Day Seven – Senate Impeachment Trial, Defense Wraps Up – 1:00pm ET Livestream…

There will be 24 hours of presentation by House Impeachment Managers (over 3 days); 24 hours of presentation by Defense team (over 3 days); 16 hours of Senate questioning; 4 hours of closing arguments, equally divided; and then a Senate debate/vote on further motions to include witnesses. If there are going to be witnesses, they will first be deposed prior to testimony. No witness testimony will be permitted without first being deposed.

The Senate Trial continues today on day seven at 1:00pm ET. Today is the third and final day of the Trump defense presentation. The next phase is two days of Senate questioning.

He has been on forever playing up the Impeachment Hoax. Dems wouldn’t even give Fox their low ratings debates. So, what the hell has happened to Fox News. Only I know! Chris Wallace and others should be on Fake News CNN or MSDNC. How’s Shep Smith doing? Watch, this will be the beginning of the end for Fox, just like the other two which are dying in the ratings.       Materials in this [House-supplied evidentiary] record will be admitted into evidence subject to any hearsay, evidentiary, or other objections that the President may make after opening presentations are concluded.

      Team Trump darn well better take advantage of this procedural opening, and the others that follow after closing arguments.

            It’s an inherent part of “the sole power to impeach.” They have no legal obligation to turn over everything. Impeachment is outside of “the law” (courts, typical court process, precedents) for the most part.
            Impeachment is rickety when run on good faith. It is a showpiece for the quality of our government when it runs on bad faith.

          • Dreamguardian, the House interviewed 18 “witnesses”, but only released the testimony of 17 of those “witnesses”. The obvious implication is that the testimony withheld (Atkinson) seriously damaged their case.

      We are supposed to have 16 hours of questions first before any vote… we will see if Atkinson comes up…and the missing testimony. I will not be surprised if that question is blocked. I would not be surprised that Adam Schiff is absent from the senate chamber during the 16 hours question period. Just like when the articles were passed to the House judicial committee.

        There are two articles of impeachment. First they should vote independently on the articles as to whether they meet the bar of an impeachable offense. I do not think either will pass that bar, That will lock in Bernie and Warren on having to vote against their party.

        The smartest thing for Schiff to do at this point is to claim an unfair process and withdraw the articles of impeachment and never let it get to a vote.

I read yesterday that some Treepers had difficulty finding full coverage of the trial. That’s why I’m posting this.

    so if there are to be witnesses called to the Senate trial, they will first have been deposed. so that would mean swearing to having first hand knowledge of the events in question, correct? and would also mean both defense and prosecution present at said deposition, correct? would any of the schiff show basement testifiers’ testimony survive deposition and make it to the trial?

      They will be deposed in private with their lawyers present .. the lawyers will guide them so they don’t incriminate themselves.. object to the question or tell them to plead the fifth.

      Nothing will be left to chance… dog and pony show.

      There is a reason questions are passed thru Roberts ..so the best BS artist can answer the question thru their ear piece and not direct questioning like the house testimony.

      FoxNews between 9am and 7pm is unwatchable. Fox and Friends is OK. The prime time lineup of Tucker, Hannity, and Ingraham is OK.

      FoxBiz is better. Maria is great. Varney is good. Cavuto is unwatchable. Payne is great. Claman is awful. Trish Reagan is OK. Dobbs is good.

      For any live political event, like e.g. election coverage — FoxBiz is way better than Fox News.

      While it is true that Fox News is slowly transforming into CNN —- if you know where and when to tune in to Fox, you can get value. Dissing the entire 2 networks is just….childish.

    They gave the defence 3 hours on Satuday. The defence only used 2. They gave the defence 8 hours yesterday. The defence went slightly over.

    Do they plan on giving the defence 13 hours today? Starting at 1pm? Or will they give the defence 5-6 hours tomorrow?

    I ask because otherwise, they are denying the defence its allotted 24 hours.

    Maybe the defence doesn’t need 24 hours, but declining is much different than denying.

    Last night could have been a great closing. I hope they do much better when they do close.

      I am under the impression this is truly leaked material and not a stunt by Bolton. I think Bolton’s lawyer’s very prompt and very direct response makes that clear. The “conspiracy theory” of it being a setup makes sense to me. Give them bait and watch them take it hook, line, and sinker . . . with “sinker” being the key. This is going to sink someone . . . and it won’t be our President, Donald J. Trump.

      The fact there were “Multiple Sources” screams that there were multiple people who leaked the info. Multiple fish on one hook!

        Somehow, when Bolton hands these Obama holdovers, that he kept on, a manuscript crafted to hurt Trump, in time to be used by Nancy’s delayed impeachment, it is not Bolton’s fault that they leaked it to do just that.

    Focus has shifted to how is the best way to learn what Bolton’s book says. Some support for subpoenaing his manuscript to avoid the calling of witnesses conundrum. IMHO any new information from Bolton should be accompanied by new information from Joe/Hunter Biden. Why are we always the ones called upon to do what’s “fair” but ends up benefiting the Dims? And if we give in to this it will be a new witness tomorrow.

      In a properly functioning government the FBI would have already interviewed everyone at the NSC, the entire team at the publisher’s, John Bolton, and the cretins that wrote the article and received classified Government Information. It would then go to the DOJ and on up the line where I imagine this one would end up with AG Barr. It would be his decision I would think.

      Problem is Adam Schiff and the resistance have created so much distrust in Federal Government that the traditional path is not acceptable. Adam Schiff has done more to jeopardize National Security than any politician I have ever seen.

      I think Sen. Lankford is going about it the right way for now. Push for John Bolton to step up to the microphones. John Bolton needs to step forward to the microphones all over the country…we get to see and hear from a National Security Advisor that spent his time allowing the weaponization of the NSC against the president rather than being a National Security Advisor to the president. The leak of his book he couldn’t wait to write is just part of that culture. Bolton needs to be pushed to own that in a visible way before he gets to the witness box.

        Gee … move to a state with intent to run for senate in new state, then use senate as step ladder to run for president. To follow this script means he has backers who will come out of the woodwork at Republican Convention time.

    First: who conducts the depositions? The Senators, or the opposing sides?

    Second: after depositions, who then questions them in official “testimony”? Senators, or the opposing sides?

    OK…a 3rd question: I presume the depositions are not public. But will the testimony be public?

      Depositions are handled by Lindsay Graham’s senate judiciary committee. Once deposed, a vote is taken based on relevance.

      The Senate Judiciary Committee would be in charge of disposing the witnesses ultimately voted on by a vote of the Senate. Most likely it would be in Executive Session (not open to the public). Members of the committee (both Dems and GOP) would be allowed to ask questions with the witness’s lawyer present.

      Then (I believe) these witnesses would be brought before the Senate body where Senators would bet to ask written questions of the witness and this would be public

      Depending on the number of witnesses, it could take a month or more

          Those rules from 1986 are just about the impeachment case brought from the House and doesn’t include a statement on new witnesses. On the first day of this trial, those rules were amended to entertain the possibility of new witnesses at the end of trial if voted on by 51 Senators.

    I’m so sick of this crap -so much so that from Thanksgiving through the New Year I basically withdrew from it. However, it’s too important to just shut down from it -it does pay to know what’s going on.

    In an honest arena there would be a vote to dismiss today due to everything that was covered yesterday. But the likes of E. Warner come out stating basically that what Dershowitz conveyed went clear over her head -really sad state of affairs when a Senator doesn’t understand the Constitution, or just refuses to acknowledge it.

    Though most here would like to assume the worst, let’s step back and realize most of these HUMAN BEINGS are really smart people who do love this country (though they may hate the current President). I am giving them the benefit of the doubt. If Alan D. can put away his left-leaning ways and come to bat for the county, I do not assume no one else will. I think (and Pray), in the end, reason, love of country, rule of law, and the Constitution of the United States prevail. I think there will be folks who cross the line toward adherence to our Constitution, rather than their party lines.

    There will be no “new” witnesses. That would be dangerous, because it goes against everything our country is built on. They can bring witnesses already interviewed, but no one new. That is the House of Representatives “sole responsibility”.

    If new witnesses are needed, it needs to get sent back into the House. If they try again, shame on them. It’s already been proven beyond a shadow of a doubt that the current articles do not meet the minimum level of “Impeachable Offense”.

    I think the reason they want access to Bolton’s manuscript in the scif is to keep it classified for now yet be sure there isn’t going to be anything in Bolton’s book that will give them problems if they don’t call him as a witness. The squish Republicans have been fretting over that .

    I use to think that John Bolton was a good guy but when this is over and the dems no longer have any use for him he will be left with his lousy book and nothing else, He can be sued for giving away private conversations with the President and I hope and pray that this time with this leak the President will shut down the NSC and I hope that he will get the book and leak it out little by little before its published so that Bolton never gets the money he thought he was going to have
    and On top of that I would sue him for doing this
    Mike Wallace should learn how to shut the hell up.
    Last night on Laura Ingraham she said that Fox had high ratings for the day, NO Don’t think so
    they decided to cut away and leave the Trumps defence team when they should have been listening to the real truth about what is going on

    Bolton has made a big mess of his life and I think that is what so many people are up set about
    but in the end he will have deserved the bull that is going to be coming his way He has shown to be a traitor to his country and all in the name of trying to help the Dems bring down President Trump I do hope they all get a good laugh now because as with all else The last laugh will come from the President and his team and just because these Republicans want to show how stupid they are So be it.. The 2020 election is coming and Susan Collins is not doing so well in her fight to keep her seat.. and in time Romney will lose too

      Realistically, we don’t really have any idea what Bolton’s book actually says.

      What they want is the news stories to make witnesses happen – then if the news stories are “inaccurate” they still got it done. That is all they want to do.

        The fbi took “news stories” to the fisc to verify the steel documents. How ridiculous was that? Stands to reason (theirs) the stories can be used to manipulate an impeachment trial. This works for a not too bright Susan, and we all know Mitty’s motive.

      • You are correct. “We” don’t know who wrote, or who leaked it or even if Bolton agrees what is in it. The leaked portion could have beebn taken out of context just to muddy up the impeachment trial.

        If Bolton were honest, he would step up to a microphone and say what was leaked is either true or was taken out of context. He preserves his integrity or sinks it.

    If the Senators were truly “jurors” sworn to be objective, then they would be sequestered and receive no outside information about the case. The decision would be based on the evidence submitted by the House managers, the defense, and the oral arguments.

      The extension with witnesses not only prolongs it for months, it hobbles front runner Bernie Sanders, Warren, & others, leaving it wide open for Biden. Meanwhile it keeps pressure onthePresident.
