The Supreme Court lifted a lower-court judge’s ruling that paused the administration’s ban on mentally unstable people who were uncertain of their gender. The DEI judges (Latino, Lesbian and Black) dissented.
Previously, President Trump stopped allowing transvestites to participate in military service for obvious ‘mission critical’ reasons. A lower court said that was unconstitutional and blocked the ban. The Supreme Court has ruled 6-3 that stopping psychologically unstable trans-identifying people, was within the scope of authority of the commander in chief.

Neither the majority nor the dissenters provided any reasoning for their positions.
The order, which followed an emergency appeal from the Trump administration, is not a final ruling on the issue, but will remain in place as litigation proceeds.
Two federal district judges had previously blocked the administration’s ban, finding the move was so unsupported that it could not be sustained even when showing great deference to military leaders. Again — this was NOT a ruling on the merits! All it did was wipe away the “stay” that the lower Court had imposed on the policy. What SCOTUS did here was remove that “stay”. it did NOT make a final ruling on the policy!
The case will presumably proceed. Whoever loses at the lower Court will almost certainly appeal to SCOTUS to rule on the merits.
We can hope that this vote to remove the “stay” will be mirrored once this case gets to SCOTUS on the merits.

The military does things that would be illegal in a civil context, like kill people. It bans other things that would be protected in a civil context.
Military personnel do not have freedom of speech or assembly, instead there is this thing called “mutiny” that can be punishable by jail or death. They cannot just walk away and quit whenever they feel like it, instead there is a thing called “desertion” that can also be punishable by jail or death. They can be ordered to go to foreign countries and go into potentially lethal situations, disobeying those commands can also be punishable by jail or death. The military can remove people who are above their maximum age and deny entry to people below their minimum age. Civil rights don’t apply to the military if they could interfere with military effectiveness.
The military defends freedom, it doesn’t practice it… for good reason.

The Article III courts are intruding simply by issuing this ruling, they have no Subject Matter jurisdiction in this area, it is exclusively the domain of the President’s, and Marbury v Madison doesn’t change that.
The initial litigation should have been dismissed for the reasons described above.
So exactly why are we here then? Millions of dollars are being wasted by these already decided decision that the Supreme Court said that the President is in charge of the executive branch during the immunity case.
As soon as Civil Rights is added and acknowledge as an issue … the Federal Courts DO have a role even in Military and Military Justice related matters.
That is the reason “RIGHTS” are included in ALL the lawfare suits, involving lawfare attacks related to any and all exercises of Constitutionally Granted Powers by the President.
The crappy part is that not single ruling and opinion issued by any of the Federal Courts, addresses the “RIGHTS” issue directly by stating how rights were violated or not violated, which would end theses cases in their tracks .. then the separation or powers issues you describe would prevail.
Thus we see the courts PURPOSELY issuing verdicts and findings with NO Remarks nor opinions that address actual constitutional issues … just like the 1-page decision above … note this 1-page order has not a single word about the law, constitutional issues … that leaves in place ALL the stayed rationale of the lower court and leaves the door wide open to continue, which is a back handed acknowledged that there are RIGHTS involved without saying it.

Didn’t the Supreme Court rule in the presidential immunity case that one person who is elected president is absolutely in charge of the executive branch of the government?
