At 1:00am on Saturday, the Supreme Court of the USA issued an injunction [SEE HERE] blocking President Trump from deporting illegal aliens identified under the Alien Enemies Act. It was/is a bizarre order considering the lower court had not even ruled on the matter; worse yet, the Supreme Court created an imaginary “class” of aliens.
Any illegal alien who happens to also be a gang member, or illegal alien who would ‘smartly’ now claim to be a gang member, is ultimately the beneficiary of a Supreme Court order blocking their removal or deportation. That’s how judicially insane this injunction is.

The Supreme Court bought the argument, created an entire class of deportees under the auspices of gang membership, and blocked President Trump from deporting anyone who might be a gang member, while the illegal aliens argue about their non-gang status.

Go back and look at the video of when President Trump went over to acknowledge SCOTUS after the State of the Union address. Roberts was uptight and tried to act like DJT wasn’t there. In addition to prohibiting foreigners from adopting Irish children, I think Irish law also prohibits so-called private adoptions (human trafficking?). If Roberts is in violation of Irish adoption law(s) this would also place him in violation of the “1993 Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption (or Hague Adoption Convention). This international convention deals with international adoption, child laundering and child trafficking in an effort to protect those involved from the corruption, abuses, and exploitation which sometimes accompanies international adoption.”
I also think that there is a provision in this convention that requires an international adoption to conform to the laws of both the adoptee’s country and the adopter’s country.

If the lower courts have not yet ruled, the Supreme Court does not have a case or controversy to decide yet. SCOTUS lacks jurisdiction. They have to wait for the process to work.
Roberts usually is a stickler for process. He loves finding any excuse to avoid taking important cases. Apparently he will make exceptions in order to undermine Trump.

The law of the alien enemies act is clear and well understood (and strangely has no funding earmarks or other congressional corrupt tricks in it). The law states that the execution under that law can have no judicial review. SCOTUS should strike that law in order to justify their position but I think that would lead to MUCH BIGGER PROBLEMS for them.

Roberts knows that Section 23 of the Alien Enemies Act sets the guardrails on the courts and judges, not on the President.
(1). A local (Federal District) court judge is restrained by the explicit statement that only those aliens “at large” in the judge’s district or apprehended in that district can have the case heard in that judge’s court.
(2). The judge is limited in making the determination of the alien’s status under the statute by the provisions set forth in the President’s Proclamation that invoked the use of the statute.

“conformably to the proclamation or regulations established as aforesaid” means that the judge’s decision, as to whether or not a particular alien is an “Alien Enemy” must be in CONFORMITY with the Proclamation through which the Alien Enemies statute was invoked by the President. Only if it is established that the alien is not in the population of “Alien Enemies” as described in the Proclamation and/or accompanying regulations, can the judge decide the alien does not fall into the “Alien Enemies population. The judge is not to make a decision concerning the Proclamation itself. The judge is also liable for the effects of the decision as in the statement, “or to give sureties for his (the alien’s) good behavior.” In that phrase, the judge is held responsible for the behavior of the alien once the judge decides the alien is not an “Alien Enemy.” “Surety” is a big deal in the law. It is like cosigning a mortgage as “surety” for the payment of the mortgage by the main borrower.
I am quite disheartened that Alito, and even Thomas, clearly hold the position that the SCOTUS is the controlling branch of the government. That is clearly unconstitutional, though it has gone on so long that the deep state has convinced the public (who have mostly not read the Constitution) that this is proper. Senator Kennedy voiced this opinion a couple of days ago. They don’t stop to think about how we can have a government OF The People, BY The People, and FOR The people, if we are ruled by an unelected cabal of arrogant judges.
Neither the Congress or the SCOTUS can override Article II of the Constitution. The Executive is charged with a duty to preserve the Constitution just as are the Congress and the SCOTUS. If the Congress or the SCOTUS violate the Constitution it is the DUTY of the Executive to ignore them and follow the Constitution. If the Congress wants to amend Article II they have the power to pass an amendment and submit it to the states for ratification. If they so choose, the House can impeach the Executive, and have him/her tried in the Senate, and if convicted, removed from office. The SCOTUS has no power over the Executive, whatsoever. The SCOTUS is charged with preserving the Constitution within the Judicial Branch, i.e. overturning lower court decisions. Beyond that, they are out of their lane and must get off of the road. This is how the system was constructed by the Founders.
We must stop letting the SCOTUS act as the final arbiter of everything. That is rule by a cabal, not by The People through their elected representatives. The only ways to do that are for the Congress to impeach Justices, or to create an exception to jurisdiction as they are empowered in Article III, Section 2, Clause 2. The Executive must declare, and defy, as unconstitutional, such decisions by the SCOTUS.
Ultimately, underlying all of this is the imperative of having lawful and secure elections. That is the only way for the People to speak, and ENFORCE, their will.

Clearly the SCOTUS is compromised thanks to Bush with the Robert’s Nomination, and the deep state slipping the Two knuckleheads in which we should have known was all show with the level of resistance the Leftists Terrorists put up against Kavanaugh, and virtually none with Amy Barrett, turns out none of the time she spent with Scalia was useful, she learned nothing.
