New York COVID Compliance Authority Issue Subpoenas Requiring Forced Depositions With Contact Tracers…

Comrades, the ministry of COVID compliance in New York has now been given permission to issue subpoenas requiring the general public to comply with COVID compliance contact tracers.  Any New Yorker who refuses to answer the interrogation questions by the COVID compliance police is now subject to arrest.

You do not have the right to remain silent, and everything you say will be guaranteed to be used against you as the state takes control over your life.

The process of “Contact Tracing” permits the state authority to identify the travel, contacts and associated risks presented by anyone who tests positive for the COVID-19 virus.

A positive test now results in a new class of citizen, considered of such a significant risk that their constitutional rights are suspended.   Thus, it is in the interest of state security for the state to have legal authority to compel compliance with questioning.

Additionally, if a parent tests positive, it may become necessary for the state to control that person’s activity; which may include the removal of any children into the care of the state; saving the minor child from the risk their parent(s) represent.  There is a myriad of new roles and responsibilities for the state in the life of a person who tests positive.

NEW YORK – Officials in New York’s Rockland County said Wednesday they are being forced to issue subpoenas to compel people to speak to contact tracers about a coronavirus outbreak because they are not speaking voluntarily.

The country’s health commissioner, Patricia Rupert, said at a news conference that subpoenas are being issued to eight people who were infected at a recent party in Clarkstown, N.Y., north of New York City, but who are refusing to cooperate with contact tracers seeking to interview them to determine who else they were in contact with and could be at risk of spreading the virus.

The drastic step of issuing subpoenas in a contact-tracing investigation illustrates a problem officials have cited around the country, that many people are not answering their phones or cooperating when contact tracers try to talk to them.

Public health officials say contact tracing is a key step in slowing the spread of the coronavirus. The process interviews infected people about who they have been in contact with so that those people can be notified and asked to quarantine for 14 days to prevent further spread of the virus. Big Tech is working to facilitate the effort of the State, and will assist the COVID compliance police with identifying your travel.  If you resist the efforts of the tracers to identify your location; and/or if you resist the effort of the state to place you into a quarantine facility; you will likely be identified as a subversive citizen, an “enemy of the state.”

We might anticipate to see an underground railroad for those attempting to avoid capture.  This is all becoming very disconcerting….  Where does it end?

        The problem is that these are not criminal cases. The Fifth Amendment provides protection against self-incrimination only in criminal cases. These are likely civil subpoenas, not part of the criminal process, that are enforceable with contempt-of-court powers

          Lawyers advise **in all cases** that you plead the 5th, and that you ask for your lawyer before speaking with police/authorities. It can prevent your being falsely charged.

          As long as there is the potential for a criminal case (and there is, since this allegedly involves a party with more than 100 participants) then these eight people have every opportunity to employ the 5th Amendment in a connected civil matter. You’ll actually find a SC case per a New Jersey case involving forfeiture that recently decided the factor.

          Still, these folks will require representation to make that point since NY is willing to apply $2,000 per day fine to non-compliance.

        The problem here is that the Fifth Amendment protects against self-incrimination; here, one would not be incriminating oneself by talking to a contact tracer, unless potentially, the person had committed some crime in the conduct for which the contact tracer is making contact. The subpoenas would be enforceable by contempt-of-court powers.

        Under the new incoming regime if the Democrats win everything, you will no longer have a 5th Amendment right, you will have no right to an attorney.

        You will be presumed guilty even before we ask you any questions, you have no right to stay silent & you can go to jail until you completely & truthfully comply w/o a judicial proceeding.

        You can claim all the constitutional protections you want—this contact tracing dog-and-pony-show is going to operate in the same way that “Red Flag” laws operate. A groundless “contact” will be treated the same way as a potentially real contact which means the cops are still going to come and kick your door in a 5AM with a demand that you surrender your rights. This is how police states work. And we are very, very close to a police state now.

      My neighbor went for a pedi today, her first appointment since the lock down. Before she could be served, she had to fill out a bunch of forms including name, address, e-mail, phone number, age, etc.

      When she asked why, she replied it was a NYS requirement to assist contact tracers. If the shop owner does not collect the data, they face heavy fines including a loss of license. [This includes letting customers sign their name ‘Mickey Mouse’] The shop has only been open a week, and have already had two surprise inspections. This is a very small town.

      I suspect barber shops are required to do the same. That’s why I’m still cutting my own hair. With number 2 clippers, I can do it in under two minutes.

    • fan- the problem in Covid Compliant Gulag of NY is this: the police only go after and arrest innocent, law abiding citizens who are trying to reopen their businesses, enjoy some relaxation at a beach or park, who don’t wear mask muzzles properly or at all, or who don’t stand far enough apart from one another. Those are all the real crimes.
      If you are an arsonist, a murderer, a rapist, a looter, a rioter, a thief or a real criminal, the cops have to leave you alone.

        At least one gym in Phoenix area defied Gov Ducey’s shutdown orders and filed suit against him. And I’ve heard that one of our gyms up here in Flagstaff had also stayed open. Local news (affiliates of the MSM, with all personnel looking to their future to “move up”) will probably pan this.
        A few defy power, they get crunched.

    Whom do they work for?
    What authority/oversight do they answer to?
    What is their salary?
    What are their qualifications, training requirements, and jurisdictional parameters?
    Who created and filled these positions?
    What is the legal framework these positions exist in? Is there even such a framework?

    The job of “contact tracer” did not exist 6 months ago. These government positions did not appear out of thin air. In their creation lies a story.

      Each county had to “create” a certain number if these “positions”, depending on population, in order to “comply” and be granted “permission” to participate in one of the four “phases” which are constantly being changed according to the whims of his majesty (/s).

      For example, gyms and movie theaters were suppose to be included in phase 4. They are now excluded until they modify their HVAC systems to be able to filter out the Wuhan virus.

      Seriously.

      Supermarkets, etc. are excluded from the HVAC requirements “because people don’t spend as much time in places like that”.

  8. They are administrative subpoenas, not authorized by a court of competent jurisdiction (i.e. – not signed by a judge) and are, therefore, a joke given the atmosphere in which they were issued.

    When was the last time NYC arrested someone for not reporting for jury duty?

    Same idea.

    They have zero way to isolate WHEN a person got the virus. You could have had the virus since Dec 2019/Jan 2020 and they want you to quarantine now? For what? For being a “possible” carrier for 6 months? What happens at the end of 14 days? You’re still a carrier.

    I would fight and fight and fight against this. Make them prove in a court of law WHEN you got the virus and that you are a threat to others. They’ve just skated on the slimmest of b.s ever-moving, ever-changing “facts” for months. And they refuse to acknowledge that there are now plenty of treatments, proactive or otherwise.

      Herr Cuomo, in his infinite wisdom, has found it just and proper to practice medicine without a license. He has forbidden doctors to prescribe and pharmacists from dispensing hydroxychloroquine, zinc and Azithromycin outside of being admitted to a hospital.

      Except if you go to a hospital exhibiting “milder” symptoms, you will not be admitted and sent home (*).

      By the time you are sick enough to be admitted to a hospital, it is too late for that treatment. (Not /sarc).

      (*) Was in a Walmart about 6 weeks ago talking with someone who relayed that information, people that they knew.

      Those people rejected from the hospital went home terrified. Local news has not been playing those stories.

    Yesterday, my brother told me to check the G@ogle settings on my Android phone.
    And there it was, a Covid Contact Tracing app.
    My location/GPS assist is usually turned off.
    The Covid tracing app had turned it back on.
    I changed it back, checked just now, and it’s still off.
    Glad I am not in NYC right now; the Covid SWAT team would be at my door in a minute.

    Kudos to those refusing. It is a violation of 4th Amendment rights. Once it gets to the courts it will be a rude awakening for the progs/anarchists.

    If there is anything good about this Covid mess it’s that it is separating the patriots vs the sheeple, both in a political and individual sense. I just hope voters are taking good notes.

    I recall reading the State of Virginia had set up a contact tracing department. That scares me! I just can’t believe these state employees are given so much power that they can separate a family if they find necessary. I wonder if they look at political affiliation before they com knocking!
