Day Five – Senate Impeachment Trial, Defense Begins – 10:00am Livestream…

There will be 24 hours of presentation by House Impeachment Managers (over 3 days); 24 hours of presentation by Defense team (over 3 days); 16 hours of Senate questioning; 4 hours of closing arguments, equally divided; and then a Senate debate/vote on further motions to include witnesses. If there are going to be witnesses, they will first be deposed prior to testimony. No witness testimony will be permitted without first being deposed.

The Senate Trial continues today on day five at 10:00am ET. Today is the first day of the Trump defense and will only be three hours long by request/agreement with the Senate.

            The 16th and 17th Amendments were a clear slap in the face to the Anti-Federalists who wrote the Constitution in such a way as to protect States’ Rights…the repeal of those two Amendments would do more to fix this country than any other steps we could take, IMHO!

            That’s right. I have been saying this for years. In the 19th c. there were a few bad apples in the state legislatures in places like Ohio, the home of quickly developing industries like Standard Oil. These guys were in SO’s pockets as legislator-lobbyists and the joke used to be, oh so-and-so, the Senator from Standard Oil. So to be properly “trust-busting,” (T. Roosevelt) the 17th amendment to the US Constitution was passed determining that Senators would be directly elected by the “people” in each state. Hah. Look how that’s turned out. More money than ever from outside the various states goes to candidates promising Big Pharma or Public-sector Unions, etc. certain “considerations” if elected. That’s how all those crumb-bums leave office with giant bank accounts. IMO Hillary Clinton would not have been elected dog-catcher for Westchester Co NY if she had had to go before the NYS legislature to be elected US Senator. I realize that using this example is too little, too late, but repealing this law would be a fresh start for the US Senate. I do not think term limits would have the same beneficial effect.

      I’m trying to listen to both sides so I will be aware, but between the one female Senator (?) saying Republicans get all their news from Fox and Adam Schiff constantly bringing up Putin (shameful and slanderous), I had to tune him out. Seems the Democrats news conference is going to be as long as the resident’s legal teams arguments today.

        I don’t understand why the defense team doesnt bring up the fact that Mueller prosecutors were asked to provide their evidence in court… Stone? can’t remember which court case ….anyway they could not provide evidence of their forensics on the DNC server and had to state they relied on incomplete report by Crowdstrike. This would justify PT wanting to find the server and his suspicions about Crowdstrike . They never did determine Russia hacked the DNC.

      First, it’s 2020, not 1960. There are no Russian missiles heading for Cuba, aimed at us. (And most of the voting public never lived during the era of the Soviet Union.)

      Second, Americans never read, “Made in Russia” on their products. So, not only do Americans not live in fear of Putin’s Russia for their territorial survival, they don’t live in fear of Russia for their economic survival either.

    Very good compromise to only go a couple of hours today (Saturday). Got full network coverage and didn’t put anyone to sleep.This is easy pickings for Trumps lawyers. I just find it astonishing that most of the dem senators are still going to vote to remove the president knowing what we all know are bogus charges and all the lies schitthead and nadler have told.Pretty scary to think that they have no problem doing that and that they have a say in how our country is run.

    I’m glad nobody watches tv on Saturday because Fox has Adam Schiff STILL talking and refuting today’s presentation. It is interesting to see that Schiff’s fellow managers look deflated!! In terms of bias, I did notice that during the dems 3 day presentation Fox only took snippets of Trump’s defense attorney comments.

    Jonathan Turley’s above tweet somewhat explains why Defense opening Statement was “less than spellbinding (i. yelling, screaming, calling Schiff a liar) was an approach Defense CHOSE to present (most visible in Sekulow’s presentation which was toned down a/d/a not spellbinding.

    JMO but Defense is treating the Senators (i.e. Rs) with respect, assuming they don’t have to be screamed at, assuming they can comprehend the presentation without anyone screaming at them.

    It’s an excellent approach. The R Senator leave, the silence if golden, blaring the facts without anyone screaming, quietly repeating in their minds for the next 48 hour, because the facts were short, simple, to the point. It’s the professional and respectful approach to the R Senator (regardless of whether we like some of them).

    This entire Defense Team’s presentation is for the Republican Senators — not the Dems. If any Ds vote against impeachment, so be it.

    Excellent presentation.

      Keep in mind….that real target audience of the Defense team are about half a dozen GOP tools like Romney, Collins, and Murkowski.

      The objective is to make it very very hard for them to justify to their Caucus why they won’t go along with the Caucus and just dismiss these abominations, or at the very least, vote no witnesses and then acquit.

    The head of the INTELLIGENCE committee in the House is VOUCHING for the same IC assessments that the FISC report said were unable to determine to be credible.

    This is a checks and balances issue which all the Dem talking heads are claiming Chief Justice Roberts WILL rule on (and they are confident in his rulings already) without EVER mentioning that that SAME person HEADS the FIS Court, also!

    Can we all say, ‘it appears to be a prima face case of conflict of interest on the part of Justice Roberts’?

          Roberts has his Big Senate Rule Book by his side. Having him rule on Senate Rules (per the Big Book) adds credibility. In other words, the Senate is not making it up as they go, as done in the House. Smart move by Founders.

    I agree with Sen. Barrasso that the opening with the Schiff parody (Purpea) was a great lead .
    Purpea effectively used oratory and video in presenting facts. Some people just have a knack for multimedia use. (Using the video without borders like those big white frames around the tiny witnesses in the Democrats case was awesome. There was full frame Schiff with his microphone in front of his mouth spouting off into the public record. Turned him from the orator of the week into the clown that he is. Coming on the heels of the “head on a pike” closer he did last night, that was really fun.)

    Philbin took out the second article of impeachment (obstruction of Congress) and further damaged Schiff’s mindreading case scheme (credibility) for the first article of impeachment in the process.

    Sekulow seemed like the sleeper that was putting out markers for arguments that may be needed later for relevancy of witnesses/documents they want if that ends up happening.

    Great job White House counsel team!

      Since the Dems took over the House, he’s never had anyone on equal footing talk back to him. Even though someone on his committee might refute Schiff in a hearing, Schiff could always gavel the person out of order.

      Here, the sides are on equal footing, with the same amount of time, and no objections allowed. The House managers couldn’t stop anything the Trump team was doing today, and won’t be able to stop them during the rest of the time. The House team can refute the Trump’s team in the final argument,s but it cannot silence Trump’s team.

      Silencing (and smearing) critics was Schiff’s basic tactic, and it is useless here.

        I dropped the Wall Street Journal after Dow Jones Co. sold out. Even then, the paper had a distinct left wing bias (in part, the AP style book), however excellent the opinion pieces were, or their daily data tables in the back, just before the advertising section. I suspect many of the opinion pieces are still good, though I am not going to spend money to see them.

    Witnesses would be relevant to a credible trial – of which this is not.
    The only persons that need to be questioned under oath are nadless and shitt.

I understand Collins position…Maine is turning blue, although I called and left her a message, as a former Mainer, that she will have better luck staying strong with the POTUS than quivering in order to attract blue voters because they are not going to vote for her, but there are Republican/Independent voters that can be pulled out of the woods to vote for her if she supports the President. Just my experience; lived in Maine for 30 years. Any current Maine residents here…would love to hear from you on the situation there.

        For instance, all the LP crap is unvetted and was not a part of the House proceedings. Why is it in this repository. It is as fake as Sh1thead’s heads on pikes comment, for which he should have immediately been immediately rebuked by the Chief Justice.

    A House member is elected to a two year term and a Senate member is elected to a six year term.
    Therefore, for a House member to be persuading to a Senate member, he must bloviate 3x as much. Additionally, he must be 3x as pompous and self-righteous.

      If Trump’s team makes a big deal of the WB Monday, I can’t help but think it will raise serious questions. Also with the Attkison testimony that is being hidden. Those points especially will be brought forth into the “trial”.

        Questioning (2-3 days): Senators are not allowed to speak during the proceedings. But after each team presents its case, senators have an opportunity to question the lawyers by submitting their questions to the chief justice of the Supreme Court.       One strategy in a very important trial is to have a mock trial set up by a jury consultant who hires a cross-section of people who might be in the jury pool (yes, they have to sign confidentiality agreements).

      The arguments are presented, some witnesses may testify, and then the jury gives feedback, some is critical to the point of brutal. Then the trial strategy is adjusted to meet criticisms that exposed serious flaws.

      Schiff has existed in such a bubble, with his ego propped by by many television appearances, he can’t fathom how he looks to others. He probably got high-fives for his “parody” after it was done, but it has not aged well.

      After his emotional pleas in his closing yesterday about how terribly serious this trial is, to now see himself goofing at a public hearing about a phone call for which he had the transcript…well, it may be sinking in what kind of an impression he’s making on the senators and the public.

      And the worse thing of all (or most schadenfreudlich) is that he gave the Trump team this all on his own.

    I didn’t watch any of the Democrat Impeachment Show, except for “clips” but I did watch the 1st two hours (Saturday’s) of Trump’s defense team In-Action. They destroyed the Dem’s Articles, biased Sham Show and displayed their strategy to Out Shifty Schiff and the Rest with facts, video clips and statements of The Usual Suspects these past four years … of Witch Hunting. The Prez will, no doubt, be found Not Guilty along mainly Party Lines with the possibility of a couple vulnerable Dems and/or RINO NeverTrumpers jumping sides.
    Not much in the DC Swamp will change. Until November, NeverTrumpers on both sides will continue their intrigues and the Congress, DOJ/DOS/FBI & Intel Branches will continue to play the Three Wise Monkey Routine to insure that The Deep State is held accountable for NOTHING!!

I briefly heard the media-enhanced spin after President Trump’s team’s fabulous rebuttal today. Apparently the media is going to tell you not to believe your lying eyes (and ears), and here is what you REALLY heard/saw. I am hopeful that people witnessed for themselves the disconnect between the two different narratives, and will do their own research. Is there an accurate number of how many people tuned in today? I would be surprised if the numbers are not staggering.

The MSM is so used to being in control of Presidential utterances (or being controlled by Obama and Clinton), able to parse and ‘interpret’ for their viewers so that they get the ‘correct’ message and narrative, that Trump’s tweets, being raw uninterpreted messages, drive them bats because of his huge audience who gets his views uninterpreted.

      I’m sure Jack Dorsey would desperately love to shut Trump down but he knows that if he did so not only Twitter would go out of business but the backlash from the platform’s users, not to mention the President himself, would be astronomically insane.

    As a dentist of 41 years, I learned early about the druggies who came to weasel out a prescription for pain pills. They always were the ones doing the most talking. Anytime I heard an emergency patient (usually late afternoon) enter the front door and start talking up the front desk and assistants, I knew immediately this was a drug weasel. They all felt that the more they talked and whined and talked and tried to explain why they needed pain pills, that they would talk themselves into our confidence. It appears that Schiff and his political druggie cohorts are trying the same ole confidence scheme. They won’t stop talking. And like the druggies, they won’t leave unless you threaten to call the law. One small aside: I found that they would leave if I pulled out the biggest, longest needle I had and explained to them that I could just go ahead right now and take care of that problem right this minute. You should have seen their faces as they made a hasty exit.
