You are correct about the price of medicines. The prices will start to go down as previously signed EOs start to go into effect on Jan1st. I guess there is a statutory time period that has to pass once signed.
But the EO that was a “big deal”(or words to that effect) sounded like something different because Trump didn’t mention what the EO was.

For what it’s worth, I find it interesting that he’s referencing votes being sent to Germany. Recall that it was Sidney, Gen. Flynn, Lin Wood mostly on board with that aspect of things – votes being to sent to Germany, where Rudy and team were separating themselves from that aspect of things.

The latest American Thought Leaders interview of Rick Green presents a very clear path that VP Pence most likely will take to address the election fraud. Highly recommended.

Rick Green, a constitutional scholar, gave a concise and clear explanation of what to expect on Jan. 6. Basically, Mr. Green suggests that Pence can, with clear constitutional authority under Article II of the Constitution as the President of the Senate, decide that evidence of the election irregularities should be heard before Joint Session’s certification of the electors from the 7 cheating states. Pence will at least go that far even if he is a closet-RINO.
After the evidence is presented live to the nation, if Congress remains unwilling to reject the Dem electors from the cheating states, Pence will be in a position under Art. II of the Constitution to reject those unlawful electors. Pence will ignore, with solid constitutional grounds, the 1887 Elector Counting Act with which Congress attempted, unconstitutionally, to limit and take away VP’s constitutional authority under Art. II. SCOTUS has never rendered an opinion on whether the 1887 Act is constitutional. Most likely it is unconstitutional – Gohmert’s law suit is addressing this issue.
At the minimum, Pence’s decision to have the evidence heard before the joint session on Jan. 6 will give both the state legislatures and SCOTUS the time and needed encouragement to act. That will open a number of avenues of clearing the election mess in POTUS’s favor.
The path Mr. Green suggested sets a low bar for Pence in this crisis. He is highly unlikely to refuse taking it. For the first time since Nov. 3, I am convinced that POTUS has a very good chance to serve 2nd term after it is all settled. I also believe that this path is what POTUS and his allies are taking very early on after Nov. 3. Ratcliffe and the acting DOD Secretary are clearly important components of POTUS’s strategy. Jan. 6 will be wild.
A thought just occurred to me. We are obviously focused on the outcome of the presidency as it relates to the electoral college. What happens to all of the down ballot candidates in the contested states?
That right there is one of the evidences of fraud, the anomaly of Biden winning the presidency but the down ballot going to the other party.
The President and Vice President are the only offices the entire nation votes on. The other offices are state and county level and won’t change, or would they? If it’s possible to vote straight ticket, and your vote is switched? Good question.

The OBJECTIONS by Representatives and Senators to cerifying the results, (State legislature, even ONE notifying Congress that after reviewing their election, were denying the Biden electors, and affirming the Trump supporters would help) will give Pence cover to having an airing of the evidence, with America watching.
THATS the “ball game”.
A fair airing of the evidence, with the biggest possible audience, and McConnell will have to relent, pull back into his shell, and release Senators to vote to award electors to Trump.
To do otherwise, is to destroy his own source of Power, permanently.
He won’t do that. So, Pence doesn’t have to be a hero, just “play it straight”. No complicated legal arguments, just follow precedent.
If ONE Senator (minimum) and ONE Representative (minimum) object, they MUST hear the objection.
Given the audience, I can’t see them hearing the evidence in closed session, the deliberations,…maybe, but NOT the presenting of evidence.
I assume the same group from the House that assisted in the Impeachment defence in the Senate, will present the evidence, and will be well briefed.
Anyway, I also believe PDJT knew, early on, that this is what it would come to.

1 Senator + 1 House member under the 1887 Act will give Pence an opening and good excuse to have the evidence heard. But even if no challenge is made, Pence can, with his sole discretion, to have the evidence heard regardless of what the 1887 Act pretends to prescribe.
Here’s my question tho. Assuming an objection (one senator, one rep) – then it goes to “discussion.” Afterwards, if the House and the Senate do not validate the objection by a simple majority (not going to happen) then the original votes MUST be counted. Can Pence still override by not counting the fraudulent electoral votes?
The procedures of the joint session of House/Senate presided over by VP Pence does not allow for debates/questioning/etc other than separate debates by the House and Senate if specific objections are raised. VP Pence has total control of the joint session providing he stays within the established procedures and I can’t see it is wise and/or possible for him to introduce a presentation of evidence of fraudulent voting particularly as the Uniparty will demand the right to reply.
Personally I think VP Pence will not be able to decide to exclude the disputed electoral votes from the count if the House/Senate have already rejected an objection and, in effect, approved the inclusion of the votes in the count. The joint session is not a court of law. No evidence is presented during debates of an objection. Each member has only 5 minutes to state their personal opinion of whether the disputed votes should be included or excluded in the count. Therefore it is, in effect, a “political” opinion/decision and if the joint House/Senate vote for the electoral votes to be included it is far more difficult (or perhaps impossible) for VP Pence to overturn the joint House/Senate vote. If VP Pence’s personal opinion is that a state’s list of electoral votes is not valid, then he should make the decision not to open and present the disputed state’s certification and those electoral votes would not be looked at and counted i.e. there would be no opportunity for House/Senate members to object.
Another way of looking at it. As president of the Senate, VP Pence has to act as reasonably impartially as the circumstances allow. If he considers that a state’s certificate of the list of electors is invalid then he should not even open and and look at it. It may even be a list of Republican electors from a red state. Provided he applies the same criteria in judging every states’ elector list validity, then he has acted impartially.
Constitution says he “shall open all certs” and “shall count them”.
I think the answer is yes. The founders realized that in the case of a contested general election, there had to be one individual who had incontestable plenary power to make a decision.
Otherwise, the election would devolve into an endless, destabilizing disaster.
Will Pence come through for President Trump? I just don’t know.
Would the Turtle blow up his power base and get rid of President Trump, only to retire and be richly rewarded by the CCP? I just don’t know.
The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted.
“Shall and Shall….” I don’t think Pence can do much.

VP Pence is suing the Republicans that want him to decide the vote for certain electors and refuse others. So, I don’t think we can count on Pence.

That law suit is trying to clarify whether or not VP Pence has the un-contestable authority to reject electoral votes himself. At present, the law/constitution is perhaps unclear which, if he is brave enough, gives VP Pence the opportunity to assume he has that authority to reject the electoral votes and for PDJT to be declared President Elect on Jan 6. The Uniparty can go to court after Jan 6 to try to over-turn VP Pence’s decision ….. but so what?
In a similar situation, Dem’s use a “winning” strategy to take every advantage of ambiguities in the law/constitution and then to spend months afterwards to argue about it later if challenged … by then any challenges are too late on a “what difference does it make now” basis. An example, although not a Dem, Kemp as Gov of Ga has certified the electoral list even though it does not comply with Ga’s law ….. and Kemp will almost certainly get away with it unless VP Pence is brave enough to refuse to count the Ga list of electoral votes.

The lawsuit also has a few other goals.
First, should no candidate get more than 50% of the number of electors. The electoral law is in conflict with the Constitution. The law sends the Presidential vote to the house where individually the representatives vote. The Constitution says the house is to vote by state with one vote per state (Gohmert’s position).
Next, there is a conflict in how objections are to be handled. This one mostly boils down to the law defaulting to the slate certified by the state’s executive branch versus the Constitution noting that the state’s legislative branch decides which should count. The conflict potential is that if the executive and legislative branch from a state both send a slate Gohmert’s position is that it would be the legislative slate that should count.
There’s a couple of other nuances in the lawsuit as well; but, these 2 are quite important in addition to the one most are focused on (VP) and could easily affect the outcome as well.
A lot of this also presumes that multiple slates for some state will be presented at the joint session – something I’m not yet confident will occur. But, that could be another “objection” point for the members of Congress.

If Pence’s position is that the VP’s role is ceremonial, then it would also imply that he should be required to open, read, and count all slates received from a state. This interpretation has multiple possibilities – many of which would hinge on the other points noted above.

A fascinating point ….. if VP Pence refuses to include disputed states’ electoral votes then it becomes:-
for President ….. PDJT 232 votes : Biden 222 votes
for Vice President ….. VP Pence 232 votes : Harris 222 votes.
As no-one reaches 270 votes then the 12th Amendment applies and it requires a contingent election to elect the President and the Vice President. As described in many recent posts, the contigent election for President is held by the House with one vote for each state … high probability PDJT is elected because there are more Repub than Dem states represented in the House. However a quorum is required for voting to take place therefore it may be difficult to carry out a vote if enough Dems and RINOs refuse to attend the House.
However it appears no-one is mentioning that the contingent election for the VP is held in the Senate with each member having one vote. If some RINOs want to be difficult they could vote for Harris i.e. it is entirely possible that PDJT would be President and Harris would be VP. Also it is required that a candidate for VP receives 51 votes in the Senate to be elected. If there are abstentions etc then it may take several rounds of voting before that 51 figure is reached.

A question for our legal branch: “as delivered to the President of the Senate”

With multiple appointed electors submitted for multiple states, do they all count in the “appointed” “as delivered” when determining the “majority?” Could that bump it from 270 to well over 300?
There are no multiple valid lists of electors for a state. To be valid, a list has to be certified by the Governor of a state and sent to the president of the Senate and the Archivist. Those lists that have been sent by, for example, a group Republicans would not be valid and would not be opened by the president of the Senate and would not be counted in the total.
However, in some of the disputed states, e.g. Ga, Governor Kemp did not have the authority to certify and send a list that had not been approved by the state legislature. If, at this very late stage, Ga’s legislature were to meet and approve a list it may be possible to decertify Kemp’s list and submit their own as the sole list for Ga that would be opened by the president of the Senate..
This is the flip side of rejecting both elector slates in contested states, that is, to count both elector slates in contested states.
Instead of subtracting both, you add both. A Trump victory results in both counts.
