Mitch McConnell Prepares for Next Steps in Senate Trial – Questions, Then Possible Witnesses…

Earlier today Senate Majority Leader Mitch McConnell announced an agreement with Minority Leader Chuck Schumer for the Senate questioning phase of the impeachment trial that begins tomorrow.

Senator Schumer and McConnell have agreed to alternating back-and-forth questions from Republicans and Democrats over the course of two days totaling a maximum of sixteen hours.   The alternative would have been 8 hours of questioning by Democrats followed by 8 hours of republican questions.  Obviously, and curiously, McConnell and Schumer see a benefit to alternating back-and-forth over the two days.

Additionally, according to several media reports, McConnell took a ‘whip of the Senate’ regarding witness testimony and does not currently have enough republican votes to block the pre-planned House Managers’ unconstitutional scheme to call witnesses.

The appropriate constitutional position for the Senate to take would be that the House investigates; the House calls witnesses within their investigation; the House assembles articles of impeachment; and the Senate is the trier of fact from those articles.

Ergo if a witness was not included in the article assembly, that would be a defect of the House articles; incurable in the Senate.  However, it appears there are enough republicans willing to establish a new extra-constitutional process whereby the House can assemble speculative supposition; avoid the executive branch using their lawful process to appeal to the judicial branch for opinion; and put the burden of witness testimony on the Senate.

How and why any senator would agree to establish this precedent is beyond my comprehension.   Perhaps it would be a worthwhile endeavor to call, email or write our senators and ask them why they would even contemplate such an undertaking.

In the current quasi-constitutional House process, the Democrats refused to allow Republicans to call witnesses during their investigative phase.  As a result the articles as assembled are completely one-sided and partisan.  There are no republican witnesses in the evidence underpinning the article assembly.  This was obviously done by design.

As a result a one-sided, Democrat only, witness group is structured in the articles.  Now the same Democrats are demanding additional witnesses beyond those they called in the House.   The witnesses they are demanding are from the executive branch; and blocking the executive from access to the judiciary explains why the Democrat plan has presented this end-run around the constitution.   This was not a flaw in the article assembly, it was a feature.

I refuse to accept that Republican senators are stupid.  Obviously they, like us, can see how and why the House used this process; yet they are willing to allow it.  It makes no sense unless we accept there are GOP senators in alignment with the usurpation plans of the Democrats.

If the House Managers are successful in executing this scheme, the impeachment process will forever be severely subject to partisan manipulation.   There will never be a republican president not subject to the impeachment whims of the House…. and this new standard of making the Senate a participatory investigative body instead of a trier of established House evidence.   There’s no good answer why any member of the upper-chamber would permit such an abusive construct other than pure political power.

If I can make this argument understandable to you as readers, surely Senate Majority Leader Mitch McConnell could emphasize the gravity of this issue to his fellow colleagues in the Senate.   Yet apparently he has not.

The inability of Senators, regardless of party, to articulate this simple and dangerous constitutional issue is the most alarming development in this entire impeachment process.

In the most general of terms, DC politicians do not understand the level of intelligent understanding held by most voters.  Perhaps, as a final firewall against losing our constitutional republic, it would be helpful if we contacted with our senators and advised them we are aware of the issue.

    I’m not ready to believe these “media reports” for a variety of reasons…

    1. With 10 months until the election, this scam will be publicly exposed just as “Trump-Russia” was, not to mention it had a similar Democrat genesis.

    2. Besides which, either way the President will survive, which will be bad news for any Senator who dares to cross him.

    3. Further, such a foolhardy action on the part of any Senators of his party could imperil the candidacies of their seatmates.

    So for these reasons of the top of my head and a dozen others, my bet is this is nothing but some more BSM “smoke and mirrors.” We’ll see shortly…

I live in the reddest of red states, and know many conservatives here, yet it boggles my mind how barasso, enzi (retiring), and cheney keep getting re-elected. Lummis is pretty much a straight shooter who listens to the voters. She was screwed by boehner on her committee assignments, and will probably be a shoe in for enzis seat. But you can bet your bottom dollar cheney and barasso get reelected.

    Why? I have my ideas, but it would take too much time and space to explain it here.

      Hi. I understand what you are trying to say. I lived in your state for about 10 yrs.
      IMO, complacency may be a factor. Most of the state hasn’t dealt with too much extreme left wing politics. There is still a sense of freedom and tranquility, urgency is not there.
      (I do miss it😉)

      Another factor in every state is who does the RNC back? Who gets the money and ads? Most of these people are chosen before they even run. They let us pretend to choose. Few outsiders get past the gate. If they do, well, they get impeached.

  7. I just looked at Pat Toomeys Facebook page and he is being swamped with Planned Parenthood and Teachers Unions people demanding witnesses. It’s very well coordinated and as usual Toomey is starting to go into his Flake mode. I’m amazed, these people will never, ever vote for Toomey and to fold will only lose his core votes. I cannot for the life of me understand why our Republican leaders are so stupid…

    So far, Mitch has followed the Clinton trial procedures; if that process continues, then following the “questions” he will make a motion to dismiss for lack of merit. Will he do that and make the Rethug snakes go on record voting against PDJT?

    If that motion is made and fails then the vote for calling witnesses is made. In the Clinton trial, three witnesses (Monica Lewinsky, Vernon Jordan, and Sidney Blumenthal) were deposed by the Republican House managers over a three day period and video clips of the depositions were then presented to the Senate. If witnesses are allowed this time, it will likely be a very contentious sh*t show.

Murkowski is just hateful and barley won last time so she is fence-sitting. Romney is living off of revenge and his state is one that I cannot fathom. Toomey is an Arlen Specter wanna-be. He pretends to be thoughtful but really is playing all sides from his state to get re-elected. Trust me on this, there will be no witnesses. The popularity of Trump right now is so powerful that these weasels will fold on the final vote on Friday. No witnesses.

    The Senators need to realizes that if they go down this path the House can tie up the Senate any time the wish for as long as they wish. With regards to that thought of tying up the Senate, does anybody else think another big reason they want witnesses so bad is to tie up the Senate to keep them from confirming judges? I’m not sure what Roberts being there does to the Supreme Courts schedule but I’m guessing it ties them up to.

    Structure the vote as a YES or NO on a specific list of witnesses. Yes to all … or No to all. No in between.

    Repub list starts with ICIG Atkinson, the fake whistleblower followed by the Bidens and then Schifty and his staffers.

    That woyuld turn the tables on the Dims. They will be the ones trying to block witnesses.

          They have Facebook, Twitter, the comments sections of the online local newspapers to get them started. The should already have block walking lists that would be helpful for finding people to contact elected officials.

          Here’s another thing they can try: They can contact elected officials on the state and local level and express concern about the constitutional damage that could happen by not sticking to trying the case as presented. Ask those office-holders if they have yet contacted their senators. I’ve done this before. The staffers were receptive.

    We still have the option of forming a new MAGA party. If President Trump is removed he can form one the next day from his campaign staff. There still may be time for candidates to file for election.

    And I also have suggested that Devin Nunes announce his candidacy for president. He doesn’t need to campaign. If President Trump is removed, Devin will be the MAGA candidate, not Nikki Haley.

    Taking that as a given Mitch needs to limit the damage that they can do. If he agrees to a vote on each witness then the Dems + traitors will vote to allow each of their witnesses and disallow Schiff, Ciaramella etc.

    Play it smart Mitch, you still have the power, use it.

    Retired Magistrate here: I don’t know about the rest of you, but I intend to continue praying for President Trump to be completely exonerated with no new witnesses and the trial ended this weekend. We can speculate all we want, but GOD is still in control and HE has placed President Trump where he is for a reason.

Even President Trump admitted during the rally tonight that he didn’t realize just how bad it was. The only thing they care about is their power. The separation of powers, the Constitution, and the people limits their powers. All three are a threat. Don’t think they won’t remove our best warrior from the fight.

    If the president doesn’t want witnesses, he should tell McConnell that if the democrats get witnesses, he’ll ask for his own witnesses – like James Wolfe, former staffer to the senate Intel committee. Ask him where he got the info that he leaked to his NY Times lover. Bring in witnesses to testify how Mark Warner was tweeting about meeting Christopher Steele. It would be playing with fire, because he can’t risk enough GOP senators voting to oust him that they might get to 67.

    Given that, should we contact other senators, including McConnell, and demand that they rebuff this insane attack upon our Constitution and forego this suicidal capitulation to the rabid house democrats? Note: have done this but wonderif they bother listening to a non-constituent.

    Also, based on his interview earlier this evening, Linsday Graham seems to think that this calling of additional witnesses is yet to be resolved (evidently, believing it will ultimately not happen), stating that he believes President Trump will be acquitted by the end of the week.

    If memory serves, he noted (as did the WSJ) that they do not need Bolton’s testimony to read and digest what is in his upcoming tell-all, those earth-shaking revelations Bolton evidently did not feel any “urgency” to disclose earlier to the sham house impeachment committee in order to bolster their Articles of Impeachment (to help save the country from the dire threat of a President who wanted evidence that corruption was being addressed before releasing aid).

    These swamp inhabitants see themselves as heroes while we laugh at their hubris.

    Am so sick of the lack of common sense in our nation’s so-called betters. During the history-changing events of this Presidency over the past three years, so many government agencies, elected officials bureaucrats, and reporters have lost my respect and my trust. I see them now as black-hearted knaves and educated idiots (and, yes Don Lemon, I am educated, but have no problem discerning truth from lies and right from wrong).

    God help us all. Senators, the Republic is in your hands – give up your petty differences and overweening sense of self and false pride.

    Act like the statesmen and selfless heroes who gave us the greatest country on earth and put your country and its people before yourselves.

    President Trump should never have been impeached on these shameless and sham accusations You know it and we know it. End this madness and stop this folly. Ruining something as precious and irreplaceable as our Republic over such partisan and false charges will be not only a High Crime and Misdemeanor on the part of the Senate, but a crime against humanity.

  42. Call your Senators whether D or R or I (hello Vermont). Tell them this from a poster above:

    “The appropriate constitutional position for the Senate to take would be that the House investigates; the House calls witnesses within their investigation; the House assembles articles of impeachment; and the Senate is the trier of fact from those articles.”

    Then call you State GOP office! Let them know that if the R person they have placed in the US Senate does not pressure Mitch to get his ‘caucus’ in line then you are holding them responsible. I don’t care if it’s Josh Hawley. Raise he!! with your state GOP.

    This is what happened in Tennessee with Corker and it was the local GOP that got him out. They need to feel the heat of giving us a Lamar Alexander. The Lamars of the world don’t want to be parriahs in their own state. Utah GOPers, give the state GOP of Utah living he!!

    Trust me. Those are the folks that will get their Senators attention. End run the 17’th Amendment.

      Democrats never have to call their Senators because they do what they say they will do.

      Our side, works for their side. We have been infiltrated with Democrats in the Republican Party. Until we clean our party up…

      Calling is an insult! They should just do the right thing PERIOD.

      If we have to pressure them on this scam, it’s just another proof that they are far left Democrats and not Republicans AT ALL.

    Alan Dershowitz made it abundantly clear that the House’s Articles are too vague to have any constitutional justification. The only correct course for the Senate now is to dismiss the Articles with prejudice, and stop the sham trial now.

    Since the House’s accusations are meaningless, and no crime has been asserted, the President cannot be judged guilty or innocent. The Impeachment must be nullified.

    Mitch does not want to be the villain in history books. He is not part of any conspiracy to convict President Trump. I believe he will have the votes to say no to witnesses. Also, the Democrats will not want to risk widespread exposure of the corruption in the Ukraine during the Obama administration as well as the corrupt nature of the House impeachment process. So, they really have no appetite for more witnesses. This is a ploy by the Democrats to allow them to claim a Republican cover-up post acquittal. If worse comes to worse and they stumble into more witnesses, the Democrats have more to lose then President Trump because there still will not be 20 Republican votes to convict President Trump. I don’t think there will be any and there will even be a few Democrats for acquittal.

This was pitched in the tenor of high-mindedness, but was really a tactic to maximize RINO autonomy a garner some straggler votes for conviction. That way Mitch can sidestep the charge of an outright procedural ambush of POTUS. Hey, let thy conscience be thy guide. Now we see him ‘losing control’ of the witness issue. He’s about to lose control and I think he likes it.

      He’s just following the script. They all are. Their will be witnesses, and the process of approving/denying witnesses will be stacked against the president. Plus, we will never know who voted what will all be done in the shadows. I say put them al in the same boat as traitors. If they don’t have enough of a sack to show their “conscience”, we need to help them find that sack.

    Didn’t I tell you Mitch McConnell was going to do this, inch by inch, backing up all the way, keeping us calm, but always getting us closer and closer – till finally it is too late, his knife flashes out and the deed is done.

    Some one better start sending them Prep-er books so they knows what supplies he needs to lay in to withstand the siege of the Capital, because I am telling you – if there is a patriot in this country they will won’t get out of that building until they agree to restore President Trump and everyone of them how dared to attack our Constitution resigns. And the rest of us should start making travel plans.
