The World Health Organization estimates that (worldwide) there have been 763,740,140 confirmed cases of COVID-19, including 6,908,554 deaths as of April 19, 2023. Unfortunately, “Article 3” is the very-shortest of all. (Clearly: our Founders were not Lawyers.) It says only this:
“The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.”
This simply does not specify under which Branch the “subsequent control” must lie, since the creation and distribution of Courts is in “Article 1.” (Not “3.”) It does not even specify what “the judicial Power” actually is.
Founder(!) Thomas Jefferson reacted with immediate alarm when the Courts, in “deciding” Marbury v. Madison, simply assumed unto themselves(!) the power to declare things “unconstitutional.” Which word appears nowhere in the text. Which power was never contemplated.
“Article 3” also does not specify how many members will sit on this Court. Nor how their number should be determined. Nor any “rules of order” that should apply to them. It says nothing.
But clearly, the Founders never intended for “a Court” – nor its subordinates – to exercise the de facto powers of “a King.” This was Thomas Jefferson’s immediate warning.
If the Founders had intended to allow “a Federal judge in Minnesota (say …)” to exercise the powers of the Presidency “in reverse,” by “ruling” as to what the actual President could not do, they would have very-plainly said so. (And their scheme would have long ago collapsed.)
This would permanently GUT federal district judge lawfare at the national level to overrride POTUS.

It is the President’s duty to see that the laws are faithfully executed, meaning that the departments under him do their jobs correctly, which would give him inherent authority to audit and restructure agencies like USAID. Both judges Nichols and Engelmayer are arrogating executive and legislative functions on policy-making to themselves, triggering a separation-of-powers dispute that the SCOTUS must adjudicate promptly.
What matters most in these cases is that SCOTUS has an opportunity to put up new guardrails against the hijacking of the federal courts for the purpose of lawfare — that is, for political dirty-fighting under color-of-law. The law is slow-moving, arcane, and incomprehensible to most non-lawyer citizens and that is why the Party of Chaos has misused it so liberally.

If “the Judiciary could adjudicate” things like “the separation of powers,” then it would inevitably become the ultimate “power,” holding a golden scepter above the other two branches, thus rendering them impotent and moot. Which is exactly what Thomas Jefferson warned us about. Human society always prefers “a King.”
The error in all of this is the statement, “The DOJ under Pam Bondi can…”
