In a letter to Judge Merchan earlier today, New York District Attorney Alvin Bragg is asking for a postponement of sentencing.
Regardless of the corrupt Lawfare trial outcome, the Supreme Court ruling around presidential immunity has thrown a wrench into the former prosecution’s case.
Alvin Bragg used evidence, within the trial, that has been deemed by the Supreme court to be inadmissible. President Trump’s lawyers are filing a motion to overturn the judgement based on the SCOTUS ruling. Bragg now requests additional time to review the Lawfare consequences and construct his own legal strategy.

As pointed out by attorney Jeff Clark – […] “Bragg agrees that Trump has filed a motion to dismiss the New York charges in light of yesterday’s immunity ruling. The Manhattan DA needs until July 24 to respond.
Also, Bragg admits that the legal effect of Trump’s ruling + their requested extension meaning that Trump should not be sentenced in New York until the motion is resolved.
This means that if Bragg gets his extension (which he will), the earliest Judge Merchan could deny a motion to dismiss the case and reset sentencing would be July 25. And that would be only after studying the matter for a single day, which should be insufficient. And doesn’t even consider oral argument on the motion if that gets held.
The Republican Convention is from July 15-18, so Trump will not be sentenced before the Convention!
On balance of all factors, the earliest Trump gets sentenced is realistically now some day in August.
And in reality, the whole case should get tossed before then. (Source)
According to Politico, the sentencing has been delayed until September 18th.

When you look at the issue through a Lawfare prism, things start to take on a different context. Perhaps one of the reasons Bragg is making this request for a delay is that the Lawfare team are now a little overwhelmed.
The SCOTUS immunity ruling means McCord, Weissmann, Eisen et al, have to restructure the strategy and instructions in 4 separate cases, simultaneously, involving Trump and the Supreme Court ruling.
All those legal motions, counter predictive responses, and legal arguments are now needed almost simultaneously. As a result, the Lawfare group needs more time.
The district attorneys (New York / Atlanta) and Special Counsel Jack Smith will not be asking for more time simply because Trump’s legal team are requesting it. The prosecution teams will likely be requesting time on behalf of Weissmann/Eisen et al, to be proactive with a new strategy and Lawfare approach.
In essence, the ever-present *strategic benefit* of scale, the collective Lawfare weight (4 venues) against the individual target Trump, has now become a strategic liability as an outcome of the SCOTUS ruling.
All four venues will need responsiveness simultaneously. Weissmann, Eisen, McCord, Berke, Goldman, etc will now be burning the midnight oil trying to catch up.
I anticipate far fewer appearances on MSNBC cable, because they will not have time.

This judge had to know every one of his decisions against President Trump’s lawyers objections and the way he ran the entire trial was grounds for having the whole thing tossed and he did it anyway.
Moving it to September might be strategic. I didn’t see anything in Merchan’s latest that lifts his remaining gag order still pending on Trump. Merchan did scale back the gag order before the debate, but part of it is still in place. The gag was supposed to go until sentencing. But now sentencing is pushed out to September, “if still necessary.”
Merchan would be in a real bind now if he tried to actually enforce his blatantly unconstitutional gag.
Roberts’ opinion went through situation by situation how much of what they threw against Trump is covered by immunity. They will need to be VERY creative to cook up some justification to keep any of these cases alive.
I suspect they pivot from “hurry! hurry!” mode to get done before election to now “slow! slow!” mode and delay dismissals to milk the “convicted felon” angle as long as they can.
The gag order is the purpose of the extended date. PDJTs team will likely be demanding immediate dismissal of all charges very shortly.

I didn’t follow the case that closely, but I believe someone mentioned in a post some of the evidence would be communications while president with “advisers” that would be covered under absolute immunity. At first I thought this wouldn’t be that applicable to the NY case, but it makes sense because the jury probably considered evidence that can’t be provided as evidence based on the immunity ruling.
Prosecutors cannot cite lawful Presidential Executive Functions as part of persuading a jury regarding supposedly unlawful non-official acts.
Bragg used a laundry list of assertions citing PDJT’s actions while in office, it was an orgy of mud-slinging and slut-shaming flinging defamation at everything they could imagine.
It cannot be unsaid, or parsed, or filtered out, the poison is inherent in the entire cesspool of that prosecution, and it will not stand.

I think this means that this “evidence” is not allowed, even though the case is about unofficial acts.
Once you actually get into Court, the political bastardization of our Legal System (a/k/a ‘Lawfare’) only works if the Court is as corrupt as you are . . . and doesn’t appear to be quite the case yet thanks to the current SCOTUS, which is why the Left is so intent on bastardizing that as well.
After the past four years, I am slow to hope anything good is happening for real. But right now I feel like I have been sawing on a tree trunk for a very long time, my arms are tired, but I just heard a crack from inside the trunk. It’s not falling yet, but I can’t walk away now, because it could crack the rest of the way anytime. I don’t know exactly when, and I don’t know exactly where. The scary part is there is a narrow angle in which it must fall to avoid huge damage. I do know is it is close to happening, and everything I do or don’t do right now could determine the direction it falls.

I think the only way to stop lawfare like this is to do it back to them. I wonder what laws Weissmann, Eisen, McCord, Berke, Goldman, etc. have broken. For one thing, I feel like they have violated my civil rights. Do their efforts count as campaign contributions? Were they properly reported? Did they adhere to all professional legal ethics? Was non-profit money involved? Did everyone pay the proper taxes? Have all financial and employment regulations been followed? Inquiring minds want to know!
Can voters file a class action suit that the law fare folks tried to violate our civil and voting rights by trying to interfere with our favored candidate’s ability to run for office?
What is required is a federal statute making it a crime for a prosecutor to bend and twist the elements of a statute in order to charge someone for a crime when no statute has been passed making it a crime. In addition, the judge sitting on an entire case based on such a statute should also have criminal and civil exposure for allowing it. Some 40 years ago, FBI agents in training had to be able to read and understand the elements of a statute and determine if those elements applied to the matter under investigation. That included NON-LAWYERS taking the training. If an accountant or a former police officer is expected to be able to read statutes, then requiring prosecutors and judges do the same is not unreasonable.
A lot of institutions are violating the “In-Kind” contribution regulations of the Federal Election law. The media’s hiding of Biden’s cognitive problems is one example. Like Bragg accused Trump of “interfering in the election” by trying to hide the Stormy Daniels “Non Disclosure Agreement.” Well, what are the Democratic Party’s Media Auxiliaries doing by hiding Biden’s mental disability with trickery (to use one of Jack Smith’s favorite terms) like “Cheap Fakes,” which all the networks and written media outlets start using at the same time? Those are IN-KIND contributions to the Biden campaign, and they are potentially worth BILLIONS to that campaign. The same with the letter by the 51 intel people about the Hunter laptop. That was an in-kind contribution that was worth a pile of money.
On the other side, FOX News puffs up the GOP and is hostile to Democrats, so a lot their coverage is an in-kind contribution, too.
Media outlets should be exempt from this law as long as they make it plainly clear they are PARTISANS of one kind or another, the way 19th century newspapers would frequently include a party’s name in the names of their papers. CNN would a “Democrat” network. FOX would be a Republican Network. That way everyone knows what is being broadcast is party talking points.
FOX, a Republican Network? Give me a break!
