Day Seven – Senate Impeachment Trial, Defense Wraps Up – 1:00pm ET Livestream…

There will be 24 hours of presentation by House Impeachment Managers (over 3 days); 24 hours of presentation by Defense team (over 3 days); 16 hours of Senate questioning; 4 hours of closing arguments, equally divided; and then a Senate debate/vote on further motions to include witnesses. If there are going to be witnesses, they will first be deposed prior to testimony. No witness testimony will be permitted without first being deposed.

The Senate Trial continues today on day seven at 1:00pm ET. Today is the third and final day of the Trump defense presentation. The next phase is two days of Senate questioning.

          Pam Bondi did the job she was sent out to do. However, in the State of Florida she could never be elected again, just my opinion.
          Perhaps choosing Bondi was a signal to Matt Gaetz that he is no longer on the boss’s “nice” list.
          Matt Gaetz has also ended his career here in Florida with Trump Supporters.
          President Trump needs to use Senator Scott and Governor DeSantis for his 2020 re-election. Both of them have done a great job for Florida and even DEMS love them.

          Funny – I had a totally different impression. Her content was good, but I assume was created by the whole team. I found her delivery amateurish, to be honest. She looked to me like she was reading her notes for the first time – stumbling, losing her place, mis-pronouncing words – just not prepared.

    I get the idea that Democrats want to get those few Republicans to cave and then open this up to something that will last most of this year and all the while they will have an endless supply of sound bites ,and panels that will sew doubt in the fence sitters. They will use their media wing to spin a story a day like they did with the Mueller thing. And more importantly they will be using tax payers money to do all this and they won’t have to use money to try and get this dirt into the news everyday. It’s a scam and they are trying as hard as they can to open this up to Witnesses and depositions. It’s their only hope of getting their corrupt greedy hands on the levers of power that matter ,where they will be able to do the damage to this country and line their pockets at the same time.

      Even a RINO like McConnell will not let this charade eat up most of the year. And there have been some rumblings here and there (e.g. in the Wall Street Journal) that he really dislikes what Pelosi and Schumer have been doing.

      It has also been observed by several people, including the president, that Pelosi and Schumer have “unified” the Republicans more than ever before through the FAKE impeachment..

    What’s with the “witness trading” talk? The House Democrats didn’t trade witnesses. They called anyone they wanted while forcing Republicans to submit their witnesses to Schiff/Nads for approval (rejection). Why won’t the Senate adopt the same stance? Huh Mitch???

      Mitch was actually talking about one-for-one on witnesses this morning. It may have finally sunk in that there’s no way they could allow Bolton without letting Trump’s team choose someone.

      Schumer and the House have so far rejected pairing witnesses. Mitch might use this as leverage against his RINOs to get them in line on Bolton.

      And no doubt Slow Joe has been on the phone to Schumer and Schiff telling them not to require his “only surviving son” to testify.

          True, but something might come out in a witness testimony that opened up the possibility of a witness not on the list. I doubt Mitch would ever let something like this go on, and I hope he sees right now where one-for-one or list-for-list could lead.

          Or how long it would keep Sanders, Warren and Klobuchar off the campaign trail, which is something Schumer might have to take into consideration if he doesn’t want the Bernibros accusing him of another rigged primary.

          I think it will come down to how much the Dems will do to protect Joe Biden in the primaries. With all sorts of polls right now, it may be hard for them to see how much they will do for Joe. And that is what makes it fun to watch.

            • After Q&A, next phase in scheduled order of business is a vote for, or against witnesses.
              I believe there should be a vote in favor of interpolating a vote to determine if the evidence if the articles as presented, and as argued by the House managers rise to the level of impeachable offenses. If vote is 51-49, NO! Then no vote will be required for or against witnesses.
              Pretty elementary, right?

        I really don’t think Hunter can add anything to the President’s defense. At any time where it becomes clear that he could incriminate either himself or his father, he will invoke the fifth. Will not solve anything – it just makes him more suspect, but who cares about him being more suspect when he’s already suspect?

        However, Eric Ciaramella would be an ideal witness. Next would be Atkinson, and finally Schiff. I would not trust Schiff to tell the truth even if he is under oath. The man (is he that?) has absolutely no morals or ethics. Eric though would be scared – because he knows other NSC and the DOJ could catch him in perjury and he goes to jail for a long time just for that – and invites the DOJ to also see if they could charge him with sedition.

        And if Eric invokes the fifth – then the whole charade breaks down.

      Not to mention that it makes no logical, process sense. You either have a process where the investigations and fact gathering is done in the House and then tried in the Senate or you don’t. If you do not use that process (allowing a possible end-run around executive privilege which is in place for good reasons) then why would you just have one witness each — how does that serve the search for the truth? Is that just for expediency? Imagine if you were being prosecuted for murder and you got to pick discrete piece of testimony or evidence and the prosecution was allowed to pick a single piece.
      If anything, the Senate leadership should be able to call witnesses they want to hear from that the President was not able to introduce in the House proceeding . . . but I just think that is more grounds for a process related dismissal.

      I am so pissed off at the whole thing —- how did we get here. Unfortunately, I am going to end up resenting these people and those that have empowered them for a long-time . . . and that is not healthy. Let me know when it’s time to take up arms.

        Since obstructing congress is not a crime for the President, we don’t need any more witnesses on that unless they want to prove Trumps lawyers are wrong.

        And since abuse of power is not an impeachable offense, no witnesses are needed for that either.

        If it’s not a crime or impeachable offense, we don’t need witnesses that testify Trump committed an offense which is not a crime or impeachable offense. It’s moot.

    A few months ago we were all reassured that the impeachment articles were dead on arrival. That was followed by a later reassurance that the entire “case” would be dismissed after defense opening arguments. Now it looks like we’ll be horse trading witnesses until the end of Trump’s 2nd term.

      • Does Lawfare also inhabit the Senate’s Legal Affairs Office? If so, might they not also be ‘guiding’ this process subtly in favor of Dems?
        It’s a very important question, because when doctors or lawyers, (who purportedly are looking out for our best interest) bring us their advice, it’s very hard to substitute one’s judgement for theirs, given a general lack of expertise among the public in such specialized and critical areas.
        I say that because anyone with legal experience knows that when a matter is sent to a trial court, the trial is not the first order of business. There are umpteen motions and general legal maneuvers prior to trial. So, when the Constitution states that ‘the Senate has sole power to try all impeachments,’ was McConnell fully advised that the ‘power to try’ an impeachment also entails pre-trial motions, which quite often, in a real court, may involve witnesses providing testimony before the trial begins? Granted, the Senate must vote on each stage of the proceedings, but instead of the general road map presented by McConnell, might not it have been better to follow what an actual TRIAL COURT WOULD DO?
        In other words, a motion to dismiss, with arguments from both sides, should have been entertained with possible testimony by expert witnesses from both sides (Noah Feldman, and Alan Dershowitz) etc. And then proceed to the actual trial, again voted on by the Senate, and according the structure and terms that the Senate would stipulate.
        I’m simply forced to believe that Lawfare is just the ‘new normal’ now.
        Depending on the outcome of this ‘trial’, we may or may not be living under the power of a constitution, but rather under the power of ‘might makes right!’

    Sen Toomey is reported to be pushing a witness trade, Bolton for Hunter Biden. While the President will be advised to exert executive privilege to protect his private conversations with his National Security Advisor, I’m now thinking that maybe he will waive that privilege, let Bolton testify, either to confirm the NYT’s report about what he heard, whereupon the President will be able to destroy Bolton on cross, or to say the NYT report was false, i.e., no there there.

    Then Hunter Biden is nearly certain to plead the Fifth, and I envision him being deposed by Rudy, as a late addition to the team, during which he can introduce all the evidence he has that the BLM do not want to acknowledge, and with Biden taking the Fifth, and indictments to follow.

      I think Joe Biden might step in and try to stop Hunter from appearing (because he knows Hunter would have to take the Fifth). At this point, the Dems cannot allow any damage to Biden (his self-inflicted wounds being another matter), until they see how he does in IA, NH, and SC.

      Bernie is such a threat to Dem success in the fall that it will be interesting to see how the Dems work this out. Protecting Biden at all costs might mean giving up witnesses and letting Trump be acquitted before the State of the Union.

      If there are witnesses allowed, how will they be deposed and testify? At the Clinton trial, three witnesses were allowed and they were deposed by the House managers with Clinton’s lawyer present. Video clips of the depositions were then presented at the Senate trial. I have serious doubts that, if witnesses are called for this trial, the same procedure will be used but with Romney, Collins and Murkowsky possibly voting with the Dems., who knows.

    Come on Jay or somebody, make the connection. The Mueller Investigation was to be the original source and foundation for an impeachment and removal of the President–it failed. So Democrats had to find or manufacture another crime, and that’s why, Jay, you’re standing there.

      I am reading this as a threat to the dems. But it seems the dems do not care, not about Biden, and not about their presidential candidates being stuck in D.C. (Maybe it’s been Hillary all along?)

    The Senators are getting their best briefing from Jay (the president lawyers) on developments on Zelensky/Ukraine’s anti-corruption reforms. I thought the president personal lawyers were bad unofficial channels 🙂 . Jay’s bringing the clarity.

      Pelosi wasn’t stupid. She presented two articles so Senators could vote against one while voting for the other. All you need is conviction of one article to remove the President. Doug is posturing much like Collins.

          The penalty for conviction is removal from office.

          Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

    Well if these senators, especially RINOS cannot listen to the plain sense of reason, then they too are corrupt because rationally speaking, Jay’s argument cannot be assailed. Common sense would say will say, throw this impeachment out, post haste! If they vote for further witnesses after this today then they are clearly part of the coup!
