(From WaPo via WZ) – Obama Backs Harry Reid’s Efforts To Change Senate’s Filibuster Rules: President Obama supports Senate Majority Harry Reid’s efforts to reform the filibuster, a White House spokesman said Wednesday.

“The President has said many times that the American people are demanding action,” White House Communications Director Dan Pfeiffer told The Huffington Post. “They want to see progress, not partisan delay games. That hasn’t changed, and the President supports Senator Reid’s efforts to reform the filibuster process.”
The Nevada Democrat has proposed eliminating the filibuster vote that is needed to formally begin debate on legislation and mandating that filibustering senators actually talk on the floor, “Mr. Smith Goes to Washington“-style. Reid intends to use a simple majority vote to pass the reforms. No major rule change has ever been instituted with a unilateral vote by one party. (read more)

Unlike House standing rules, which are voted on each session, and apply to that session only, Senate standing rules do not apply per-session, and do not require reauthorization with each new session. The Senate is a continuing body, with standing rules to remain in place from one session to the next.
Per Senate standing rules, changes to standing rules require a 2/3 vote, not a simple majority.
The Senate set itself up in this manner, under its Article I constitutional authority. Thus, attempting to amend Senate standing rules with a simple-majority vote would violate the Standing Rules put in place under constitutional authority.
The only problem is: I don’t know if SCOTUS would hear a case, or if they would say that the Senate has the right to dictate its own rules, and must deal internally with any disagreement about those rules.
