The Supreme Court has stayed a lower court injunction against the Trump administration {Ruling Here}.
In the 1-page decision, the Supreme Court cleared the way for the Trump administration to immediately end immigration protections called “Temporary Protection Status” that allowed roughly 350,000 illegal alien Venezuelans to remain in the USA. Justice Ketanji Brown-Jackson would have allowed the block to stay in place.

I think SCOTUS is finally getting tired of all the emergency appeals on Trump’s executive orders. I’d guess the appeals courts are sick of them, too. I said last Wednesday that the constant emergency appeals might be the reason for SCOTUS taking the birthright citizenship case that also raised the issue of nationwide injunctions.
Maybe it finally sunk into everyone there with a functioning intellect (why the vote was 8-1), that this has to stop.
The justices don’t like emergency appeals, and one cannot blame them. The record is sparse, the legal issues are not fully developed, and all they have to review is an order and one district court judge’s opinion.
Of course, part of their job is to handle emergency appeals, but there have been so many since Trump took office that perhaps they’ve come to the conclusion to just let Trump issue his orders, and they’ll sort everything out once the cases have come up the appellate pipeline. Took them long enough, but maybe they finally figured out what Lawfare is doing.
I think this was a slam dunk for the SCOTUS, different from many of the other cases with injunctions. What one President can do, another President can undo. There is no Congressional law in play here that could possibly have been violated.
It’s possible, although in 2020, when Trump tried to reverse Obama’s DACA policy, the Court said Trump did not give adequate reasons (adequate to the Court) for reversing the policy. But then, RBG and Kennedy were on the Court, not Barrett and Gorsuch.

I heard a portion of her oral arguments on another matter before the Supreme Court on another blog site and my Gawd, she did not sound impressive. Her oral arguments and legal reasoning were simpleton at best. One does not need a law degree to construct better legal arguments than her.

This only removes the TRO, “WITHOUT PREJUDICE”, that does not stop the case from going forward to the 9th District Court of Appeals for disposition.
Also, per the last Supreme Court Ruling, each one of the 350,000 Venezuelans is due the entire journey through the entire Federal Court System as part of “their due process rights”, before they can be deported.
There is a long way to go before they are deported.
It will be interesting to see the depth of the pockets supporting these lawfare actions.
The ruling means ZERO as long as the due process appeals continue along side this case in the 9th Circuit.

SD I truly love your work but I have to disagree when you use the term “illegal alien” under TPS. How many of you and your readers understand the process for registration under TPS? Registrants are vetted; interviewed; pay annual fees to the USG for this registration; and pay additional fees to get a work permit.
My wife and I put our nephew and niece from Venezuela through college on students visas paying three times the resident’s fees. They were able to get TPS following graduation and are able to work: one as a chemical engineer and the other as an architect.
We got them out of Venezuela as “students” were brandishing guns at the university. They had familial connections to the Maduro administration. It was unsafe then and worse off now since they have become “successful”. They areNOT ILLEGAL ALIENS.

People were not being vetted, as happened in your family’s case, and were actually being brought in (!) en masse, simply based on their category, not their need. And when a legitimate administration comes into power, the riposte sometimes catches the good with the bad. But all it really means is that TPS as an automatic shield against deportation is being removed. In the case of Venezuelans, given the Maduro regime and the TdA invasion, there will now be real scrutiny given to the Venezuelans brought in to sift the chaff from the wheat and I imagine that many of them will have to leave, and rightly so. But Trump has not moved away from his insistence on merit-based immigration, and good chemical engineers and architects are an asset to this country.

The courts have to be reined in, they are out of control and exceeding their authority, all of them.
“The Supreme Court allows…” The scotus shouldn’t be ruling on an issue that Congress made off limits to them (under Article III, Section2, Clause 2) It is unconstitutional for them to defy Congress when Congress has exercised it’s Contitutional authority.
Immigration and Nationality Act
This strips the Article III courts’ jurisdiction over immigration cases. This was passed in 1952, and has been amended several times. (Authority: Article III, Section II, Clause 2) To ask the Supreme Article III court to rule that it is itself in violation of the Act is a pipe dream as they have been usurping the powers of the other two branches since Marbury vs. Madison (1803). The solution is to impeach each judge in violation. The President is required by his oath to defy and ignore such unconstitutional orders.
On September 30, 1996, President Bill Clinton signed the “ILLEGAL IMMIGRATION REFORM AND IMMIGRANT RESPONSIBILITY ACT OF 1996”
Under Sec 302, it states that illegal aliens can be “removed from the United States without further hearing or review”.
