WASHINGTON DC – Stephen K. Bannon was indicted today by a federal grand jury on two counts of contempt of Congress stemming from his failure to comply with a subpoena issued by the House Select Committee investigating the Jan. 6 breach of the U.S. Capitol.
Bannon, 67, is charged with one contempt count involving his refusal to appear for a deposition and another involving his refusal to produce documents, despite a subpoena from the House Select Committee to Investigate the January 6 Attack on the U.S. Capitol. An arraignment date has not yet been set in the U.S. District Court for the District of Columbia.
“Since my first day in office, I have promised Justice Department employees that together we would show the American people by word and deed that the department adheres to the rule of law, follows the facts and the law and pursues equal justice under the law,” said Attorney General Merrick B. Garland. “Today’s charges reflect the department’s steadfast commitment to these principles.”
“As detailed in the indictment, on Sept. 23, 2021, the Select Committee issued a subpoena to Mr. Bannon,” said U.S. Attorney Matthew M. Graves for the District of Columbia. “The subpoena required him to appear and produce documents to the Select Committee, and to appear for a deposition before the Select Committee. According to the indictment, Mr. Bannon refused to appear to give testimony as required by subpoena and refused to produce documents in compliance with a subpoena.”
In its subpoena, the Select Committee said it had reason to believe that Bannon had information relevant to understanding events related to Jan. 6. Bannon, formerly a Chief Strategist and Counselor to the President, has been a private citizen since departing the White House in 2017.
Each count of contempt of Congress carries a minimum of 30 days and a maximum of one year in jail, as well as a fine of $100 to $1,000. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors. (read more)

Congressional subpoenas are enforceable only when they apply to legislation, so it appears Democrats are using Bannon to specifically enact legislation to outlaw Trump rallies. It’s not personal (they could care less about Bannon), it’s making sure that Trump’s kind never rises again.
So we should not be surprised to read in the news one morning that a federal SWAT team has entered Mr. Bannon’s residence(s) and confiscated all his computers, cell phones, documents, and put him under arrest while a CNN camera crew stands by to film everything, right?
Also, if arrested, can Bannon make a case that since the federal government now only does selective prosecution against people ignoring Congressional subpoenas now in fact means that Congressional subpoenas must be categorized as non-prosecutables since they have clearly now been shown to be simple political exercises, and if a citizen elects to not participate in such ‘compelled speech’ are actually protected by the First Amendment?

If Bannon had conversations with President Trump they come under” privilege”. Obviously, the commission calling in Trump’s inner circle is an attempt to undermine a President’s (Trump) ability to speak freely with advisors.
It also is for the fear factor and the chilling effect. They want to make anyone in the Trump era a pariah. That is why they were trying to out any major donors to the MAGA movement.

I can guarantee you that millions of guns have been readied. Each individual person decides where and what that red line is. Each community decides how they will protect and defend themselves. I would never shoot someone because I don’t like their politics (unlike our current government). However, if they/thee/them try to harm my family PHYSICALLY, then the guns come out. They can create shortages. They can create financial distress. We’ll work around their stupid attempts at “compliance”. First and foremost…this is not a sanctioned congressional nor joint congressional committee. The senate took care of that with the vote on the issue, when they voted NOT to support the House.
Botox Nancy Pelosi unilaterally formed an “Investigative COMMISSION”. As a commission it does not have the authorities granted a sanctioned congressional committee.
Next, as we have discussed here the seperation of powers described in the US Constitution does not allocate “police” powers to the legislature. The Congress can investigate and gather information on matters related only to legislation before the Congress.
The rules set by the COMMISSION has limited legal representation to those called to participate, thus violating their 4th, 5th and 6th amendment rights.
How the current corrupted courts rule is subject to debate these days but the law, civil rights and Congressional rules of operation favor the plaintiffs resisting the 1/6 Commission.
Forgot to add that given the above, the head of the US GESTAPO, AG Garland, actually had zero basis to request indictments in any “properly functioning” court of law.

It does indeed appear that everything connected to the Democrat Party of late is focused on completely neutering “4th, 5th and 6th amendment rights!”
I would also add that in our constitutional scheme of coequal branches, the Office of the President of the United States (as separate from the DOJ that is also under his authority) would have just as much right as Congress (does, or does not have!) to compel testimony and issue contempt citations with referrals to DOJ for prosecution.
If memory serves me right, it was one single judge ( some 50-100 years after our founding) that ruled that such congressional authorities (subpoena power etc.) were IMPLICIT in Congress’ constitutional mandate, something that is not at all apparent in the Constitution and was merely created (incorrectly, I believe!) by judicial fiat.
However, if one believes the judge was right, it should also be IMPLICIT within the constitutional mandate of the President of the United States to carry out his own, separate investigations into various issues related to the Office of the Presidency, and that would require compelled, sworn testimony.
Recall that only Republican presidents (apparently!) are forbidden from guiding DOJ into directions that reflect their priorities. However, if this “unwritten law” were enforced upon all presidents (not just Republicans), then the President of the United States, as the chief law enforcement officer of the Republic, could, and should also CLAIM FOR HIMSELF these same authorities regarding subpoena power, in presidential hearings and proceedings separate and apart from DOJ. After all, it is the President’s signature that gives legislation its force of law. How can he sign his name until he gathers all the facts independently? Why should he be limited to taking the word of Congress regarding the merits of the legislation they propose?

That Congress has subpoena power is a serious Constitutional question. It’s my understanding their subpoena power only extends to matters of pending legislation so the Jan. 6th farce of a committee does not fall within that scope. Congress does not have the right to subpoena anyone it wants for any reason such as it is in the case of Steve Bannon and others.
This is so out of control that if a Republican president wins in 2024 and has at least one chamber in Congress they need to retaliate against the radical left and arrest Garland, Biden, Wray and dozens of others for their gross violation of the Constitution.
