Pelosi, Nadler and Schiff Announce Two Articles of Impeachment – Abuse of Power, and Obstruction of Congress…

The Democrats within the House of Representatives have decided to suspend House Impeachment Resolution [HR 660] without following their own rules that established a House Minority Hearing. Instead, House leadership have produced two partisan articles of impeachment for a full house vote.

Both articles are exceptionally weak; the Democrats are rushing to cut their losses:

♦Article One is “Abuse of power” – and structured on a false premise that President Trump “exercised the powers of his public office to obtain an improper personal benefit, while ignoring or injuring the national interest.”

♦Article Two is “Obstruction of Congress” – and structured on a ridiculous premise that President Trump “engaged in unprecedented, categorical, and indiscriminate defiance of the impeachment inquiry”, by challenging congressional subpoenas and seeking relief from the judicial branch.

Both articles are structurally deficient in the extreme. It will be interesting to see which House democrats could possibly vote for these articles, especially article two. There is a possibility some democrats will ignore Pelosi’s whip.

The weakness of the articles now actually appears to be a feature, not a flaw. The exercise of the “impeachment process” writ large was more of a political promise to the far-left constituents of the resistance movement itself. Structurally there is no strength to either article; they appear designed to fail in the Senate. Again, a feature not a flaw.

Nationally the democrat resistance voters are not too smart. What Pelosi, Schiff and Nadler are delivering for them is an impeachment in name only. The downstream consequences for this incredibly partisan political effort could be a massive backlash amid independent voters and centrist democrats.

Traditionally, impeachment is constitutionally designed to remove an elected official from office. However, in this modern example the process has been intentionally corrupted to disparage the President, not to remove him.  In essence Pelosi has used the impeachment process as way to sooth the emotional needs of the far-left resistance.

  1. Newhere says:

I don’t think this is about the “far left.” Pelosi and Obama shafted the far left all the time (see: “fast track” for trade agreements, the “public option” for Obamacare). That’s the rationale offered by people who don’t understand the subterranean war among factions of the intelligence community and its stateless, oligarch handlers (collectively, the “deep state.”)

Rushing impeachment is part of the democrats’ “defense by offense” strategy. What this tells me is they don’t know when Barr/Durham will strike, and they possibly don’t know where the indictments will land. So, they want impeachment done quickly, that way any indictment looks like retaliation.

But it’s not just the democrats. The republicans are playing their part, too; and I don’t just mean Romney, Mukowski and McConnell. I mean Graham and Barr and supposed “allies.” What we’re seeing is operation chaos. The country is being divided into separate, rivaling camps, each believing the other camp is dangerously disconnected from reality. For all the promises and signals of accountability that have been dropped like crumbs over the past 3 years — when you separate signal from noise — what if the muddled message and constantly deferred promise of “truth” IS THE WHOLE POINT? The perpetuation of a “hoax” that much of the country believes is utterly serious, and the rest believes is an assault on our very republic.

What if the real “plan” is exactly what we’re seeing: a slowly detonating hand grenade tossed into the body politic.

The mess from the DOJ yesterday crystallized things. Because it was utterly CONFUSING. An IG report whose topline conclusion was totally disconnected from its underlying facts; an IG report that purports to resolve questions beyond the scope of its mandate; an AG and prosecutor who are known to know everything and are deputized to reveal everything — but who continue to hold their own counsel, saying nothing, except to cryptically suggest their own colleague is at once a consummate professional, but also totally wrong.

    What the ever-loving F***.

So maybe what we need to realize is that chaos and confusion is the point. Occam’s razor.

What happens when you have the country divided on principles they believe go to the core of the republic? What happens when you have increasing talk of treason and civil war?

An excuse for even greater control, surveillance, censorship; centralized control, constraint of basic liberties. We are the only citizens of a country that still has them. We are a target.

I’m not saying President Trump is a part of this; but what’s clear is that he has very few allies. In fact I don’t know who we can say unequivocally is on his side, except for General Flynn and Admiral Rogers who aren’t in positions to affect events (that we know of). No one person can do it alone.

This isn’t a game. Maybe their IS a plan folks.

This shit is planned, timed, and implemented to finish up right around the time primaries are happening. Once it’s done, they will be through their primary challenges and impeachment will vanish.

      • Doesn’t matter how baseless or ill-founded. Rushing bill to House floor for vote to get over to the Senate while on holiday leave merely opens the door for a small quorum of Senators to vote to adopt House bill. Remember this is how the Fed Reserve bill was passed in 1914…when everyone had gone home for Christmas holiday.

        • If that’s the truth, they’d better disable Trump’s twitter account, put Rand Paul in jail, and do a lot of other preparations that in and of themselves are dead giveaways. They could get away with it in 1914. Much harder to do today.

      • Newhere says:

Yesterday was really a pivot point for me. Compare Barr’s handling of this report and the Mueller report. Why didn’t Barr intervene to prevent the IG from issuing conclusions beyond the scope of his “fact-finding”? There was no need to announce ANY conclusion on intent/political bias. The IG didn’t have enough information to make that call; the report was structurally limited. The only affect of a “finding” on intent is to minimize the impact of the conduct, and circumvent a public undertaking to connect the dots for itself. And it is HUGELY prejudicial for any eventual allegations by the actual prosecutor.

It was precisely Barr’s role to prevent that sort of over-reach. And we know Barr knows that — because he did it with the Mueller report, i.e., prevented over-reach. He canned the “executive summaries” that Weisman crafted, and — critically — prevented the issuance of a report that left open the question of obstruction of justice. Barr did what he was supposed to: he said a prosecutor either has the evidence to indict or he doesn’t; a prosecutor doesn’t raise a question and then shrug and say “your guess is as good as mine.” Here, the corollary was to PREVENT a conclusion based on incomplete evidence. The proper posture was to note the lack of “documentary or testimonial evidence” but also to note that limitations on the mandate preclude a conclusion.

As a consequence, the IG report breeds confusion and fuels division; it sits there as an immutable “fact,” pre-coloring any potential indictment. FUBAR.

I hear you. This has occurred to me as well. If you “hang out” with the Lefties, then “hang out” with the Righties, both are impassioned in their beliefs and diametrically opposed to one another, both fearing the country is at stake. I believe there are factions within and without the country that would love nothing better than to take advantage of the situation, the Republic to fail and CW 2.0 to commence. But, we’re smarter than all that. Most people have a gut level feel for when they are being gaslighted. We can all see through the chaos model. While it may seem to be complicated, it’s not really. What separates us out as a successful Republic is The Rule of Law, and the Constitution AS WRITTEN. I think what most people want to see the Law applied fairly to everyone, fair elections, and fair justice. It’s really that simple. If we don’t like the Law, we work towards changing it, but we don’t subvert it. I think everyone agrees on that. The law takes out the emotional chaos being sown in our country.

Occams Razor here is that they are really all this, they are all this dumb/bad/corrupt. That what we cannot believe is true (that when one is deeply embedded in a fallacy reality for so long – the swamp is its own country – that they cannot see the mess they have made). There are many examples of this disaster in any small government office. They believe that what goes on around them is the central universe.
Occams Razor – would tell us that ‘this is the state of our leadership’. A cartoon in the world. China however is another matter, and if USA does not show some responsible big picture leadership soon (Trump is trying), China WILL ‘make the changes’…. Thought Leaders YouTUbe are doing a ton of incredible interviews at the moment with Hong Kongers who are wrestling with the monster, and they have warned us, if you do not pay attention here, this beast, this out of control reptile (China) will be doing this to you.. that is its master plan. This one was particularly good. Pres Trump is fully awake – the others are simply lining their pockets from all of this.

I’m pretty cynical too but I’m not ready to dismiss AG Barr, especially in light of his very public statements about the IG report since yesterday. He’s doing a good job of getting his message out and isn’t shy about expressing his doubt that there was sufficient predicate for the FBI’s actions. He’s not being equivocal at all on that point and seems to be mindful that the Democrats/MSM/NeverTrumpers will use the excuse of retaliation for impeachment when the hammer falls on some malefactor or another, and so he’s getting in front of that narrative.

And I still believe the hammer WILL fall, not on the entire “small group” but on someone. And who knows how much that someone may incriminate another or others when faced with prison time? I’m not ready to give up hope for some greater degree of justice than employment termination. The IG report after all had quite a lot of damning info about the FBI in it, and it left the door open for the need of further explanation for the many serious problems it revealed.

BTW Durham said he respected the “mission” of the IG and the work that went into his report, He didn’t say he respected Horowitz. Besides, it would be a mistake for either Durham or Barr to give fodder to the idea that THEIR mission is partisan.

I get every point you are making. Consider this.
Of PDJT’s allies, his 80 million voters, a sizable number of them are more firmly in his corner than the enemy appreciates.

If the domestic enemy miscalculates, and miscalculation is a by product of their ideological illogic, they will find themselves on a limb with a saw. For all their acting out and faux Antifa army etc. they are I’ll prepared to deal with a bloc of 80 or 90 million Americans who get prosperity and the great things that POTUS is accomplishing for them.

If even 5 million of that bloc resolve to end this ongoing coup, it will be as decisive as an axe through white pine. It won’t be pretty, but the threat will be stopped.

    Lurking Lawyer here.
Agree completely with Sundance, but add some additional legal color.

Main con law point is simple. Dems are claiming two articles: abuse of office and obstruction of congress. Both might arguably be within the Constitutional Conventions original “…or Maladministration.” But both are expressly not in the founders ultimately adopted British term “…or high crimes and misdemeanors.”

Abuse of office is also factually disproven at least four separate ways.
1.The transcript shows the favor asked was investigating Crowdstrike concerning the 2016 election, from which PDJT did NOT benefit.
    2. Giuliani had completed his initial Ukraine investigation (Chalupa, Ukraine Embassy), during which he stumbled upon the Biden corruption, in Feb 2019. Biden did not declare until April 2019.
    3. A2§3 take care clause requires PDJT to follow up on the Giuliani discovered Biden corruption. Especially given the 2018 CFR video on which Biden explicitly brags about his extortion to get Shokin fired within 6 hours.
    4. Regardless of what Yovanovitch and Sondland might think, A2§2.2 says PDJT, not they, is in charge of US foreign policy, including for Ukraine.

The other BIG abuse defect is that the Article does NOT say what thing of personal benefit PDJT obtained by his purported abuse of office. In any normal sense, that is by itself a fatal charging defect. Crimes are not left to the jury’s imagination except in a Kafkaesque world.

Obstruction of Congress is disproven three different ways.
    1. Congress has not even followed its own ‘new special’ rules concerning its impeachment hearings. For example, no minority witness days, as demanded in writing but not granted. You cannot obstruct an irregular random process.
    2. As discussed at CTH in detail previously, Schiff’s Intel committee had no proper subpoena power despite claiming it did. His ‘subpoenas’ were legally mere letter demands that can simply be ignored. Obstruction requires not obeying a lawful subpoena. SCOTUS has ruled Congress has that power in only two cases:
—making, repealing, or amending a law under the expressly delimited legistaltive powers of A1§8.
—exercising oversight of executive administration of N existing law.
    Schiff’s ‘impeachment inquiry’ was neither.
    3. Using lawful judicial processes to stall or block anything is by A3§2.1 definition NOT obstruction.

History is NOT going to look kindly on Pelosi, Schiff, Nadler, and Waters standing at that podium announcing this utter BS. And some of PDJT’s suits to halt elements of this grossly TDS shampeachment will give SCOTUS opportunities to weight in, as previously commented and as highlighted by Sundance.

History? To the left, they seek to win because they want to erase and re-write history. Take for example, the whole Nationalist Socialist thing. Those on the left were in support of Hitler until he lost and the horrors he made happen came to light. After that, somehow Nationist Socialism magically shifted from a left-wing ideology to a right-wing ideology without so much as a reasonable explanation as to how that could possibly be the case? Still most people today actually believe it. (When is socialism on the right? When it’s “National” socialism… make any sense to you? Me neither!)

But they wrote that history and journalists have been mostly on the left for a very long, long time running cover for Lenin and Stalin and their horrors and keep doing it today.

They aren’t worried about history. The left WRITES the history.

We have a long, long way to get right of leftist ideology. And just as Marx and Guevara were spoiled kids born into rich families, today’s leftists are every bit as spoiled senseless and when you see the patterns of history for what they are, it all becomes more than a little obvious. And it’s on every last one of us to correct for this cultural crisis. If you love Christ and love freedom, then you know what we need to do.

    • Well done, ristvan!

Regrettably, none of the “constitutionality” factors are enforceable unless CJ Roberts intervenes during a Senate Trial … or rules them out during ground-breaking Pre-Trial Conferences.

BEST STRATEGY might unfold in two stages [RE 2 posts immediately above]

      • Force the House to DO ITS JOB before the Senate will consider the House Impeachment to REMOVE a President for DOING HIS … allowing time for AG Barr to reveal and prosecute the Demo☭rat COUP D’ETAT.

      • Delay Senate action until the VOTERS have SPOKEN … THWARTING the House from COLLUDING with FOREIGN COUNTRIES to LOOT the USA and OVERTHROW our GOVERNMENT.

      • … because the House HAS NO POWER over WHEN the Senate Trial starts
… just as the Senate HAD NO POWER over HOW the House denied Due Process

      • ristvan says:

BKR, thanks. CJ Roberts will play no meaningful role in this per A1§3.6. He presides over the Senate ‘trial’ but must follow Senate rules for the proceeding, which have not yet been decided. The provision was intended to underline the solemnity of the occaision, breached already here.

Separately, I entertain hope that some of PDJT’s legal challenges, for example as explained in detail previously to House Oversight demand for 6 years of PDJT tax returns, will result in CJ Roberts weighing in as one of nine SCOTUS votes on elements of this monstrosity.

Btw, I differ with many Treepers on Roberts. He is in my opinion a magnificent traditional centrist CJ. His Obamacare four part opinion was a thing of legal beauty for many reasons, part four mostly for the future. And, he does not oversee the FISC as many here wrongly assert. He only appoints the judges to it per FISA law. They are overseen by one of their own (Collyer at the time of Admiral Rodgers).

    • jbowen82 says:

Agree with everything you wrote. Note, however, that the standard is not a legal one (not even preponderance of the evidence) but a political one (does the article meet the test of “misdemeanor,” which is not defined in the Constitution). Taking the Democrat point of view, I could analogize the House to a grand jury, simply preferring charges to go to trial based on probable cause, but not being the ultimate trier of fact. So for the Democrat House member from a purple district, is it politically good enough to say that you voted for the articles because there was probable cause to believe that these actions, if proven at trial in the Senate, would qualify as Constitutional misdemeanors? That you’re not making a judgment that the President should be removed, but instead you’re saying that IF the charge is proved at trial, it would justify removal, but deciding whether it’s true isn’t your job, your job is to decide whether the charge itself is serious enough and merely that there’s probable cause to believe that the President did the acts alleged. Would this be enough of a fig leaf to get those vulnerable Democrats on board? Personally I think not, but I have a hard time thinking like a Democrat.

The problem with the CrazyCrat analogy of a grand jury is that a grand jury is comprised of citizens, vertted against biases. The CrazyCrat party is anything but.
That analogy falls on it’s face.

JB, a small quibble, previously commented on in earlier threads. The term ‘high misdemeanor’ did have a specific meaning in the pre-existing British ‘impeachment’ law the Founders ultimately adopted. It meant behavior grossly unbefitting the public office.

As explained previously here at CTH, the very first impeachment and conviction in 1804 was of a NH federal judge who appeared drunk on the bench. By definition, a ‘high misdemeanor’. Clinton should have been impeached for banging intern Lweinsky in the OVAL, not for perjury nd obstruction. Another ‘high misdemeanor’.

    • The grave danger to our Republic simply consists in the fact that one Branch of Government has sought … now, by purely illegal means that border on pure nonsense … to interfere with the operation of another Branch, literally for said Branch’s entire tenure. It obviously will not stop doing this … there will be one Article after another after another … and so the only future course is to decisively shut the whole thing down, legally.

Which we can do. The authors of our Constitution clearly foresaw exactly the thing that we are now witnessing. This is nothing new: it is called a Bill of Attainder, and it is expressly prohibited on both the Federal and the State level. The authors realized that any one of their delicately-balanced Branches could and at some time probably would seek to usurp the powers of the other two, and that the Legislature would be the most likely one to do this, as we see here now.

No amount of “reasoning with them” is ever going to stop this. They are by now extremely aware that any or all of them could face prison for the billions of dollars of American money that they embezzled, the gun-running that they participated in, the racketeering, the extortion, the influence peddling, the … the … the felonies go on and on.

This must not be allowed to become precedent. The Constitution prohibits what they are doing, but we must force it to actually do so.

How do these two articles violate the Constitutional prohibition on Congress passing a “Bill of Attainder or ex post facto Law”? Are you suggesting that these so-called Articles of Impeachment create new ‘crimes’ that are being applied ex post facto to the President? That might apply to the phony ‘Obstruction’ claim that ristvan describes. It’s an interesting possibility. I’d like to see more discussion. /LEJ

        • These Articles of Impeachment are not predicated upon “high crimes and misdemeanors,” as would be found by an actual Court and for which the President would “face indictment, trial, conviction and punishment.” Instead, they represent a declaration by the House that the President is guilty of a crime, based solely on the House’s own decision of what that crime should be. There is no corresponding definition in the actual United States Code, and the Attorney General has previously stated that this sort of thing “is not the standard we use at the Department [of Justice].”

The House, with malicious intent, also intends to punish the President, by Impeachment, and to deny him any of the legal rights that even a common horse thief would be perfunctorily afforded. Thus, these Articles are a Bill of Attainder, and should now be called out as such. All of the legal measures defining attainder are clearly met by this action.

Our Founders, as I have said, did not accept the English standard of “maladministration” as a possible grounds for impeachment … although this is basically what the House is now trying to do. (“We just don’t like you …”) They said there had to be a crime … a real one.

(This is not an “ex post facto law” situation, which refers to passing a law that retroactively declares an offense to be a crime when no such law existed at the time the crime occurred.)

          • L. E. Joiner says:

I agree with you that the provision in the Constitution declaring that a President subject to Impeachment and Removal from office can still be prosecuted for his “crimes and misdemeanors” when out of office makes it pretty clear that the founders were thinking of statutory crimes, not made-up ones.

But some did, and do, think that “High Crimes and Misdemeanors” can extend to ‘abuse of power’, if not ‘maladministration’. E.g., when Hamilton writes in Federalist 65,

A well-constituted court for the trial of impeachments is an object not more to be desired than difficult to be obtained in a government wholly elective. The subjects of its jurisdiction are those offenses which proceed from the misconduct of public men, or, in other words, from the abuse or violation of some public trust. They are of a nature which may with peculiar propriety be denominated political, as they relate chiefly to injuries done immediately to the society itself. . .

He was arguing that the Senate, which at the time was not popularly elected, and hence not subject to the whims of factionalism, was the best choice for a Court of Impeachments (and not the Supreme Court, which after removal could end up trying the removed President again, hence double jeopardy). It seems to me, however, that what Hamilton and other Framers meant by “High Crimes and Misdemeanors” were actual crimes, committed by high officials, and that’s why they are also ‘political’.

The only clear history of Impeachments has to do with judges, and I expect that would tell us that you (and I) are right. But would extending the definition of High Crimes and Misdemeanors at some point (as today) cross the line to a Bill of Attainder? I’d like to hear from others on that question. /LEJ

      • Jederman says:

I agree with your point but this started in the executive branch of the previous admin. The loathsome, rotten obama tossed the 250 yo tradition of peaceful transfer of powers when clinton bombed.

Once they gained the majority in the house then the (legislative) Branch took their shot.

Their vain attempt to “sooth the needs…” of the lunatic haters scam is not the end. We all know the Left lacks, among many things, restraint. They have been rewarded so they will demand more.

PT, and I admire the hell out of him, must get complete and total control of his Exec Branch and correct this situation. If it started with the previous admin they have to suffer the consequences, regardless of obama’s skin color.

Yes, yes, that pr!ck Burr and his ugly brother Warren, as well as others in the legislature have to be punished, but most of this was driven by a rotten, Gramsciesque executive branch packed with sneaks, nut cases and craven ideologues being paid by tax dollars.

        • “Soothing the needs” has nothing to do with this. If Congress figures out that they can get away with this, or even to continue this ongoing attempt all the way to November 2020, then there will be no end to it, both for this President and for all future Presidents, Supreme Court Justices, and Executive Branch officers. All of them will now serve at the pleasure of Congress and will know that they can be capriciously ejected from their Office on the purely-specious accusation that, according to the convenient and now-unquestionable prerogative of Congress and according to its own kangaroo, “they have committed high crimes.” Tyranny will be the inevitable result.

Trump has stated that he is fighting, not only for himself, but for all future Presidents. And so he is. He must take his fight to the Supreme Court.

  12. There seems to be a lot of talk about doing multiple rounds of impeachments in the House and making the Senate acquit the President multiple times. If Senator Graham has his way with no trials and with the help of then legacy media it will look like the Republicans are just covering for the President and not taking the impeachment seriously by not holding a real trial.

I wish people would just listen to the President on this and everything else. String this impeachment out. The Democrats and the Republicans (Deep State) are assuming there will be no real trial and that the Republicans are just covering for there corrupt President. A long trail, lots of testimony will help expose the Deep State. And that is why it will never happen.

So for the next 10 months every 3 months we will see sad Nancy with her prayer beads come before us saying that President Trump hasn’t stopped Tweeting and must be impeached again and would the bad Republicans in the Senate please take the House serious.

      No quarter given.
And for every one of those who lie have them brought up on perjury charges. Bring in Brennan, Comey, McCabe, Rosenstein. Make it a thorough complete trial where the country gets to see for themselves who the liars are. • k4jjj says:

Actually, I lean more toward a Supreme Court ruling REQUIRING a full Senate trial which the U.S. Constitution does require. Without a full trial, the President has no legal rights to challenge three years of slander, lies and threats by his requiring evidence presented and witnesses called to assert ALL of his defenses. I see an appeal to the Supreme Court to give the President ALL of his rights to defend himself and not let scoundrels like Lindsey Graham short circuit and preempt those rights to hide his own criminal conduct and the crimes of his multitude of accomplices in the wicked political class.

Not giving the President a full Senate trial is a violation of the U.S. Constitution.

Lee Smith said that Stefan Halper was hired onto Reagans campaign in 1980 to defend against a possible October surprise by the Carter campaign.

So if he was used for the same purpose again, what October surprise would they have been most worried about Trump springing on them?

Their own colluding with the Ukrainians.

So they use the ol’ Alinsky tactic of accusing others of what you yourself are doing. They accuse Trump of colluding with Russians. They send in moles to dirty up the campaign and spy on the everyone on the campaign in order to know ahead of time what they are planning.

After Trump won, they turned it into a Special Counsel. But they had no hopes of actually finding crimes, they knew he hadnt done anything wrong because they had been spying on him for years.

It was really just a cover-up for what they had done.

Fast forward 3 years and they get wind that Trump is digging into Ukraine. Now they are worried he is going to discover and expose THEIR collusion with Ukraine.

So what do they do? Accuse Trump of exactly what they themselves had done WRT to Ukraine in 2016: “Using a foreign power to attack a political opponent”

They work that up into an “impeachment”.

But its not really an impeachment. Its really a cover-up. Same as the Mueller special counsel.

Its putting Trump and all the Rs on defense, changing the political discourse from one of talking about Spygate and Ukraine corruption, to Trump cheating in 2016 and Trump cheating in 2020.

Crossfire Hurricane and the Mueller Special Counsel were the cover-up for Spygate, and this “impeachment” is the cover-up for Ukrainegate, which the Dems (and others) corrupt dealings with Ukraine, which, predated Spygate.

This is a trial balloon. The Democrats have floated this to see how it plays to:

    1. The hard left demanding impeachment. Will this appease them?
    2. The rank-and-file Democrats. Will they have the fortitude to support this?
    3. Never-Trumpers. Can anyone like a Susan Collins or Mitt Romney go along?

They have NOT called for a vote yet, only “scheduled” it.

Think how badly they have played this. As Sundance pointed out, they even abandoned their Impeachment Rule. They are trying to figure out how to back up. The problem is, they can’t.

The next 3-4 days will be full of private angst as EVERY trial balloon they float will not gain traction, and they slowly come to the realization that they went out on the limb and the limb has already been cut. The Horowitz Report gutted Adam Schiff like fish. An Obama appointed Inspector General has shown that there was Z*E*R*O facts to the Russia Collusion story. COMPLETELY EMPTY. Schiff, and Pelosi and the “go along” House members look like complete fools.

All Doug Collins and the House members have to do now is start asking “What Federal Law was broken in “Abuse of Power”? As they start hammering the Dems on “What does this mean?” the Dems will take a BEATING in public perception because they will not be able cite a single law that has been broken. All they will be able to do is talk about betraying the office of President. and the oath of office. Obstruction of Congress is dead as a door-nail right now.

  25. Now that these articles have formally been drafted, now is the time to hit back in the Supreme Court with Trump v. US House of Representatives. Future historians will recognize this to be quite possibly the most important case the Court has heard to date.

The fundamental defense is that this is a Bill of Attainder, as expressly prohibited by Secs. 1.9.3 and 1.10.1 of the Constitution. It clearly meets all of the prongs of the legal tests for attainder:

    (1) The Legislature is acting on its own supposed authority to declare that a particular person is guilty of a specific crime.

    (2) The Legislature, with malicious intent, then seeks to punish said individual, in this case by impeachment.

    (3) … all without a trial or due process.

The framers of our Constitution did not select “maladministration” as a cause of impeachment, knowing the grief that this causes English law. Impeachment, in their eyes, is not a political act. They did not give the Congress judicial powers, knowing that if they did so they would be rewarded with … well … “exactly what we have here.” Namely: attainder.

This SCOTUS case fundamentally needs to be filed, not only to protect this President but all future Presidents, and the concept that our Government consists of three co-equal branches, neither of which serves at the pleasure of Congress. If this is not done, the following will become routine:

    (1) A new President is elected and sworn in.
    (2) On the first day of Congress, Articles of Impeachment are drafted and passed against the President and the Vice-President.
    (3) The Speaker of the House (currently, Nancy Pelosi) now becomes President.
    (4) Articles of Impeachment are now similarly drafted and carried out against all sitting Supreme Court Justices who are unpopular with The Party. The Speaker cum President nominates new Justices, and on the same day they are approved.
    (5) Now, notwithstanding the will of the People, “The Party” has taken control of all three Branches of Government. Tyranny will be the immediate result.

Our Founders foresaw this, based on generations of bloody European history. But, do we?

    Dear Newhere,

I understand your comments, but I can’t quite get out there as far as you are on all of this.

I haven’t given up on Barr and Durham and i still believe they will do everything to bring justice. However, I think they only get one shot at this and they need airtight indictments that are unquestioned. Barr statement on NBC today gave me hope…..paraphrase: “DC politicizes bad behavior into criminality too easily. To uphold the rule of law it must be what you can prove, not what you think” and it takes time to build the facts. I don’t read into his comments he’s going to go soft, just that he’s not going in before it’s airtight. I also believe there is going to be an indictment strategy to help loosen up facts from unwilling co-conspirators.

On the other side of the fight, The left and media have their motives, Deep state agencies have their motives and Republican establishment, Chamber and Wall street have their motives to keep things as they are and hidden from the public. Sundance has opened my eyes considerably to the war behind the scenes and i’m amazed at the Harvard level Legal maneuvering and deception that is utilized in these wars. Way beyond my level of thinking.

I will say this. I’ve watched politics all my life and i’ve never, ever seen the left and the establishment get their rear-ends kicked as often and as good as Trump has done the last 3 years and i’m really enjoying it. That gives me hope that i can still trust in Barr. That doesn’t mean Trump is going to win this war, but so far i haven’t seen him lose too many battles.

I’ve decided there’s only two things I can do.

    1. pray for our country and our President. Pray for transparency/truth and justice.

    2. Advocate for primary candidates to run against Republican establishment RINO’s. Draining the swamp starts at home. In Missouri my RINO Senator is Blount. I still trust Hawley. who is your RINO?

We’ll see how they do in the shampeachment to know whether I’ll trust a Republican ever again.

I work with two democrats who hate Trump and had been out loud talking about impeachment during the whole Mueller sham investigation. They have not uttered a word today…not even their usual “Donnie” comments. Very telling!

The second one is meaningless. I can’t imagine the second passes without the first, because alone it’s just a tantrum about their witch not playing along with the hunt.

But the way the first is worded, for Congress to pass it would be an act of hypocrisy so extreme that few would miss it.

This is a promise being kept by the looney DemonRat Party ‘we will remove him from office’, the promise! Its a colossal failure of course, but their crazy followers will not realize its a failure till late 2020.

To bad for them, President Trump will still be in office in the year 2025.

The Dems and their mouthpieces have been talking about getting the “asterisk” next to our President’s name for a long time. It will be forever and I think they will feel victory with at least that. They may be hoping it will damage PDJT enough for the election, but I already know we get a second term.

I believe that Sundance makes a correct assessment. The reason? Why have Maxi up there at the podium if you aren’t appeasing your low iq and low info base?

Looks to me like they devised the charges to limit/prevent the full on exposure of Uniparty corruption in Ukraine and elsewhere. They are also so flimsy there will be very little defense required.

No Ciaramella, Schiff, Schiff’s staff, IG Atkinson, Vindman, et al

These people are not dummies, but they are evil

NPR (I know) reported that Pelosi is not going to demand party unity – that each member is free to vote their conscience (if they have one). Is this true? Does it mean anything? Is there actually a chance that she doesn’t have the votes?

  45. Parker says:

Well… now that the IG report is another attempted whitewash, here come the ridiculous articles of impeachment. So… next will come the Barr/Durham indictments and the media DNC talking points will be, “These indictments are just political retribution.” And now we all know what the big rush to get those articles filed was all about.

    • You’ll look really good in orange jumpsuits … Biden, Pelosi, Schiff, and Nadler, among many others … for the billions of dollars of American taxpayer money that each of you embezzled; for racketeering, money laundering, gun running, drug running, extortion, and much much more.

I know this is important, but I got so excited hearing clips of Barr’s interview w/ NBC that I checked a whole bunch of twitter accounts and blogs, Sundance’s first, and was disappointed not to find anything on many of them. Guess I have to hold my horses and give folks a chance!!!!

No pressure, Sundance! You do a great job on everything.

  47. Watched Barr / NBC interview , very good . One of his best observations , midway through, says in January 2017 FBI knew dossier false because main source said all info in it was supposition , rumor etc . But in January FISA renewal they affirmed that dossier was still valid because “ we talked to main source and they were truthfull “ Barr said it was an out and out misrepresentation to FISA Court , Yes the sources were “ truthful” yes but truthfull that dossier false . He said that was inexplicable ( he is being generous there I think ,) Also said campaign and President spied on without question .

  48. Demo☭rat SPLODY-HEAD MOMENT following a House vote to Impeach:

The Senate announces that President Trump will be given 2020 to prepare his defense
… honoring the DUE PROCESS MANDATE that House Demo☭rats had denied him
… recognizing the YEARS of SPYING and INVESTIGATIONS
… that WITHHELD and ALTERED EVIDENCE that would exonerate him.

  49. Eric says:

My wife and I were discussing what we think is going on…

Impeachment has failed for the Dems and they just want to get this over at this point. So they issued two weak, BS articles.

Nancy probably went to Mitch and said, “We’ll keep this weak if you dismiss quickly.”

Mitch, who wants to protect the Swamp and doesn’t want GOP corruption exposed, will go along. In return, Nancy had to sign off on the USMCA.

President Trump wants the trial, but Mitch and Lindsey aren’t going to give it to him.

So this is all kubuki theater at this point. The good news? President Trump is still in office, revitalizing the nation, and folks are finally waking up to all of this corruption.
