Cunning Lawfare Maneuver – House Will Withhold Submission of Articles from Senate…

Seemingly overlooked by most, when the House voted on the ‘rules of impeachment’ they removed the traditional appointment of House Managers to a later date.

Normally the House Managers would be appointed at the same time as the impeachment vote; however, by withholding the appointment House Democrats are indicating they will not immediately send articles of impeachment to the senate but will rather hold the articles as support for pending court cases toward their judicial authority.

A cunning Lawfare ploy.

As interested observers will note the House never voted to authorize the full judicial impeachment process; instead they voted to approve an inquiry into whether an impeachment should take place.  By not voting to authorize articles of impeachment the House never gainedjudicial enforcement authority‘.  The absence of judicial authority is now working its way through the courts in various cases.

It appears the absence of appointing House impeachment managers; and the decision to withhold sending the articles of impeachment to the Senate; is now a specific design.

As the process appears to be unfolding, the Lawfare contracted lawyers representing the House: chief legal counsel Douglas Letter, Barry Berke, Norm Eisen and Daniel Goldman will now argue before the courts that all of the constitutionally contended material is required as evidence for a pending judicial proceeding, a trial in the Senate.

What the house crew have assembled is an interesting back-door attempt to position a valid claim for evidence against the accused without having first gained judicial authority for it.  The Lawfare crew will argue to the lower courts, and to SCOTUS, the blocked evidentiary material is critical evidence in a soon-to-be-held Senate trial.

The material they have been seeking is: (1) Mueller grand jury material; (2) a deposition by former White House counsel Don McGahn; and less importantly (3) Trump financial and tax records.  Each of these issues is currently being argued in appellate courts (6e and McGahn) and the supreme court (financials/taxes).

The House impeachment of President Trump succeeds in applying the label “impeached president” that was their primary political purpose. President Trump is marred with the label of an ‘impeached president’.

Now the delay in sending the articles of impeachment allows the House lawyers to gather additional evidence while the impeachment case sits in limbo.

The House essentially blocks any/all impeachment activity in the Senate by denying the transfer of the articles from the House to the Senate.  Additionally, the House will now impede any other Senate legislative action because the House will hold the Senate captive. Meanwhile the Democrat presidential candidates can run against an impeached President.

Lawfare’s legal svengali Lawrence Tribe recently penned an op-ed with this type of  recommendation; and it appears the community that worships Tribe, including the House lawyers writ large, are following his advice.

While Politico outlines the plan from a position if the scheme as a new idea, the fact the House impeachment rules were changed to drop the appointment of the managers speaks to considerable forethought on this type of plan.

It does not appear this is a new idea; rather it looks like this is a pre-planned procedural process by design:

Washington – House Majority Leader Steny Hoyer, the second-ranking lawmaker in the House, said Wednesday that Democrats must discuss a last-ditch gambit to delay sending articles of impeachment to the Senate and prevent the Republican-controlled chamber from summarily discarding the case against President Donald Trump.

“Some think it’s a good idea. And we need to talk about it,” Hoyer said just as the House began debating articles of impeachment that charge Trump with abuse of power and obstruction of Congress.

In recent weeks, some legal scholars have suggested Speaker Nancy Pelosi could consider refusing to transmit articles of impeachment — likely to pass the House Wednesday evening — to the Senate, where Majority Leader Mitch McConnell has declared he is coordinating trial strategy with the White House.

[…] Notably, House Judiciary Committee Democrats huddled with Tribe earlier this month as they practiced behind closed doors for their series of impeachment hearings.

    I disagree with SD! The two articles of impeachment have no relation to the the three court cases headed to the Supreme Court. Neither abuse of power or obstruction of Congress hinge on President Trump’s tax returns fIkeda years ago, grand jury evidence related to debunked the Russian collusion hoax and his long gone attorneys testimony none of which have anything to do with withholding aide to Ukraine or defying a Congressional subpoena! The Lawfare Bolshevicks have something up their sleeve but I don’t think it’s too help the SC court cases.

      Agreed. They ‘have something up their sleeve’ because they are illusionists. They know RBGs time is short. They may not be able to stop appointment of her replacement but they are setting up to try. And if they fail, their fallback is the horrible optics they’re conjuring on Republican Senators. An election year appointment by an impeached President to a Supreme Court that is set to rule on separation of powers issues would be the best campaign issue they have to try and win back the Senate.

      Agree. Too clever by half. The unintended consequences of such a strategy could wreak political havoc including the further loss of public support and the sucking of oxygen from the Dem presidential primaries that are scheduled to begin in early February. And then there is Mitch who can throw a monkey wrench into their plans. Add to this possible indictments and revelations from the Durham investigation.

      one has to understand the corrupt dems do not expect to win any cases or even gain access to grand jury mueller material..if they do succeed, which is very very unlikely, that’s a bonus.

      the goal here is to frustrate a process and delay it…

      the reason to continue to delay sending this to the senate is obvious:

      they cannot win anything on the arguments/articles in its present form.

      there are BOTH house and senate dem seats that are vulnerable from the expected blowback from a failed impeachment outcome (left voters aren’t as party loyal as the press makes them out to be..they are still human…and can’t stand losers….they will defect and retaliate at the polls from this miserable ineffective bunch of clowns..that’s a very real risk that is almost certain of the dems allow this senate trial to go forward.

      by delaying, they can achieve an interim temporary demonstration that they are doing something..anything…and that might help them somewhat politically to not have a complete party mutiny on their hands. It also has the effect of continuing to cast a dark cloud over the president and gives them chances to have the complicit media spin the narratives that is open ended.

      by delaying, they are also working to find other paths (corrupt fraudulent intentions) to find another series of political weapons they can use to continue this fraud against the president. I would expect the dems to find another whistleblower, or perhaps even another stormy daniels they can slap together to impugn him with.

      this is all about delaying the inevitable.

      there are no advantages in seeking a trial in the senate for the dems. that ends the show.

      it ends the charade.

      it ends their very power

      it also results in many seats getting lost in congress AND back at home states!

      this is why they do these things…it a desperation move…one, I do not consider cunning or even intelligent….unless you allow yourself to consider a thief is smart.

      the left does these things, because they are caught out with a failed coup attempt.

      and everyone is noticing it now..

    I was watching Laura Ingraham a few minutes ago. She and her guests were nibbling around the edges of the discussion of why the Dims are not sending the articles to the Senate. Why are the Dims doing this is basically their question. They touched on the “other evidence” …without really grasping why the Dims are manipulating the process hoping to get what they want from the pending court cases. Laura and her guests are not quite sure what is going on. Laura needs to learn to read the tea leaves better.

      I can’t see SCOTUS giving them victories on any of this, even if Roberts is,compromised, as this is too basic (seperation of Powers) for them to mess up.

      I guess the novel argument they are going to make, is that this material they want would be for,ADDITIONAL charges, but they can’t make the,charges, without the evidence.

      Its a fishing expedition, and both SCOTUS and the Constitution just LOVE fishing expeditions.

      But, it draws out the process, until at least March, if they are going to wait for court decisions.

          Well, no I don’t. Our argument is no “quid”, and no “quo”; POTUS (past tense) didn’t withold the aid, and they had their WH meeting, and Ukraine didn’t ANNOUNCE that they were starting investigations, which as I understand it is the allegation.
          That “Trump” wanted them to publically announce they were investigating Biden.

          Doesn’t mean that forever more, throughout history, they are forbidden from opening an investigation of Biden.

          Its spin, vs reality, again. In the age of Trump, which began with the escalator ride, spin has proven to have lost much of its umph.

      Better would be to assume the House has voted and now it is the Senate’s turn. he can write a rule that allows a motion for dismissal as prelude to trial.

      Pelosi has two options, do nothing or say NO impeachment has occurred, which scuttles their judicial authority claim..

    It’s really quite astounding how everything has proceeded almost exactly as Sundance has predicted from the beginning, even incorporating the trade deals into the timeline.

    Even so, with their impressive long-term planning, there always seems to be something unexpected up the sleeve that they can rationalize with the media sales job so enough people on the coasts buy in.

    Still, they have to know that most people realize that their intelligence is being insulted.

    Being so blatant could indicate that they think they have voter fraud just about perfected and can change just enough votes in the right places to steal 2020.

    Proof of that theory will be if Clinton throws her (pussy) hat in the race.

    Pelosi and her unelected Lawfare contractors may have put themselves over a barrel.

    If they claim the Articles are approved and President is impeached, then McConnell can immediately create a rule that says he can pick them up and make his motion to dismiss as a prelude to the Senate Trial.

    If the Pelosi says they are not complete, then NO impeachment has occurred and the democrat arguments before the courts for documents suffers.

    NcConnell does not even need to ask if the House has Impeached. All he has to do is assume the vote is done and the Senate can now deal with the Articles. The House cannot have not both ways.

      I have formally challenged that mistake: it isn’t accurate or even logically.

      it’s not the correct description.

      the house has voted on articles, but short to two very important aspects:

      a. the House HAS NOT named managers, which are prosecutors, thus the impeachment is not sound. This reality is not some mere footnote of trivial significance….it literally means the president IS NOT impeached. It ONLY means that the house has voted on the articles.
      b. the House has not sent the articles TO THE SENATE…again, this is the duty of the impeachment managers. The house managers take the articles, to the senate and formally hold a hearing and present the articles before the senate. Then they report back to the House …etc….etc…

      I want everyone that can to contact wikileaks and demand they remove the incorrect documentation and write it clearly and accurately about the current status of this fraud.

        it will be entirely up to the real free press to expose that …

        I am not too sure how well this will work for the impeachment process however.

        there is a timing consideration.

        me thinks it would be best to prioritize actions now…and keep these other matters on hold, after the major threats to this nation are corrected.

        it might be very counter-producting to introduce neutron bombs rights now. That plays nicely for the dems cause.

        remember the main press is a decidely corrupt club…they will just ignore the left’s failures.

        let the current battles play out, with the expected re-election of this president.

        then we can get back to business of cleaning up ….

    Don’t play by Pelosi’s attempt to set the field of play and the rules.

    With Collyer’s letter basically accepting that the FBI violated the rules for FISAs, POTUS should direct AG Barr to assign another US Attorney (not Durham) to immediately indict everyone that signed either the original FISA or subsequent reauthorizations on Carter Page. Indict them for 4th admendment violations. Start at 20 years and disbarment. Seems to me these should be pretty cut and dry cases where the parties are guilty of not verifying the contents of the FISA applications that they signed off on. Signatures need to mean something.

    This should get some folks attention and create a line to Durham’s door with offers of “assitance”.

      there are other strategy reasons to do this also.

      once you have open cases and indictments, this captures all prior grand jury materials these people orchestrated…

      essentially making it ilegally problematic for the left dem corrupt congress from getting the traction or the access of any of the mueller grand jury material.

      even if these cases go no frustrates the left’s ambitions to use the grand jury material.

      we have to consider the possibility that a corrupt judge might be tempted to allow them access to grand jury material.

      thus, immediate action to take away that opportunity is necessary right now.

      we need to be thinking big picture and removing all opportunities for these corrupt schemes to have any movement.

As the House certainly can’t show an adherence to precedent (let alone constitutional standards), the Senate could act to dismiss and make the fishing expedition moot by doing so as it relates to what was just passed in the House, no?

  16. I just cannot understand one thing – with all due respect to Sundance, but every time he mentions “lawfare” it is like they are the ultimate lawyers in this country and there is no lawyer or group of lawyers that can counter their bullschiff moves.

    I understand, that what we are seeing is pretty much how Sundance is analyzing and laying it out for us in layman terms for folks like us to understand what is going on. But C’mon man! There has to be equally ruthless lawyers on our side who can take a wrecking ball to these “lawfare goons” strategies.

    Question is – where are they and why they have not shown up yet on the scene?

    After thought (original comment ended at the “Question is”) – I do play a little bit of chess so anyone coming with 3d-4d chess theory explanation …. they don’t understand that in a game of chess, if you keep playing defense all the time, then no matter how many players you have left on your side, it doesn’t matter, because time, one of your most valuable and important player, is one player that you have lost. Another analogy is – my kid plays a boat racing game on XBOX and is usually greedy to collect her “nitros” but never came first till I explained her that collecting nitro is good, but it is of no use if you will not use it at the right time. It took her a while to understand what I was saying until I showed her few times – and I rarely play the game – but after seeing that after only few attempts I was able to come first, she understood the importance – use your ‘nitros” to your benefit, rather than being happy that your boat is showing that it has full “nitro”, because at the end of the race, what matters is – did you win against your opponents? From my point of view – declass documents and Comey / McCabe / Brennan / Clapper etc. documented lying to the FIB / congress (real crimes for which Cohen, Roger Stone and General Flynn are probably going or went to jail) “were/are” our “nitros”, I hope we use it on time.

    Unfortunately for them, the Senate can act, regardless — and would vote to acquit.

    That’s because the Constitution is absolutely clear about the Senate’s authority. Article I, Section 3 says: “The Senate shall have the sole Power to try all Impeachments.”

    “Shall” is the key word, legally meaning mandatory. I fit had said “may” is would be discretionary.

    IF this information is accurate I don’t see the problem. Senate goes forwad without the House naming their managers. Wouldn’t that be a benefit?

          Yes to both pokey and zekness. The work of God through the authors of our Constitution makes it the greatest document there is. USA is the only counrty other than Israel that was founded on Godly principles and guidance. I commented yesterday that President Trump is a Christian and has honored God in all his presidential actions and although the impeachment was/is extremely disturbng to me, I know God is sovereign. Scripture states He does not do evil, but we have evil on this earth now due to sin and satan. But, in Gen 50:20 God can use evil for good in the lives of those purposed for Him.

          As bad as this all seems to me, I do believe Scripture and believe God’s overall plan for these events will be used for good in President Trump’s life and his term. There is a big, big picutre here, and God is using PTrump for great and good things for His glory. Only God can fix this mess in a way that brings good.

      They can write rules which bar 599 out the the 600 pages of the fake articles of impeachment, and which bar articles that depend on evidence nobody has seen.

      It’s just more proof that these articles are a fraud, and should be treated as such.

      The House cannot dictate the Senate rules. Like I wrote below, the answer to this is to have HJC subpoena Hunter Biden, Joe Biden, anybody Giuliani wants to call, the fake whistleblower, Adam Schiff, etc. then send criminal referrals to the DOJ regardless of what they say.

        IMO, McConnell wants the trial. He is going to “play it straight.” He will not procedurally scuttle Pelosi’s tactics to delay and influence the Senate rules.

        SD’s observation that the associated court cases can now be leveraged as evidence-enabling requirements for the Senate trial is accurate, and it will likely elongate the impeachment process which will do maximum possible harm to the President.

        I don’t expect McConnell will respond aggressively in support of the President.

          I guess we’ll see, right? What the House is doing, however, is so ridiculously lawless and absurd that this is pretty easy for the Senate to slap down. The House GOP voted unanimously against impeachment yesterday, and even picked up 3 Democrats, making the “no” vote the bipartisan vote. In D.C., being able to claim a vote is bipartisan is practically a saintly act. I don’t see the House GOP voting 100% no and the Senate being a risk. At all.

    My two cents worth:
    – McConnell has stated that the Senate has to hold a trial if articles of impeachment are forwarded by the House. Without a formal submission and subsequent review, trial specifics would be moot. I know he is not reliable but this new twist should piss him off;
    – Announce list of witnesses that Senate cannot agree to – Biden, Schiff, Ukrainian prosecutors, whistleblower, Vindman, Pelosi, Nadler, …..
    – Delay Senate cooperation till Durham investigation is complete;
    – If impeachment by the House does not impact PDJT’s executive order authority, the ‘suspended’ impeachment process would be the perfect excuse to bypass Congress through EOs (House obstructing Executive function): (I) accelerate border wall construction, (II) suspend availability of lottery visas, chain immigration, … (III) accelerate deportation of criminal illegal aliens, (IV) order priority investigation & prosecution of classified info leaks, (V) disband & reconstitute the NSC, (VI) order review / study of intelligence & law enforcement agency practices & create new oversight department to prevent abuse, (VII) change intelligence & law enforcement classification authorities to prevent everything being lumped into ‘sources & methods’.

    My point here is two-fold: (a) demonstrable activity that addresses current problems, and (b) all Executive branch focused. I do not know if the President can sue the Speaker for a rigged, pre-determined process that trashed his basic rights. Even if ultimately unsuccessful, it may prevent any further action while it is being litigated & appealed.

    An indefinite hold in forwarding articles to the Senate works for PDJT too – just like a nuisance lawsuit filed only for payoff / afraid of what Durham will find or has found / do not want anyone to know about Biden corruption etc.

    Apologies for the length of this post – just really angry at what this President has to deal with. St. Teresa once said that God will never give us something we cannot handle. Maybe PDJT’s trials are needed for our country to return to its roots.

    This is how she’s chosen to end her career. You can only imagine the skeletons she has in her closet, to be the face of this sham of an impeachment.
    It’s repugnant when she brings up the constitution. I truly do not believe she will go down in history as anything but a very corrupt politician. What a shame, when she had the chance to be held up as a trailblazer for future female politicians. I can’t picture too many parents pointing to her as a role model for their daughters.
    I don’t trust the Republicans and hope that the polls continue to keep them in line. All these politicians that have been around decades want Trump out.

    Just wait a couple of days. If the House does not assign managers by Friday, Mitch McConnell should just hold a news conference and announce:

    “The Democrats in the House of Representatives initiated a precipitous rush to impeach the president. They claimed over and over that they COULD NOT WAIT for the election, they had to remove him NOW.

    After rushing through hearings that denied him due process, they hastily got to the point of voting Articles of Impeachment….. and now decide that it isn’t necessary to actually have a Senate Trial.

    I will tell you why they are waiting: They are gauging the best time POLITICALLY to send the articles to the Senate. This is all political. POLITICAL. Playing politics with impeachment of the President of the United States.

    Well, we have a remedy for that kind of political activity. These Articles of Impeachment are dead. DEAD. They will not be considered in the Senate If they are transmitted to the Senate, we will convene and will dismiss them the same day. We will not allow bitter partisan politics to paralyze the country and the United States Congress.”

    Once the final House votes were tallied and the two articles passed Nancy Pelosi’s job was done.

    McConnell should summarily take up the Impeachment matter tomorrow afternoon and ask the House to send their prosecutor over to the Senate within 24 hours. If no one shows up on Friday take a Senate vote to dismiss the case entirely.

    If the democrat smartypants lawyers don’t like that let them file suit … somewhere.

    McConnell should advance rule changes which state that the Senate will not consider articles of impeachment older than 2 weeks, all hearsay evidence is prohibited, as is ________ evidence still working it’s way through the courts. This would be the equivalent of inventing a crime in hopes of later obtaining the proof.

    Literally, write Senate Rules stating automatic dismissal without a trial unless the articles of impeachment are legitimate. Which these are not.

    Throw it right back in their faces with a senate rules barring the articles. Give that bitch a taste of her own medicine. Then tell Lindsey Graham to subpoena Hunter Biden, Joe Biden, Adam Schiff, Eric Ciaramella, and ICIG Atkinson.

    the mueller,report with possible obstruction charges and tax returns are pending as SD noted, i believe they are just stalling to see if the courts uphold em or rescind em.if they rescind em then the dems will say they need em to add to the impeachment,but would (should) the court deny them access as they did not have the full formal vote to move it to the judiciary?if i was the courts i would say no.then this forces them to hold a formal vote if they want those tax records etc(which they will)BUT then would they want the minority to have a day to call witnesses.this the dems do not want.then the bidens,and schiff get called as witnesses.the SC said it will not get to the tax returns til march or so ,so they might string it along til then.

    Look at what they tried to do with Russia. That did not work so damage control with that and msm is even throwing bones about the FiSA abuse.
    The media and corrupt politicians on both sides are counting on the public’s lack of sustained ability to pay attention. They are doing this around the holidays another distraction. The delay is because they have damning information that they feel gives them a real shot at getting enough of the public sentiment to change. Once that happens the senators can get Trump to resign. They believe the public will tire of it enough and notice how every channel on msm keeps talking about the historical significance of Trump being impeached.
    That is BRAINWASHING. It should be reported that it is a travesty that impeachment is now being used as a tool to get rid of a president that was elected by the people. The arrogance of these politicians is vile.
    This is how the holocaust started. We should be up in arms NOW.
    This is not acceptable. There are too many unknowns about what happens next. Too many politicians powerful figures pulling the strings to predict what’s up their sleeve next. We can not be complacent.

    The Communist Democrats never intended to remove The President with impeachment and never intended to allow a full trial in The Senate. Pelosi likes the show… She cannot give up control.

    Any Senate trial will expose massive criminal wrongdoing by both Democrats and Republicans. As he has publically stated, Sen Graham has vowed to kill impeachment quickly without ANY trial. But now the House Democrats have pulled the rug out from The Senate’s plans.

    It remains to be seen if Sen McConnell can simply create a new set of rules to deal with this development.

    In the meantime, all the Democrat 2020 Presidential candidates will not be pulled off their campaigns to attend a Senate trial and they can create slogans and ads with the language that they are running against an ‘impeached’ President. But the ‘progressives’ underestimate the strength of We The People. We will re-elect Donald Trump over their objections, by hook or by crook!

    You know, it’s a funny thing. I’ve been watching the news about Impeachment, but also have been living a life. Went on a vacation. Sold a house. Watched my investments. And I love PDJT, and love what he’s done for the economy, the markets, the country. And I never wanted him impeached.
    And the funny thing is that my emotions were not what I expected – the impeachment thing didn’t really hit me hard at all. It’s like all the other arrows they’ve thrown at PDJT. And I would bet that 100 years from now (if not much sooner), the Dems will be shown to be the poor players they are – and the Trump Impeachment would be nullified. The stain on his presidency will be washed away.
    And then I saw snippets of Trump at his rally. And he’s acting the same way.

    I think we all act the same way – what Impeachment? Ignore the bastards. Keep doing what we’re doing – except we work harder to re-elect Trump. That’ll drive them even crazier – if that is at all possible.

        It’s not a real Article of Impeachment, the crimes are unexplained, the only purpose is to punish the elected citizen and his voters/ supporters.

        Bill of Attainder is the definition that fits it, and the Constitution forbids it to Congress. The Senate does not need to vote about it; only declare the Articles are rejected and will not be accepted.

        The House is welcome to start over and strive for an acceptable new product.
