Judge Sullivan Digs In – Asks DC Circuit for a Full Panel Rehearing (en banc) on Dismissal of Flynn Case…

Judge Emmet Sullivan is refusing to accept the three-judge appeals court ruling – which granted a writ of mandamus and instructed Sullivan to dismiss the Flynn case per the DOJ and Flynn defense unopposed motion. Today Judge Sullivan is asking the Full DC Circuit Court panel to conduct an en banc rehearing of the issues. [pdf here]

There is no guarantee the full DC Circuit will agree to the en banc request. However, given the nature of the court, it should be anticipated. What really appears to be the undiscussed background is an effort to keep dragging this issue out as long as possible. This is beyond judicial activism running amok, we have now entered the realm of judicial weaponization.

The Lawfare resistance was strongly advocating for this judicial approach. However, what we can infer from the need for Sullivan to trigger the en banc request is that no individual circuit court judge was going to do it independently (sua sponte) which was an option.

It appears Sullivan waited to see if one of them would; then, after a period of time where he identified no circuit judge would independently put himself/herself into the spotlight, Sullivan makes the en banc request himself.  The panel will likely accept the request.

Sullivan’s en banc petition essentially says his requests to have an outside amicus brief the court -on all the reasons not to accept the unopposed motion to dismiss- as commonplace; and he decries the DC appeals court mandamus decision as “a dramatic break from precedent that threatens the orderly administration of justice.”  [I think he’s stalling.]

            For me, not quite yet. I am prepared,..and have predetirmined my go-no go line, while remaining flexible to changing field conditions.

            My longstanding “go”; IF PDJT is removed from the Oval office before 2024, by any means other than losing a legitimate election, which I no longer believe is possible.
            And in 2024,…we’ll access the situation at that point, but if Republicons still control the party, and offer me another Romney, Ryan, McStain, Rubio etc,….well its lock and load.

            A new criterion; if Sundance gives a call to arms,…ready to pack and transport, on short notice.

            Beyond that, ….we’ll see what happens. Sometimes you never see the ‘triggering event’ until it happens, but when it does,…Millions of people respond.

            Actually, that was a MAJOR tactical blunder, by dear Lindsey.
            He proposed legislation, actually wrote and submitted it to the Senate, that WOULD have made it illegal for PDJT to fire mueller.

            Then, had to withdraw it, when it was pointed out that the law would be UnConstitutional, which made it clear it was perfectly legal and Constitutional for PDJT to fire Mueller.

            When PDJT STILL didn’t fire Mueller, even after that is when they realises he simply WAS NOT going to ‘fall’ for their trap (no matter the provocation) and the Mueller gambit, which DEPENDED on goading PDJT into a mass firing) ran out of steam.

            Islamism is a CON, which relies on mass manipulation, to motivate the masses into putting a small group in complete control.

            JUST like Conmunism. They each recognise the other for what they are, and know whatever ‘ideology’ is espoused is just a part of the con, so like birds of a feather, they work together, and will split the spoils.

        I think you’re right, and more than “committed” to the cause, they are such zealots, they will die for the cause. I think this is clearly demonic activity on the left; they are being controlled by evil to the point that they are so strongly held in the hands of Satan’s demons that they will follow them into hell and the abyss itself.

        Judge Sullivan is still using the heavy-hitting counsel of the Wilkins firm to push this case into uncharted waters, to win at all costs. Why? What is so important for the Deep State to keep Gen. Flynn subjected to continual judicial harassment and in trying to shut him up? On the surface it seems like low-level infractions, so why the full brunt of the law? There must be something so grievous that they cannot allow him the light of day.

        Or, another explanation is; Judge Sullivan etal., the Leftist Swamp, are such zealots, they are willing to commit professional and physical suicide for the sake of evil. I hope I’m wrong, but for the life of me no other explanation comes to mind.

          Exorcisms are on the rise, massively so, but the mainstream Catholic Church is basically paralyzed by its worthless Vatican II hierarchy. However, the fight for the soul of the Church goes on, as we can see from Archbishop Viganò, Bishop Scheider, and others, and I am fascinated by how that fight parallels the fight to retain self-government/Republican (as in Res Publica) government in the U.S. and in Europe (Hungary, et all v. EU).

          I suppose the bottom line is that there can be no true separation of Church and State. There never was historically until the U.S. Constitution of 1787. Thereafter the idea spread quickly, but the result has been a world gone totally mad. Religion is treated as a private business (and over course of time, ultimately a private idiosyncrasy) of its devotees, and has no place in the “real” world of law and politics. (Everyone see that toad Biden’s pledge to make the Little Sisters of the Poor pay for contraception, if he’s elected?)           There will be a lot of warfare — there is now, ongoing — both spiritual and physical. We must pray, sacrifice, support those willing to fight, as Sundance is.       I found one the other day dug deep into my upper chest near my armpit. All my misses could see of it was its a$$whole.
      We sprayed that sucker with bug repellant and sure enough it started to back its way out. But it stopped only part way so I had my dear one get the tweezers and yank that blood sucking f,er our of my body piece by piece.
      Kinda sounds like what we need in Washington DC.
      If this election goes wrong, I pity the fools that think they are gonna go unscathed. This is way past politics.

When PDJT hit they freaked and understood the strategic error in not letting HRC win in ’08; Obama would have likely been the victor in ’16 as I’m certain he would have won the close states of Mi, Wi, Pa which would have put him over the top.             I really hope and pray you’re right. But I’m not seeing any transformations here. Like most of the people I meet around here, my in-laws are die hard socialists and even though they think Biden is a creepy Alzheimer’s patient, he’s still preferable to the Big Bad Orange Man, on whom they’re blaming all the current mayhem. I wish I knew some libs without a raging case of TDS, but I don’t know a single one. There is one bright spot here in Philadelphia – several reluctant 2016 Trump voters I know who held their noses and voted Trump simply because he wasn’t Hillary, are all champing at the bit to get back in that voting booth and pull the lever this time.

    Hold on. This sentence is not clear.

    Are you saying they will grant his request to VOTE on whether to grant a full court hearing? Or that they will GRANT a full court hearing?

    My understanding is that regardless of whether Sullivan makes the request OR any sitting judge on the Circuit makes the request …. all it does is trigger a vote on whether to review/re-hear the 3 judge panels ruling.

    Lastly, I believe there is also another issue in play. Opinions vary on whether Sullivan himself (his court) even has the standing to ask for en banc. If this is the case, the court could reject his request without a vote and never even get to the issues he wants addressed.

      The mandamus order is directed to the “district court” not personally to Sullivan (although he obviously is the USDC judge in charge of this case). But, hey, why not throw in a standing challenge just to liven things up and give the en banc court another reason to deny Sulivan?

        I get that. That is why I emphasized “his court”. But that distinction between HIM and “his court” isn’t why I raise the standing issue.

        It’s because he is NOT am party to the case itself. Usually such a request can only be made by one of the parties in the case …. OR a sitting judge on the Circuit.

          The mandamus petition asked that Sullivan be directed to grant the motions to withdraw the guilty plea and grant the motion to dismiss or to assign the case to another judge who would. So in that sense, he is a party in his official capacity as long as he is the presiding judge,.

          A mandamus order must be carried out by a person, even though it is directed to the “district court.” When a trial judge writes an opinion, he doesn’t use first person singular (or shouldn’t); he says, “this court.”

      • The party or standing issue is a trap or perhaps planned sabatoge by the court.
        Good ol Rule 21. If the judge cannot be a party, and rule 21 can not be reinterpreted, there is no case and controversy, no adversarial parties for our side. Don’t give Sullivan an issue.
        The court needs to deny petition on the merits.

What surprises me is that there has not been more background filled in on the Judge’s prior cases or overall background in the fourth estate. This does leave one to scratch one’s head as to the scant total picture there has been of this individual.

      You make a good point. And the fact that Ms. Wilkins (or who ever wrote the appeal) is arguing that Judge Sullivan was denied his opportunity to a hearing on the matter of Flynn’s and the government’s request to dismiss. What kind of horse manure is that?

      No matter how much judicial double-speak those high-brow attorneys shovel out of their stalls, the facts remain; there is something suspicious about this whole case and Judge Sullivan.

          If they En Banc is denied, Sullivan has no further recourse except asking the SC and they won’t take it. Sydney may have to go back to the panel for Sullivans removal. As I recall, they did not rule on the removal from the case question as they were allowing him his legal obligations and rights. If no En Banc, then he is exhausted of those remedies. If he delays, the appeals panel can rule on his removal from the case. All delays.

          This is pure corruption by Sullivan. Amazing he would put his neck on the line but if he gets removed form the case, there still is no real risk for him. So he does it.

Instead of doing interviews AG Barr needs to do his job & stop with the excuses: President Trump tweeting made his job difficult, Coronavirus delayed Durham etc. Bring Ric Grenell back & declassify everything! Beyond time to go on offense.

      There are two forms of injustice, both reprehensible.

      The first is the guilty “getting away with it”, or being found “not guilty” by the process, and claiming exhoneration.

      The second is the innocent, being railroaded and convicted of a crime they didn’t commit.

      We are seeing BOTH, over and over and it is INFURIATING. They aren’t even trying to be sly about it, but are rubbing our faces in it.

              Several of my childhood friends are Trumps Direct SS Agents. I know if Trump needs help and I go down there those guys will wave me to the other side of the fence. And I will happily join them.

              But I moved this far out because I am able to skin out to the hills or the south much quicker from here. I’ve always kept a go bag and that hasn’t changed. Those around me have their kits as well.

              As you said, we never truly know what’s gonna be the catalyst, but we should all understand that it’s coming.

The federal courts in California are even worse. The trial courts are full of hard leftists and the 9th Circuit is still majority leftist. There is no way to challenge Newsom’s blatantly unconstitutional lockdown orders which prohibited going to church, buying a gun or peacefully protesting the violation of our civil liberties, but it allowed rioting and looting as well as abortions.

      This is as serious a time in the history of the United States as we have ever experienced. I think the dilemma is graver and more dangerous than the pre-Civil War era. At least then, the dispute broke down roughly along regional lines and there were defined geo political boundaries that de-lineated the two sides of the dispute. Now, we are dealing with something more akin to a termite infestation that has infected the entire house and there may be no way to save it. That isn’t an over statement. The communists won the cold war. The Soviet Union collapsed but American leftists followed Gramsci’s strategy to take control of cultural institutions like K-12 education, higher education, the media, the arts etc. They did that while idiots like the Bushes and other Rinos pandered to every group that slandered the country. People need to understand what is happening which starts with an accurate description of what is at stake. The other thing that needs to happen is that the middle class needs to organize. As it stands, this is an assymetric conflict. Soros, the Ford Foundation, the Tides Foundation, Silicon Valley oligarchs, Wall Street, etc are funding a permanent army of leftists who attack our democracy in a swarm directed at all of our institutions. Non-leftists need to get on juries to foil the politicized administration of justice (see Scooter Libbey). Non-leftist judges need to be as aggressive as the leftists in the judiciary who have massively overstepped the bounds of fair administration of justice. People need to organize against the cancel culture and back up those with the courage to state the truth about all the leftist agenda. People need to NEVER vote democrat, ever. Public employee unions must be eliminated. Silicon Valley must have its immunity against libel lawsuits eliminated or social media and search companies must be regulated like utilities with absolute restrictions on any kind of censorship. The law must be applied equally to everyone. The Clinton Foundation, the Epstein cohort, the Bidens, the SPLC etc. must all be sued and/or prosecuted for their malfeasance. The law should be changed to establish recourse against colleges and universities for student loan defaults and there should be organized pressure on all state schools as well as private institutions to ensure freedom of expression and ideological balance.

      There is a lot more. There is a fight that needs to be joined by people who are in touch with the reality that the founding principles of this country have led to the most free, most prosperous and most powerful society and nation that has ever existed in the history of man kind. The nihilistic left seeks to destroy it. They are succeeding. It has to be stopped or else, we are done. China is moving forward with its intent to dominate the world. The Davos crowd is still obscenely rich and still desires a borderless world controlled by an elite who populate non-governmental organizations like the UN, the WHO, the WTO, the TPP bureacracy etc. That is fast track to 1984 and we are on the precipice.

        I’d speculate that Barr, Durham and Jensen have been squeezing little Brandon for every bit of information he has about the Mueller probe, the Flynn setup, and such until the little twerp has been wrung dry.

        Then Barr could fire him, and justify it by Von Grack’s violation of Flynn’s constitutional right to Brady material – or possibly hiding Brady in other cases, too.

            I practiced law for 40 years, most of it civil litigation, but what I did see of criminal investigations made me appreciate how complex an investigation can be, and how long it can take to get admissible evidence for every element of every crime you want to charge.
            In Philadelphia, it wasn’t uncommon to hear “After a year and a half investigation.,,, the US Attorney indicted…” Usually Democratic politician or union official or mobster. But I repeat myself.

              Well, in my mispent youth, I was a career criminal. Couldn’t afford lawyer, didn’t want public defender, and so represented en proper.
              5 felonies, 1 Federal offence, and a # of misdemeanors, traffic tickets, etc.
              Only lost once, and did 1 1/2 years.
              The excuse of needing to dot I’s and cross T’s has expired, trust me.
              IF Barr truly came out of retirement to RESTORE the good name of the FBI and DOJ, he could have instituted policy changes on day one that would have gone a long way towards accomplishing that, no I’s or T’s neccesary;
              ORDER (he has the authority) the FBI to abandon its 302 system, and go to video recording ALL subject interviews.
              When I was interviewed, 40 years ago, by Treasury agents, the interview was recorded.
              The FBI doesn’t have to reinvent the wheel, EVERY other Federal LE; DEA, Treasury, etc. Video records subject interviews.
              Secondly, implement policies to seek out and FIRE (again, he HAS the authority) any Federal Prosecutors engaged in what Sidney Powell calls “Prosecutorial Terrorism” and what we generically call ‘lawfare’.
              Specifically, withholding Brady evidence.
              A HOUSECLEANER would have known that he needed to do these things on day one, in order to begin to reform the culture.
              Barr hasn’t, 2-3 years later. Incrementalism doesn’t work in this situation.
              Allowing miscreants guilty of crimes to retire with pensions, doesn’t work.
              It emboldens the bad actors, and discourages the “good” people.
              Barr is well past his “best buy” date, and is starting to smell.

          I hope there is a tranch of material on sullivan’s workarounds on his sons’ activities, and any sullivan ex parte communications with the coup plotters which may or may not exist.

    I saw an interview with Sydney Powell where she stated repeatedly that she was very surprised by Sullivan’s actions in the Flynn case. She also mentioned how Sullivan had been the hero of her book; a judge known to stand up to the government, with regards to Brady issues in particular.

    Now we see this behavior, which according to Sydney, is surprisingly uncharacteristic. Makes me speculate that someone might have something on this guy.

    Obama had 8 years to mine IC databases. He clearly spied on numerous Americans. He clearly intended to disrupt the transition and administration of his successor. Doesn’t that constitute motive, opportunity, and ability?

    Again just speculation, but if that was your mindset why wouldn’t you build dossiers Supreme Court justices, CEO’s, politicians, etc…?

      Sidney Powell was talking about Judge Sullivan’s behavior in the Senator from Alaska’s case. He lambasted Government lawyers for withholding exculpatory evidence.

      But, the “job” had already been done on the Senator. He got beat for re-election, and then died. Judge Sullivan could afford to be indignant.

      He is an Obama-Clinton Democrat first—a judge second. He does what he is told.

Both deep six a key Senator AND convince the good hearted believers in truth, justice, and the American way that you will be on that side of the law for future cases. Win-win.

        So blowing that cover now? That’s a tell about much Flynn and what he knows and can prove are a sword pointed at the heart of the beast.

        And, Sullivan did NOT write a sternly worded letter to the Bar association, reccomending or even insisting disbarrment for the Prosecutors, which he COULD have done, and which would have almost certainly resulted in disbarrment.

        They weren’t fired, by DOJ either which he could have pushed for.

        No, he had them go thru ‘ethics training’, which was almost as effective as tap dance lessons, for a snake.

        Sidney was fooled, it happens.

      As an old sportsman that enjoys exercising my 2A rights, the present ammo shortage is the worst I have ever seen it.

      It is not a supply issue. US factories are running full-throttle turning it out. The demand has become simply absolutely insane. People are scared, and are hoarding it. Lots of new gun owners are being born with the left’s assault on our LEOs. They all want ammo, too.

      Fresh ammo production is selling out within minutes of delivery to vendors. Literally minutes.

      If we ever did have a SHTF collapse, you don’t want 5.56 anyway. Most of it is FMJ target chaff. Stick with 223 in a true tactical round to survive something like that.

      But I think we are much closer to a peaceful political victory than many think. I remember 1968. The left is more scared than we are. They are losing. That is why they are attempting a violent marxist riot with their failed Millennials.

    Keep in mind that this is not just about Flynn, although destroying the lives, fortunes, and reputations of anyone who worked for Trump is a standard Dem tactic (Manafort, Papadopolous, Flynn, Stone), and one going back to Bork, Thomas, Kavanaugh, etc.

    It’s about the election, and the “Trump politicized the DOJ” meme.

    That’s why Sullivan wanted Gleeson to investigate the decision to move to dismiss – to get dirt to support this. That’s the goal of the judiciary committee hearing at which Barr will testify – to give the Dems sound bites in which they accused Barr (and Trump) of using the DOJ for political purposes. Same thing with the little rodents like Zelinksy who testified about the changes in the Stone sentencing memorandum.

      If the relevant documents are internal to the FBI/DOJ, it would more likely be Barr declassifying them, as it was a set-up of a domestic criminal prosecution.

      The problem for Barr and/or Jensen is knowing where to look – i wonder where some of these handwritten notes were stored – and were they also scanned into the database and properly indexed – and not quite knowing what you’re looking for other than any evidence from notes, emails, correspondence, etc. that indicates a plot to frame Flynn despite the investigation concluding he did not lie to investigators or violate the Logan Act.

    Petition for rehearing was about as persuasive as Gleeful Gleeson claiming he is neutral. This petition will be denied within ten days. It does not meet the standard for rehearing. Another Hail Mary pass from Suspicious Sullivan and his beach friends. There is a question as to whether a non-party can even seek this relief, but I agree with other posters that the full court should deny it on the merits so as not to leave any technical grounds to appeal/challenge the case further. The current Chief Judge wrote the Fokker opinion. There is no Circuit conflict – there is Circuit agreement. There are not enough votes for rehearing, so I’d expect a denial of the petition with Wilkins, who never misses an opportunity to showboat, and whatever fellow traveler (maybe one more judge) he recruits writing a dissent.

      And this is an opportunity for a lawless rogue Judge to be put back in line by other non lawless Judges. Even if one or two on the full appeals court are dirty, the one that are not should be in the majority and stop this in it’s tracks.

      Sullivan on his own can do a lot of corruption but to expect a majority of appeals court judges to do the same is much more difficult.

His intransigence is worrisome; does he know something of the Democrats plan to steer the election to Biden? This latest delay tactic has all the markings of a pending SCOTUS appeal. Problem is the Court is soon going to recess until October. This is the only way the Flynn case gets dragged past the election.

    So during the Nov 5 – Jan 20 time period Durham comes forward with indictments against a host of people not including Biden but various members of the prior administration.

    Just how pissed and angry will 60+M Americans be that this information was withheld only to be released after the election, especially if key people in Obama’s administration WHO worked with Biden on a regular basis and sat with him in numerous meeting are indicted?

    Shouldn’t truth have no boundaries? Shouldn’t the truth and justice be told and administered regardless?

    After all the attacks on PT were political AND illegal.

    To hold back the truth from the ENTIRE American voting public until after Nov election is just flat out wrong.

    It will only outrage and drive massive protest and unrest IMO.

    Barr must see this right?

      Yes, Barr knows this so if they punt it means to me they will come up with some cockamamie excuse why all of this was policy and procedural issues but no criminal crimes.

      So to me Barr’s only options are to indict now and do the right thing as per his equal justice and one tier of justice for all statements.

      Or

      Punt and use a Comey type “no intent” BS excuse of some kind to justify no indictments.

      I’m thinking if PT now sees everything is getting punted post Nov that he MUST go nuclear ASAP and bring back Grenell and between he and Ratcliffe they declassify and unredacted virtually everything so the American voters can see the truth of these perpetrators crimes.

      Surely PT must know this?

    Judges in general ( there are noble exceptions) are passionate and hunger approval of fellow judges. This is who now governs us. Arm your self.

  42. Regarding delay time limits. The decision or vote on en banc should be quick. If en banc review is denied. Sullivan must petition for cert by July 23 at the latest. If that is denied it should be within two or three weeks. Sullivan does not have the right to an automatic appeal to the S.Ct. where it will just sit. Appealing and losing alone will not delay things much. He has to win somewhere.

  43. KT Mc Farland appeared at 7:45. She has concluded that the Durham investigation is over and the the Deep State has won. She was convincing. I hope this was a head fake. There is alot of conflicting stuff going on. Things look bad if she isn’t faking.

    Flynn is not under gag order. I think he would put his country first and work with Durham and Barr.
    I don’t think Flynn is delaying the investigation by not talking. He needs to be vindicated to get a security clearance.

And, due to the privileged station of the a*****e, the pensive one keeps working the room talking the talk but slow walking the articles. If/when the time comes, it will be a pro forma slap on the wrist–a technical finish. Either that, or it gets handed off to another who simple vanishes over time.

    The talk is the sale. No talk leaves the matter settled in everyone’s mind: he won’t act. So, he talks….there’s always the future, right?

    The Appellate Court should have enforced its order on Sullivan. The Court ordered Sullivan to reply, not some hired mouthpiece lawyer. When he failed to file his own reply – his reply – the Court should have issued a rule to show cause why HE should not have been held in contempt so he’d have to come in and explain HIMSELF. He is the best evidence of why he took this extraordinary and franly ridiculous action and should have been subject to the Appellate Court’s discipline.

    Have no idea why he will not let this Flynn case go and get on with his life and his work. Its very sad . Very Sad. Would like to know who is pulling his strings. Certainly not the rule of the law.

    It will be interesting to see the response to this “petition for rehearing en banc”. As an interested observer with no legal training who has been following the case for some time, it is my clear impression that Judge Rao (who filed the opinion for the Court of Appeals, ordering dismissal) is operating on a significantly more elevated intellectual plane than Judge Sullivan’s counsel, Ms Wilkinson. Whether there is anyone else at the DC Circuit of Judge Rao’s calibre who would be willing to go head-to-head in challenging her carefully-crafted arguments for dismissal, remains to be seen.
