Boasberg and the other Leftist district judges are trying as hard as they can to get Trump to do something rash that will give their Democrat allies in Congress the ammo to start pushing for impeachment and give them a narrative to coalesce around so they can have a chance at taking back the House in the mid-terms next year. Agreed. And when the appeal finally goes up, which I hope will be soon, it will be a “clean” appeal with no distracting side issues on contempt orders against Trump and the DOJ. They followed the letter of the law (as they interpreted it) and never disobeyed a judge’s order.
Yes, I think it will. I’m a retired litigator, and while the delays have been frustrating, getting an appealable order is not always easy under the federal rules if the case hasn’t concluded. Of course, these are unique cases that should justify emergency appeals. Roberts and Barrett just said the appeal was premature.
An appeal dismissed as premature can be refiled with a fuller record, and that is what Boasberg is doing. Unfortunately for Boasberg, he hasn’t found a single way to punish Trump yet for the flight, so the record will support Trump.
Trump has argued that a) these were “enemy aliens,” as Venezuela has used gangs for an incursion into the US, that the flight details have to remain secret because the Cabinet determined beforehand that it was, and that an oral temporary restraining order is not enforceable. The law backs him up.

The Congress writes the laws. It levies the taxes to pay for that law enforcement. It can impeach members of the Executive or Judicial branches, for which there is NO APPEAL.
They define the structure of the Courts and decide who sits in the big chairs.
They can write laws that limit the jurisdiction of the courts. They can deny the courts the funds to pay the judges, and they can remove its members for any damned reason they want. There is no appeal.
Congress should restrict the jurisdiction of the lower courts across the board to make exactly this point and solve the problem.
Repeal FISA and it’s star chamber anti-constitutional court and petty tyrants like Biasberg become much less powerful. Without their IC extortion machine, they’re small potatoes.

One is a civil infraction the other is criminal. Big difference.
This is common on every level of judgeship. My colleague was arrested for a DUI In Fairfax, VA back in 2011. My colleagues gf at the time was friends with the top defense attorney in the county. We met with him and he said he could get the charge dropped. But she had to get him some “things“ because the judge was a frequent “partier”.
I won’t go in to too much detail. But suffice it to say, the lawyer told us that he had attended parties with all the judges and attorneys that were as wild or more than the hottest night clubs in DC.
Anyway, he got my colleagues charges reduced to a misdemeanor traffic violation. Which to me was absolutely shocking. But that confirmed for me that what he told me was true…
But THAT is how our justice system works. Scary

I can confirm, from my personal experience of more than 20+ years with lawyers, attorneys general, judges at the local and state levels that they are without a doubt the most corrupt human beings on God’s green earth.
The honest, hard-working attorneys, judges and court clerks are in the minority and I mean maybe two or three at most (over my lifetime, which is far greater than 20 years).
I not only witnessed it, I felt the pain of it and understand how shocking is to wake up to the fact, that after years of believing in the “system” justice is nowhere to be found, (or rarely found) in our country, (at least the part of the country I was raised in, educated in, and live in today).
The judges that I personally knew for a good share of my life, ended up in disastrous life situations at the end of their careers and yes they do, in fact, sexually harrass, at will, their law clerks, their court clerks, their secretaries, and they do punish them if they do not acquiesce to their advances.
Finally, with President Trump, that reality is being exposed for the world to see.

By the end, most of the Judges lacked judicial temperament and restraint, and many were installed hacks who did not belong anywhere near the Bench.
It infected their Courthouses, and the administration became a labyrinth of influence fiefdoms. All the administrators expected ‘favors’ and ‘gifts’ to stay in their good graces as ‘friends’.
It was only slightly better at the federal level, but personal patronage and political influence was still heavy. Many political animals to contend with.
The best judges were the very oldest ones, who had cut their teeth and learned the right way when Truman or Eisenhower was still President. They were the most even-tempered, and understood the limitations of their institution.
The problem with them was keeping them awake, although a few were what could be called “pistols”, in a good way.
And the lawyers had become completely unethical snakes, who craved only money and power. The worst were happy to play the game, and keep the right people well greased with a pittance of what they were making off the system. They thought a Bar admission was a golden ticket to an elite club, and not a professional certificate issued as a public privilege.
A thoroughly distasteful business and profession by the end. It became the ‘injustice’ system for those outside the power webs or who could not afford to pay the toll to those who were, and had turned hard that way at some point in the early to mid 1990s.
