2ANYS Tells National Guard Cuomo Order Violates 5th, 14th Amendments

Cuomo’s state-mandated kleptomania of health care supplies amounts to COVID-19 induced euthanasia of upstate residents

April 4, 2020 – BUFFALO, N.Y. – 2ANYS, New York State’s premier civilian rearmament enterprise securing maximal Second Amendment civil rights by, with, and through The People, issued an urgent letter today to Major General Raymond F. Shields, Jr., commander of the New York Army National Guard.

    https://www.2anys.com/2020/04/2anys-tells-national-guard-cuomo-order-violates-5th-14th-amendments/

According to a news report by The Buffalo News on Friday, April 3, 2020:

“National Guard troops will be dispatched to upstate hospitals and other health care facilities to pick up ventilators, masks and gowns from areas not yet hard-hit by the spread of the coronavirus.”

“Before you participate in carrying out the executive order described by Mr. Cuomo, I’d like to articulate that said order, as described by the governor, is at least violative of upstate New Yorkers’ Fourteenth Amendment right to equal protection under the law, and Fifth and Fourteenth Amendment right to due process of law,” 2ANYS Founder Steve Felano explains in the 2ANYS letter to Major General Shields. “The unilateral edict described by Mr. Cuomo clearly, under color of state law, allocates substantially more legal protection to New York City residents by mandating the forceful theft of critical health care equipment from upstate New Yorkers for the redistributive benefit of New York City residents amid a deadly pandemic. Upstate New Yorkers have no due process available to challenge such theft because Mr. Cuomo has unilaterally and effectively shut down the state court system via executive order.”

Additionally, should Major General Shields allow such government-sanctioned theft from a hospital that is a religious health care institution, he will be violating First Amendment protections of the free exercise of religion, as the practice of many religions includes caring for the sick as the religious institution sees fit, not the state.

Overall, if Major General Shields permits New York Army National Guard soldiers to carry out Mr. Cuomo’s executive order to steal critically needed ventilators and PPE from upstate hospitals so they can be redistributed to New York City residents, he will be directly violating the oath he swore to support and defend the United States Constitution, which states:

“I, Raymond Shields, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.”

“Mr. Cuomo was wrong when he said, ‘you don’t need an AR-15,’” Felano relayed in the 2ANYS letter to Major General Shields. “Upstate New York residents most certainly do need an AR-15 to protect themselves from the governor’s myopic mission to transform upstate into soylent green for New York City by executive fiat. Don’t make the path to oppression a smooth one. Respect your oath to remain faithful to the Constitution, not the ramblings of a tyrant grasping at straws amid events beyond his control.”

As a lifelong New Yorker and someone who’s been involved in our state politics I believe that El Duce Cuomo and his Demon Rat minions will be robbing and plundering most of the financial, material and medical aid that is being give to us from President Trump and the Feds. Highway Robbery is not a bug, it’s a feature.

Who are the officials in our State who would be charged with keeping track of the billions that are supposedly being sent here for we the people? I can tell you this, that probably 99% of state workers are on paid vacation. They are worse than useless in my own experience and that of my many friends who are small business owners.

There is nobody out there helping us fill out forms, manning the phones or doing anything to expedite the process that’s been set in place by the SBA and CARES Act.
Instead, NY is a choke point. It seems that the money, materials and support are being hijacked, most likely by State workers who know all about how easy it is to steal from the unwitting taxpayer. When this fiasco is over, there will be many, many new millionaires who made their fortunes through outright theft or selling supplies on the black market.

Finally, one other NY honorable mention from American Thinker, regarding the criminal actions of Comrade Deblasio and his affirmative action, know nothing “health” commissar.

“ Leaders are dealing with the crisis on a largely national basis, but the virus’s society-dissolving effects do not recognize borders. While the assault on human health will – hopefully – be temporary, the political and economic upheaval it has unleashed could last for generations. No country, not even the U.S., can in a purely national effort overcome the virus. Addressing the necessities of the moment must ultimately be coupled with a global collaborative vision and program. If we cannot do both in tandem, we will face the worst of each.”

See, when you are not prepared for ANY emergency then all are life threatening so they don’t need to perpetuate anything,’ life’ becomes a willing accomplice. And then the cries for safety are universal and ‘freedoms’ are the coins we will pay demanded by those rulers.
Past history was, advancing technology was copied to ‘better’ a civilization.
Present, we see the plight of third world countries immersed in diseases and poverty being forced on advancing civilizations to control their populace.
It is strange our entrepreneurial advancement is more linear instead of upward in many essential areas, vaccines, medicine, nutrients, cures especially, which is very odd considering we have AI computers able to accomplish tasks far beyond our human reach.
Money has dictated ‘why’ we don’t see cures, IMO of course.
Advancing under that premise then, a ‘cure’ would be against the interest of the ‘powers that be.’
Nutrition seems always the best direction because it is preventative.
IF the advancing technology of AI does reach the general population eventually people will be able to acquire their own information, maybe? I guess that regulation is next.

The “recovered” tally is essentially meaningless because those who are/were asymptomatic are not even allowed to be tested. There could be (probably are) millions of Americans in that category meaning the vast majority exposed to the virus have already recovered from it and are now immune. Fauci and his minions do not want that known because it makes the virus a whole lot less scary and destroys their doomsday scenario based lock downs.

A family member works for a company that has international business interests and thus executives who travel internationally. One executive became ill on return from China with the symptoms of moderate COVID19 but recovered, along with others who also caught the mystery illness once it was spread in the office. No one was hospitalized, all recovered. I’m not certain anyone did anything beyond treat it as a form of flu.

What is happening makes no sense, and to be honest if Obama was still President I would be certain this is a manipulative hoax. With PDJT in the White House , I find this all more confusing because I trust him. Is there something he knows and cannot share? It all doesn’t make sense.

People die every year from flu and the deaths, while weighted more heavily in the elderly/ infirm demographic, occur across all age groups. The reaction to this disease seems disproportionate to the illness.

I saw a video in one of the other thread comments, where a guy was walking around New York reporting about the situation on the ground at the hospital’s, etc. I will not discuss what he said, I will only offer a few observations.

It seems that the coronavirus hotspots exist in only a few States, and then it’s at a few hospitals in each of those States. I noticed that whenever this reporter met any members of staff outside of the hospital and tried to to obtain information from them, he was directed to the official media spokesperson.

This got me thinking, and it appears that the entire information operation is being run by very few people. I was wondering if it would be possible for the government Coronavirus task force to place official observers on the ground inside the relevant hospital media centres, on the wards, and inside the executive office to gather facts about what is actually going on. It would also help if they had the power to interview staff under oath while gathering information.

    Is any of this possible?

This is highly misleading. You need to change your heading to “Total Tested Positive for Coronavirus” instead of “Total Coronavirus Cases”. We have absolutely no idea how many cases there are because asymptomatic carriers (of which there could be millions) are not even allowed to be tested. Unfortunately, they can still transmit the disease. Read article linked in Tweet below to understand.

      This is a very telling article summing up a recent TED talk that Bill Gates did. A few shocking things stood out;
Bill Gates isn’t worried about the cost of the whole nation being on an economic shutdown for months on end. BUT, he is worried about the cost effectiveness of using antibody treatment for Corona Virus (of course that’s because he wants his vaccine to bring in big bucks to he and his cohorts).

Bill Gates speaks to reopening the country AFTER his digital certificate is implanted in citizens via his Super vaccination (covering multiple viruses.) He is on a mission for control. We no he wants to eliminate a big portion of the population, I just can’t imagine the gall to go about this thru vaccines and abortion. Ugh.

I have to admit that I was a bit perplexed myself during the presser yesterday… At first I was very encouraged as The President seemed very focused and resolute on getting the economy back up and running, reassuring his restaurant buddy that he’d be back up to full seating capacity soon, and mentioning getting sporting events going again as well…

But then he threw in the whole thing about how dangerous this virus is…that it can be spread by people just talking to each other and that it can live on surfaces for long periods of time. My husband and I looked at each other and said, “Why is he saying that?”

I guess the Sunday shows are hammering him for mixed messages and I have to admit that I felt that way yesterday myself…was he just going off script and trying to show that he was taking the virus seriously or what?

Just need some help to figure this out, please….

PDJT is always looking for a way to create a tension about any situation so that he can then deliver his preferred narrative. In this case… what can come after the suffering???

Who’s getting tested? Largely, people with flu symptoms.

When they test those people, they find that between 10 and 20% of those tested, don’t have the flu, they have the Coronavirus.

They then go on t.v. and tell you that anybody that thinks the Flu is just as dangerous as the Coronavirus is an idiot…. when 80-90% of the people tested have the Flu instead of the coronavirus.

Think about what they are telling you. They are largely testing people with symptoms. 80-90% of those tested have the Flu, not the Coronavirus. They are then telling you in the next breath that the Coronavirus is nothing like the flu and anybody who says that is a moron.

I think an 8 year old could logically see what’s going on here. I don’t think people are necessarily doing it on purpose (most of them) I think they just don’t think very logically. What would I know though, i’m just a good old boy, everybody knows we’re not very smart.

This has been my observation as well. Scientists spinning this are clearly not mathematicians as their numbers don’t add up and have not from the beginning. Even Dr. Brix, who I thought was a voice of reason early on, said emphatically a week ago 200K US deaths were the low side if everything was done perfectly… then a few days later 100K-200K… they will end up with where I was at a month ago… below 40K, or a normal flu season. All the measures we are taking are not about prevention, just flattening the curve so hospitals are not over-run. But ventilators still have 85% mortality rate… beyond having and prescribing HCQ, which the medical community fought in the beginning, it seems the reduction in death that hospitals are providing with this virus is marginal, more so hospitals and government do not want to be perceived as inadequate.

Just read article on Italy that said government quarantined Northern Italy, so everyone escaped to Southern Italy, expanding contamination rapidly. More times than not, governments create law of unintended consequences with their actions, to the detriment of the people.

We still have a commodities rout, global market turmoil, unemployment thanks to The Great Pause, immigration issues, etc that did not go away. There is a stealth cleaning of the IGs for FISA going on as well.

One of the Great Tragedies of this whole sorry episode:

When our medical “expert” team running the country went to DJT and said, “SIR, we have to shut the country down,” there was NO proponent of our free society, rule of law and Constitution there to interject: “SIR, you have NO authority to “shut the country down. This is not a totalitarian police state. Our federal and State constitutions protect the citizens’ freedoms from all Tyrants, Federal or Local, no matter how well intended. Whatever ‘extra-constitutional’ powers you might have as Commander in Chief to declare martial law in SOME small segment of the country in wartime, you do NOT have any authority to exercise such powers to fight a virus.”

And then when the Deep State “experts” and their legal enablers said, “Well, you can declare a Federal Emergency, grant unlimited federal funding to Governors, and then they CAN shut their States down. ‘Federalism,’ you know”; NO adviser to retort, “SIR, you have NO authority to engage in such a ruse to get around our federal Constitution, and anyway both our Federal and State Constitutions deny Governors any such totalitarian police State powers in their own States. If some Tyrannical Governor tries this — even without federal funding — it may become YOUR duty to protect citizen’s liberties from such Tyrants.”

In doing this, shutting down businesses that produce state sales tax (or fees or licenses) dollars to the individual states, AND in many states, NOT generate the volume of patients that could result in a ‘big payday’, citizens in these states can clearly discern for themselves if their state government’s ‘consent’ to be governed by we the people, or if they whore themselves out to their desire for this sickness (fed.$) . . .

It’s not even about the money, IMO. Look at how easy it was to shut down the most of the world and take away our rights to worship and make a living. There will be another run at this, and the next time around, a much higher fatalitiy rate. A lot will be learned from this by TPTB. In order to “be allowed” to return to society, get your chip. The biggest tell in the Gates’ TED interview, parts of which have been edited out, came at the end when Gates admits the plan for shutting down the U.S. is disallow at least 1% to get the virus and develop immunity, in order to require “digital immunity proof.” The question in my mind is how much economic and psychological pain will be allowed this time around.

His lackeys (WHO president and Dr. Fauci, both funded/supported by Gates) are stopping the real cure that President Trump is promoting, and is now official preventative in India and is being used in Italy.

It is effective (NY doctor cured 699 patients, 100% success rate), safe (used since the 1950s) and cheap ($20 per patient for 5 day treatment).

Problem with the theory is that there is 20+ companies working on a vaccine. (I know cause I’m in Vaccine R&D). I’m a Pharm.D so I also know of Hydroxchlorquine/Azithromycin. Currently know if it’s use in hospitals today with my contacts in various hospitals in my current job.
We will have (I will guess) 6+ successful candidates when all is said in done. So free market will have some force regarding use.
So, it will be 12-18 months before any of these candidates will be ready.
Hydrox/Azithromycin (we do worry about the cardiac issues) or hydrochlorquine (and other antivirals) will he but a bridge until we can get vaccine.
In infectious disease, prevention is always preferred. Many will have been exposed and it seems from what we know from the virus so far, that the mutations are minimal, so one will be protected from season to season. Those without natural immunity need some type of protection. Hydrochlorquine could be a top gap until a vaccine, but his drug is not like taking say metformin. Eye issues, makes you feel like sh*t..plus you have to take it daily. Sure it’s cheap, but it adds up if one has to take it daily. Daily for say 6 months?
So really, the best bet is a vaccine. Will be two doses probably. The mutations seen aren’t the targets most vaccines are targeting so won’t be like the flu shot. The most “expensive” vaccines available now are a couple hundred bucks a shot. Yeah, that’s expensive, but 180 tabs of Hydrochlorquine at Walmart I just checked is $230.
So, I guess give people a choice. Take a daily pill for however long…or get a vaccine.

            • Infidel- way back in the 1980s and 1990s I belonged to several statewide Taxpayer groups that worked to advocate for those of us who are paying the bill for the Dem/ Commie agenda.
We would have meetings at various locations in NY and exchange information with one another. Sometimes we marched on Albany and confronted our legislators directly.
Mostly we worked in our towns and counties to try and get good people to run for elected office including school boards.
We had some pretty good results and accomplished a great deal in some places.
Something happened when we entered the 21st century and it’s been downhill for taxpayer advocacy ever since then.
Many of those involved had passed away, retired, left NY or just plain gave up.
Fast forward to the present and I can tell you that nobody cares about Taxpayer justice.
The new, younger, wealthier people who have moved into my suburban town are clueless imbeciles who don’t seem to care how high their taxes are. They couldn’t care less about Liberty or Freedom either.
I ran for town board unsuccessfully to see if I could make a difference, but couldn’t get the support of the RINOs so had to run Libertarian. No way can you get elected without a D or an R after your name.
I am grateful beyond words that people like us have the Tree House to meet and exchange our thoughts during these perilous times.

Well my friend, if the leftists are successful in cheating President Trump out of this election there will be no sane place to run to. I have no idea, and neither does the Guv, how they are going to pay for this $177 billion budget. All his green energy proposals in this boondoggle will drive even more business out of the State.

            • scrap- yes you can definitely tell what their priorities are when you look at the budget.
_ ending taxes on tampons and feminine hygiene products so as not to discriminate against trans freaks.
              – permanently banning good cheap energy from fracking while imposing unworkable, subsidized wind and solar power that couldn’t keep NYC running on a hot summer day. And don’t forget one of Il Duce’s proudest accomplishments- shutting down the Indian Point (nuclear) Power Plant that has safely provided electricity for 25% of the NYC metropolis.
The Marxists are relentless and this Chi Com Flu is their dream come true. If this wasn’t planned somehow it surely has become their Perfect Storm.
We have to work to make sure that President Trump wins by such a large margin that they can’t cheat him out of a second term.
If we lose in November, game’s over.
We are seeing what the other side is capable of and it ain’t pretty.

All of the above-mentioned efforts are now in place to help fortify the Governor’s Making Progress Happen agenda.

I didn’t want to copy and paste all the grief in the article – there is more.

Unfortunately, DJT’s Emergency Declaration opened virtually unlimited Federal funding for whatever Royal Governors “certify” to be needed for the “emergency.”

State Tyrants only began issuing their regal edicts AFTER this Emergency Declaration. They would not have DARED to undertake their totalitarian police state mandates IF they knew they would have to tax their own citizens/voters to pay for them.

Congress, the Treasury and the Fed are now in the process of making up and distributing staggering amounts of new costless digital money to “anybody and everybody” who’s hurt by this crisis. Look for States to be among the major recipients of these funds (with the most Tyrannical Governors getting the largest shares).

  36. At my house, if someone gets sick cold, flu, whatever I have always changed the filter for my furnace/AC at least weekly if not every 3 days depending on the severity of the sickness. How often are air filters being changed in these massive apartment buildings, I can’t imagine they all have their own separate furnaces. Couldn’t some of this massive spreading be from the air being blown in for the heat and AC?

I read on here yesterday that the lawyer for the Covington kids, Robert Barnes, was planning to file suit somewhere regarding the unconstitutional stay at home orders. I want to support any lawyer who may take on such an endeavor since the ACLU is conspicuously absent on this (of course).

I wrote to Robert Barnes yesterday and he emailed back shortly saying support can be given through the website free America law center. He did not answer the question regarding the rumor of a lawsuit regarding the stay at home orders. Lawyers gonna lawyer lol.

Anyway I wanted to mention it because I think he’s doing good work regarding the Covington kids and hopefully he will sue regarding stay at home.

Admins, if I should not post this regarding fund raising, I apologize.

Simple. They do not want to end the shutdown. They want people to be sick and die and for the USA economy and everyone in it to go broke. They have already transferred wealth we do not have into power hungry people’s bank accounts, and they are salivating on what comes next.

My overall view is that all information coming in should keep one purpose in mind: getting those regions of the U.S. with “good control” back to work and back to normal medical procedures by May 1.

Sundance’s post asking for current conditions around the U.S. came up with one big conclusion. Way too many hospitals, medical offices, and clinics are longing, pining for their patients and clients and are having to layoff or furlough doctors and nurses. Unacceptable. They must function again very soon again.

Basic assumptions: 1) This new virus has extreme infectvity; 2) Few are harmed by the illness in younger age groups, but the numbers of older folk and those with “co-morbidities” (please note, probably the majority of “old folk”) are seriously impacted by the illness from death to permanent organ damage. This is unacceptable and what the current conditions are attempting to ameliorate. 3) Now, with President Trump and his Task Force’s efforts, this emergency is being handled during the month of April. 4) Separate out the treatment for CoVid-19 from all other procedures. It looks like we have the national capacity to do so. Those who want to move away from the urban infestations should be able to do so, with agreement to self-quarantine for 14 days (or appropriate time).

Going forward: 1) Everyone will have to accept more risk. If as we move about more normally, AND with our new-found ability to be more healthy, and become infected, we must have access to the proven medicine for cure – hdroxycholorquine + zinc + if needed, azithromycin; 2) President Trump and his Task Force must demand that adequate quantities are manufactured in the U.S and every region of the county have access to it and individuals may purchase it (ok if by prescription) for peace of mind.

Additional assistance: 1) Antibody tests which might give peace of mind if, and a big if, recovery from an infection with normal antibodies formed against reinfection actually prevent a recurrence of the disease. I think we must test this outcome in practice. There is no time for the years of double-blind research. 2) This test must be available to anyone who wants one. That means manufacturing in the U.S. lots of tests.

Titrating back-to-work. 1) The younger first in person-to-person businesses. 2) What has worked by internet, e.g., tele-medicine (I have engaged in this both as doctor and as patient), can continue. 3) U.S. national security must demand that the U.S. develop a product with the capabilities of Zoom (Chinese owned, as I understand it) for new U.S.-developed businesses. The imagination and creativity of American entrepreneurship is extraordinary.

If shutdown goes into May this will dwarf the Great Depression. That is when temporary business closings will start to become permanent. Both Great Depression and Great Recession were caused by the financial sector which then spread to the rest of business sectors. This is on the verge of a complete economic and business collapse all at once. Every single sector of United States businesses will need to be bailed out. Unfortunately what we are witnessing is the greatest overreach of governmental powers in our history, all because of an unknown and what ifs and letting data run 100% of the path. Everyone knows who works with data never let it completely overtake your decision making.

Don’t know about ” greatest over reach of Governmenyal powers in our history”, Lincoln suspending habeous corpus, and indefinately jailing those he percieved as a threat, and FDR locking up japanese american citisens comes to mind.

And somehow, our Republic recovered from those two UnConstitutional over-reaches, both excused due to ’emergencies’.

So, while I understand and even agree with the concerns expressed, that these over-reaches will become permanent, I am frankly sceptical.

Overall, I remain optimistic that things will turn positive, “in the end”.

A criminal investigation has been launched in Australia into how cruise ship passengers were allowed to disembark in Sydney despite some exhibiting flu-like symptoms.

More than 600 people on board the Ruby Princess later tested positive for coronavirus and 10 have since died.

The ship remains off the coast with nearly 200 sick crew members on board.

Police in New South Wales said they would look into whether national biosecurity laws had been broken.

Australia has so far reported 5,548 coronavirus cases and 30 deaths.

Those sickened on cruise ships account for nearly a tenth of all cases in Australia.
