TALLAHASSEE, Fla. — Today, Governor Ron DeSantis announced a lawsuit against the Biden Administration’s unconstitutional Occupational Safety and Health Administration (OSHA) employer vaccine mandate. As soon as the unlawful emergency temporary standard (ETS) is published in the Federal Register tomorrow, the lawsuit will be immediately filed with the United States Court of Appeals for the Eleventh Circuit. On page 5: “The ETS protects these workers through the most effective and efficient control available – vaccination – and further protects workers who remain unvaccinated through required regular testing, use of face coverings, and removal of all infected employees from the workplace.”
A recent study from Sweden published in The Lancet found that within 200 days, mRNA vaccines had no ability to prevent transmission whatsoever.
On page 15: The agency is not required to support its conclusions “with anything approaching scientific certainty and has the “prerogative to choose between conflicting evidence.”
The CDC recently released a review of research studies and its own unpublished data indicating that both infection-induced and vaccine-induced immunity are durable for at least six months. This rule should account for natural immunity.
On page 20: The agency does not believe it appropriate to impose the costs of testing on an employer where an employee has made an individual choice to pursue a less protective option. For the same reasons, OSHA has also determined that it is not appropriate to require employers to pay for face coverings for employees who choose not to be vaccinated.
Employees will have a direct financial penalty for making a medical decision of which they have every right to be in control.
This rule, if allowed to be implemented, will impact nearly 9,000 employers in Florida and the 4.5 million Floridians they employ who make up 60% of our workforce. Nationally, it will cost $2.9 billion. This OSHA rule must be deemed unconstitutional and Florida will be leading the way in taking the Biden Administration to court. (read more)

EXACTLY. a lawsuit is great and all, but we need to just openly declare we will not comply, will not send any fines or fees, will fine companies that do try, and if the fed would like to start withholding funds, they withhold taxes.

The question was, since your taking this to court, why are you still calling the legislature into Special Session.
And his answer, being diplomatic, was “while he is confident they will win in court” (had to say that) Courts can take time, and then he went on to list the things they intend to address IN THE LEGISLATURE, pointing out THAT is the Constitutional way to deal with these issues, rather than by Executive edict, OR Court decisions.
So yes, he is fully prepared for the Courts to slap him down.

I also live in Florida, but as I look for meaningful work, I am seeing more and more companies requiring full vaccination before you can be hired. Of course I avoid those jobs, but there is no recourse as of now and if hired then mandated to get the jab there still won’t be recourse other than to possibly sue.
Long time, I know it might be easier said than done, but try to be patient. I think this is like a big nasty zit that’s going to pop, all over bixen and the dems. The pure blood hold outs that make up too large a % of the workforce are going to make it happen. That along with the truth (the deaths, inefficacy, etc.). The media can’t keep a lid on it forever. But it might take 2-3 more months.
Note: Thank you dear Lord! I’ve been waiting since the sixties to see just what it would take to get the American people to stand up and throw the incompetent/corrupt/self-serving/witless politicians, bureaucrats, academicians, and media folks out on the street. A Soldier/Cop/Mercenary’s Confession/Lessons Learned
* Soldiers (ground combat soldiers, that is) do not fight first and foremost for their country, the flag, motherhood, girls back home, or apple pie! Before all else, soldiers engaged in ground combat fight for their fellow soldiers and their unit. Why? Because in every war/police action/whatever including WWII the strategies and tactics adopted by mostly incompetent/corrupt military and civilian managers (notice I said managers not leaders) were/are designed to maximize the profits of the military/industrial/political complex with little regard for the those personnel charged with employing the same. In short, the American soldier has been/is nothing more than a “mercenary” since 1969 with the creation of the “All Volunteer Army (VOLAR)”.
* The Seven C’s of Leadership according to a survey of 1646 Vietnam era ground combat veterans listed of the order of their importance (according to the vets) are; Candor, Competence, Consistency, Commitment, Courage, Compassion, and Courtesy. The reason the soldiers in the survey chose the word “candor” is because to them candor encompasses both omission and co-mission. To a combat soldier lack of absolute candor, be it co-mission or omission, are equal sins! In short, soldiers expect/demand absolute candor from their leaders before all else. Note: The democrats have proven they are masters of co-mission, while republicans have proven they are masters of omission!
* The American people are the most effectively lied to people in modern times thanks primarily to politicians, bureaucrats, academicians, and the media.
* Arrogance plus ignorance equals stupidity (A + I = S).
* The greatest threats to the American people are the corrupt and/or incompetent politicians/bureaucrats/academicians found at every level of government/academia, and the majority of the American so-called media.
* The American Profession of Arms and our brothers/sisters in the Blue have failed to protect the American people from all of their enemies, both foreign and ‘most especially’ domestic.
* There are only two primary requirements to be a career soldier and/or cop in America. One must be smart enough to do the work and dumb enough to take the job.
* American soldiers and police officers must in addition to mastering all of their professionally mandated tasks learn to accomplish the same with at least one arm tied behind their backs and their vision impaired 50% or more.
* Far too many of the politicians, bureaucrats, academicians, and media types I have encountered during my years as a soldier/cop/mercenary I most kindly refer to as; self-serving, witless, cowards. Note: I originally referred to the aforementioned folks as; “Self-serving, witless, cowardly, pissants!” After retiring to the deep woods I dropped pissants once becoming acquainted with the little guys; in that I learned pissants are not self-serving nor witless, and certainly not cowards!
* After carefully watching the whole of the political class since May of 1960, I can say without reservation that most of the group will sell their souls and our bodies just to remain in power.
* Want to see what the United States of America will look like if the left takes control of the government? Take your pick: New York City, Baltimore, Chicago, Seattle, San Francisco, Los Angeles, or the complete packages; California, New York, Illinois, etc, etc, etc…..
* If the so-called Progressive movement continues unchecked a number of able veterans are going to be presented with a challenge/decision. Are the American people worth another drop of our sweat and/or our blood?
* The end goal of the elites and their minions is not (nor ever has been) socialism, communism, or capitalism. The elites of the world have used all manner of ideologies, religions, terrorism, brute force, etc. to drive the masses/peasants/serfs/whatever in one direction. That direction leads to one of the oldest forms of human control ever employed in the history of mankind. That form of human control is Feudalism!

PS All of the lessons learned above (save the last three, which were added during Obama’s last two years in office) and the four mentioned below were written for the prelude of a book titled: “Rape, Pillage, Plunder; America You’ve Been Had!” (After Obama was elected to his second term I added; “And It’s Your Own Damn Fault!”). The book has not been published in that the Department of Defense has denied four requests to publish the same due to classified information they claim is in the book. That so-called classified information primarily deals with the number of politicians and bureaucrats sitting at the federal, state, county, and city levels of government during the Carter years who made the list of subjects in an investigation of the international drug trade and money laundering. Three of those politicians went on to be President of the United States of America. Four of the original lessons learned will remain unpublished in that I do not believe most of the Americans alive today can handle the level of anxiety that might be generated from their exposure. Few Americans can imagine the lengths so many have gone to destroy this nation just since President Eisenhower’s last year in office. I say that because that was the year I joined the army and have stood witness to the destructive policies first initiated by the Kennedy administration with folks like his brother Robert and Robert McNamara (Mac the Knife- soldier’s nickname for the #$%) laying the ground work for administrations that followed! Thus the reason for the two part prayer I said immediately upon learning that President Kennedy had been shot. First I prayed that God would spare him and second that the shooter was not a soldier from my unit nor any other military unit!

Those of us who were offspring’s of the Greatest Generation fought in WWII and Korea…..also mismanaged by Civilian and Military leaders. Yes we did think the U.S. was all about Baseball, Apple Pie and Mom and we had that image in mind overseas….it helped keep us focused on the things we had to do !!!! We came Home to smiles and Hometown Parades not the spit and name calling Hippie Freaks'( The parents of ANTIFA/BLM) and “Hero’s” who deserted to Canada……I can only agree with your Opinion that the Government Sucks and is getting worse up until todays Election results which indicate a “Trend” toward Conservatism and away from Socialism/Communism. Long story (involving a lib ex-wife), but in 1999 I prayed to God and asked him if I should move from PA to FL. I don’t know if I always get a clear answer, but I did that time. rom a pretty good job in PA, moved to FL, met my awesome 2nd and final wife in spring of 2000. Been in beautiful St. Augustine for almost 20 yrs.
At one time I thought after kids are out of the house, we’d move to the Rockies (I miss skiing), but after this past year, I’m not leaving the free state of FL! I’ll visit the mountains. I thank God every day for answering my prayer that day in ’99. Faith and Romans 8:28 got me through that year and it sure came true.

Exactly what DeSantis explains, there is no legally binding law passed by legislation. This is how all these agencies circumvent the Constitution. All laws reside in legislation!
There is enough court precedent to prove this very Constitutional fact.

My sister got her second dose mid-September, had COVID mid-October. And her unvaxxed husband contracted it. This number needs to be greatly reduced!

I can understand why they totally ignore prior infection.
First off, many were told not to come in, unless they got worse, so may have no “proof” of prior infection
Secondly, if they DID get tested, it was most likely an unreliable test.
The only way to confirm prior infection, is with a more expensive antibody test,..and having lots of people get those test results, would reaffirm how robust and long lasting the natural immunity from prior infection is.
So because it doesn’t fit their narrative, they pretend it doesn’t exist; they ignore it.

1. There is no “grave emergency” requiring workers be vaccinated.
2. The national death rate for covid includes death “with” covid, deaths from other causes, and is a false rate.
3. Covid is no more than a serious flu, and can be cured with ivermectin and HDQ.
Unless the plaintiff’s show WHY THE MANDATES ARE UNNECESSARY, they won’t be able to definitively show government overreach.
…. and the experimental “vaccines that don’t work” were authorized by the FDA on an emergency basis. There is no longer the need because there are successful treatment protocols for Covid-19, and the FDA should be forced to cancel the emergency authorization, and require the full approval process with long clinical trials for the jabs , which t will fail as the real numbers come out on how dangerous these drugs are to many people.
Pay attention to the put options on the big pharma stocks involved. Follow the money.

The first thing I noticed is that they wrote the rule as if they’re protecting the unvaccinated.
This is allegedly temporary, but as Sundance points out: No end date (for either the “emergency” or the rule).
It’s an “emergency” (two years into the pandemic), yet it took almost 60 days to write and publish after reversing course and deciding to mandate vaccines after promising not to mandate vaccines.
Not to mention that they DELAYED implementation/enforcement of the rule until next year, because they want to accomodate businesses that depend on the holidays–with all the purchasing and shipping issues. Money to be made!
So this is so critical, such an emergency, it’s so crucial to save the lives of the unvaccinated from themselves, that they can delay addressing this emergency for another two months.

How will they remove ALL infected employees from the workplace without testing all employees on a regular basis?
Why do they seem to not care about vaccinated employees, whose lives will also be at risk because not everyone has to wear masks or test regularly?
The “grave danger”, if it exists at all, exists for all, not just the unvaccinated. Are there provisions for making sure that vaccinated people keep their antibody levels up to snuff, so they don’t at some point suddenly present a “grave danger” to co-workers?
Flu also kills people, as does RSV, pneumonia, and other respiratory diseases, as does hepatitis and other contagious diseases too numerous to mention.
Why does OSHA only “protect” certain employees from COVID (unvaccinated) and not protect all employees from other contagious diseases?
After making ivermectin available otc and educating the public on its use (along with zinc, etc.), Uttar Pradesh, the largest state of India (population some 240 million) is now declared covid free. A cheap, quick and easy fix. None of which are good for a regime at war with their own people.
