Booker is up for re-election. He is on the Senate Judiciary Committee. He is about to have the opportunity to make an idiot of himself again (while defaming Spartacus) just before the election.

Booker’s opponent, Rik Mehta, should be so grateful that the good people of New Jersey will get another dose of what a cringe-worthy idiot is representing their state in the senate.

Whether Trump or Obama nominate or not, it still remains the legal prerogative of the Senate majority leader to bring it to a vote or not.

When, in the past, the Senate and Pres’ were of opposing parties, a scotus justice has never been confirmed in last year of a President term – according to what I read yesterday.

This time the Senate and Pres’ are of the same party. Tough toenails. Enjoy the sandwich.

Besides, after what the Dems did to Bork and Clarence Thomas and Kavanaugh, I feel no remorse.

Decency, politeness, propriety, fairness……a fools errand when dealing with these Dem’ gutter carp. The lipstick isn’t going to work. They’re radical animals out of control, without a trace of conscience or civility.

Haven’t seen this kind of “virtue signaling” from them in forever. Hilarious audacity, belongs on Saturday Night Live.

This, from a Dem’ party that has recently publicly stated that they, once back in power, will also end the filibuster rule for just regular legislation? Really? Can you say “dictatorship”? And now they want “fairness”?

Any country boy knows that white wash don’t stick to no dirt.

Practically speaking, “The lady doth protest (peacefully this time) too much, methinks.”

The extreme, other-worldly bewailings on the Left about Ginsburg’s passing, lead me to more than suspect John Roberts in a cabal to throw the election.

(Honestly, they appear more angry than mourning of her. Isn’t that odd?)

Afterall, the court was 5 – 4 before her passing. Think about it. Duly connect dots.

Just the suspicion is damning enough to replace Ginsburg NOW, and neutralize Roberts. The stakes are too high. Mortally.

Never forget – Remember Robert’s Obamacare deciding vote? And his twisted, tortured reasoning about a direct tax? (Huh?)

He needs to retire, move to Ireland with his adopted Irish children and salvage any ashes of his self respect.

But, say, Trump nominates Judge Sullivan (Flynn case). Well, Antifa/BLM would lay down their molotovs, their rocks, their pepper sprays and guns, and there’d be dancing in the streets of Portland. Maybe if he had a mask to match his black robe, John Roberts could join them.

There is no hypocrisy in Mitch’s bringing Trump’s nominee to a vote but not Obama’s last nominee. It’s a matter of politics, and there is no inconsistency. The GOP controlled the Senate then and it does so now. “But you didn’t bring Garland up for a vote! Inconsistency! Hypocrisy!” is a dog that won’t hunt. There is no legal duty here but only politics. Mitch can bring to a vote, or not. That’s the rules. His choice.

    Politics ain’t beanbag.

She knew she was going to die and she did not want to be replaced by O’bama. Then, like every other Democrat leftist, she was disappointed by Hillary when Trump interrupted their fever dreams of Utopia. The funny part is she would oppose Trump’s pick, because the woman doesn’t think right.

        Correct.

Now factor in her pledge to step down when she could no longer fulfill the role of Supreme Court Jurist.

        Which, she didn’t fulfill!

Her dying wish to hold her seat open could, and should, have been a resignation letter.

But she NEVER wanted to resign.

Seems to me she also hoped to linger on her death bed, thereby preventing any appointment to fill her seat for who knows how long.

However, she passed quickly after her death bed missive, so her plot to keep the seat open through the election was foiled, and her fall back “dying wish” came into play.

        Despicable!

Either her death bed missive is a fabrication, or it was part of the plan to cause more outrage. If her docs had been honest with her, they would have told her in July that she would most likely not make it to the election. Being hospitalized less than a week after her procedure to clear the stent, clearly meant that it didn’t work. Pretty much a death knell.

        Poor RBG (RIP).

She thought that mentioning to a relative her wish to postpone her replacement until the next president was inaugurated would be viewed by PDJT as a moral obligation.

After so many years as a SCOTUS Justice, her rabid leftism made her think that her wish was tantamount to a legal testament. However, POTUS’ main responsibility is to adhere to the constitution, not to abide by the wish of a dead justice who thought she had the right to enforce it after death.

Anyway, there is no hypocrisy because in the last case, there was a divided government (Dems controlled Presidency, Republicans controlled Senate). Thus, there was no clear-cut will of the people–the two entities responsible for the appointment were on different sides of the aisles. Now, there is not a divided government — the will of the people is clear in terms of to whom they have given authority.

Actually, if the confirmation hearing is NOT to DEM’s liking, they COULD blame Bill Clinton, who nominated Ruth Ginsburg, who in turn REFUSED during her own confirmation hearing, to answer questions that might come before her as a Supreme Court Justice, including regarding abortion.

Joe Biden was in charge of Senate Judiciary Committee when Ruth Ginsburg refused to answer questions during HER confirmation.

Biden “stipulated that she had no obligation to answer questions about her personal views or on issues that might come before the Court.”

This became known as “the Ginsburg Rule” which CLEARLY was established by DEMOCRATS in the first place.

He may very well be a wet noodle jurist in real life and the fact that most Pub-nominated justices are less predictable speaks to them actually evaluating the law…. but some of the contortions he has had to go through to justify his “opinion” on key cases, versus previous ones in his career, versus the more clear-eyed analyses he provides on “lesser” cases, and the brevity the ridiculous ones come with, speak volumes to what is actually going on.

The answer is easy. Put up and vote in a conservative constitutionalist jurist for the Supreme Court. End of discussion.

        Liked by 5 people

      • WRB says:

        the Biden/SCOTUS doctrine

These are not “doctrines” or “rules,” rather they are pronouncements by the party in power on what they intend to do, and reflect how far they can go, politically speaking.

For example, the party in power announces they will not confirm a nominee in the last year of a President’s term. They do so because they think the voters will not punish them in the coming election, because they believe their excuses will convince enough voters that they are “doing the right thing.” Contrast with the majority party announcing they will not consider any nominee by the President, and hold the seat open until the President leaves office, either four or eight years hence. Politically, that would be suicide. (If it were not, they would do it in a heart beat.)

Anyway, the long and short of it is we are seeing an exercise in political power, and the losing side is arguing as hard as possible that the other side has “gone too far.” The next election decides who did or did not go too far.

P.S. The repubs should exercise their power, as it was given to them by the voters for just this purpose. Those “repubs” that refuse to support their voters should be punished.

Do you realize how significant this is

the NSA Director stops contractor access to the database 7 months prior to the 2016 election, after identifying:

      • unauthorized searches
      • searches beyond the query audit system
      • unsupervised private entities accessing the database
      • memorandum allowing the FBI to give access to individuals unbeknown to the NSA and FISA Court

During the time period of contractor access cutoff we have the following:

      • Contractor (Fusion GPS) CEO’s wife visits the White House (day after contractor access cut off)

      • At least 1 FISA is denied ( of the thousands submitted to the court less than 20 have been denied)

      • Hillary Clinton Email “matter” is closed

      • Anthony Weiner Laptop is found during an NYPD warrant for Child Sex Crimes (online activity with underage female)

      • Hillary Clinton Email “matter” re-opened, due to Weiner Laptop illegally syncing emails with his wife’s computer (Human Abedin – Assistant to Hillary Clinton)

      • FBI announced hundreds of thousands email of Hillary Clinton found on Weiner laptop. To many to review in a timely manner.

      • FBI announced miracle tool that allowed review in days of emails. Says all emails okay, and the matter can be closed.

      • Hillary Clinton Email “matter” closed

      • Government pays Western Assets to lure Carter Page and Page in separate situations overseas, and records the conversations that create the appearance of Russian collusion

      • To this day – No formal Western Intelligence products have been identified as supporting or provided to the US regarding the Trump Campaign and Russia Collusion

      • FBI gets a Wiretap on a Trump Campaign member (Carter Page) gaining complete surveillance of Presidential Candidate Trump and his Wife and Children due to the 2-Hop surveillance authority of a FISA.

      • Donald J. Trump wins the Presidency of the United States

      • Lame Duck Period from election to inauguration of the next president – President Obama kicks Russians out of the country

      • Incoming National Security Director is contacted by Russian Ambassador to understand the kicking out of their diplomats. He is informed to equally retaliate, but to not escalate.

      • This conversation is used to removed General Flynn from the WhiteHouse and has resulted in a 4 year trial that has cost him his home, and the possible threatening of his son (We have still not see the Rosenstein 2nd Scope Memo in October for Mueller Special Counsel)

      • SSCI makes joint statement they have no evidence the President was wiretapped

      • Next day, request review of the wiretap of the President (03/03/17) the FISA on Carter Pages with 2-Hop authority to surveil 2 levels of contact from ever Carter Page Contact.

      • SSCI republicans leave the country as SSCI Vice Chairman reviews the 03/03/17 FISC clerk stamps Carter Page FISA (Wiretap of the President via 2-Hop authority)

      • the SSCI requested FISA is leaked to a Buzzfeed Reporter

      • Buzzfeed publishes the content, CNN reports Buzzfeed published it, The media starts the Russia, Russia Russia narrative.

      • This narrative evolved into Congress and the Senate doing the “moral thing” and appointed a Special Prosecutor to look into “Russia Collusion”

      • Special Counsel attacks the entire staff and family of President Trump

      • Special Prosecutor finds $75,000 Facebook ads purchased by a Russian Company

      • He indicts them and allows the media to frame this as “Russia Hacked the election” conflating this with the DNC hack (that again, the FBI never reviewed – instead a Ukrainian Contractor called Crowdstrike did – that you’ll see later the President gets impeached for bringing this company’s name up)

      • The indicted Russians ask for a trial to demonstrate they only bought ads. Special Prosecutor declines and case is never brought forward (however, the narrative of Russia hacked the election is set in the media, and keep in mind this was all done on days the President was overseas trying to secure peace with North Korea)

      • Ultimately, the FISC court finds all 4 FISAs on Carter Page lacked candor (2 were renewed under the Special Counsel)

      • FBI lawyer pleads guilty to falsifying documents provided to the FISA court that granted the Carter Page FISA renewal

      • At the close up of the Mueller Probe, his entire team “accidentally” put their phones into airplane mode and attempt the pass code 10 times that results in a reset to default (clearing the data).

      • The Steele Dossier is identified as the sole source of the FISA ( and the primary sub source is interviewed and tells the FBI he cannot corroborate any of the information attributed to him within the Dossier)

      • The primary sub source is identified as a co-worker and friend of Fiona Hill via Brookings Institute (Russian expert with the State Department that testified against the President in the Ukraine Impeachment). Later we find out Shearer with Brookings is the other avenue the Dossier gets into the government and media talk stream.

      • Oh yes, forgot about that, the House of Representatives – impeached the President of the United States for calling the Ukrainian President after he won his election, and also mentioning an oligarch, a server, and a company called Crowdstrike.

      • Crowdstrike was the company that investigated the ‘DNC Hack” (shocking right? the FBI never reviewed the DNC and instead took the word of a contracted [remember contractor access to NSA database? via Comey Memorandum – unknown to NSA and FISA court? good])

      • Prosecutor Durham was appointed during this time – evolves into a Criminal Inquiry

      • Currently the FBI and DOJ appear to be cooperating in the Crime Victims Rights Act holding unauthorized data obtained on Carter for Litigation

I want a constitutional convention, and Trump needs to get in and agree that no more will be passed or budgets, NOTHING, until we have a reconciliation to try and permanently shitcan the corruption that has rotted us to the core.

No amount of rules reviews or “reform” will do, at this point. We’ve been brought to the brink of civil war by allowing the aristocracy to run roughshod over us all, as long as we got a few scraps and times were good.

It has to end. I think if the GOP was open about it and agreed to convene some radical new rules that restrict government forever, a lot more people would rally to our cause.

Was the first FISA warrant on President Trump’s campaign in 2016 modified? Who in the FISCR appeals process modified the FISA warrant on President Trump’s campaign in June 2016?

FOREIGN INTELLIGENCE SURVEILLANCE COURT OF REVIEW (FISCR) — 3 JUDGES, their regular Judicial District Court assignments, and Terms of FISC assignment

If an application is denied by one judge of the court, the federal government is not allowed to make the same application to a different judge of the court, but may appeal to the United States Foreign Intelligence Surveillance Court of Review.

Such appeals are rare: the first appeal from the FISC to the Court of Review was made in 2002 (In re Sealed Case No. 02-001), 24 years after the founding of the court.

Also rare is for FISA warrant requests to be turned down. During the 25 years from 1979 to 2004, 18,742 warrants were granted, while only four were rejected.

Fewer than 200 requests had to be modified before being accepted, almost all of them in 2003 and 2004.

The four rejected requests were all from 2003, and all four were partially granted after being submitted for reconsideration by the government. Of the requests that had to be modified, few were before the year 2000.

During the next eight years, from 2004 to 2012, there were over 15,100 additional warrants granted, and another seven being rejected.

Over the entire 33-year period, the FISA court granted 33,942 warrants, with only 12 denials – a rejection rate of 0.03 percent of the total requests. This does not include the number of warrants that were modified by the FISA court.

Covid Crisis Opens a Schools Voucher Moment for Trump
Editorial of The New York Sun | September 19, 2020

Never let a crisis go to waste, it’s said. The crisis that beckons at the moment is that which the Covid pandemic has precipitated in our public schools. It is laying bare how our K-12 education serves teachers unions more than their customers, meaning parents. Could this be a moment for President Trump to launch a national schools voucher for parents scrambling to get their children back to school — and corner Joe Biden?

How and when did the FISA warrant on the Trump campaign move from Judge William Curtis (FISCR) Bryson to Judge Rudolph Contreras(FISA) for final approval?

In May 19, 2016 Judge Rudolph Contreras was appointed to the FISA court by Obama and Roberts. Then in June of 2016 a non-partisan FISA court committee turned down a wiretap on Prsident Trump’s campaign

The case then went to a three man appeals court(FISCR) headed by William Curtis Bryson which just happen to be all be Clinton appointed judges.

What follows are extracts from their procedures manual of the FISCR.
    court.
The review is expected to be done by the full court consisting of three judges but what the hay, they can just ignore the requirement and use one judge. If this is too much for them, they can just ignore all the rules and go directly to the verdict.

    Rule 2. Suspension of Rules.
On its own or a party’s motion, the Court may-to expedite its decision or for
other good cause-suspend any provision of these rules in a particular case and
    order proceedings as it directs.

    (3) A motion under Rule 6(b) must be filed with the Clerk and normally
will be considered by all members of the FISCR. But in an
exceptional case in which time requirements make that procedure
impracticable, the motion may be made to and considered by a single
    FISCR judge.

    Rule 6. Stay Pending Appeal.
    (a) Initial Motion in the FISC. A party must ordinarily first move in the FISC
    for the following relief:
    (1) a stay of a FISC order pending appeal; or
    (2) an order suspending, modifying, restoring, or granting an injunction
    while an appeal is pending.
(b)Motion in the Court of Appeals. A motion for relief described in Rule 6(a)
may be made to the FISCR.

This would be great, if it were validated. The author badly needs to provide confirmations.

But here’s the thing. Up until July 11, 2016, all direct contact was with George Papadopoulos through Mifsud and Downer. Carter Page did not personally meet Halper until July 11, 2016 at the July 2016 Cambridge symposium.

If there was a June and/or July 2016 FISA Application, it’s pretty certain that Papadopoulos was in it.

The first was a hodgepodge of unofficial foreign intelligence with Papadopoulos information mixed in. It was denied by the FISA Judge.

The FISA Judge asked the FBI to narrow their focus and present a second FISA Application. The FBI presented another FISA Application centered around Papadopoulos but their “evidence” was so weak the FISA Judge denied them a second time.

Papadopoulos ultimately proved useless to the FBI in obtaining a FISA Warrant. But he served perfectly as a stop-gap measure allowing the FBI to open their Counterintelligence Investigation while they set their sights on Carter Page.

Hey Sherri! While the FISC judges serve 7-yr terms which puts the 2017 time frame solidly within Obama’s administration, Obama does not pick appoint the judges to FISC, Chief Justice Roberts does.

He can pick/appoint any judge from the entire pool of federal district court judges, which would at that time and the preceding 7 years would include many judges still from the Reagan, Bush, Clinton, and Bush II administrations.

So to have all of them in 2017 be only Obama appointed district judges to be then appointed by Roberts to FISC would seem to indeed be ‘packing the FISA’ court.

Matter of fact, the latest FISC judge that was appointed this year, Liam O’Grady, is from the Bush II administration.

This morning I was coming back from my morning walk and saw a man pulled over by our neighbor’s driveway picking up a lawnmower they were throwing away. Went over to talk to him and he had a Trump hat on. He stated that he picks up old lawnmowers and gives them to the Amish who take the engines and use them to power their equipment. He is a big Trump supporter because of the economy. He is retired military police and his wife is still working; both their retirement funds are doing well despite covid-19, thanks to President Trump economic policies.

We then talked about the Amish supporting President Trump. This gentlemen then told me about a big Trump parade on Rt. 4 yesterday. The State Highway Patrol was there to make sure everything went well. Rt. 4 is located in farm country so all the farmers got together and had a parade.

Then went to our small country church down the road from where we live; all Trump supporters. After that stopped at a yard sale and met a man with a Trump hat on; great conversation. All these people were very passionate for President Trump.

So, it has been a good day here in Delaware County, Ohio. GOD is still on the throne, clear skies, church open, yard sales, enough to eat and surrounded by Trump supporters, except for our next door neighbors. Oh well, can’t have everything.

You are posting good news, but it is not surprising.

      Ohio 2016 numbers:
Republican 2,841,005 51.69% Donald John Trump, Sr.
      Democratic 2,394,164 43.56% Hillary Clinton

In other words POTUS won OH by 8+ points, and I expect him to win by a larger margin in 2020. And as long as I am prognosticating, POTUS won FL by 1.3% in 2016, and I expect him to win by 3+ % in 2020.

    CTH Friends,

You know I was thinking about it today, it is really strange when people transition at the most interesting points in time (no my tinfoil hat is in the corner, I promise = ).

JRBG has transitioned at a time of crises in our nation, and her departure would make it extremely hard for SCOTUS to rule on a challenged Presidential election.

Madelyn Lee Dunham (Barry’s grandmother; Stanley’s mom) transitioned just as he was assuming office in his first term. Based on the questioning of Bubba’s mother after he went into office, Ms. Dunham’s passing was very fortuitous as to making sure there was no slippage of information as was the case with Mrs. Clinton.

Then there are such notable passings as :

    1. Secretary Ron Brown

    2. Justice Scalia

    3. Mr. Vincent Foster, Esq.

    4. the DC Madam

And the list goes on and on and on…

    Strange indeed on the timing.

    Best,

We have to assume that if the Democrats hold Congress and pick up even 2 in the senate, impeachment after impeachment will begin should President Trump win the election. We know know all the dirty tricks, outright lies, and criminality that ALREADY exists – there will be NOTHING stopping them. I have ZERO faith anybody aside from a full on civil revolt will stop them.

  39. As I predicted yesterday, the passing of Ruth Bader Ginsburg, and the process to fill her open SCOTUS seat HAS kicked off political battles that WILL drive more voters to the polls on Nov 3rd.

    See this craziness:

    LOL. THAT’S A BLUFF

Joe CAN’T “Pack the Court” in 2021 IF President Trump is re-elected

Does anyone know if the BLM/ANTIFA terrorists are moving to hit and runs. I’m in Orlando and keep hearing sirens so I looked up the calls to see what is going on and there are 14 car crash calls, all within a few minutes of each other and quite a few of them are hit and runs. All different areas too.

I have been noticing lots of “accidental” deaths in the past few months – I feel like there are some mentally ill people out there who wish anyone dead who may be a Trump Supporter so there is a good possibility this is happening –

Today there was a Trump car parade in Texas where a couple stopped at a convenience store for drinks – they were pulling a trailer with Trump flags/signs on it – someone pulled the pin on their trailer hitch and after they started driving their trailer fishtailed and almost killed them – things like this continue to happen and I feel like it will get worse –

Maybe the MAGA supporters should get military gear, ‘assault sticks’ and actually threaten people within 15 feet of the voting station, which is proven by the DOJ/FBI to NOT BE intimidation.

“Team Obama Turns Blind Eye to Voter Intimidation
      By Deroy Murdock – July 12, 2010

Voters at a precinct on Philadelphia’s Fairmont Street witnessed unusual sights and sounds on Election Day Nov. 4, 2008. Two members of the New Black Panther Party, King Samir Shabazz and Jerry Jackson, stood within 15 feet of this polling station dressed in military-style black jackets, black berets and black combat boots. King Samir Shabazz wielded a 2-foot-long night stick.

“Cracker, you are about to be ruled by a black man,” one of the New Black Panthers told a white voter. They taunted others as “white devils.” A black couple who served as Republican poll watchers said they felt endangered when the Panthers called them “race traitors.”

Murkowski, announced earlier today, and Collins, will withhold SCOTUS vote until after the election
That makes it very easy for Graham and others to demand a vote, and say they will vote yes.
Very easy because the outcome is predetermined.

Because NOBODY is changing their vote and no one is going to be moved by the debate, whether the nomination is debated 15 minutes or 15 months.

It’s theater. Either you support the President’s pick or you don’t.

Well, if they are not going to vote at all, that means we’re down to 49 needed votes for a tie with VP Pence casting the deciding vote or 50 for a straight out majority.

Which sets up an interesting board. Will the RINOs actually abstain from voting at all, vote “present”, or vote “nay”? I believe each decision/choice changes the board to how many “yeas” it takes to approve the nomination. And also Manchin might still be a wild card.

Who knows where it actually stands and if the person nominated will make a difference–except–probably the Turtle probably already knows the outcome.

If that sad excuse for a human being shows up for the Presidential Debates, he will have an opportunity to answer a few questions:

      (1) Do you use a teleprompter when answering questions for the press? How often?
      (2) Why do you refuse to take questions after an event?
      (3) Count backwards from 100 by 7. OK, that is not a question. How about, “If your life depended on it, could you count backwards from 100 by 7?”

There must be quite a few more that will help clarify how incompetent this guy really is.
