An important part of the court’s thinking is whether the order will be upheld.
Trial courts are careful of their record of upheld versus overturned.

The problem with a move to dismiss is that it is just throwing another bandage on the Constitutional gangrene of electoral fraud. Given the public can see the evidence presented, it will just make the situation worse.
Part of the evidence presented in the plaintiff’s brief is foriegn IP addresses on the Dominion machines. Imagine the judge foolishly dismisses, and those same IP addresses turn up on machines in an audit in another fraud state? How would the dismissal decision look then?

The bombshell I got out of it (maybe was common knowledge) was hearing that Microsoft has some kind of a patch or something that under no circumstances should be in there. DePerno seems to be a very serious, determined and impressive guy. Really grateful to him for this work. I don’t think the MS patch is common knowledge, Bigsky, at least I haven’t heard about it and I’ve been following it. I’m no lawyer, but have been surrounded by them in business for decades and DePerno’s case seems solid to me. The Left knows no shame and no bounds of corruption so anything is possible. But, in an honest system, I think the courts would side with Bailey and DePerno….

I was appalled at the judge raising the inevitable protest or chaos if someone on either side is unhappy with the results/findings of the audit, instead of Bill Bailey’s and every voter’s right to request for audit. Corruption is now the top word in anything resembling news. Corrupt politicians, police, DOJ, FBI, all forms of bribery on the bench. DePerno presented an impeccable case for his client and for all citizen voters to each belongs the real power to fight corruption in every which way they can and to spread the word, lobby, call and write their statesmen, create and sign polls, share the realinformation when/where they can and to sue when push becomes shove.
DePerno made a good case for Bailey to have standing. Just because there could be thousands of new cases filed, he said something about the SC held that should not be an issue. I would have repeated that at least 7 times to nail Gill to the wall and imply that the State (Gill) is doing exactly what they are being accused of, denying Bailey’s civil rights.
The big question is if the judge will accept that. I hope so, or this case is moot. Appeals will take 3 years to work it out. Best thing would be to get like 2000 people to join the case with Bailey and make it a class action.

This is a key point. 1st, it bring in the question of integrity, thus justifies the audit. Second, if network traffic was monitored as reported by Rudy’s team and several others that testified, it blows everything up.
Routers are not going to tell you much except maybe if security patches were applied. I am pretty sure they have deleted all logs. If not, they are totally exposed. A lot of time has passed and unless these routers were only used for the election, then they have a problem. Problem is that the systems have a cell phone type modem chip in they. They may not need a router. Same with blue tooth access. They can use blue tooth (like what you use to connect your phone to your car) to access the machines and leverage unnoticed.
If non compliance, then again, they are security risks exposed. It is death by a thousand paper clips and they know it. Bringing in DOJ is a stop gap. I am guess from previous presented information, they already know the issues and have supporting evidence, they just need to expose the swamp.

Sorry, but it is difficult to say based on that video alone. I expect the admin software to be there somewhere. You need to be able to adjust to the various changes that will occur during the nomination process. The question is one of who (including how many) had access to the software, and when did they have it which the video doesn’t cover. Certainly the more widely the administrative program is distributed the more questionable the integrity of the election because anyone who has the software can manipulate the process. I expect this information to be in other parts of the brief and I only checked the video.
But I will agree it certainly throws even more bad light on the electronic voting process. If the code isn’t in some way locked before election day it is a crap shoot that depends too much on trust.
Sadly, I’ve also been in a situation (not an election thankfully) where even though the database should have been static, we needed the ability to manipulate it after the data was entered. Programmer forgot to sanitize his data and the commas entered in some text fields became database delimiters corrupting the database. Once the problem was figured out, the database could be properly reconstructed. Granted, there shouldn’t be that sort of issue here but they do happen in other contexts.
Quite honestly, there is no sure fire method of securing the integrity of an election. The best you can theoretically do is allow an equal number of partisan representatives unfettered access to observe the ballot counting process. If that doesn’t happen, which it didn’t in too many cases this past election, there is zero confidence in the results.

DePerno’s problem is that he frequently states publicly that they have a huge discovery and presents it as if it was something that was confirmed to have actually happened. But instead, it’s usually something that they confirmed could have happened. They would be better off saving it for court, and not working so hard to raise expectations. The court and the defendants can see the public releases they make, and it’s really easy to shoot them down as not living up to the claim.
I like that he’s fought this so hard, but the strategy has not been the greatest. That’s only my opinion.
The Antrim county vote flip did happen. It’s not a “maybe”. It’s right there in the Edison Research time series tally data, if you care enough to download it and actually look.
You will see the flip occurs in a 26 second time step, thus proving the “official” excuse to be mendacious.
I agree with Fuarfearg. DePerno needed to be more specific about how the State is stonewalling this. The reason they can’t do discovery is the State is not letting the truth out. Is that not the job of the court?
A primary function of trial court procedures and of rules of evidence in cases before courts in which facts are in dispute is to find the truth. By preventing “Truth to be heard” Bailey’s civil rights are being denied.
There were huge problems with the count. No doubt. And it took way longer than it should have to get it figured out.
But there has not been concrete evidence that votes were “flipped”, even though that’s the actual language people have been using. They’ve only shown one possible way votes could have been flipped.

No, SQL suit is a set of tools to manage data. Structured Query Language (SQL) can be used to produce reports, manage data (including changing it) and part of programming code logic.
IE: Select Voter Roll Data element equal to Trump and change the 5th one to Biden.
Code like this can be run outside standard program code and deleted. The fact that they were doing updates like the night before is scary. Same with GA! Maybe they were not doing anything wrong, but it break every security rule to have it on the systems. Enough evidence that something is not right justifies looking for where that something could be. MS SQL is an easy fix to change data quickly.
If the code is found on the machine (which I doubt ..let no trace) then they are busted. If they did leave it on the machine and the SQL logs are there. They could be toast. Judge may never let them get there.
The reason they are fighting tooth and nail to prevent the information from being gathered and protesting the audits so much is that something is there. They didn’t cover all of their tracks. It may be the logs, it may be code, or it could be both.
I’m pretty sure it’s at least one of them. No reason to fight so hard if nothing is there to find.

The issue was that the machines had Microsoft SQL software on it. It might have been an oversight but SQL can change databases on the fly. For a system to loose votes (even 3) when they scream every vote counts but it doesn’t he made a good argument.
Problem is a technical issue. Discovery appears to ended awhile back. That could be a problem and it could end this on a technically. The A Widmer kisser Gill took several digs at DePerno, but Deperno did a great job of shooting him down and zinged him with a delivery documents 2 hours before the deadline and only giving him one hour to review documents. Classic move by these law-fare types. They did huge document dumps at the Floyd trial, too.
Deperno may have some hope in this case.

I agree the bigger problem ought to be the illegal orders from the SoSs. Last minute changes unequally applied ought to automatically invalidate the election. No trial required except possibly finding of fact.

Of coarse, Step 2 is – why didn’t machines stop in California, Alaska & Wyoming? It’s mathematically impossible for machines to stop in 6 swing states.
Step 3, they all stop about the same time, and restart about the same time period. Another mathematical impossibility. (Why didn’t one reboot after 30 minutes or 1 hour?)
Steps 4 & 5, every single state has a massive swing towards Biden. Impossible on a state level, and for all 6 states to have a massive swing, in the same direction, towards a candidate who couldn’t draw flies.

After watching the video, I am less than underwhelmed. I expect the judge to dismiss.
Fraud could have happened. Sure.
Did he show that fraud DID occur in the 2020 Presidential Election? I didn’t see it. I saw a guy feed ballots into a counting machine, then tell you that he was switching the totals, then telling me the numbers didn’t add up. Horribly presented.
If you want to win, you had better show raw paper ballots with a human counted vote count, then show that the machines gave a different number, and that you can repeat the discrepancy when the votes are recounted by the machines.
We know they COULD have been manipulated. That has been proven. We need the forensic audit PROOF that they were manipulated.

The state Uniparty and the RINO subset of same is joining with the vote thieves, apparently. We are alone on this.

I may be reaching but I find it interesting that both counties being audited: Antrim Co. MI, Maricopa Co. AZ, and the town of Windham NH which is about to undergo an audit all seem to be very important to the progressives in the Uniparty.
There are no coincidences. Sydney Powell’s team has had server traffic information since November. Her team coordinated with the Army. I wouldn’t be surprised if the data they obtained is why the focus is on these locations. The oligarchs of the Uniparty are using every means to stop, impede, and more so discredit these audits. They know that Sydney and others know. They know that we know. They are fighting tooth and nail to suppress the evidence and prevent the truth from surfacing with evidence. AZ is proving this with what has come out in regard to MCBE not having control over routers, allowing off-site scanning of ballots, and the worst part- handing over complete control of the election night processes to two Dominion employees.
This in Antrim. And, you can bet the progressives fight to keep the citizens of Windham from getting copies of the voting machine data about to be audited by a very shady audit firm (the owner is part of the lawsuit to stop the audit in AZ).
If we Treepers live in a county or area that uses the machines we all should push for forensic audits in our places of residence.

Dec 14: there was not enough fraud to overturn the results
Mar 10: there was literally so much fraud, but you have no standing to talk about it

We have a two-tiered legal system now.
Trump and his followers have less rights than others.
Even with incontrovertible evidence, this Judge will find a way to let it go.
In every state, in every election, there is a very well-defined right to mount an “election contest.” And, to demand an independent audit of original election materials, which must be securely retained for at least two years expressly for this purpose. (Unless you’re the State Senate, you’re required to post bond to cover actual costs, forfeit if you lose your case.)
Also in every state: “Election fraud” is at least a Class-5 Felony. The sort of thing that gets you a nice “hotel room” where you get to stay for a very long time. Longer if you’re a corrupt Secretary of State or State AG. No wonder these people are running scared. They should be.
