Can Trump be pardoned by the President for the conviction in NY? Answer: YES. Here’s why: the New York felony charges directly relied on claims that Trump violated federal law. New York prosecuted Trump based on the novel legal theory that he committed a misdemeanor (falsifying business records) “with the intent to commit” another crime, including violations of federal campaign finance law. That means if the alleged federal violation is expunged, the state felony conviction disappears along with it. It’s shocking how far the MSM has gone in the last 24 hours to hide this fact by expressly writing headlines that a pardon is impossible.
It will all be about those nit picky definitions and actual legal text … NO the state of NY did NOT accuse President Trump of violating Federal Election Law.
The State of NY charged him with NY State crimes meant to cover-up Federal Level Crime he “INTENDED to COMMIT”. Granted the “INTENDED CRIMES predicate” gets wiped away on appeal if the NY State Appellate Courts actually allow the testimony barred by Judge Merchant … but “technically” no claim of commission of a Federal Crime was made. The NY Courts are as corrupt as they come but they are not stupid and used the right wording … they had 5+ years and information from other related trials to plan this attack.
One can likely count on the NY Federal District Courts, supported by the Supervisor Justice Sotomayor, to drag their feet on this point as well…discussing terms, text and intent. The process wonk Justice Roberts will demand the discussion as well.

Jovan Hutton Pulitzer has explained this many times. The machines were used to change ballots during adjudication which is lawful. The ballots are the key to proving fraud and the Republicans in every state kept them from doing forensic audits of the ballots in every state except Arizona. Arizona Republicans blocked allowing the results of the audit to be announced by merely stating that the recount matched the total ballots. They did not disclose the thousands of ballots that did not match signatures or were from deceased voters or from non-existent addresses. Jovan still has all of that and says that he has spent over $2 million of his own money to collect and store. He also has the documents where many of the Republican homes mortgages were paid in full shortly after the election. Listen to some of his podcasts.
