The state supreme court found that being vaccinated does not stop the spread of COVID-19, saying the vaccine mandate and firing of the non-compliant employees was “arbitrary and capricious.” This is a strong rebuke to the totalitarian fiats created by state leaders including the state governor, mayor of New York City and health commissioner.

I have in my Advanced Directive that I am only to receive unvaccinated blood. Thankfully, many people that I know have the same blood type as me and they are unvaccinated. Absent of Pure Blood, they can just let me die. I will not allow them the joy of killing me via destroying my blood.

I donate blood and the question is asked if you have had the jab. Problem is they don’t separate the blood from those who had it and those that declined the jab. A recent article implicating the ARC. Claiming a public policy reason to force a medical procedure on one but not both groups of similarly situated human beings is the definition of arbitrary and capricious. The existence of the claimed reason is belied by the failure to apply it across the board.
It is, however, a cold drink of water in the desert to see that the rule of law still exists in some degree. The language of the opinion – particularly its very clear factual statement that the jabs do nothing to stop the spread of Cov2 , is the best part.
Now those who are awake to the truth can point to this legal finding when dealing with the misinformed and the still wilfully blind. Too many people out there are still walking in a mental prison in which CoV2 is deadly and the jabs are a social protection measure that actually works.

I want to know if being “othered” at my job until it became such a hostile work environment that I had to quit will get me standing in a lawsuit. Unvaccinated had to get bi-weekly tested (at our expense), vaccinated did not have to wear a mask (for a time), if a vaccinated employee caught covid then they got 10 paid days off while unvaccinated employees did not receive pay, unvaccinated gamblers did not have to wear a mask while unvaccinated employees did, I got hauled into an office and had the shift manager and his right hand man lecture me about how dangerous it was for me to be unvaccinated, and I had several co-workers tell me that they hope that unvaccinated people catch covid and die.
I’m not kidding. I despise them so much that I am willing to take their money.

Without an emergency, OSHA will have a rough time pushing through a reg for the same reasons the court cited in this case. The shot doesn’t keep someone from getting it, transmitting it, and the hypothesis that the shot makes a person who gets it less sick is iffy. That could just as well be due to the mutated virus being less deadly.
Healthcare workers won their case in Chicago`s Northshore University hospital. Jobs back with backpay, and seniority. Damages were $25,000 each for fired, and $3000 for those that caved in on religious exemptions.
Don’t forget, they also continue to require the shot for all healthcare workers.

First let me say i’m against all mandates.I encourage everyone to read the ruling.There are many factors taken into account by the court.This is a lawsuit by sanitation workers against the ny health official who issued this mandate and mayor Adams executive order exemption for some private employees.The court has a lot to say about their actions.The court is not against mandates just the way it was applied.Quoting the court ”Either there is a mandate for all, or there is a mandate for none”.
Additionally I believe the decision is only for the petitioners in the complaint.
It does not mention all the city workers that were terminated.
Reinstatement does not mean what you may think it means. Yes, they will get a job back and pay plus back-pay.. However there are a great many internal means and methods they can and will use to continue the persecution.
It’s nice to see on the surface but like always… it lacks any real resolution and is so vague it lacks any means to ensure compliance.

Unfortunately, this was not NY’s high court decision. The poorly named NY Supreme Court is new York’s lowest court and this was the decision of a single lower court judge. It is not meaningful news unless and until it is upheld by the NY State Court of Appeals which is New York’s actual supreme court – and that’s two layers of appeal away.
We will see if there is any Judge who has the stones to overturn the decision of the Supremes. The way the city applied the mandate is the DEFINITION of Arbitrary and Capricious. This will be fun to watch. Lawyers all over the country will be coming out of the woodwork. I remember when the Exxon Valdez tanker did a number in the Gulf of Alaska in March of 1989. You couldn’t get a plane ticket to Alaska for weeks as they were all bought by attorneys.

As a NYer who has worked from home because I was deemed a leper, first by Dumblasio and then Adams, for not being jabbed, my/our prayers were answered twice for NYers: jab mandate lifted for private sector on 11/1 and thousands of hard-working NYers whose lives were almost destroyed by those same mandates have finally been reinstated with back pay, as icing on the cake. I have never taken a PCR test, if forced to wear a cuck muzzle it was a fake one I could breathe freely through that looked like a legit one, never even considered taking the lethal va666cription. I was attacked by employers, my family, my friends throughout this fake Scamdemic. My wife and I held my ground the entire time and tried our best to reason with them. The “supreme” court in NY state is the lowest level of court, not the highest. The city can appeal this to the next level court, and then on up to the highest court in NY state, called the “Court of Appeals”.
If this holds, those vaccination cards will mean nothing going forward.
And the hiring practices of many companies requiring vaccination will need to change.
The heads of many will explode that a control mechanism has been neutralized.

A firefighter from NYC was on Tucker last night for this reason. Suspended without pay since November and terminated in March.
His was a religious exemption that he had applied for.
He made the point, which should be amplified over and over, he had worked all thru the pandemic and just as it seemed it was over the vaccine requirement came.
I hope they get their jobs back with back pay.
And in cases like this where they provided coverage thru the pandemic and then were released when pandemic appeared to be over, they should file suit for damages too.

That suggests that the freedom to decide whether to receive the covid vaccine should be based upon the efficacy of the vaccine.
That is wrong. One should always have the right to decide which vaccine, if any, to receive regardless of the efficacy of the vaccine in question.
Mandating the covid vaccine, or any vaccine, is wrong.
Science doesn’t require that vaccines of any sort to be mandated. It doesn’t even matter how efficacious the vaccines in question may be.
Science is simply an impartial tool that allows us to learn about the world around us. It doesn’t compel us to do anything.
Medical freedom is paramount. People should always have the right to decide what vaccines and other medical procedures that they wish to receive or not receive.
I never understood why, *if* a vaccine is effective in preventing infection, anyone would care whether or not other people took it. Those who want protection can take it themselves and the rest can take their chances with a mild virus. Natural immunity is more robust, anyway.
So what’s the problem? To each his own..
These mRNA injections, however, are not even vaccines. Plus they are leaky, so trying to vaccinate during a plandemic will unleash more unnatural strains and variants to overcome the non-vaccine spikes.
