Earlier today Joe Biden raised some eyebrows when he said “no amendment to the constitution is absolute.” The first ten amendments to the constitution are commonly known as “The Bill of Rights.”
The occupant of the oval office, and head of the executive branch, saying the Bill of Rights is not absolute, should be challenged immediately to qualify that statement.

– Rights of Accused Persons in Criminal Cases
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor; and to have the assistance of counsel for his defense.

– Rights in Civil Cases
In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise reexamined in any court of the United States than according to the rules of the common law.
♦ Amendment 8
– Excessive Bail, Fines, and Punishments Forbidden
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
♦ Amendment 9
– Other Rights Kept by the People
The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.
♦ Amendment 10
– Undelegated Powers Kept by the States and the People
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

Every jot and tittle of the Constitution and its amendments is absolute until such time as it may be amended by the authorized and prescribed procedure.
There is no authorized procedure for the 1st amendment. The first 5 words are “Congress shall make no law”
Article 5 of the constitution states: The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.
Hence, it is absolute! Theses progressive have been cracking the mirror of liberty for awhile. In Joebama’s 80 days, they have shattered the mirror. The bill of rights were written constitutional limitations on the Federal Government required by some states for constitution ratification so the government could not “infringe” on the god-given, “unalienable rights” of individuals and the masses.

First Amendment: You can be banned from speaking in the modern “public square” of social media for failing to recite from he approved narrative. It may not be government actively abridging the right to speak, but government inaction is most definitely promoting it. Not to mention the right to freely practice one’s religion being waived under the excuse of a virus with a 98%+ survivability rate.
Amendment 2: The prefatory clause outlined one of the primary reasons for the right to keep and bear arms as having a core of military aged people who are properly trained and armed to rise up as a defensive military when called upon…but it’s perfectly OK for states to ban firearms and for the federal government to ban import of foreign firearms if they don’t serve a “sporting purpose”. …even though, ironically, the Supreme Court case that upheld the National Firearms Act did so on the basis that the firearms restricted by the NFA had not been shown to have a military use and so didn’t fall under the auspices of the 2nd Amendment. Had Miller been arrested with a machine gun rather than a sawed off shotgun, the NFA would very likely have been ruled unconstitutional. We have the right to keep arms, but not to buy them from a dealer without specific permission from the federal government. We have the right to bear arms, but only in the privacy of our own homes unless the state we live in specifically allows for it.
The fourth amendment? How “absolute” is that when you can be pulled over for an imaginary traffic infraction and then have your car searched because a dog was trained to indicate the detection of drugs on command? When they can kick your door down, shoot your dogs and put your whole family in handcuffs at gunpoint in the middle of the night on nothing more than the word of a drug-addled “confidential informant”?
5th Amendment: Can’t be deprived of life, liberty or property without due process of law…unless your name ends up on a secret watch list that you can’t even know that you’re on, let alone how your name ended up there or have the opportunity to appeal it. Oh…and they can’t take your property without just compensation, so they just condemn the property so it’s not worth anything and “compensate” you for the new value of nothing.
6th and 7th Amendments: In what universe is 6 to 12 months from being charged to trial “speedy”? Civil cases are even worse: Mark Steyn has been waiting for 8 years for the civil case that Michael Mann filed against him to get to court and there’s still no date in sight. The process has become the punishment, you don’t even have to lose the case to see your life savings frittered away and have your life ruined.
I could go on, but I think you get my point.
The only amendment in the Bill of rights that’s pretty strictly adhered to is the Third. In fact, in our current society Biden is absolutely correct, we have no rights except those that the government sees fit to allow us.
Of course there is another name for that state of affairs. The founders were very familiar with it. It’s called “tyranny”.
The disheartening thing is that we’ve gotten to this point with little more than a “peep” from We The People. I don’t expect that to change any time soon. By the time the outrage level gets to the point where people are ready to actually do anything about it, the only people lawfully armed will be the tyrants and anyone who speaks out against it will be immediately arrested for insurrection.

Challenge anything you want, but the first 10. There’s a legal process for the rest called amendments suggested by Congress or Constitutional Convention by the states. Or you can repeal them by another amendment to repeal. Not as easy a process as the Dems think they’ll get away with. You cannot just nullify the Constitution and no wish by any party in control in DC should stand any legal test or lawsuit. Stand up for your rights people, we need to hear a loud roar from the “sleeping giant” again.
