So is Trump going to bow before the black robe yet again telling him he can’t be commander in chief of the military?
Unsurprising for a California judge to “declare” that Trump “cannot” take control of the California National Guard.
US Constitution, Article 2 Section 2, names the President as Commander-In-Chief “[…] and of the Militia of the several States, when called into the actual Service of the United States […].”
And, Article 1, Section 8 requires Congress “To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions.” Which they have done.
In short, the President has the authority to call State Militias into the service of the United States, and to command them. Presidents have done this several times before.
Therefore, this “California ruling” is utterly meaningless, and of course the President should pay it no mind. Except possibly to consider whether these individuals – the Governor and this Judge – should be arrested for the crime of “aiding and abetting” insurrection against the United States.
An appeal with the 9th Circuit has already been filed by the Administration.
So. Freaking. What. Why even play the appeal game when a ruling like this contradicts a president’s CIC authority? He’s still playing nice and obeying a judiciary that is corrupt.
Agree, the fuse that has been lit is damn near the dynamite. This weekend is going make 2020 look mild.
