is Technically the Government and Plaintiff in this case, any discussions would have had to include the doJ and Defendant’s Lawyers (i.e. the same as the Public disclosure that has everybody’s panties in a twist).
DoJ, as the representatives of the GOVERNMENT Plaintiff (including the President) had 100% of the responsibility to keep the President informed.
Once engaged in the case Judge Pirro is required to maintain 100% neutrality.
While Pirro is appointed by the President, she works for the DoJ via the Executive Office for US Attorneys and the Deputy AG in main justice. Main Justice should be working with the White House not individual US Attorneys though I suppose this would be considered a high profile case. But Blanche is the one you should be angry at.

I really think the pool should have been properly redone with a more permanent and durable inside surface rather than a cheap (by comparison) vinyl liner. It just seemed tacky to me from the start.

Either there was a very large cut in the liner or there wasn’t. Either there was algae poured in or there wasn’t.

Many pictures of the damaged liner revealed lengthy, jagged cuts/tears in the material. It seems highly unlikely that it was installed so asymmetrically.
You can’t paint an underwater surface without pressure cleaning, etching it and make sure it is completely dry. You may even need a primer sealer coat. This was clearly a screw up by the contractor and lack of supervision by washington D.C.
Don’t pay the contractor and demand a make good. Don’t make me come up there and do your job for you million-dollar jerks in Washington.

It doesn’t look like the lining contractor thoroughly prepared the parts of the bottom that got tagged with “8647” graffiti while the pool was drained. They just pained around it, then pained right over it.
The contractor began spraying-on the liner the same day the graffiti was discovered.

Trump had a shot at becoming the Zorro character who might have swooped in to administer swift certain justice. Death by hanging. Huge public events like the old days. 15 or 50 “congressmen” getting their necks stretched woulda slowed down the tyranny for a decade or two.

I’ve read the whole thread and I have more questions than answers. We don’t have nearly enough information here to arrive at the right answers.
It seems like Judge Pirro ruled upon the information put in front of her but I question how accurate and complete it all is and was.
She’s only as informed as what the investigation puts in front of her.
She’d have to be knowledgeable about how the entire project was designed supposed to be installed to then know if it there was a problem or not with the installation.
She’s a Judge, not an architect or a construction project manager- she doesn’t know what she doesn’t know in order to then ask the right questions and this is also likely the case for whoever did the investigation.
We live in a country now where construction companies are forced to use a whole lot labor that is not very good for all sorts of reasons from drug use making people not good to foreign labor and language issues, it’s a constant battle trying to find good help. There was a ton of labor on this project and potential for mistakes everywhere.. every inch of that liner where there is an adhered seam is a place for something to go wrong. We also have the danger of materials failure and that does happen too.
So projects can and do go sideways.. they pretty much always do in fact.
Having said this, whenever we had critically important projects like this reflecting pool project, your better project supervisors had many eyes there on the job to make sure this kind of crap didn’t happen- but then there aren’t enough of those either and they cost a lot of money which then blows the budget.
Clearly there was installation issues but get this point: If this pool liner was this easy to vandalize, then whoever made the choice to use this method, use that material, that was a critically wrong decision.

It’s a valid point. I for one would like to know how durable this liner material was? How thick? What was it made of?
Maybe there are better alternatives but the time frame was short which may have been an error in judgement.

The standards of workmanship have gone down a lot. Someone sent me pictures from a big commercial construction project, every single door was framed in 3 inches too short. Every rough opening was 3 inches too short. What kind of framer doesn’t know how tall a door is?

The evidence is clear, vandals have repeatedly caused damage to the Reflecting Pool. Some of these acts were even caught on camera. We also provided the U.S. Attorney’s office expert and eyewitness testimony to the damage done by vandals and provided every piece of evidence they asked for in the requested time line detailing each area of damage at the pool.
The Reflecting Pool is part of the Lincoln Memorial and dates back to 1922.

Intentional damage done to the Reflecting Pool is no different than defacing any one of our other national monuments.

Maybe Jeanine Pirro should give David Hearn an award for investigating and producing evidence that the installation of the reflecting pool was botched. ??? Seriously, it seems to be somewhat of a pattern that some of the women that President Trump appoints are disappointing.
Who within the DOJ decided the damage was done by a faulty contractor I would like to know.
Revitalizing the Reflecting Pool and making it beautiful was very important to President Trump, and many Americans myself included. Judge Jeanine must know, and have known that.
Out of respect for President Trump, Judge Jeanine should have given him a heads up before dropping the vandalism charges against David Hearn.
I don’t believe this. I know there is a lot of Trump hate out there, but I just can’t imagine that a contractor would permit his workers to do such shoddy work on a historical landmark such as the reflection pool. This could put the company out of business; no one would want to hire them to do a backyard pool. I think that Jeannine Pirro is using the contractor as a scapegoat. Can’t get enough financial restitution from a former Olympian but you can from the contractor’s insurance company. I am getting insurance fraud vibes.
IMHO POTUS is right and ms Piro is all hat. Never been impressed with her record before this appt., she was big talker with a show … however her legal finesse leave much to the ether. Furthermore, before the charges filed, thought she was a little out of left field Uber declarative before judicious review.

She and her office are 100% responsible for not doing President Trump the courtesy of providing a warning as well as briefing as to why they are dropping charges before moving to the courts, to file the motion.

A D.C. grand jury found a felony subpoena? That information alone tells you there was enough evidence. Pigs are flying.
According to reports, the grand jury was presented falsehoods. That is a felony in itself and might lead toward disbarment of those who were in the decision chain.
Why does this occupy even a minute of time? There are so many much more important issues. Ballrooms and pools are so low on the list. Could be the last few months. At best the last few years.

The judiciary is a separate branch of the government and in spite of leftist accusations that our President directs the actions of the judiciary, this is a good example that he does not. And he should not.

At what point in time was it discovered that the contactor botched the installation? Was there documentation/evidence of some kind by the contractor that showed they messed up and continued with the installation anyway? Was there a 3rd party inspection during installation that discovered a flawed process, but said nothing at the time? How did David Hearn discover that he could pull up the lining? Was it obviously already loose and easy to pull more of it loose? Wouldn’t this alone be indicative of poor installation as well as show he was vandalizing the pool?
