Last night U.S. District Judge Charles Breyer issued a ridiculous temporary restraining order (TRO) removing President Trump’s control of the California National Guard [SEE RULING HERE]. Charles Breyer is the 83-year-old younger brother of former Supreme Court Justice Stephen Breyer.
What made the TRO ruling transparently ridiculous was: (A) the state of California never requested a TRO; and (B) the citations Breyer used to underpin his decision were all left-wing media reports about the events. The facts, his facts, underpinning his judicial opinion, were wrong.
Those who follow judicial writing will note that using media reports as citations inside judicial decisions is a common attribute of Lawfare operations. Factually, it seemed unlikely District Judge Breyer even wrote his own ruling; it reads like something from Norm Eisen or Mary McCord.
This morning, a three-judge panel of the 9th Circuit Court of Appeals blocked Breyer’s order just hours after he issued it [SEE RULING HERE].
The appellate intervention retains the power of President Trump as commander in chief over the California national guard. The appeals court set a Tuesday hearing on the full context of the matter, thereby ensuring Trump’s deployment will remain in place at least into next week.

We have seen this before during the Obama reign. Having an order written from outside the court (judge and staff) should get the judge removed from the bench.
Take a look at Sundance’s link to the TRO. Maybe someone can reproduce it in these comments. The signature is fancy script with OUTLINED broad tip pen. Looks like some auto-pen or electronic signature facimile that a clerk might have access to.
That pre-writing has done before with anti- second amendment legislation. It sits in s drawer until an event occurs and then all of a sudden in magically appears – ready to be voted on.

While he and Bass were spouting off about the protests being “mostly peaceful” and Trump being an overreacting Dictator, the highly organized, well equipped anarchists & Cartel foot soldiers were bashing in the windows of the federal building and had federal officers cornered in a garage. They were blocking the 101 freeway that runs through downtown LA and throwing cinderblocks off an overpass onto the windshields of CHP vehicles. They were launching mortars and throwing Molotov cocktails at LE, setting fires to buildings, cars, grass areas, and looting stores. It’s a miracle no LE officers or citizens have been killed, although many were injured.
Bass and Newsom should be arrested for their refusal to cooperate with ICE, shielding dangerous illegal alien criminals as well as their refusal to send LAPD in to back up federal ICE officers under attack at the Federal Building when this all started, their refusal to allow LAPD to do their job, and for refusing to deploy the National Guard. They severely restricted LE from using many of the standard crowd control techniques that are used to control violent mobs. It seems Newsom thinks police work “inflames” unrest, rather than subdues it. What inflames unrest is when police manage to arrest violent criminals and then they are released back onto the streets in hours by Bass and Newsom’s corrupt local DAs. We were SO glad when Trump ordered the National Guard in as well as the Marines to stand by for back up. Only the federal officers have a ghost of a chance of apprehending the violent criminals and then actually being able to keep them in jail so they cannot continue to prey on citizens here and destroy our cities.
It would be a complete travesty if control of the National Guard were to be handed back to Newsom. He is grossly incompetent and unwilling to do his job to protect the city of LA or the state of CA. We tried and failed to recall him once already in CA and it is doubtful another attempt would succeed, because our elections are so fraudulent here. The only way to get rid of him is if he is brought up on charges and is forced to resign or go to jail. Thankfully he will be termed out in 2026 if all else fails but can CA survive another year of him?

Not in this matter. “Grave threats to the Republic” can take many forms, and, pursuant to Article 2, Congress (pursuant to Article 1) has empowered the President alone to identify, declare, and respond to them. This is not a criminal finding. The Courts have no say.

There should be a mandatory retirement age for politicians and judges.
The Constitution gives Article III judges lifetime tenure. Bankruptcy judges and magistrates are appointed for fixed terms.
I’m much more in favor of mandatory mental tests, myself. I’ve met 65-year-olds with well-established dementia, and 95-year-olds still near the top of their game.
Old-age wisdom, combined with uncommon old-age clarity, is still important. Young and dumb has no place in leadership.
Forgive me if someone else has already said this, but I have a half-baked thought to share. Here’s what I know about LA. 1) Downtown has been a tinderbox waiting for someone to throw a match for decades – old buildings that aren’t fireproof and tons of homeless people and bad streets. 2) The economy there is tied to the entertainment industry – can’t get away from that no matter what. 3) There has been less and less filming in LA or CA for many years – then Covid/lockdowns really hurt the economy. 4) Then the WGAstrikes really hurt the economy. 5)The fires in January were the last nail in the coffin. Secretly I think some people in LA were privately a bit hopeful for Trumps tariffs on foreign production because the studios work around is to make everything in Budapest with cheap labor. SO IF TRUMP CAN BE BLAMED FOR DESTROYING LA VIA RIOTS OVER IMMIGRATION, it kinda shifts the blame because I think LA was going down the tubes anyway. And maybe they need an excuse to get out of hosting the Olympics. Would love anyone else’s thoughts on this line of thinking.
