Hennepin County Judge Peter Cahill reinstated third-degree murder charges against Minneapolis police officer Derek Chauvin on the third day of jury selection. The trial now includes a set of charges against Chauvin more favorable to the prosecution who may not be able to prove second-degree murder and/or possibly second-degree manslaughter.
Meanwhile the political activists are using the opportunity of the trial to take control over a portion of the city where even the police will no longer patrol. The leftists have created an autonomous zone, a no-go zone, near the site of the George Floyd memorial. (Video Report Below):

I am mystified how, under the concept of “due process” in a criminal case, a judge can throw out a charge in October, and reinstate that charge while jury selection is underway and not continue the trial date to allow the defense to prepare to defend on that new charge.

Judge Cahill threw out 3rd degree, the prosecution appealed and prevailed in their appeal (Appeals court said Cahill had erred). The defense appealed the Appeals Court decision to the MN Supreme Court – which declined to take it up. So Cahill is bound by the appeals court’s overturning of his initial tossing of 3rd degree. Cahill didn’t wan to allow 3rd degree but now he’s forced to.

The real issue is that Floyd clearly died of a massive fentanyl overdose. Whatever you think of Chauvin and the neck restraint is irrelevant.
The key to the case is in the expert medical evidence and the testimony of the doctor who performed the PM . The types and levels of chemicals within the deceased ‘s bloodstream have a period of activation, we can see on video ( this might have come from a cop cam ) and its only a millisecond where the deceased appears to ingest white tablets, whilst sat in the front of a vehicle. Time stamp that and cross relate it to the choke hold sequence of 8 minutes.
It is critical to establish that the point of causation actually started before the choke hold.
It is also critical to establish the choke hold was performed in accordance with police regulations.
The reinstatement of the third degree murder charge at the last minute is without any justification.
The autopsy showed that his lungs were edematous and full of fluid and weighed 2 to three time steering normal weight. This is a symptom of fentanyl overdose. That’s why he couldn’t breathe. We don’t know when he took the fentanyl but admitted to officers that he had been “hooping”, or inserting drugs anally. He was also foaming at the mouth, another symptom of fentanyl overdose. There was no “choke hold” used in the Floyd incident. The officer used a legitimate and commonly employed method of restraint called “neck restraint.” In fact the Minneapolis PD trading manual included the technique of neck restraint, as do many other PDs (or at least they did before the Floyd incident).
The officer is NOT kneeling on the subjects neck. The officer is fairly balanced while half-kneeling and, keeping his foot on the ground for support, lowers one knee onto the subjects neck but does not apply much pressure unless the subject attempts to rise up. Veteran officers know this technique and use it on occasion when an unruly detainee must be restrained. By keeping the detainees head on the ground and his arms behind him, it makes it more difficult for the detainee to execute a sudden move to overwhelm the officers.

George Floyd … a low life thug made into a hero by Marxist thugs, that committed negligent suicide … was basically walking dead from all the drugs he took when apprehended by police. The police were in a lose/lose situation … they couldn’t get him into a vehicle because he was so resistant to the notion, so even if they knew he needed to get to a hospital, they couldn’t overcome his resistance and if they just stood by and waited him out, he would have died and they would have been accused of denying him medical aid.

Discovery ok. We know the Minneapolis PD training manual has written instructions, accompanied by illustrations, for the knee-on-neck constraint. No way evidence of this documented procedure won’t make it in. Autopsy is also favorable to the defense.
But the primary driver in my view is jury selection. I happened to catch the defense attorney questioning a male juror candidate. The guy said the bystander video of the knee-on-neck incident reminded him of the occupiers in WWII. He was very favorable toward BLM. There were many, many other red flags. The defense was very skilled, professional and cordial – and rejected the candidate.
Guess what? The prosecution jumped right up and objected saying the defense objection was based on RACE! The judge took a couple moments then ruled the defense rejection would stand. Judge cited a half a dozen of the defense issues and also reminded the prosecution that the six jurors selected so far were a balance of races.
You know that RACE objection will be picked up a repeated as a major thematic story. As for me, the video didn’t show the juror candidate, and I didn’t pick up a Hispanic accent, so the whole maneuver was a surprise.

I don’t know how the prosecutors can prove that Chauvin’s actions were “eminently dangerous” to others when his actions were not even eminently dangerous to Floyd?
As we know Chauvin was acting by the book by using the knee restraint to hold Floyd on the ground so as to prevent Floyd from injuring himself while he was in a state of excited delirium.
We also know that the autopsy did not find any life threatening injuries but it did find lethal levels of fentanyl.
Based on the facts Chauvin clearly did not contribute to Floyds death. Floyd is the only person responsible for his death. Given these facts how could Chauvin’s actions be considered “eminently dangerous to others”.
In the Noor case 3rd degree charges made sense because Noor’s reckless discharge of his firearm threatened his partner and other bystanders. I don’t know why this judge re-imposed 3rd degree charges. I suppose he wanted to give the prosecution a little victory perhaps in the hopes of calming the mob.
I look at the reinstatement of the charge as a consequence of recognition that the more severe charges were already greatly over-charged and likely to fail so adding a weaker charge makes a conviction more likely.
Call it a preemptive do-over.
The charge was reinstated at the order of the appellate court. The trial judge still disputes their opinion.

It cannot be known whether Floyd would have died of an overdose without any knee on the neck or would have died from the knee on the neck if he hadn’t had any drugs in his system. The more demonstrable accusation is that Chauvin showed a wanton disregard for whether his actions were endangering Floyd’s life. That seems to have been the case. That’s why he’ll be convicted of 3rd degree, which in MN is described as evidencing reckless (or wanton) disregard for his actions. That’s why the defense didn’t want the 3rd degree murder charge to be leveled. It’s the only provable charge.

After Floyd had been cuffed (bound at the legs, too?) and especially after he’d been motionless for a couple of minutes, it was inhumane for Chauvin to keep kneeling on him and not check on whether he was even still alive. The Minneapolis PD training doesn’t relieve a person of the obligation to use common sense and retain some semblance of humanity. Floyd may well have died of a fentanyl overdose within a minute or so of being on the ground. Chauvin was stupid to keep kneeling on him, not only because he may have been unnecessarily increasing the risk to Floyd but also because he created a murder charge for himself that probably wouldn’t have been charged if he’d gotten off of Floyd after a minute or two.
He was still alive when he was put in ambulance. Nothing would have change. He would have been charges with something no matter what. Just like the Brown matter Floyd is the prop.
They were in the process of trying to apply leg restraints when the ambulance arrived. It was complicated by his kicking.

It’s very possible that he had applied little to NO pressure on the neck, something by standers could not see or “feel.”
Why put the knee there, then? To keep the prisoner/patient (the cop knew he was in a drugged and dangerous state, you can be sure), from thrashing around, something that could have hurt both of them.

I have a hard time actually defending the man, I was angry and horrified to begin with my own self, but he was indeed following a technique that is commonly prescribed for those enduring excited delirium. That and similar practices are being given a hard look across the land now, and I hope that effective methods can be devised that don’t invite worse outcomes for all parties.
The length of the hold technically does not appear to be prescribed, though I agree it wasn’t pretty, and more attention to his condition as the wait for medical attention dragged on seems to have been clearly called for. The imperative to control does not obviate compassion.
The apparent callousness of Chauvin and those around him surely won’t do him any good with the jury deliberations to come.
Yoy do not cut off circulation having pressure on the side of your neck. The intent is to keep him from moving his head. Try to see how much you can resist and twist and turn when you cannot move your head. Sorry, but the lesson is you should not do more drugs than your body can handle and then try pass fake twenties. If you do you should follow police commands. He was stoned out of his mind. Whatever happened to personal responsibility?

First step is easy, you should move away from blue cities and blue states. Don’t come to a red one and forget why you came. A lot of us are starting to feel like cornered animals. We won’t be any easier to get along with either once it all goes south (pun intended).
Second step is to stop supporting local Law Enforcement. I don’t mean in the red areas but in the blue yes stop. Treat them with the harshness the left does (figuratively). Of course I don’t mean any of that physically or verbally but stop encouraging them. If you are a good cop in those cities sorry about your luck if you want to stay. You should come to red areas and be a good cop. Let them recruit antifa and blm for places that deserve it. I have no more patience for the “there are good people who need help.” crap any longer.
Citizens and cops you can stay if you want but nobody is coming to save you if it gets rough. Minneapolis, Seattle, Portland, etc, etc need to feel the touch of the Devil they let loose. I live in a red state and cashiers examine $20’s all the time. It’s their loss if they accept a counterfeit. They actually have infrared scanners that takes just seconds to determine if fake. If they call the police it is probably what they were told to do, i.e., following the boss’s orders.

Sorry to say, but the trial MUST result in a conviction to (please, oh pretty please, with sugar on it) keep the peace in Minnesota and around the country. Acquittal is a sure trigger.
Chauvin is a sacrifice, but the riots will happen any way. Mob culture wins. At least Chauvin can ask for protection while in custody.
We’ve all been lied to about NO-GO Zones in European cities for decades. Now we clearly have our own. Although they took it over long ago, sleeping on our sidewalks with all their trash and so forth, with ZERO enforcement of any kind. Next thing you know they will just walk into your home and tell you to get out or die.
As to the person who died, heartbreaking, and I can totally relate. My loved one died in a situation like that. A gunshot wound almost exactly like Steve Scalise’s and on a day much like it as well. Except in our case the property had to be secured before the ambulance could get in and they bled out while waiting. That was during the gang wars of the 1990s.
These are gang wars as well, we are just too STUPID to call it that. It’s all about the turf and the territory. We are a third world country, with this and our election system, and our open door borders.
