“Subject to the jurisdiction” is a big clue… tourists and illegals do not qualify. Green card holders would qualify because they take an oath of allegiance to the US.

You need to read the entire opinion of US v Wong Kim Ark to see what it says, implies, and doesn’t say. I think the other side will argue that the US hasn’t tried (until now) to kick these people out (and remember Biden used the asylum provisions to let many foreigners in “legally”) so the illegals are “subject to the jurisdiction”.

Please read Techno Fog’s very well written and properly-sourced article and you will see that the issue is not that “black-or-white” simplistic when you see how the U.S. courts have approached and dealt with it over the past two centuries.
Whether or not you agree with those previous courts’ decisions, you can “go to the bank” that SCOTUS will absolutely take previous court decisions into account (weighted very heavily) if Certiorari is granted and the case gets to their desks.
The 14th Amendment does not distinguish between the legal status of ‘the parents’.

Too hard to summarize — you need to study the opinion for Wong Kim Ark. Nothing in there touches on the question of “legal presence” as regards “subject to the jurisdiction of”. It does make reference to the Civil Rights Act of 1866 and differences in the wording of the act and the subsequent 14th amendment. Seems to me the whole “legal presence” is a new issue that isn’t covered by precedent.
“Subject to the jurisdiction thereof” has historically meant that the person affirmed their primary loyalty was to the US, not to any other country. It is embedded into the first sentence of the oath people take to become Naturalized US Citizens:
“I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen
When this finally gets completely adjudicated by the Supreme Court, or maybe fully codified into law by Congress, that “jurisdiction thereof” might end up limiting the ability for US Citizens to accept dual-citizenship in other countries.
I don’t see that United States v. Wong Kim Ark says anything about being in the country “legally”. There was no question or dispute that the parents of Wong Kim Ark were here legally. The question was about “subject to the jurisdiction thereof”. It is suggestive that anyone domiciled in the US is automatically “subject to the jurisdiction of” but the question of legal presence was not at issue and I think would need to be examined de novo.

I am so happy! On a side note, for some reason Occupy Democrats is coming through on my facebook feed. The latest post was about fauci losing his private security. I kid you not there were over 20,000 comments of pure Trump hatred and how Fauci is a saint who saved millions of lives during covid ! I literally gasped. These people are living in some sort of alternate universe. I just couldn’t believe the vitriol against Trump. It was actually pretty scary. I’ve never seen a facebook post with over 20,000 comments.

Our Constitution says there are two ways to attain citizenship.
One is by the fortuitous circumstance of being a natural born citizen.

Please read Techno Fog’s very well written and properly-sourced article and you will see that the issue is not that “black-or-white” simplistic when you see how the U.S. courts have approached and dealt with it over the past two centuries.
Whether or not you agree with those previous courts’ decisions, you can “go to the bank” that SCOTUS will absolutely take previous court decisions into account (weighted very heavily) if Certiorari is granted and the case gets to their desks.
The 14th Amendment does not distinguish between the legal status of ‘the parents’.

Too hard to summarize — you need to study the opinion for Wong Kim Ark. Nothing in there touches on the question of “legal presence” as regards “subject to the jurisdiction of”. It does make reference to the Civil Rights Act of 1866 and differences in the wording of the act and the subsequent 14th amendment. Seems to me the whole “legal presence” is a new issue that isn’t covered by precedent.
“Subject to the jurisdiction thereof” has historically meant that the person affirmed their primary loyalty was to the US, not to any other country. It is embedded into the first sentence of the oath people take to become Naturalized US Citizens:
“I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen
When this finally gets completely adjudicated by the Supreme Court, or maybe fully codified into law by Congress, that “jurisdiction thereof” might end up limiting the ability for US Citizens to accept dual-citizenship in other countries.

Being in this country legally does not address foreigners who were or are on foreign visas.
These people are still foreigners who may birth equally foreign children.
I don’t see that United States v. Wong Kim Ark says anything about being in the country “legally”. There was no question or dispute that the parents of Wong Kim Ark were here legally. The question was about “subject to the jurisdiction thereof”. It is suggestive that anyone domiciled in the US is automatically “subject to the jurisdiction of” but the question of legal presence was not at issue and I think would need to be examined de novo.
It doesn’t say anything because the parents were granted permanent resident status.
In this case the parents were both legal PERMANENT RESIDENTS of the United States.
