A recent appeals court ruling, unrelated to the current year ballot counting, may have an impact within the close Pennsylvania senate primary race between David McCormick and Mehmet Oz. Currently Mehmet Oz is ahead by around 1,000 votes [NYT LINK]
The court ruled that mail-in ballots without a date on the envelope may be counted in the prior election.
“The three-judge panel’s judgment said the state election law’s requirement of a date next to the voter’s signature on the outside of return envelopes was “immaterial.” They said they found no reason to refuse counting the ballots that were set aside in the Nov. 2, 2021, election for common pleas judge in Lehigh County.”
This ruling happens as the current mail-in ballots in PA are being counted. McCormick is slightly winning the mail-in ballot count, so his team quickly sent the ruling out to all Pennsylvania voting districts.

(AP) — A federal court ruled Friday that mail-in ballots without a required date on the return envelope must be allowed in a 2021 Pennsylvania county judge race, a decision that could complicate the ongoing process of vote counting in the state’s neck-and-neck U.S. Senate Republican primary.
Elections officials, lawyers and candidates are scrambling to understand and respond to the 3rd U.S. Circuit Court of Appeals decision, which was issued late in the day without a written opinion laying out its rationale.
It had an immediate effect in Pennsylvania’s too-close-to-call Republican primary contest for U.S. Senate, where counties are still adding up votes in the race between celebrity heart surgeon Dr. Mehmet Oz and former hedge fund executive David McCormick.
McCormick has been doing better than Oz among mail-in ballots and McCormick’s campaign quickly wrote to the state’s 67 counties to advise them of the decision and request a hearing if they won’t count the ballots in question. (read more)

But that date is different than the post marked date, isn’t it? So how many ballots will that really impact and those folks may just as well have voted for Oz or Barnette. I don’t think it will matter much. Plus the mail-ins after Trump’s endorsement of Oz have evened up.
It’s very few ballots….because I’m in PA and my job was to make sure mail-in ballots had dates and signatures on the outside envelope. We saw maybe 5 at our table all morning and we counted hundreds of ballots…..but having said that our county did go for McCormick.

Voting = use of force, the fact that it is government force is irrelevant to the point. Voting is the excruciatingly thin line between “monopoly on the use of force” and “do as thou wilt shall be the whole of the law”. A reliable and trustworthy voting system is as fundamental to a system of government as a functioning non-violent dispute resolution system.

How quickly will vote choices scrawled on the back of a store receipt be accepted? The receipt does have a date on it. I guess it all depends on the store in question and what was purchased. If I understand the court ruling correctly, it’s not that the mail in ballot lacked a post date but that the signed part of the ballot wasn’t dated. Still sketchy, but it doesn’t appear that it’s an attempt at late ballot stuffing. I doubt there’s many of them on the GOP side anyway.
Meanwhile, Allegheny county finally figured out how to remove their stuck memory sticks from the ballot machines. Nothing fishy there at all. 🙄
Hi Magabear. I don’t think Oz believes (knows) that at all re: military ballots of which there probably not too many anyway seeing as how this is a primary. He knows McCormick is just trying to eek some more votes out of where he thinks he has an advantage. Mc Cormick has been running around with his hair on fire implying that he has already won. We haven’t seen the written court ruling yet. May be full of qualifiers…plus I just don’t see how the Feds can get away with trumping state law anyway in the middle of an ongoing election. You can bet that Philadelphia and Bucks county are holding out some precious votes, too, just waiting. And if Allegheny had the winning numbers they would have coughed them up by now. Everyone is digging the rock bottom with their fingernails. Kinda painful.
There are over 1500 military ballots and also civilian overseas ballots yet to be counted and there could be more by the Tuesday cut off to receive those ballots. The McCormick team put in over a million dollars in there military ballot initiative, so that’s why they have some confidence that he’ll do well with them.
Allegheny Co is a lost cause..my permanent residence is in that county.. I run two community FB groups..around 9000 members..they really believe that Biden did not cause i the high gas prices and that 2000 mules is fake news..they love mask mandates and vaccines..the PPS are still wearing masks and going virtual if 20% of staff and students report a positive co vid test result..yep..self reporting..if 8 parents/staff call in a positive test result they close down the school for 3 days..our local elementary school shut down last week..on election day!!!

should– MUST – ignore this.There it is. A very democrat party-like solution to finding votes that should never be counted and thinking they will help one candidate over the other. All the while it’s days now after the Election Day and results are still coming in. The whole system of mail in has lived up to its preceding history as the most corrupt voting policy ever, allowing fraud to be easily committed and then accepted.
It is the biggest criminal event in our history that was uncovered and proven to be severely harming our right to a fair voting process and legitimate elections decided by us. So wrong and the repubs are using it to steal as many votes as they can for whatever candidate they want to push. Huge war going on in the repub party and the GOPe are not going to allow a MAGA candidate to win even if they have to cheat to make sure their guy wins. Disgusting.
